ANTHONY • COUNCIL MINUTES October 27, 1970 The meeting was called to order by Mayor Miedtke at 8:00 o'clock P.M. The following were present at roll call : Crouse, Miedtke, Levandowski , Englund. Councilman Emond appeared a few minutes after roll call . Also Present : Village Attorney, Larry Vickrey Village Manager, John R. Printon The following corrections were noted on the minutes of the October 13, 1970 meeting: On page 2 after the motion by Councilman Crouse amending the motion to approve Ord- inance 1970-15, it should show the voting on the amendment as follows : Roll call voting - Crouse, yes; Englund, no; Miedtke, yes; Levandowski, no; and Emond, yes. Then it should show "Amendment carried". On page 4 in the motion by Mayor Miedtke commending the Student Council represent- atives, the part after Village Council should be deleted from the motion. Motion by Councilman Crouse and seconded by Councilman Englund to approve the minutes of the October 13, 1970 meeting as corrected. Motion carried. Motion by Councilman Crouse and seconded by Councilman Emond to approve the minutes of the October 6, 1970 Special Meeting as presented. Motion carried. Charles Herman presented the minutes of the October 20, 1970 Planning Board Meeting. :Motion by Councilman Englund and seconded by Mayor Miedtke to follow the recommend- ation of the Planning Board and approve the request of Andrew Gawel of 2600-31st Avenue N.E. for 24 foot variance in width of corner lot, 4 foot front yard setback variance and 13 foot rear yard variance. Motion by Councilman Crouse and seconded by Councilman Levandowski to amend the motion requiring that if the owner builds a garage on this property that it be attached to the house. Voting on the amendment: Aye: Crouse, Emond, Miedtke, Levandowski Nay: Englund Amendment carried. Voting on the motion as amended: Aye: Emond, Miedtke, Levandowski , Englund Nay: Crouse • -2- Motion 2-Motion as amended carried. Councilman Crouse stated that he voted against it because he felt the neighbors -had�not had a chance to comment on this. Motion by Councilman Levandowski and seconded by Councilman Crouse to deny the re- quest of Don Zebro of 4017 Penrod Lane N.E. for a 20 foot addition to the rear of his two-car garage because of a lack of information on this proposed addition. Motion carried. Motion by Councilman Crouse and seconded by Councilman Englund to confirm the action of the Planning Board and deny the request of John Wakiriak to rezone the Fest 2 of Lot 10 and all of Lot 9, Block 6, Mounds View Acres, 2nd Addition. Motion carried. Motion by Councilman Crouse and seconded by Councilman Levandowski to table action on the request of Happy's Potato Chips, Inc. to replat Lot 1, Block 9, Mounds View Acres, 2nd Addition, until the next meeting for the purpose of getting more inform- ation on this. Motion carried. Motion by Councilman Englund and seconded by Councilman Crouse to uphold the action • of the Planning Board and deny the request to paint a sign on the north and west walls of the G & K building, identifying the St. Anthony Shopping Center. Motion carried. Motion by Councilman Crouse and seconded by Councilman Emond to concur with the action taken by the Planning Board in tabling action on the Industrial Credit sign. Motion carried. It was requested that a notice be put in the Sun Newspaper informing the residents that at the November 17, 1970 meeting of the Planning Board, they will be reviewing the sign ordinance. A representative from the Northgate Motel appeared requesting permission to relocate their motel sign. Motion by Councilman Crouse and seconded by Councilman Englund granting the North- 3ate Motel permission to move their 'blinking" motel sign as requested. 'tion carried. Mr. Youngdale appeared for Standard Oil Company regarding their remodelling plans for their station at 37th Avenue N.E. and Silver Lake Road. Motion by Councilman Crouse and seconded by Councilman Emond to close the public hearing on rezoning of the Standard Oil Company property at 37th Avenue N.E. and Silver Lake Road and leave it as it is presently zoned based on the letter from Standard Oil Company stating their remodelling plans. :lotion carried. -3- Mike Carroll appeared requesting that the Village fix their driveway as was dis- cussed at a previous Council meeting in October 1969. Motion by Councilman Crouse and seconded by Mayor Miedtke that we reaffirm the intent of the Council at the October, 1969 meeting and that the Village fix the second driveway at the Mike Carroll residence with blacktop from the service road to the existing concrete in accordance with the Village Engineer's recommendations. Voting on the motion: Aye: Crouse, Miedtke, Levandowski , Englund Nay: Fmond Motion carried. Mr. ^oscoe Smith appeared requesting permission for an access to 39th Avenue N.E. He was referred to the owner of the property involved to get this permission. Motion by Mayor Miedtke and seconded by Councilman Emond to approve the 2nd reading of Ordinance 1970-15 and that it be adopted. ORDINA14CE 1970-15 AN ORDINANCE PROVIDING FOR THE SAN- ITARY STORAGE AND COLLECTION OF WASTE MATTER, Motion by Councilman Crouse and seconded by Councilman Englund to amend the motion substituting for Section 6 the paragraph identified as Item 2, Section 6 from the first drafting of the Ordinance designating that all garbage containers, etc. be placed at the front lot line of the premises on the day of pickup only and that they be returned to their regular place of storage not later than 8:00 P.M. on the same day. The Village Attorney again read Ordinance 1970-15 with the suggested change. Voting on the amendment: Aye: Crouse, Levandowski, Englund Nay: Emond, Miedtke Amendment carried. Voting on the motion as amended: Aye: Crouse, Levandowski, Englund Nay : Emond, Miedtke . Motion as amended carried. Motion by Councilman Levandowski and seconded by Councilman Crouse directing the Village Manager to write letters to all licensed garbage haulers in the Village informing thein that the 3rd reading of the garbage ordinance will take place at -4- the November 10, 1970-Council -meeting--and to invite their comments; and also to ask the Sun Newspaper to put a notice of this in the paper. Motion carried. Mayor Miedtke declared a ten minute recess at 9:35 P.M. The meeting was reconvened at 9:45 P.M. All present who answered opening roll call. Motion by Councilman Englund and seconded by Councilman Crouse directing the Village Attorney to add a section to the garbage ordinance making it applicable for residen- tial premises and also to change the title of the ordinance. Motion carried. Motion by COUncilman Crouse and seconded by Councilman Levandowski directing the Village Manager to discuss this statement regarding Ramsey County Ditch No. 2 with Village of New Brighton and also authorizing the payment of $183.40 as our share and to settle out of court. Motion carried. Motion by Councilman Crouse and seconded by Councilman Levandowski authorizing the payment of the statement from Dorsey, Marquart, Windhorst, West & Holladay in the amount of $1,011.93 for services for the month of October. Motion carried. Motion by Councilman Crouse and seconded by Mayor Miedtke to refer back to the School Board for action the item as set forth in the letter from Superintendent Renz regarding the purchase of gasoline for tax exempt vehicles of District #282. Motion carried. The Village Attorney was directed to prepare an ordinance providing for the increase of sewer charges for 1971 and to include a 90% pro-rate for apartment buildings. Motion by Councilman Crouse and seconded by Mayor Miedtke that a letter be written to Happy's Potato Chip Company commending them for their continued efforts in trying to keep down the odors, etc. Notion carried. Motion by Councilman Crouse and seconded by Councilman Levandowski granting the request of the Northeast Y's Men's Club for a Christmas Tree sale lot in the St. Anthony Shopping Center as requested and requiring that it be cleaned up within a week after the sale or that they pay the bill for having it cleaned up. Motion carried. Motion by Councilman Crouse and seconded by Councilman Englund to approve the request of the St. Anthony Lions for a temporary sign on the northeast corner of • Silver Lake Road and Kenzie Terrace. Motion carried. The Village Manager was directed to secure a copy of the State Plumbing Codes and to report back to the Council at the next meeting. .�. s -5- Motion by Councilman Crouse and seconded by Councilman Emond to pay the statement • from Hall, Snith, Juster, Feikema and Haskvitz in the amount of $280.00 for services for September and the first part of October, 1970. Motion carried. Motion by Councilman 6nond and seconded by Councilman Crouse to approve the Domestic Heating v Cooling license as requested. Motion carried. Motion by Councilman Crouse and seconded by Councilman Emond to approve the re- quest of Minneapolis Gas Company to repair a 4" gas main at 3100 36th Avenue N.E. Motion carried. Motion by Councilman Levandowski and seconded by Councilman Crouse to pay the Certificates of the Engineer in the amounts of $2,483.11 and $455.21 for services from August 31 to September 26, 1970. Motion carried. The Village Manager was directed to prepare an ordinance setting forth all present and existing traffic signs in the Village and to get a report from the Public Spifety Department for their suggestions and recommendations for other signs and to present it at the November 24, 1970 meeting. . Motion by Councilman Crouse and seconded by Councilman Emond directing the Village Manager to write a letter to the Director of Mediation requesting an election to make a determination as to which union will represent the Public Safety Department officers. Motion carried. There was mention of Resolution 70-029 regarding sewer improvement for the Equinox Apartments but no action was taken on it. The Village Attorney read Resolution 70-029. Motion by Councilman Crouse and seconded by Councilman Englund directing the Village Attorney to work with Brooklyn Center regarding the Melba Evanson case. Motion carried. Motion by Councilman Crouse and seconded by Councilman Emond to pay the verified claims. Motion carried. A special meeting was set for Tuesday night, November 3rd, at 9:30 P.M. at I% ache Plaza to tabulate the voting machines.
