ANTHONY COUNCIL MINUTES December 13, 1966 The regular meeting of the Village Council of St. Anthony was called to order by the Mayor at 8:00 o'clock P.M. on Tuesday December 13, 1966. The following were present at roll call : O'Connor, Dougherty, Springer, Bailey, Sorenson Absent: None Also Present: Village Attorney, Raymond Haik Supt. Public Works, Norbert Maher Village Manager, John Printon It was noted that on page 2 of the Minutes of November 22, 1966 as pertains to Ordinance #76 that the motion should read "prohibiting plantings on the R/W and that existing shrubs be trimmed to three (3) feet above the top of curb or CA of the roadway along intersections". Upon motion by Councilman Dougherty seconded by Councilman Springer it was moved that the minutes of the meeting of November 22, 1966 be approved as amended. Motion Carried. • Mr. Everett Hamilton, reviewed the minutes of the Park and Recreation meeting of December 1st, 1966. The Minutes of the special meeting of the Planing Board of December 5, 1966 were reviewed. Upon motion by Mayor O'Connor seconded by Councilman Bailey it was moved that a request for variance be approved granting a 2 ft. variance in the rear yd. of Lot 1, Block 1, St. Anthony Terrace Manor. Motion Carried. Upon motion by Councilman Sorenson, seconded by Councilman Bailey it was moved that the request for a rear yard variance of lot 6, Block 1 , Olson's Addition be returned to the Planning Board for review of the deck overhang. Motion Carried. Upon motion by Councilman Bailey, seconded by Councilman Sorenson it was moved that the sign request of Ledwein Carpet Company for a sign permit be returned to the Planning Board for review. Motion Carried. • Ordinance #76, Tree Ordinance, was considered. After discussion of the advisability of tabling the adoption of the ordinance until such time as a sidewalk program is resolved, it was moved by Mayor O'Connor and seconded by Councilman Bailey that the third reading of Ordinance #76, Tree Ordinance, be approved. -2- Voting 2-Voting on the motion: Aye: O'Connor, Dougherty, Springer, Dailey, Sorenson Nay: None Motion Carried. Upon motion by Councilman Sorenson seconded by Councilman Dailey it was moved that Ordinance #77, Personnel Ordinance, be adopted on third reading. Voting on the motion: Aye: O'Connor, Dougherty, Springer, Bailey, Sorenson Nay: None Motion Carried. Upon motion by Councilman Sorenson, seconded by Councilman Bailey it was moved that the 2nd reading of the Excavation Ordinance be tabled for review of possible conflicts with Ordinance #12. Motion Carried. • Councilman Sorenson intorduced Resolution No. 66-081 and moved its adoption. RESOLUTION NO. 66-081 RESOLUTION AUTHORIZING MAYOR AND VILLAGE MANAGER TO EXECUTE 1967 SNOW MAINTENANCE CONTRACT WITH THE HENNEPIN COUNTY HIGHWAY DEPARTMENT. The resolution was duly seconded by Councilman Bailey. Voting on the resolution: Aye: O'Connor, Dougherty, Springer, Dailey, Sorenson Nay: None Resolution declared adopted. The Village Manager was directed to obtain three bids on the rings not sold at Auction. The proceeds of the Auction were reported as $280.00 in cash and the three rings unsold due to lack of reasonable bids. Upon motion by Councilman Dougherty seconded by Mayor O 'Connor it was moved that the request for a street light at Crest View Drive and Bell Lane be approved provided the pole be located on one of petitioners property. • Motion Carried. Upon motion by Councilman Sorenson, seconded by Mayor O'Connor it was moved that N.S.P. be notified that the previous approval of a street light at 35th and Roosevelt &t. has been revoked. Motion Carried. • -3- The Village Manager was directed to answer the letter of Walter Ezzell, 2913 Armour Terrace, regarding the Village repair of a private drainage system. A letter from Mr. and Mrs. Thomas Nash was received regarding division of Lot 3, Block 4, Clark and Kings Garden Tracts. The Village Manager was direct- ed to contact the property owner at 2608 - 36th Avenue N.E. in regard to having that rear portion of the aforementioned Lot 3 combined with his property. Councilman Sorenson introduced Resolution No. 66-082 and moved its adoption. RESOLUTION NO. 66-082 RESOLUTION ORDERING HEARING FOR THE SUPPLEMENTAL ASSESSMENT OF LAND FOR WATER AND SEWER IMPROVEMENT 1960-2 PURSUANT TO MINNESOTA STATUTES 429.071 The resolution was duly seconded by Councilman Springer. Voting on the resolution: Aye: O'Connor, Dougherty, Springer, Bailey, Sorenson Nay: None Resolution declared adopted. A letter from Senator elect, Dean Nyquist, was received and the Village Manager was directed to request of both Mr. Nyquist and Mr. Myer that the Village Council be notified of any legislation that might affect the Village of St. Anthony. The Village Manager was requested to make copies of refuse Ordinance and distribute to Council . Council members were requested to turn in Capital Improvement proposals for the December 27th meeting. The Village Manager was directed to have a street light installed at Old Highway #8 and the cross over to New Highway #8. Upon motion by Councilman Springer, seconded by Councilman Dougherty it was moved that stop signs be installed at the Old Highway #8 and New Highway #8 Cross over, and that they be located to control Old Highway #8, North and South bound traffic , and that a blinker light be installed for warning of the South Bound lane, and also that a sharp curve sign be installed at Rankin Road and Old Highway #8. Motion Carried. • Upon motion by Councilman Sorenson, seconded by Councilman Dougherty it was moved that the architects statement for the month of November for remodeling of liquor store g#1 be approved. Motion Carried. -4- The 3rd quarter liquor store report was ordered placed on file. Upon motion by Mayor O'Connor, seconded by Councilman Bailey it was moved that the engineers Certificate for services, October 31 to November 26, in the amount of $149.00 be approved. Voting on the motion: Aye: O'Connor, Dougherty, Springer , Bailey, Sorenson Nay: None Motion Carried. Upon motion by Councilman Sorenson, seconded by Councilman Springer it was moved that the engineers certificate for Street Improvement Project 1966-1 , October 31 to November 26 in the amount of $58.00 be approved. Voting on the motion: Aye: O'Connor, Dougherty, Springer, Bailey, Sorenson Nay: None • Motion Carried. The engineers report and certification for the 35th and Stinson Boulevard storm sewer was received and ordered filed. Upon motion by Councilman Sorenson, seconded by Councilman Dougherty it was moved that N.S.P. Company's request to place poles at the following locations be approved: Silver Lake Court and Silver Lake Road Chelmsford ' Road and Wendhurst Avenue Motion Carried. Upon motion by Councilman Sorenson, seconded by Councilman Dougherty, it was moved that the properly verified claims be approved. Motion Carried. Upon motion by Mayor O'Connor, seconded by Councilman Sorenson, it was moved that the Architects Certificate in the amount of $16,335.00 for construction completed by Henning Nelson Company, liquor store #1 Addition, be approved. Voting on the Motion: Aye: O'Connor, Dougherty, Springer, Bailey, Sorenson • Nay: None Motion Carried. -5- Upon motion by Mayor O'Connor, seconded by Councilman Bailey, it was moved that items #1 ,2,4, Change order #1 , be approved as submitted. Voting on the motion: Aye: O'Connor, Dougherty, Springer, Bailey, Sorenson Nay: None Motion Carried. Upon motion by Mayor O'Connor, seconded by Councilman Sorenson it was moved that change Order #2, as noted this date, be approved in the amount of $1279.98 Votio g on the motion: Aye: O'Connor, Dougherty, Springer , Bailey, Sorenson Nay: None Motion Carried. Upon motion by Mayor O'Connor , Seconded by Councilman Springer, it was moved th at Minneapolis Gas Company permits #1720, 1721 , and 1200 be approved as submitted. • Motion Carried. After discussion, Lion motion by Councilman Springer, seconded by Mayor O'Connor, it was moved that the operation of motor vehicles, including snow mobiles, motor scooters, etc., be prohibited on public property.
