ANTHOIIY • COUMC1L MINUTES Movember 4, 1975 The meeting was called to order at 7:30 P.M. by Mayor Miedtke. Present for roll call : Sundland, Miedtke, Stauffer and Haik Absent: Sauer Also present: Jerry Dulgar, City Manager . ,iiro Fornell , Aden. Asst. Councilman Sauer arrived at 7:32 P.M. The following corrections were made to the minutes of the October 23, 1975 meeting: Page 2, para. 3: Substitute ' balcony, for ' ba 1 ony' Page 3, para. 6: Substitute "Could" for "Bould" Page t!, para. 2: Substitute "interr.a! ly lit" for ' indirectly lit" Page 5, para. 5: The meeting was recesssed from ''9: 10 to 9:30 P.M." rather than `10: 10 to 10:30 P.M.' • notion by Councilman Sundland, seconded by Councilman Stauffer to approve the minutes of the October 28th meeting as corrected. Motion carried unanimously. The Manager read the revised Ordinance 1975-007 into which he had incorporated the changes suggested at the October 28th meeting. fiction by Councilman Stauffer; seconded by Councilman Sundland to waive further readings and adopt Ordinance 1975-007. OP.DINANCE 1975-007 AN ORDINANCE RELATING TO THE PARKING OF VEHICLES: AMENDING SECTION 720:05 OF THE 1973 CODE OF ORDINANCES Before voting, the following amendments were made: Motion by Councilman Haik, seconded by Councilman Sundland to strike "in violation of the law' in the 13th line of the second paragraph. Notion to amend carried unanimously. Motion by Councilman Stauffer, seconded by Councilman Sauer to change the word "during ' to "between' in the fourth sentence of the second paragraph. • Motion to amend carried unanimously. i-lotion to adopt Ordinance 10,75-007 as amended, carried unanimously. f � -2- Mr. Dulgar explained his recommendations for eliminatinq the ponding conditions • along 39th Avenue H.E. between Shamrock and Fordham Drive with which recommend- ations he said he had the concurrence of Larry Hamer, Supt. of Public Works. They suggested installing a catch basin behind the curb but on the boulevard aiong 39th Avenue in the area of the City's drainage easement and to straighten out the existing drainage ditch so it will enable storm water to run over to the catch basin. The Manager explained the City had been pumping out the area at the request of pprents who feared some child might drown in the pond which formed after each ,Jownpour but he felt since this procedure was proving more costly each year, it X-ovided no long term solution to the problem. The Manager further explained `that the owner of the syo undeye!opnd .-f-s where the ponding occurred had been requesting the City tri run a st"o m sewer line to the rear of the lots to take care of the drainage, a request which the City had declined since it seemed that s it should rather be the owner's responsibiiity to provide any such inprovements for those lots. Mayor Miedtke was concerned that a precedent might be set for requests for the City to provide drainage for other private properties and mentioned similar requests in other areas of the City which had been denied. The Manager said in most of the previous cases the City did not have the easement it has on this property and the catch basin was not installed when 394-h Avenue war, rebuilt. Motion by Councilman Sauer, seconded by Councilman Sundland to authorize the Maintenance Department to straighten out the ditch and install a catch basin in the City-owned easement between Lots 2 & 3 of Barrett's Addition and that the grade of the ditch be maintained until the tile is installed at the expense of the owners of the subject lots with an option given him to have the tile installed at this time with the cost to be assessed against the property. Motion carried unanimously. Motion by Councilman Stauffer, seconded by Councilman Sundland to set the 4th Tuesday in January as the date for presenting honorary citizenship certificates to A.F.S. students who reside with city families. Motion carried unanimously. Motion by Councilman Haik, seconded by Councilman Sauer to accept the resignation of Mr. Henry Zeug as Plumbing inspector effective December 1 , 1975 and to direct that a Certificate of Appreciation be presented to him for his long faithful service to the City for almost a quarter of a century. Motion carried unanimously. The Manager said there had been no action taken to date to find a replacement for Mr. Zeug. Canvassing of the city election was deferred to the time when the election officials had completed the tabulation of the votes. • The Manager said he and Larry Hamer had attended a meeting at which the aid program provided by the State Legislature to property owners for the removal of diseased elms and oak trees was explained. He said that the removal of only a ha'df a dozen such trees in the past six years would have benefited from such aid and suggested waiting to set up the program for the City until a need is apparent. He also explained the limitations of the program. � 1 , -3- Motion by Councilman Stauffer, seconded by Councilman Sundland to table action on setting up a shade tree disease control financial aid program until such time as such a program seems necessary. Motion carried unanimously. There was also a ma:'Ifiration of the Committee's proposal for conjunction of 29th and Highway 8. The plans with the suggested changes had not yet been received by the Committee and Mr. Shabaz said the letter did not answer the Committee's questions to State officials regarding the restriction cf truck traffic or funding of curb and gutter repiacement, nor did it verify whether funds would be avaiinbie to comp- ensate the City for the damage done to the stt-:etc by trucks, buses and cars &I-ira the time 29th served as a detour while Highway 8 was being reconstructed. The Manager also reported that he had received no reply to his queries to the • Highway Department regarding such compensation for damage to 29th and was to further pursue the matter with Commissioner Marzetelii . There was some discussion of which engineering firm would prepare the cost estimates for the new proposal to be presented to property owners on 29th but it was agreed that the perogative should rest with the Council and the following motion was made: Motion by Mayor Miedtke, seconded by Councilman Stauffer to request that the City Enaineer prepare cost estimates for upgrading 29th Avenue based on the modific- ations made to the Committee's design by the State officials including the possible funding of the costs of curb and gutter installation and other potential costs, with the Planager to pursue the availability of compensation from the State for damage done to the street when it served as a detour. All the above inform- ation is to be provided to the T.A.F. Committee so they may report their recommendations back to the Council at the Povember lath Council meeting. Motion carried unanimously. Councilman Haik reported queries from residents who wondered why driving lanes were not painted in on Silver Lake Road to indicate four lanes of traffic on that road. The Manager said the City felt it was better not to encourage the use of Silver Lake Road south of 37th Avenue N.E. as a four lane roadway. Motion by Councilman tlaik, seconded by Mayor Miedtke to request Hennepin County to stripe and paint ''right turn lane only" at the 29th and 33rd Avenue inter- sections with Silver Lake Road. M,nti7n carried unanimously. -4- Mr. Shabaz said he felt the restricting of right hand turns on a red light on the Kenzie Terrace and Highway 8 intersections with St. Anthony Boulevard was causing a traffic tie up at those points. Mayor Miedtke suggested waiting until the City had at least six months exper- ience with the new traffic patterns before any complaint is lodged with the Highway Department. Councilman Sundland did not feel the Council had information conelus vc. enough to make a decision regarding a bond referendum for a sports center as requested by a committee of residents and the Manager wanted more time to compile pertinent information from c:ommunitles which have similar facilil:;es in Operation, Council-man H9';( said the Opp95ed the c' ty in`.ollve!-cent since the center wouid be located on school property. Motion by Councilman Sundland, seconded by Councilman Sauer to refer the request for a sports center to the City Manager and School District #282 administration for evaluation and further operating data. Such information be given to the Council at a later date. Motion carried unanimously. Motion by Councilman Sundland, seconded by Councilman Sauer to approve payment of $112.51 and $81 .27 to Comstock & Davis. • Motion carried unanimously. Councilman Stauffer indicated her interest in having current statistics on juvenile involvement in crimes committed recently in the City. There followed a discussion of the newspaper report citing the City has a high crime area. Mr. Dulgar pointed out that the statistics used resulted from the efficiency of the St. Anthony Police Department in reporting the crimes , most of which were shoplifting or garage burglaries which other communities such as Minneapolis do not list as felonies in their reports to the B.C.A. The Mayor felt the report indicated the police are doing a better job of apprehending and reporting such crimes than other communities and should be commended for a good job. fie also pointed out the City's uniqueness in having two shopping centers which generate more shoplifting within the city boundaries. The Manager was instructed to raise the question of the validity of the statis- tics with those who compile them. Mr. Dulgar reported that there appears to be adequate speed limit signage at all entrances to the city as well as near the major intersecting streets. Mayor Miedtke reminded the Council of the observance of the 100th birthday of Mrs. Nellie Connors to be held at the St. Anthony Nursing Home on November 8th. Motion by Councilman Sauer, seconded by Councilman Haik to approve payment of • all verified claims listed in the November I4, 1975 agenda. HoL ion carried unanimously. -5- The October 31st notification from Hennepin County of a doubling of daily charges for prisoners committed to the Hennepin County Adult Corrections Facility (formerly the tlpls. Workhouse) was discussed. The City Manager and Mayor intend to voice their objections to the raise in charges at the hearing of the Ways and Means Committee of the County Board on November 17th. ANTHONY CANVASS BOARD 11-4-75 The meeting was called to order at 10:05 P.M. The following were present for roll call : Sally Haik, Donna Stauffer, Wm. Sauer, Robert Sundland and Duane Miedtke. Motion by Councilman Sundland, seconded by Councilman Stauffer to certify the election results as presented by the election officials.
