A RESOLUTION APPROVING A JOINT POWERS AGREEMENT
RELATING TO A POLICE TACTICAL TEAM WITH THE CITY
ROSEVILLE AND AUTHORIZING THE MAYOR AND CITY
MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE
CITY OF ST. ANTHONY VILLAGE
WHEREAS, the City Council of St. Anthony Village recognizes the current need for increased
police protection and law enforcement services; and
WHEREAS, THE City Council of St. Anthony Village finds it is in their common interests and
benefits of their Cities citizens to enter into an Agreement with the City of
Roseville concerning staffing and activities of a Police Tactical Team within their
respective jurisdictions.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of St. Anthony
• Village hereby approves the Joint Powers Agreement to Provide for a Police Tactical Team
Between the City of Roseville and the City of St. Anthony Village and authorizes the Mayor and
City Manager to execute said Agreement on behalf of the City of St. Anthony Village.

JOINT POWERS AGREEMENT
TO PROVIDE FOR A POLICE TACTICAL TEAM BETWEEN THE
CITY OF ROSEVILLE
AND THE CITY OF SAINT ANTHONY VILLAGE
THIS AGREEMENT,entered into by and between the CITY OF ROSEVILLE, a
Minnesota municipal corporation,and the CITY OF SAINT ANTHONY VILLAGE, a
Minnesota municipal corporation, is effective upon the execution of this Agreement by
the named officers of both cities.
WHEREAS, the Cities provide police protection and law enforcement services
within their respective jurisdictional boundaries, and;
WHEREAS, the Cities desire to maximize the level of police protection and law
enforcement services provided within their respective jurisdictions, and;
WHEREAS, the City of Roseville Police Department currently staffs and equips a
Tactical Team to provide specialized police services in emergency and non-emergency
situations, and;
WHEREAS, the Cities have previously entered into a joint powers agreement
dated November 15, 1968 to furnish assistance to each other on request in the form of
personnel, equipment and supplies in the event of an emergency in the participating
jurisdictions, and;
WHEREAS, Minnesota Statutes Section 471.59 authorizes political subdivisions
of the State to enter into agreements for the joint and cooperative exercise of common
powers, including those which are the same except for the territorial limits within which
they may be exercised, and:
WHEREAS, the Cities desire to enter into an agreement to extend Roseville
Police Department Tactical Team services throughout the jurisdiction of the participating
Cities, and membership in the Team by peace officers of St. Anthony, and;
WHEREAS, the Cities find it in their common interest and benefit and in the
interest and benefit of their citizens to enter into an agreement, one with the other,
concerning staffing and activities of a Tactical Team within their respective jurisdictions,
as supplementary to the preexisting joint powers agreement.

• NOW THEREFORE BE IT RESOLVED,that the Cities hereby, by act of their
City Councils, enter into this supplementary Joint Powers Agreement to furnish
assistance to each other upon the terms and conditions hereinafter set forth, as follows:
1. Each city may authorize its officers to seek membership on the Tactical Team
under the application procedures and requirements specified by the Roseville
Police Department, and the cities shall cooperatively budget for and equip
their respective team member participants.
2. All training and equipment requirements, and command and operational
protocols, shall be established by the Roseville Police Department.
3. Each Cities' Police Chief or designee may request the services of the Tactical
Team.
4. All activities of the Tactical Team shall be under the direction of the Team
Leader. Each City shall continue to be responsible for its own personnel,
equipment,and for injuries or death to any such personnel or damage to any
such equipment. Each City's personnel shall be deemed to be performing their
regular duties for the City. Insurance coverage and any financial
compensation shall be the responsibility of each party for its own personnel
and equipment. Each party waives the right to sue the other party for any
worker's compensation benefits paid to its own employee or volunteer even if
the injuries were caused wholly or partially by the negligence of any other
party, its officers, employees, or volunteers.
5. No charge shall be made to either party for assistance rendered under this
Agreement. Provided, however, that in the event the City that is requesting
assistance under this Agreement is reimbursed for said personnel, equipment,
or any other costs, from a party or parties responsible for the emergency, or
otherwise reimbursed by a third party source, then reimbursement, on a pro-
rata basis, shall be made to the responding party for any equipment or
personnel charges. Proper written documentation of expenses must
accompany a request for reimbursement.
6. The Cities agree to indemnify and defend one another against claims brought
or actions filed against one of the participants to this Agreement or any
officers, employees, or volunteers thereof, for injury or death to any third
person or persons, or damage to the property of third persons, arising out of
the performance of services under this Agreement.
7. The duty to indemnify and defend under this Agreement shall rest with the
City where the incident giving rise to the duty to indemnify and defend
occurs. The duty to defend and indemnify under this Agreement is subject to
• the liability limits under Chapter 466, Minnesota Statutes. The purpose of
creating these reciprocal duties to defend and indemnify is to simplify the
• defense of liability claims by eliminating conflicts among defendants, and to
permit liability claims against multiple defendants from a single occurrence to
be defended by a single attorney.
Under no circumstances, however, shall either City be required to pay, on
behalf of itself and another participant to this Agreement any amounts in
excess of liability limits established in Chapter 466, Minnesota Statutes,
applicable to only one Party. The limits of liability for each City may not be
added together to increase the maximum statutory liability limits to any Party.
Each City shall satisfy themselves that they have adequate insurance to cover
any claims brought under this Agreement and that the activities and
responsibilities set forth herein are covered under the provisions of their
respective insurance policies. To the extent the activities are not currently
covered, each City shall obtain appropriate insurance coverage
8. Either City may terminate its participation by providing sixty days written
notice to the other participant.
IN WITNESS WHEREOF,the Cities of Roseville and Saint Anthony Village have
• caused this Agreement to be duly executed effective on the day and year last entered
below.
