A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO
EXECUTE THE AMENDMENT TO THE CONTRACT BETWEEN THE
CITY OF ST. ANTHONY AND THE MINNESOTA POLLUTION CONTROL AGENCY
WHEREAS, the City of St. Anthony has requested that purchase of a portable generator
be included as part of the Remedial Action project to be used in emergencies
to provide electricity to the high service electrical pumps to enable the City
to provide water during times of electrical outages; and
WHEREAS, the State and the EPA have reviewed this request and have agreed that a
standby generator is an acceptable purchase as part of the Remedial Action
project.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of St. Anthony
• hereby authorizes the Mayor and City Manager to execute the amendment No. 2 to Contract
No. 32300-19754 which allows the City to purchase a generator as part of the Remedial
Action project.

AMENDMENT N0. 2 TO CONT'RAC'T' NO. 32300-19754
WHEREAS, the State of Minnesota (State) , Minnesota Pollution Control
Agency (MPCA) has a contract identified as Contract No. 32300-19754-01 with the
city of St. Anthony (City) to rehabilitate city well #3, obtain pipeline
easements and provide operation and maintenance service at the St. Anthony
• Granular Activated Carbon Plant during the first year of the Extended Remedial
Actions (Extended RA) , and
WHEREAS, the City has requested that a standby generator be included as
part of the Remedial Action project. This standby generator would be used in
emergencies to provide electricity to the high service pumps to enable the City
to provide water during times of electrical outages; and
WHEREAS, this generator is only to be used for its intended function by
the City; and
WHEREAS, the State and the EPA have reviewed this request and have
agreed that a standby generator is an acceptablepurchaseas part of the - - - -
Remedial Action project; and
WHEREAS, paragraph 1.2.3 provides that:
Part 4.0 of this contract describes the tasks to be performed and the
manner of performance under this contract. This contract may be amended
• if the parties agree to undertake additional activities beyond the scope
of work described in Part 4.0; and

WHEREAS, paragraph 6.5 Was amended on June 19, 1990, and now provides
that:
The contract dollar amount for this Contract for Task 1 and 2 as
described in Part 4.6 of this contract shall not exceed seventy-three
thousand nine hundred dollars ($73,900) . This contract may be amended
to increase the total funding for Operation and Maintenance as provided
for in Task 3 of Part 4.6 of this contract for the shakedown year of the
Extended RA; and
WHEREAS, the purchase of a standby generator requires additional costs;
and
WHEREAS, the City has completed Tasks 1 and 2 at a total cost of
$57,961.
NOW THEREFORE IT IS AGREED BY AND BETWEEN THE PARTIES HERETO:
1. Paragraph 4.6 shall be amended to include Task 4.
• Task 4. Standby Generator.
The City shall purchase a standby generator to be used only in periods
of electrical power outages, to provide electrical power that will
enable the pumps to lift water to the elevated storage tank. The City
shall solicit bids for a generator that provides sufficient capacity to
operate one high service pump, serving the water towers.
The City, as part of the Remedial Action project, shall be reimbursed at
a cost not to exceed $35,000.00 for the purchase of a generator. This
cost will be paid out of the Remedial Action construction funds which
are 90 percent federal, and 10 percent state Superfund funds.
2. Paragraph 6.5 shall be amended to read:
The contractor dollar amount of this contract for Tasks 1 and 2 as
described in Part 4. 6 of this contract shall not exceed fifty-seven
thousand nine hundred sixty-one dollars ( $57,961 ) . For Task 4 as
described in para. 4.6 this contract shall not exceed thirty-five
thousand dollars ($35,000) . The total contract dollar amount for
Tasks 1, 2, and 4 shall not exceed ninety-two thousand nine hundred
sixty-one dollars ($92,961 ) .
3. Paragraph 17.0 shall be amended to iliclude the following:
In using the generator the City shall comply with all the requirements
of 40 CFR Part 35 subpart 0 pertaining to the acquisition, use and
• disposal of equipment at CERLA sites.
4. Except as herein amended, the provisions of the original agreement
remain in full force and effect.

IN WITNESS WHEREOF, the parties have caused this Amendment No. 2 to be
executed as to the date of encumbrance by the Commissioner of Finance.
