ANTHONY JANUARY 12, 1965 1 . CALL TO ORDER A regular meeting of the Village CounciI was called to order by Moytr James H. McNulty at 8:12 P.M. 2. ROLL CALL The following councilmen were present at roll call: Robert Bailey V\'. R. Dougherty James H. McNulty Richard Sorenson Absent and excused was George Erickson. Also present were the Village Nionoger, Village Attorney, and Village Clerk. 3. MINUTES On motion by Councilman Dougherty seconded by Councilman Bailey reading of the minutes was waived. The minutes were approved as submitted. The motion carried unanimously. 4. PUBLIC HEARINGS A. Hearing on vacation of Belden Drive by Nativity Lutheran Church. Upon motion by Councilman Bailey seconded by Councilman Sorenson it was moved to table action. The hearing was adjourned by the Mayor pro-tem, N.B. Dougherty. Abstaining from voting as an abutting property owner was Mayor McNulty. The motion to table carried unanimously. 5. RESOLUTIONS AND ORDINANCES A. Resolution No. 65-001 designating the St. Anthony Record as the official newspaper for 1965. Upon motion by Councilman Bailey seconded by Councilman Dougherty is was moved to waivo reading of Resolution No. 65-001 and adopt the resolution. 40 The motion carried unanimously. -r- B. Resolution No. 65-002 designating the State Bank of the Village of St. Anthony as depository for village funds and accepting collateral securities as counterpart funds. Upon motion by Councilman Dougherty seconded by Councilman Bailey it was moved to waive reading of resolutica No. 65-002 and adopt the resolution. The motion carried unanimously. C. An Ordinance regulating the erection, construction, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use and maintenance of all buildings and/or structures; providing for the issuance of permits and collection of fees; providing penalties for violations; declaring and establishing fire zones; repealing Ordinance Numbers 18, 20, 29,34, 46, 47, 56, 57A and 68 . Upon motion by Councilman Bailey seconded by Councilman Sorenson it was moved to refer to the Planning Board for review and recommendation in accordance with the M & C 65-1 submitted by the Village Manager. The motion carried unanimously. D. An ordinance providing an Administrative Code and establishing rules for the organization and procedure of the Village Council of the Village of St. Anthony . Upon order of Iviayor McNulty the ordinance was deferred for study by the Village Council until the meeting of February 9, 1965. 6. COMMUNICATIONS, PETITIONS AND REPORTS A. Communication from Antonio Fellicetta of Local 11792 regarding salary adjustment to Liquor Off-Sale employees. Upon order of the Mayor the communication was referred to the Village Manager and attorney for report at the next regular council meeting, January 26, 1965. B. Communication from Minneapolis Gas Company- re: rate reduction. An oral report by Stanley Peickert indicated that the t rate revision returned to the rate schedule utilized by the Gas Company for the first nine months of 1964. The Suburban Rate Authority is considering action to counteract the impression left by the news releases on the rate reduction that savings of a substantial character could be expected. C. Communication from Robins, Davis & Lyons re: Anthony GollicWs Health Insurance. Upon order by the Mayor the matter was referred to the attorney for report at nexlt regular meeting of January 26, 1965. -3- D. Connumication from Robins, Davis & Lyons re: Appeals of dismissal for Anthony Ga I I ick and Robert Dawson Upon order of the Mayor the matter was referred to the Manager and Attorney with instructions to contact union representative to discuss the appeal. A report was to be made at the meeting of January 26, 1965. E. Communication from Minnesota State Highway Department re: detour of Highway 8 from County Road C to Highway 35N during reconstruction. Upon order of Mayor McNulty the communication was received and filed. F. Minutes of the Park and Recreation Advisory Committee meeting held January 7, 1965. Upon order of Mayor McNulty the minutes of the Park and Recreation Advisory Committee meeting held January 7, 1965 were ordered received and filed. G. Report of the Village Manager on the Uniform Building Code adoption a - Upon order of Mayor McNulty t M & C 654 relative to the Uniform Building Code was ordered received and filed. H. M & C 65-2 - report of the Village Manager re: LPG conversion of municipal equipment. Upon motion of Councilman Bailey seconded by Councilman Dougherty the Village Manager was requested to have a representative of HOME GAS COMPANY appear at the next regular meeting January 26, 1965 to explain the operation of LPG equipment. Motion carried unanimously. I. Report of the Village Manager of employee appointment. Village Manager reported the appointment of James Shaughnessy as Village Assessor effective January 4, 1965. Upon order of the Mayor the appointment was placed in the minutes. 7. MISCELLANEOUS A. Mayor's appointments for 1965. The Mayor recommended the appointment of the following people for the Planning Commission: Zone I - Louis Howitz Zone 4 - Thomas J. Emond Zone 2 - Peter DiCarlo Zone 5 - Thomas Coulter, Chairman Zone 3 - Clement Springer Zone 6 - Robert Mesenbring Vice-Chairman) At Large - Curtis Englund -4... • Upon motion by Councilman Dougherty seconded by Councilman Sorenson it was moved to recommend approval of the Mayor's appointments. The motion carried unanimously. The Mayor recommended the following appointments to the Park and Recreations Advisory Committee: Robert Eagle, Chairman John Andryehowicz, Vice - Chairman George DeAngelo Jerome Bennek Everett N. Hamilton Upon motion by Councilman Bailey seconded by Councilman Dougherty it was moved to approve the appointments of Mayor McNulty. The motion carried unanimously. Upon motion by Councilman Bailey seconded by Councilman Dougherty it was moved to express with a certificate of appreciation the council's sentiments for the service rendered as a member of the Parks and Recreation Committee, • to Miss Frances Kidd. The motion carried unanimously. The Mayor recommended the following appointments to the Business and Industrial Development Commission: James K. Wrkins, Chairman Dan Burrill Robert Dircks Upon motion by Councilman Dougherty seconded by Councilman Sorenson it was moved to approve the Mayor's appointments. The motion was carried unanimously. The Mayor recommended the following appointments to the Ramsey County League of Municipalities. Delegate Richard K. Sorenson Alternate Robert W. Bailey It was moved by Councilman Dougherty seconded by Mayor McNulty to waive • the reading and adopt resolution 65-005 naming delegates to the Ramsey County League of Municipalities. The motion carried unanimously. Mayor McNulty recommended the following appointments to the Hennepin County League of Municipalities: Delegate James H. McNulty Alternate James K. Perkins Upon motion by Councilman Sorenson seconded by Councilman Bailey is was moved to waive the reading and adopt the resolution naming delegates to the Hennepin County League of Municipalities (65-004) The motion carried unanimously. The Mayor recommended the following appointments to the Suburban Rate Authority: Delegate George Erickson Jr. Alternate Stanley A. Peiekert Upon motion by Councilman Bailey seconded by Councilman Sorenson is was moved waive the reading and adopt resolution No. 3 naming delegates to the Suburban Rate Authority. The motion carried unanimously. Upon motion by Councilman Bailey seconded by Councilman Sorenson it was moved to authorize the mayor and manager to certify the appointments to the various boards agencies and to send copies of the resolutions to the secretaries thereof as notice of appointment . The motion carried unanimously. B. Appointment of a Mayor Pro-Tem. Mayor McNulty recommended the appointment of 1A`. R. Dougherty as Mayor Pro-Tem. Upon motion by Mayor McNulty seconded by Councilman Sorenson it was moved to concur in the appointment of the Mayor naming W. R. Dougherty as Mayor- Pro-Tem. The motion carried unanimously. C. Revision of the salary of John Lukach. • An oral report offered by the Village Manager indicating an error in the 1965 salary appropriation of John Lukach and indicating an accumulation of 29 days compensatory leave was made. -6 • It was moved by Councilman Baily suconcled by IV;ayor McNulty to revise the salary of John Lukach to $581 .70 monthl - and to authorize the village manager to pay fifteen (15) days leave or to callow fifteen (15) days compensatory leave . The motion carried unanimously. D. Request transmitted by Dewayne Olson of Comstock & Davis, Inc. to discuss addition of .37 miles on Stirseri Boulevard as a Municipal State lid designated route. Upon order of Mayor McNulty the village manager was authorized to communicate with the City of Columbia Heights indicating the willingness of the Village of St. Anthony to designate .37 mileson Stinson BoulQvard as a Municipal State Aid designated route. 8. OLD BUSINESS P,. Request by the Minnesota State Highway Department for approval of final plans for Trunk Highway 35�.,V through a portion of the Village of St. Anthony. Mfr. McFadden and Mr. VYeiner appeared before the Council , representing the I"v;innesoto State Highway Deportment. • Upon motion of Ntayor McNulty seconded by Councilman Dougherty it was moved to waive the reading and adopt resolution disapproving preliminary and final plans 4; for the construction of Trunk Highway 35W through a portion of St. Anthony 9 Village and authorizing the village manager to request a hearing before the iv'teAropoliton planning Commission to determine the necessity and convenience for an inter-change linking Trunk Highway 35W and St. t,nthony Boulevard. The motion carried unanimously. B. Communication from Ros-_ Radio Cab Company requesting ordinance changes reducing liability coverag-- and rate of fare sections for operation of cabs servicing St. ;nthony Village. Upon order by Mayor McNulty the matter was deferred to the regular meetings of January 26, 1965 pending clarification of the present village ordinance per- taining to cab licensing. 9. VERIFIED CU-- IMS Upon motion of Councilman Dougherty seconded by Councilman Bailey it was moved to approve the verified claim; as presented. • 10. CONTRACT PAYMENTS Request by Brauer & ;,ssoeiates for supervision and inspection of work under contract for Central- Park in 'the amount of $103.50 . • Upon motion by Mayor McNulty seconded by Councilmen :ougherty the claim for payment Nes referred to the Village Manager for discussion and clarification by the consultant. The motion carried unanimously. M. Request by Brauer ? Associates for supervision and inspection of work under contract for S i Iver Point Park in the amount of $177.70. Upon motion by lvtoyor iVicNulty and seconded by Councilman Dougherty the claim for payment was referred to the; village manager for discussion and clarification by the consultant.
