ANTHCNY, MINNESOTA AND ADUPTI N'G C!9AP TER I OF SAID CODE The Village Council o+ the of St. Anthony, Minn: s:.•ia hereby o i:abl i sties an administrative code does resolve: CHAPTCR I RULES FOR THE ORGANIZATION AND PROCEDURE OF THE VILLAGE COUNCIL Rnqular Meetiras - Regular meetings of the Village Council shall be held on the 2nd &4th Tuesday of each calendar month at 8:00 P.M. Any requi nr meeting falling upon a holiday shall be held on the next fol lcv!i ng business day at the same time and place. By vote of its members, the Council may cancel any regular meeting providing at least one regular meeting is hold in each month. All business set for consideration at a meeting which i - cancelled shall be deemed adjourned to the next succeeding regular meeting. All meetinos including special and adjourned meetings shall be held in the Village providing however, based upon published notice in the offir.ial newspaper five (5) days in advance of the meeting including the date of publication, it may be held elsewhere. At least one day before the meeting, the Clerk shall notify each member of t_!,e tirre, pInce and purpose of tie meeting by causing written notice thereof to be delivered to him personally if he can be found or if • he cannot be found, by leaving a copy at the home of the member with some pers^;i of suitable age and discretion. Special meetings may be held wit:hotirt prior written notice when all Council members are present at the meeting unless a member appears for the special purpose of objecting to the holding of S:-;ch me ti nq, or when -Il the C('u ,(^i l members consent thereto in writing. Such consent shall be filed with the Clerk prior to the beginning of the mee-ing. Any special meeting attended by the Council members shall be a valid meeting for the transaction of only that business for which the special meeting shall be caned. Section 3. Preparation of Agcnda - An agenda of business for each regular council meeting shall be prepared and filed in the office of the Village Clerk not later than 5:00 PM Friday, next preceding the meeting. Any business brought before the Council , including hearings • and matters adjourned, or referred to a specified meeting, and not disposed of by motion or resolution, or postponed by formal action entered in the minutes to a. definite date, shall he deemed indefinitely tabled and may be r,cted upon at any subsequent meeting held within the same calendar year. Section 5. The presiding officer.- 1he ;rrsirling officer of the councii shat be the mayor or in his absence, the president pro-tem. In the absence of the mayor and the president pro-tem the clerk shall cell the meeting to order and shall preside until the council members present at the meeting shali choose one of their number to act temporarily as a presiding officer which shnl 1 become the first order of business follow- ing roil call . Upon the arrival of the mayor or president pro-tem, th temporary presiding officer shall immediately relinquish the chair upon con-elusion of the business immediately before the council . At its organizational meeting the Council shall elect from its members by a majority of all councilmen a president pro-tem. Section 8. General Rules of Debate. - The presiding officer may debate from the chair, subject to such limitations of debate as are by these rules impos- ed on all members andAhal 1 not be deprived of any of t;ie rights and privileges of a councilman by reason of hip, acting us the r.,residing officer. Getting the floe;-: Every member desiring to speak sh-iil addr^ss the presiding officer and upon recognition by the presiding officer shall confine himself to the question under debate. Interruptions: A member, once recognized, sty=11 not be interrupted when speaking unless it be to call him to order, or as herein otherwise provid^d. If the appeal is seconded, the member may speak once sciely on the question involved and the presiding officer may explain his ruling, but no other council member shall participate in the discussion. The appeal shall be sustained if it is approved by a majority . of the membei-s present exclusive of the presiding officer. Motion to reconsider. A motion to reconsider any action taken by the council may be made only at the meeting at which such action was taken. It may be made either immediately during the same session or at a recessed or adjourned session thereof. Such motion must be made by one of the prevailing side but may be seconded by any member, and may be made at any time and havorecedence over all other motions or while a member has the floor; it shall be debatable. Nothing herein shall be construed to prevent any member of the council from making or remaking the same or any other motion at a subsequent meeting of the council . Remarks of councilmen when entered in minutes; A councilman may request • through the presiding officer, the privilege of having an abstract of his statement or any subject under consideration by the council , or the reason of his dissent from any action of the council entered in the minutes thereof. A_ddressinq council - ti;T, limitt Each p.rson addressing Che council shall , if recriested by the +residing officer, step up in front of the rail , shall give his name and address in an audible tone of voice for the public record and unless further time is granted by the presiding officer shall limit his address to five minutes except at public hearings when the limit shall be ten minutes. All remarks should be addressed to the council as a body and not tc 7-n•, member Lhereof. No persca., other than the council and the person hav- ing the floor, shall be permitted to enter unto any discussion either directly or through a member of the council, without the permission of the presiding officer. No question shall be asked a c:oun.-ilman except through the presiding officer. Section 9 - Votinq. An absent councilman may move to reconsider any question voted on at a meeting not attended, but, such a motion must be made at the first meeting thereafter which he is present . The votes of the members on any question pending before the council may be by voice vote, standing vote, or in any other manner of voting which signifies the intention of the members,- but embers;but if the vote is not unanimous, there shall be a roll call and the names of those voting for and against the question shall be recorded irythe minutes. • All council members in attendance shall vote on every question pending before the council unless he is excused by the presiding officer for having a direct or personal interest on the question under consideration. Section 10. Ordinances, Resolution and Motions. Introduction for adoption and adoption. Ordinances, resolutions, and other matters or subjects requir- ing actioryby the Council shall be introduced and sponsored by a member of the council , except that the village manager or village attorney may present ordinances, resolutions, and other matters and subjects to the council . Every ordinance and resolution shall be presented in writing and read full at a council meeting; provided however, that the reading of the resolution or ordinance may be dispens_d with by majority consent. All administrative business may be transacted by ordinary motion. Upon the vote on ordinances, resolutions, and motions, the ayes and nays shall be recorded unless the vote is declared unanimous by the presiding officer. Upon the request of any member of the council, the vote shall be by roll call of all members of the council . A majority vote of all members of the council shrill be required for the passage of all ordinances, resolutions and motionsexcept as otherwise pro- vided by statute. Approval of all public improvements, the verified claims, appropriations and contract payments shall be only by roll call vote. Every ordinance other then enercency ordinances shall have two public readings, in full exec t, as provided by waiver, znd at least seven days shall elapse between the first reading or waiver thereof and second reading or waiver thereof. • An emergency or,ainance is an ordinance necessary for the immediate preservation of the public peace, health, morals, safety or welfare in which the emergency is defined and declared, passed by a vote of a majority of the council as recorded by ayes and nays. An emergency ordinance shall not require that seven (7) days shall elapse between 1st and 2nd readings or waiver thereof to become effective. No prosecution shall be based upon the provisions of any emergency ordinance until the same has been filed with the village clerk and posted in three conspicuous places in the village and twenty-four (24) hours after such filing and posting shall have elapsed or until such ordinance has been published. No grant of any franchise shall ever be made by an emergency ordinance. All motions shall be recorded in the minutes and shall be stated in full • before they are submitted to a vote. All petitions and other communications addressed to the council shalt be in writing and shall be read in full upon presentation of the same to the council . They shall then be recorded in the minutes by title and filed with the minutes in the office of the clerk. Every ordinance and resolution passed by the Council shall be signed by the mayor and village manager and attested by the clerk, and filed by him in the ordinance or resolution book; proof of publication of every ordinance shall be attached to and filed with the ordinance. -4- Every ordinance and resolution repealing a previous ordinance or resolution • or a section or subdivision thereof sb-ill give the number; if any, the title of the ordinance or resolution to be repealed in whole or in part. No ordinance or resolution or section or subdivision thereof shall be amended by reference to the title alone, but such an amending ordinance or resolution shall set forth in full each section or subdivision to be amended. All ordinances, resolutions and contract documents shall before presentation to the village council, have been approved as to form and legality by the village attorney and shall have been examined and reviewed for administration by the village manager where there are substantive matters of administration involved. Section 11 . Suspension or amendment of the Rules. These rules, or any of them, may be temporarily suspended by a four fi the vote of all the council members, and shall not be repealed or amended except by a four fifths vote of the whole council after notice has been given at some preceeding council meeting. Section 12. Committees of the Council . Any matter brought before the council for consideration may be referred by the presiding officer to the appropriate committee or to a special committee appointed by him for a written report and recommendation before it is considered by the council as a whole. Each committee shall act promptly and faithfully on any matter referred to it. Each committee report shall be signed by a majority of the members and shall be filed with the clerk prior to the council meeting at which it is to be submitted. Minority reports may be submitted. • Each committee shall consist of three or more members. Each committee member shall serve as appointed unless excused by a majority of the members of the council . Section 13. Minutes. The Village Clerk shall be the secretary to the Village Council and he s all maintain a true and faithful record of the proceedings of the Council which shall be the official record of Council activity when signed by the Mayor, Village Manager, and attested by the Village Clerk. The minutes shall include the following information in such format as shall be determined by the Village Manager, provided, however, that the Council may by motion and upon passage by a majority of its membership direct the Manager to revise the format of the minutes: 1 . Date and location of the meeting. 2. Regular or special meeting and if special, on whose call and for what purpose. If meting is special call, a copy of the notice of call and approval shall become a portion of the subsequent minutes. 3. The disposition of all items of business in the order shown on the agenda for that meeting. 4. The minutes shall show the maker and co-maker of all motions, the substantive wording of the motion, whether the motion failed or carried, and the vote of each councilman if the vote was by roll call . 5. The minutes shall indicate all matters of parliamentary action. 6. The minutes shall indicate by number and title all resolutions and ordinances adopted; providing however, that such resolutions and • ordinances shall become a part of the minutes by reference. 7. The minutes shall include the name and address of all interested parties appearing in behalf of or against any proposition at public hearings. 8. The minutes shall include theup rpose and names and addresses of signatories to all petitions; providing, however, that the petition shat Ib come a -part of -t-he-mi nutes_by- reference. 9. The minutes shall show the time of adjournment. Section 14. Organization: At the first regular council meeting in January of each year the council shall: I . Designate the depositories of village funds; • 2. Designate the official newspaper; 3.
