MEMORANDUM
TO: Mayor and Members of the City Council
Michael Morrison, City Manager
FROM: Jerome P. Gilligan
DATE: January 21, 2004
RE: Vacation of Portion of 39th Avenue N.E.
At its meeting on January 27`'the City Council will be holding a public hearing on the
vacation of a portion of 391h Avenue N.E. as dedicated in the plat of Apache Plaza. In
connection with the commercial development occurring in connection with the redevelopment of
Apache Plaza, the right of way for 39th Avenue N.E. in the development area will be relocated
slightly and rededicated in the plat of Silver Lake Village. I have prepared a resolution vacating
the portion of 39th Avenue N.E. to be relocated and I recommend that the City Council adopt this
resolution with the condition that it should not be filed with Ramsey County until 39th Avenue
N.E. is rededicated in the plat of Silver Lake Village. This condition should be made in the
motion to approve the resolution.
