RESOLUTION TO APPROVE A VARIANCE TO THE SIGN ORDINANCE
TO ALLOW A SECOND IDENTIFICATION SIGN FOR
HENNEPIN COUNTY MEDICAL CLINIC
AT THE MARKET PLACE SHOPPING CENTER
WHEREAS, Mr. Richard Lang of Visual Communications contacted City staff advising
them that Hennepin County Medical Clinic is locating at the Market Place
Shopping Center and wanted to discuss the need for a second identification
sign; and
WHEREAS, Staff advised Mr. Lang that City Ordinance §155.29 (B) (1) allows only one
identification sign; and
WHEREAS, Mr. Lang, as the representative for Hennepin County Medical Clinic
applied for a variance to the City's Sign Ordinance to allow for a second
identification sign; and
WHEREAS, the Planning Commission held a public hearing on the variance request on
December 20, 2011; and
WHEREAS, The Planning Commission determined that the Hennepin County Medical
Clinic's request for a variance to the sign ordinance to allow a second
business identification sign has met the criteria as specified in the City
Code's Zoning Ordinance, §152.245 (C) which states that no variance will
be granted unless evidence presented supports that strict enforcement of the
City Ordinance would cause practical difficulties for the applicant.
1. The property cannot be put to a reasonable use without the
variance due to the architecture in the planned unit development;
2. That the circumstances causing the practical difficulty were not
created by the tenant;
3. That the variance, if granted, will not alter the essential
characteristics of the locality;
4. That economic considerations alone are not the basis for the
practical difficulty;
5. That the circumstances causing the practical difficulty are
unique to the individual lot; and
6. The granting of the variance is in keeping with the spirit and
intent of the Zoning Code and Comprehensive Land Use Plan.
WHEREAS, Staff received one phone call in opposition to the applicant's proposed
second business identification sign;and
WHEREAS, The Planning Commissioners voted unanimously to recommend approval of
the variance to the City's Sign Ordinance to allow a second business
identification sign.
BE IT RESOLVED,that the City Council of the City of St. Anthony does hereby agree with
the Planning Commissions recommendation; and
BE IT FURTHER RESOLVED that the City Council of the City of St. Anthony does
hereby approve the variance to the City's Sign Ordinance,allowing a
second business identification sign for the Hennepin County Clinic located
at 2714 Hwy 88, Market Place Shopping Center.
