RESOLUTION 01-083
A RESOLUTION ADOPTING A FLEXIBLE BENEFIT PLAN
WHEREAS, City of St Anthony previously adopted the City of St Anthony
Flexible Benefits Plan on January 1, 1991;
WHEREAS, City of St Anthony desires to amend and restate such Plan to include
full flex provisions;
NOW, THEREFORE, BE IT RESOLVED, that the City of St Anthony Flexible
Spending Accounts Plan be and the same is amended, restated and adopted in the
form presented to the City Council, effective as of January 1, 2002;
BE IT FURTHER RESOLVED, that any proper members of the City Council are
hereby authorized to make such contributions from the funds of the City as are
necessary to carry out the provisions of said plan at any time; and
BE IT FURTHER RESOLVED, that in the event any conflict arises between the
• provisions of said Plan and the Employee Retirement Income Security Act of
1974 (ERISA) or any other applicable law or regulation(as such law or regulation
may be interpreted or amended), the City shall resolve such conflict in a manner
which complies with ERISA or such law or regulation.

Description.
• The Resolution of the City Council
• The Administrative Services Agreement
• IRS Publications 502 and 503
The Plan Document and Summary Plan Description have been prepared for review by you and
• your legal counsel. Once reviewed, please have the appropriate person sign the last page of
the Plan Document, and retain it for your files. I have enclosed an extra copy of the signature
page to be signed and returned to us.
After the City Council has met and formally adopted the Plan, please forward a signed copy of
the Resolution to Stanton Group.
Please have the appropriate person sign the Administrative Services Agreement and return it to
Stanton Group as soon as possible. IRS Publications 502 and 503 are for your files. As contract
administrator of your FSA plan, we will use these publications for guidance.
Both Yvonne Johnson and 1 thank you for accepting the Stanton Group Flexible Spending
Account administration proposal. We are looking forward to working with City of St Anthony.
