RESOLUTION NO. 05-073
RESOLUTION RELATING TO ASSIGNMENT, ASSUMPTION, EASEMENT,
PARK MANAGEMENT AND MAINTENANCE AGREEMENT
WHEREAS, the City of St. Anthony(the"City") and the St. Anthony Housing and
Redevelopment Authority(the "Authority") entered into a Redevelopment Agreement, dated
December 19, 2003, regarding an area located in the northwest portion of the City(as amended,
the "Redevelopment Agreement"); and
WHERAS, under the terms of the Redevelopment Agreement, certain members of the
development team are responsible for construction of Ponding Site Improvements (as defined in
the Redevelopment Agreement); and
WHEREAS, in exchange for public use of the Ponding Site Improvements and other
developer-provided improvements, the City and the Authority wish to assume certain financial
responsibility for ongoing maintenance; and
WHEREAS, rules need to be established for public use of the facilities.
® WHEREAS, this shall be known as Salo Park.
NOW, THEREFORE, BE IT RESOLVED, by the City of St. Anthony, Minnesota as
follows:
That the Mayor and City Manager are authorized to finalize and enter into a
Assignment, Assumption, Easement, Park Management and Maintenance
Agreement with the Housing and Redevelopment Authority of the City of Saint
Anthony, Minnesota, and Apache Park, LLC.
