ANTHONY RESOLUTION 00-019 A RESOLUTION RELATING TO THE MIDDLE MISSISSIPPI RIVER WATERSHED MANAGEMENT ORGANIZATION WHEREAS, the City of St. Anthony is a member of the Middle Mississippi River Watershed Management Organization (MMRWMO); and WHEREAS, the purpose of the MMRWMO is to protect and enhance water quality resources within the watershed; and WHEREAS, the MMRWMO Board of Commissioners recently approved technical changes to the MMRWMO Joint and Cooperative Agreement Bylaws relating to watershed boundaries and payment of budgetary obligations. • NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of St. Anthony hereby approves the proposed changes to the Bylaws of the Middle Mississippi River Watershed Management Organization. Implementation of the Capital Improvement Program will begin upon adoption of the Watershed Management Plan subject to the availability of funding. Such notice shall be written to the Commission's Secretary and delivered by certified mail to their principal business address. The Commission, upon notice delivered by US Mail to all Members and after a hearing, may modify or amend the budget. The MMRWMO Commission shall hold a public hearing in accordance with Minnesota Statutes 103B and 103D on the proposed capital budget. On or before September 15 of each year, the Commissioners shall adopt a capital budget for the next year and decide on the total amount to be raised • from ad valorem tax levies. By the September 15 of each year the budget shall be • certified by the Secretary of the Commission to the County, Counties or the clerk of each Member's Council together with a statement of the proportion of the budget to be provided. Subdivision 7: Following certification of the capital budget by the Secretary of the Commission, each member having a financial obligation therefore, shall provide to the Organization on or before February 1 documentation of the member's budgetary approval and commitment of the funds required. Changes in funding availability or anticipated costs will require modifications or amendments to the original budget and must be approved by majority vote of the Commission. If the Organization is responsible for the planning, design, acquisition, relocation, or • construction of an approved capital project on behalf of a Member, each Member having a financial obligation therefore, shall also provide to the Organization the funds required by the budget from that member on or before February 1. If the Member is responsible for the completion of the capital project, the Organization's approved share of the project cost coming from its tax levy will be reimbursed to the member from actual tax revenues received in a manner agreed to. Approval of Commission Minutes from May 19, 1999: Motion for approval of the minutes was passed unanimously. Insurance Coverage: Tom Frame reported that the Insurance Coverage was at the minimum amount possible: $2,413. Motion to approve the insurance coverage was passed unanimously. • Technical changes were made to the MMRWMO boundary to better reflect actual conditions and to remedy situations where the boundary split parcels.The boundary was also adjusted to include a portion of the Basset Creek Watershed in anticipation of the acquisition of this piece of land.The Basset Creek&Middle Mississippi River proposed boundary change is moving ahead.One-third of the Basset Creek municipalities have signed on.Finally,a letter concerning the boundary change has been sent to BWSR for review and comment. The MMRWMO Final Draft Watershed Plan, 1999 reflects these changes. • • Because of boundary changes,Minneapolis' share of the operating cost will increase slightly;the other municipalities will stay the same or decrease slightly. Dates for budget initiation have been modified. JCA article VI,subd.6,was changed to better reflect the timeline requirements according to the Minnesota Statutes. Adoption of Capital Improvement Budget,June 1. MMRWMO staff offered to attend council/commissioner meetings to explain the budget,timelines,etc.to member communities(contact Bill Anderson for more information, 612-673- 3179). MMRWMO Watershed Management Final Draft Plan: Future amendments were of concern to the Board. It was clarified that minor amendments are done on the board level and major amendments are brought to BWSR and then to the Board.The MMRWMO Final Draft Watershed Management Plan was approved by the Board. Chair Biernat moved to distribute the MMRWMO Watershed Management Final Draft Plan to the Reviewing Agencies as described under Minnesota Statutes,MMRWMO TAC,MMRWMO CAC,and other entities. Staff Report: • Legislative Update and Twin Cities Metro Area Watershed Network(TCMAWN)-The Department of Revenue refused the MMRWMO the right to levy.On the advice of the MMWWMO legal staff,
