ANTHONY AND THE STATE OF MINNESOTA, MINNESOTA POLLUTION CONTROL AGENCY RESOLUTION 90-021 A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE THE AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF ST. ANTHONY AND THE STATE OF MINNESOTA, MINNESOTA POLLUTION CONTROL AGENCY WHEREAS, the City of St. Anthony and the State of Minnesota, Minnesota Pollution Control Agency have a contract to rehabilitate City Well #3 at a cost not to exceed $53, 660; and WHEREAS, the State and City agree that additional tasks are necessary for the satisfactory completion of the contract at an increase of $20, 240 to the original contract at a cost not to exceed $73, 900. NOW, THEREFORE, BE IT RESOLVED that the City Council • hereby authorizes the Mayor and City Manager to execute Contract Amendment #1 to the contract for the rehabilitation of City Well #3 on behalf of the City. STATE OF MINNESOTA E OWL= Minnesota Pollution Control Agency MAY 0 4 ','� AMMt1l' $20,240 iY! i�f-�, Ground Fate: City of St. Anthony C: Solid Waste Div. 3301 Silver Lake Road St. Anthony, Minnesota 55418 AmEmm Tr No. 1 TO CONTRA= NO. 32300-19754 WHEREAS, the State of Minnesota, Minnesota Pollution Control Agency has a contract identified as Contract No. 32300-19754 with the City of St. Anthony to rehabilitate city well #3, obtain pipeline easements and provide operation and maintenance for the Granular Activated Carbon Water Filtration Plant, and WHEREAS, the State and the City have agreed that additional tasks are necessary for the satisfactory completion of the contract; and WHEREAS, paragraph 4.6, Task 1 Rehabilitation of City Well 3, provides that: The City shall provide the state with an evaluation and justification for extent of rehabilitation required for long-tern performance of Well 3 and a work plan. Upon approval of the Work Plan by the Project Manager, the City shall subcontract the rehabilitation of City Well 3 at a cost not to exceed the • following: City labor and reimbusable costs $4,600 Subcontractor Normal Repair 21,360 New Motor and Controls (potential) 14,100 Bowl Replacement (potential) 10,600 Total $50,660 Well 3 shall be in sufficient operational condition at the completion of the work to begin normal pumping for the city water supply and treatment on long-tern basis. This task must- be completed by June 30, 1990; and, WHEREAS, paragraph 6.5 provides that: The contract dollar amount for this contract for Task 1 and 2 as described in Part 4.6 of this contract shall not exceed fifty three thousand six hundred sixty dollars ($53,660) . WHEREAS, the work plan submitted by the City has indicated that repairs to well #3 will expand the scope of work to include a ventilation system, an increase in motor size and its related reduced voltage starter and additional service capacity, necessitated by the new granular activated carbon facilities, and WHEREAS, the expanded scope of work has increased costs for the repair Well U. • NOW THEREFORE IT IS AGREED BY AND BETWEEN THE PARTIES HERETO: The City shall provide the state with an evaluation and justification for extent • of rehabilitation required for long-tern performance of Well 3 and a work plan. Upon approval of the Work Plan by the Project Manager, the City shall subcontract the rehabilitation of City Well 3 at a cost not to exceed the following: That paragraph 4.6 Task 1 shall be amended to read: New Motor $11,900 Motor Control Center 35,300 Electrical 11,400 Contingencies 5,800 Engineering 6,500 Total $70,900 Well 3 shall be in sufficient operational condition at the completion of the work to begin normal pumping for the city water supply and treatment on long-tern basis. This task must be completed by December 31, 1990; and, That the first sentence of paragraph 6.5 shall be amended to read: The contract dollar amount for this contract for Tasks 1 and 2 as described in Part 4.6 of this contract shall not exceed seventy three thousand nine hundred dollars ($73,900) . Except as herein amended, the provisions of the original agreement remain in full force and effect. IN WITNESS WHEREOF, the parties have caused this amendment to be executed as to • the date of encumbrance by the Commissioner of Finance.
