The following were present at roll call : O'Connor, Dougherty, Springer, Bailey, Sorenson absent: None also present: Raymond Hai% Village attorney John Printon, Village manager Councilman Dougherty noted that an ommission in the minutes had been made on page #7, second to last paragraph. Insert "and Silver Lake Road". Upon motion by Councilman Sorenson and Seconded by Councilman Springer it was moved that the minutes of the regular meeting of August 23, 1966 be approved as • amended. Motion Carried. Upon motion by Councilman Dougherty seconded by Councilman Sorenson it was moved that the minutes of the special meeting of September 6, 1966 be approved. Motion Carried. Senator Hoium extended greetings to the Council and offered the help of his off• ice on any legislation affecting the Village. Mr. E. F. Schwope, representing the St. Anthony Shopping Center businessmen, explained the association's advertising proposal to drop ping-pong balls from a helicopter hovering over the parking area. After discussion as to safety precautions, Councilman Sorenson moved and seconded by Councilman Bailey that the request be approved with the following requirements: debris be cleaned up, the complete area be roped off and traffic- halted in the drop area, and that all necessary safety precautions be taken, these to be subject to the approval of the Chief of Police. Motion Carried. Mr. Ev Hamilton reviewed the minutes of the Park and Recreation Board Meeting of August 4, 1966. Changes in a tree ordinance proposal to be forwarded to the Village Attorney for preliminary draft. The Village Manager was directed to examine the park utility accounts for funds to use the Central Park skating lights for football practice. The Village Manager was directed to prepare a cost estimate for a screen planting for Highway #8 and Rankin Road. A letter from the Minneapolis Park Board in opposition to participating in any lighting program on St. Anthony Boulevard was discussed. The owner of Diamond 8 apartments reply to a notice by the Village attorney was discussed and it was the opinion of the Council that efforts were being made to correct the problem. The offer of the use of a portable siren by the Hennepin County Civil Defense was forwarded to the Fire Chief. A petition was received from residents in the vicinity of 35th and Coolidge St. opposing the construction of a storm drain. The Council took no action to rescind their action ordering the improvement. The petition was ordered filed and the Village Manager was directed to notify the petitioners of the action of the Council. The Village Manager was directed to secure a copy of the Minneapolis Comprehen- sive Zoning plan for the Village Planning Board. Petitions were received for the installation of street lights on 35 and 36 and Roosevelt St. and for Silver Lake Court. Upon motion by Councilman Dougherty seconded by Councilman Sorenson it was moved that the petitions be tabled until a pole location be determined by N.S.P. Company. • Motion Carried. Upon motion by Councilman Sorenson seconded by Councilman Bailey it was moved that the proposal of Nason, Law, Wehrman and Knight be accepted and that the Mayor and Village Manager be authorized to enter into contract an behalf of the Village. Motion Carried. Upon motion by Councilman Sorenson seconded by Mayor O'Connor it was moved that the engineers certificate in the amount of $268.75 for engineering services project 1966-10 August 1-27, 1966 be approved. Voting on the Motion: Aye: O'Connor, Dougherty Springer, Bailey, Sorenson Nay: None Motion Carried. Upon motion by Councilman Springer seconded by Councilman Bailey it was moved that the certificate of engineers estimate #3 in the amount of $26.00 be approv ed. Voting on the motion: • Aye: O'Connor, Dougherty, Springer, Bailey, Sorenson Nay: None Motion Carried -3- After 3-After discussion in which the Council was informed that Empire Sales Inc. had sold their interest in the proposed 42 unit apartment at 3807 Macalaster Drive, and also that Empire Sales Co. was in default of their agreement to lower the water utility line and sanitary sewer manhole, South of 39th Ave. N.E., Council- man Dougherty moved and seconded by Mayor O'Connor that the approval of the 42 unit apartment complex at 3807 Macalaster Drive be withdrawn and that the Village Engineer be notified to proceed with the street improvement, at such a grade as to not cause the water or sewer utility lines or apurtenances to be relocated. Motion Carried. The Village Manager was directed to notify the property owners of the Council action. Upon motion by Councilman Sorenson seconded by Councilman Dougherty it was moved that the request of Minneapolis Gas Company for a street excavation for the re- pair of a 3" valve be approved. Motion Carried. The proposed excavation ordinance was deferred to the meeting of September 27th, 1966. • Upon motion by Councilman Sorenson seconded by Councilman Bailey it was moved that the request for license by Clark Oil Co. be approved. Motion Carried. Mr. Ron Ekstrom asked to be heard as to Village plans for sidewalks. The Mayor explained in detail to Mr. Ekstrom the action taken to date by the Council, School Board, and Sidewalk Committee. Mr. Ekstrom stated that he would like to review the connittee work and to gather additional information to present to the Council at a future date. The Mayor informed Mr. Ekstrom that the Council would be glad to review the proposal when it was completed. Councilman Sorenson moved and seconded by Councilman Dougherty that the properly verified claims be paid. Motion Carried.
