A RESOLUTION TO "HOLD HARMLESS" THE STATE OF MINNESOTA FOR
GRANTING A VARIANCE FROM MINNESOTA RULES FOR STATE AID 8820.9920
WHEREAS, the City of St. Anthony has applied to the Minnesota Department of
Transportation, State Aid for Local Transportation Office, for a Variance from
Minnesota Rules for State Aid Operations 8820.9920 as they apply to the proposed
reconstruction of Chandler Drive and Foss Road, between 37' Avenue NE to the
east city limits.
WHEREAS, the variance requests to allow a 84' radius (20MPH) curve between stations 27+75
and 28+45 and a 182' radius (25MPH) curve between stations 39+65 and 41+45
within the project limits in lieu of the minimum 30 MPH (300' radius) design speed
as required by the rules.
WHEREAS, the Office of State Aid for Local Transportation has granted this variance
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of St. Anthony that:
1) The City of St. Anthony does hereby indemnify, save and hold harmless the State of
Minnesota and its agents and employees of and from any and all claims, demands, actions,
or causes of action arising out of or by reason of granting this variance, and further agrees
to defend at their sole cost and expense, any action or proceeding commenced for the
purpose of asserting any claim of whatsoever character arising as a result of the granting
of this variance.
