ANTHONY COUNCIL MINUTES • September 14, 1965 1, CALL TO ORDER The regular meeting of the Village Council of the Village of St. Anthony was called to order by Mayor Pro-Tem Dougherty at 8:05 P.M. on Tuesday, September 14, 1965, 2, ROLL CALL The following members were present at roil call : Robert Bailey W. R. Dougherty Richard Sorenson George Erickson and the following were absent: James McNulty 3. MINUTES • Upon motion by Councilman Sorenson, seconded by Councilman Bailey, it was moved to waive reading and approve the minutes of the regular meeting of August 24, 1965. The motion carried. 4. PUBLIC HEARINGS None 5. RESOLUTION b ORDINANCES Upon motion by Councilman Erickson seconded by Councilman Bailey it was moved to adopt Resolution No. 65-073, Corporate Bank Resolution. RESOLUTION NO. 65-073 CORPORATE BANK RESOLUTION Voting on the motion: Ayes Erickson, Bailey, Sorenson, Dougherty Nay: None Absent not voting: McNulty • The resolution was declared adopted. -2- After 2-After a discussion among the attorney, engineer, and council, it was decided to table voting on a resolution authorizing the mayor and clerk to execute a Quit Claim Deed on the Village School District Park Land to the Sept. 28th meeting. The engineer was asked to review the deed and present a more exact description of the area in question than that stated on the deed. 6. COMMUNICATIONS, PETITIONS & REPORTS Upon motion by Mayor Pro-tem Dougherty, the minutes of the special Park and Recreation Board meeting of August 26, 1965 and the regular meeting of September 2, 1965 were received and filed. A petition was presented to the council to have a street light installed in the alley south of 27th Ave. N.E., north of Kenzie Terrace, west of Wilson and east of Stinson Boulevard. Mayor Pro-tem Dougherty said the village lighting program was for streets not alleys. After discussion, a motion was made by Councilman Bailey seconded by Councilman Erickson to deny the petition. A petition to have street lights installed on the corner of Roosevelt and 27th Avenue and between Roosevelt and -ilson on 27th Avenue was presented to the council. The village manager was instructed to have the maintenance supervisor and police chief check these intersections for pole locations. The report is to be presented to the council at the September 28th meeting. • Upon motion by Councilman Erickson seconded by Councilman Sorenson it was moved to accept the service contract from Allied Store Equipment Company as submitted for 12 months service at the sum of $250.00. All in favor. The motion carried. A letter from the village attorney regarding the Gordon and Melba Evanson property was read by the village manager. No action was taken. A letter from the Roseville Village Manager regarding withholding payment of sanitary sewer monies to St. Paul was read. The attorney felt it was up to the council to decide whether or not to withhold the payment. Upon motion by Councilman Sorenson seconded by Councilman Bailey it was moved to release the money held in escrow for second quarter Roseville sewer payment as now due and to withhold future payments as requested by the Village of Roseville beginning with the third quarter payment due October 1, 1965. All in favor. The motion carried. • -3- the 3-the village attorney explained the summons received by James Shaughnessy, Building Inspector re: Lot 5, Block 6, Gardena Acres. A discussion followed. The village attorney felt the village should take some action before the 20 day period for filing an answer was up. Upon motion by Councilman Erickson seconded by Councilman Bailey it was moved that the village attorney be instructed to investigate the summons with the village manager to protect the village's interest. All in favor. The motion carried. 7. OLD BUSINESS A letter from the Hennepin County Office of Civil Defense was read regarding reimbursement for flood damage. Councilman Sorenson made a motion to submit the name of John Printon, Manager, as the authorized individual to act for the community and the forms be completed as accepted at the July 27, 1965 meeting. The motion died for lack of a second. Action on the letter was tabled to the next meeting - Sept. 28th. The village attorney reported on the revision of the Village Taxi Cab Ordinance No. 70. After a short discussion among council and attorney, Councilman Erickson moved and Councilman Sorenson seconded to revise Ordinance No No. 70 as presented with rates o��f,.� :ability insurance at $25,000. per persons $0,000. per accident; and $9,000- f9 r property damage; and a rate schedule • of $.35 first 1/4 mile, $.10 each 1/3 mile, and $4.00 per hour. An amendment to Resolution 65-016 was read and found to be in line with the findings of the adjustment panel that met January 22, 1965. Upon motion by Councilman Sorenson seconded by Councilman Erickson it was moved to approve Resolution No. 65-074, an amendment to Resolution 65-0160 with respect to salaries of Maintenance Man III Positions. RESOLUTION NO. 65-074 RESOLUTION AMENDING RESOLUTION NO. 65-016 WITH RESPECT TO SALARIES OF MAINTENANCE MAN III POSITIONS Voting on the motion: Aye: Erickson, Bailey, Sorenson, Dougherty • May: None Absent not voting: McNulty The motion carried. f -4- a. MISCELLANEOUS • Upon motion by Councilman Erickson, seconded by Councilman Bailey, it was moved to accept the applications for licenses as follows: PLUMBING Johnson Brothers Plumbing Backdahl - Olson Plumbing Harris Bros. Plumbing ELECTRIC Hansen Electric Company Clinton Electric Company HEA® Royalton Heating & Sheet Metal Gordon lieating Company All in favor. The motion carried. Upon motion by Councilman Erickson seconded by Councilman Sorenson, it was moved to approve the license application of Perkin's Pancake House to have a Pancake House at 2529 Harding Street N.E. and the application of • Sroga's Pure Oil for a cigarette license. All in favor. The motion carried. Upon motion by Councilman Sorenson, seconded by Councilman Erickson, it was moved to deny the request of Mr. George Moody to make time payments on the sewer and water hook-up charges for his property. All in favor. Motion carried. A report from N. F. Maher, Village Maintenance Supervisor, on the sinking of curbs and blacktop on 32-1/2 Avenue was read. A discussion between the council and engineer followed. Upon motion by Councilman Sorenson seconded by Councilman Bailey, it was moved that the village accept the responsibility for this and make the necessary repairs. All in favor. The motion carried. The engineer was instructed to look into the code for requiring proper stabilizing material for back fill to avoid future problems of this sort. • -5. • Upon motion by Councilman Bailey, seconded by Councilman Sorenson, it was moved to authorize verified claims and approve payment thereof. 10. CONTRACT PAYMENTS Upon motion by Councilman Sorenson, seconded by Councilman Bailey, it was moved to approve partial payment to Victor Carlson and Sons in the amount of $11,0213.60 for site work done in Central and Silver Point Parks in accordance with the 1965 Parks Construction Contract.
