RESOLUTION 07-071
• A RESOLUTION FOR APPROVAL OF A CONDITIONAL USE PERMIT FOR THE JACK&JILL
DAYCARE AND PRE-SCHOOL FACILITY LOCATED AT
2812 ANTHONY LANE SOUTH
WHEREAS, the St. Anthony Planning Commission held a public hearing on September 18,2007 as
required by the City of St. Anthony Zoning Code,Section 1655.04,Conditional Use
Permits; and
WHEREAS, the Planning Commission moved to table the CUP application to October 16,2007 for
additional information in support of the application;and
WHEREAS, the Planning Commission reconvened the public hearing at the October 16, 2007
Planning Commission meeting;and
WHEREAS, the Planning Commission reviewed and considered that the proposed use is one of the
conditional uses proposed by a text amendment to the City Code;that the use will not
be detrimental to the health, safety or general welfare of persons residing or working
in the vicinity or to the property values in the vicinity and that the use will provide a
service or a facility which is in the interest of public convenience and will contribute to
the general welfare;and
• WHEREAS, the Planning Commission reviewed and considered specific conditions regarding
Licensure,Traffic Control,Parking,Signs,Play Areas,and Text Amendment Approval
recommended for City Council consideration and to be made part of the Conditional
Use Permit for Jack&Jill Daycare and Pre-school facilities;and
WHEREAS, the City Council has received and reviewed the Conditional Use Permit application as
provided by Mr. Robert Foster regarding the Jack&Jill Daycare and Pre-school facility
to be located at 2812 Anthony Lane South;and
WHEREAS, the City Council has received the Planning Commissions recommendation for
approval.
NOW,THEREFORE BE IT RESOLVED, the City Council approves the requested Conditional Use
Permit as applied for the Jack&Jill Daycare and Pre-School facility,with the aforementioned
conditions.
