A RESOLUTION APPROVING A DRAINAGE AND PONDING
EASEMENT RELATING TO THE HARDING STREET
PONDING PROJECT
WHEREAS, to help control flooding problems within the City of St. Anthony, and as an
integral part of the overall flood mitigation program, it has been recommended
to construct a holding pond in the area of Harding Street; and
WHEREAS, perpetual easements are needed for the construction, operation, maintenance,
repair and removal of facilities for the drainage and ponding of water; and
WHEREAS, to obtain needed easements for the construction of said holding pond,
discussions, meetings, and negotiations have taken place with affected property
owners in the targeted area.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of St. Anthony
hereby approves the Drainage and Ponding Easement between the City of St. Anthony and
• John M. Hunt, owner of the property addressed as 3012 Silver Lake Road; property described
as that part of the North 149.20 feet of the East-half of Lot 19, Auditor's Subdivision No. 365,
according to said plat on file and of record in the office of the county Recorder, Hennepin
County, Minnesota, which lies within the following temporary easement for construction
purposes:
The West 20.00 feet of the north 120.00 feet of the East-half of Lot 19, Auditor's subdivision
No. 365, according to said plat on file and of record in the office of the County Recorder,
Hennepin County, Minnesota..
Adopted this 2 day of 1 , 2001.

Re: Harding Street Ponding Project

I have been negotiating with Mr. Hunt to secure a temporary easement on his property for
the referenced project. Mr. Hunt has offered to settle and sign the easement for
$3,000.00.
• Our offer was $1,500.00 and was based on an appraisal of the property. The appraisal
stated that every effort to protect trees, shrubs and plantings will be made, and if
damaged of destroyed, the items will be replaced. Mr. Hunt has extensive plantings of
flowers, shrubs and trees. He will attempt to move some of the flowers and shrubs, but
will not be able to move them all. Our agreement will be that this settlement will be
payment for any losses, no replacements.
Mr. Hunt also has a swimming pool in his back yard. He feels he will have to have it
cleaned numerous times during construction that would otherwise not have to be done.
This will also be additional costs for him directly related to the project.
In discussing this with Mr. Todd Hubmer, he stated that the temporary area will be staked
in hopes that Mr. Hunt can remove as many plantings as possible, but not having to
replace them will save time and money.
I have also discussed this with Mr. David Treaver. He stated that we cannot litigate the
matter for less then $3,000.00 and it would be uneconomical to settle any other way.

In condemnation, Mr. Hunt would be entitled to appraisal costs of$500.00 plus damages
for loss of plantings, extra cleaning of the pool which altogether could easily total
$1,500.00. This plus the easement value could total $3,000.00 or more.
May I have your approval to accept Mr. Hunts offer to settle for$3,000.00?
