A RESOLUTION FOR A VARIANCE FOR PARKING EXPANSION
AT 2825/2827 ANTHONY LANE SOUTH
WHEREAS, the St.Anthony Planning Commission held a public hearing on July 18,2006,
regarding a request for a variance for parking expansion located at 2825/2827
Anthony Lane South;and
WHEREAS, The property cannot be put to a reasonable use without the variance. The
Planning Commission determined that Mr. O'Brien would not be able to put his
property to reasonable use if the variance request was denied. His business has
grown over the years,requiring hien to add more employees. Denying the
variance would cause him to restrict the operations of his business; and
WHEREAS, The circumstances causing the hardship were not created by the owner. The
building was originally built in 1981 as Hub Warehouse and Mr. O'Brien is a
subsequent owner. The current 27 parking spaces met the number required for
the warehouse square footage and the number of employees on the largest shift
for the Hub Warehouse. Over time,Mr. O'Briens business has grown,requiring
• him to add staff to accommodate the needs of his business. As a result,this has
increased the number of parking spaces required by the Ordinance for the site
based on the number of employees on the largest shift; and
WHEREAS, The variance,if granted,will not alter the essential characteristics of the locality.
The Industrial District is designated for and the regulation of the development of
light industry. This designation is due to the proximity of high traffic capacity
roadways and rail facilities to accommodate the transport of manufactured
products. The Planning Commission found that approving the variance for
additional parking spaces would not alter the essential character of
the area; and
WHEREAS, Economic considerations alone are not the basis of the hardship. While the
variance, if approved,would provide for the construction of the minimum
number of parking spaces required to satisfy the spirit and intent of the Zoning
Code for this zoning district. Adding another 19 parking spaces as part of this
variance could possibly be seen as economic in nature but the Planning
Commission found that Mr. O'Brien's request is not based on economics alone.
His request is based on the operational needs of his business and the requirement
of the City's Ordinance requiring him to have parking spaces enough for the
largest shift;and
WHEREAS, The circumstances causing the Hardship are unique to the individual lot. The site
• is a corner lot, adjacent to a busy county road and two interior streets. Each side
adjacent to a street requires a larger set back than an interior lot. This is

• especially true on the west side of the lot where it is adjacent to County Road
C/29th Avenue. The west side is also considered the front yard,requiring a large
set back. In addition to being bordered by three streets,the building occupies
more than 50% of the lot. This situation further limits the amount of space
available for parking. The Planning Commission found this property is unique
as it is bordered on three sides by streets,which according to the City Ordinance
requires additional setback distances. Anthony Lane South on the west side of
the property is found to be a wider street and as such would not be impacted by
allowing the parking lot to encroach into the setback by nine feet; and
WHEREAS, The granting of the variance is in keeping with the spirit and intent of the Zoning
Code. The Zoning Code requires 38 parking spaces for the Building Fastener
building based on square footage and largest shift. Granting a parking variance
for the additional 11 spaces would be in keeping with the spirit and intent of the
Zoning Code. The Planning Commission found that by allowing the parking
variance,the impact on the surrounding properties and vehicular traffic would
be reduced. Cars would not be parked on the street creating difficult passage for
traffic in the area and Mr. O'Brien would not have to depend on neighboring
properties to provide overflow parking for his employees and customers;and
WHEREAS, The Planning Commission stipulated that if this request is approved and if any
trees are removed for the construction of this parking area,he needs work to
with City Staff to replace them.
• NOW,THEREFORE BE IT RESOLVED,the Planning Commission recommends to the City
Council approve a variance for parking expansion at 2825/2827 Anthony Lane South.
