N0. 65-087 A RESOLUTION AUTHORIZING THE MAYOR, AND VILLAGE CLERK TO ENTER INTO AN AGREEMENT WITH THE MINNEAPOLIS PARI( BOARD CONVEYING THAT PORTION OF ST, ANTHONY BOULEVARD AS LIES WITHIN THE CORPORATE LIMITS TO THE VILLAGE OF ST, ANTHONY WHEREAS, after due consideration, the Village Council wishes to accept the offer of the Minneapolis Park Board in the conveyance of that portion of St. Anthony Boulevard lying within the corporate limits, and WHEREAS$ it appears that to accept this offer is in the best interest of the people of the Village of St. Anthony, N014 THEREFORE BE IT RESOLVED that the Mayor and Village Clerk are hereby authorized to execute said agreement conveying that portion of St. Anthony Boulevard as lies within the corporate limits, to the Village of St. Anthony.., and that said agreement is attached to and made a part of this resolution. u Adopted this 9 r; day of }'lit u e ��-� , 1965. • �� y ATTEST: L: Clerk Man er • THIS AG'REEKE,14T, Made tr,is �fday of 1965, '-)y and between tne city of Minneapolis, a municipal corporation, through its board o.l-. WHEREAS, party of the first part I is the owner of an easement for public parkway purposes only over tniac part of St. Anthony Boulevard lying sole ;" , wt�hlln the village limits of part,,,, of the second part , and 4HERI::46, the party of the first pert on Apr'iL 1963, has determined to convey said port!Qn of St . Anthony Boulevard to party of the second part upon the following conditions : 1. That conveyance be made by the City of Minneapolis through its Board of Park Commissioners of an easement for parkway purposes of a portion of St. Anthony Boulevard lying between Ridgeway Road and Stinson Boulevard to be more full-,.- and legally described in said easement. 2. That the area conveyed shall be restricted to use for parkway purposes only and conunericaL. industrial and truck traffic shall be pro- hibited thereon. 3. That the area conveyed shall be maintained and operated by the Village of St. Anthony, which shall relieve the City of Minneapolis and its Board of Park Commissioners from anv and all expense and costs of such operation and maintenance. 4. chat the City of Minneapolis and its Board of Park Commissioners shall. not without their consent, be assessed for boulevard or other improvements within the Village of St. Anthony. • i And WHEREAS, the party of the second part did concur and adopt the above conditions by proper action of its Village Council on May 17, 1965, Now, therefore It Is Hereby Agreed between the first and second parties, that the party of the first part will give, grant and convey to the party of the second part all its right, title and interest in and to that portion of St. Anthony Boulevard lying within the village limits of the said party of the second part and party of the first part agrees to execute and deliver a quit claim deed of conveyance of the said easement for parkway purposes. IN WITNESS WHEREOF, the City of Minneapolis through its Board of Park Commissioners, party of the first part, has caused this agreement to be executed by its President and by its Secretary, and its seal affixed, and the Village of St. Anthony, party of the second part, by its officers duly authorized, has caused this agreement to be executed and its seal to be affixed this day of Cf 1 ' , 1965. WHEREAS, the so-called at . Anthony Boulevard crosses the tracks of the Minneapolis branch of the Railway Company outside of and near the northerly city limits of the City of Minneapolis, Min- nesota; and "PHEREAS, it is desired that an overhead highway bridge be constructed at the point of crossing and that the use of a grade crossing be avoided; and ?"WHEREAS, the Railway Company desiring at a future date to '• change the grade of its tracks at and in the vicinity of the point of crossing permitting a change in the grade of the higP way the parties hereto have deemed it advisablefirst to construct a timber bridge ; NOW THEREFORE, in consideration of the mutual dependent promises herein set forth, the parties hereto agree as follows: 1. The location of said overhead bridge is correctly shown in the sketch attached hereto, marked "Exhibit A" and iden- tified by the signatures of the Chief Engineer of the Railway Company and the Engineer of the Park Board. 2. The Railway Company shall, at its sole expense, con- struct and complete on or before April 1, 1924, timber bridge shown on Exhibit A. 3. At any time subsequent to April 1, 1934, the Railway • Company shall , on demand from the Park Board, replace said bridge with a bridge of concrete, steel or a combination of these materials, 'i at its sole cost and expense. 4. The ?4ai lway Company shall maintain said temporary bridge at its sole cost and expense. "I I � I 5. The approaches to the bridge shall be constructed I - 1, and graded by the Park Board and all necessary material fur- nished by it, and said approaches thereafter shall be maintained ,I at its sole cost and expense.
