RESOLUTION 06-057
A RESOLUTION APPROVING PHASE IIA OF SILVER LAKE VILLAGE
WHEREAS, the City of St. Anthony and the Housing and Redevelopment Authority of the City
of St. Anthony entered into a Redevelopment Agreement (the "Redevelopment
Agreement"), dated December 19, 2003, with Apache Redevelopment, LLC (the
"Master Developer") for redevelopment of a portion of the City located in
Redevelopment Project Area No. 3 and commonly known as Silver Lake Village;
and
WHEREAS, the City of St. Anthony and the Housing and Redevelopment Authority of the City
of St. Anthony entered into a Phase II Redevelopment Agreement (the "Phase II
Agreement"), dated as of November 9, 2005, with Apache Redevelopment, LLC
for redevelopment the Phase II area (as defined in the Redevelopment
Agreement); and
WHEREAS, both the Redevelopment Agreement and the Phase II Agreement require the
Master Developer to seek certain land use approvals for portions of the Phase II
project; and
WHEREAS, the St. Anthony Planning Commission held a public hearing on June 20, 2006
regarding:
• 1. Amendment to the Planned Unit Development Agreement, dated September
23, 2003, and approval of a Phase II Development Plan;
2. Subdivision of property in Phase II; and
3. Approval of preliminary plat.
WHEREAS, the Council has received the Planning Commission's report and corresponding
Staff Report VI.1, dated June 20, 2006;
WHEREAS, if submission of Plat recordation does not occur within 30-days, approval of the
final plat will be null and void; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of St. Anthony hereby
approves, consistent with the descriptions and conditions contained in the
Planning Commission's report, the subdivision of and final plat of the Phase IIA
property; and
BE IT FURTHER RESOLVED that the City Manager and City Attorney are directed to finalize an
Amendment to Planned Unit Development Agreement consistent with this
Resolution; and
BE IT FURTHER RESOLVED that the City Council approves Ordinance 2006-03 and directs its
