ANTHONY March 23, 1965 1. CALL TO ORDER A regular meeting of the Village Council of the Village of St. Anthony was called to order by Mayor James H. McNulty on Tuesday, March 23, 1965 at 8:00 PM. 2. ROLL GALL The following members were present at roll call : Robert Bailey 1d. Dougherty George Erickson James H. McNulty Richard Sorenson Also, present were the Village Manager, Village Clerk, Village Attorney and the Village Engineer. 3. MINUTES Upon motion by Councilman Sorenson, seconded by Councilman Bailey, it was moved to waive reading and approve minutes of the meetings of March 9, • 1965 and March 16, 1965. The motion carried unanimously. 4. PUBLIC HEARINGS None 5. RESOLUTIONS AND ORDINANCES Upon motion by Councilman Sorenson, seconded by Councilman Dougherty, it was moved to waive reading and adopt Resolution No. 65-030 designating Stinson Blvd. from 37th Avenue NE to Silver Lane as a Municipal State Aid Street jointly with Columbia heights. RESOLUTION NO. 65-030 RESOLUTION DESIGNATING STINSON BOULEVARD FROM 37th AVENUE NE TO SILVER LANE AS A MUNICIPAL STATE AID STREET JOINTLY WITH COLUMBIA HEIGHTS The motion carried unanimously. Upon motion by Councilman Dougherty, seconded by Councilman Bailey, it was moved to waive reading and adopt Resolution No. 65-031 signifying willingness to assume responsibility for St. Anthony Boulevard from Stinson Boulevard to proposed Highway 351"1 provided a connection to and under T. H. 35VI is provided. RESOLUTION NO. 65-031 RESOLUTION SIGNIFYING UILLINGNESS TO ASSUME RESPONSIBILITY FOR ST. ANTHONY BOULEVARD FROM STINSON BOULEVARD TO PROPOSED HIGHWAY 351! PROVIDED A CONNECTION TO AND UNDER T. H. 351.1 IS PROVIDED. The motion carried unanimously. Page 2 • Council Minutes March ;9, 1965 Upon motion by Councilman Erickson, seconded by Councilman Dougherty, it was moved to waive reading and adopt Resolution No. 65-032 Petition Railroad and Warehouse Commission to Signalize Soo Line Crossing at 37th Avenue NE and Stinson Boulevard. RESOLUTION NO. 65-032 RESOLUTION PETITIONING RAILROAD AND WAREHOUSE COMMISSION TO SIGNALIZE SOO LINE CROSSING AT 37th AVENUE NE AND STINSON BOULEVARD The motion carried unanimously. Upon motion by Councilman Dougherty, seconded by Councilman Sorenson, it was moved to defer action on appropriating money from the general fund reserve to Account 475 to finance 1965 Parks Construction until a suitable agreement can be accomplished between the St. Anthony I.S.D. ##282 and the Village Council regarding the conveyance of land in the area of the tennis courts. The motion carried unanimously. Upon motion by Councilman Dougherty, seconded by Councilman Sorenson, it was moved to waive second reading and adopt, as corrected, Ordinance No. 49A Relating to and Regulating Use of Village Paeks and Prescribing Penalties and Repealing Ordinance No. 49. ORDINANCE NO. 49A • AN ORDINANCE RELATING TO AND REGULATING THE USE OF PARKS AND PRESCRIBI14G PENALTIES; REPEALING ORDINANCE N0. 49, ADOPTED AUGUST 27, 1959• Voting on the motion: Aye: Bailey, Dougherty, Erickson, McNulty, Sorenson Nay: None The motion carried unanimously. 6. COMMUNICATIONS, PETITIONS, AND REPORTS Upon motion by Councilman Dougherty, seconded by Councilman Bailey, it was moved to instruct Village Manager to contact the residents within two houses of the corners of the intersection of 36th Ave. HE and Selden Drive to obtain their feelings on the installation of a street light at that intersection as requested by Carl Looyen. The motion carried unanimously. Upon order of Mayor McNulty, the report on the Mun4cip6l Liquor operation for the year ended December 31 , 1964, was received and filed. Upon order of Mayor McNulty, a special meeting was called for 7:30 PM on April 6, 1965, to discuss the 1964 liquor report. Upon order of Mayor McNulty, the report of police activities for February, 1965, was received and filed. Upon order of Mayor McNulty, the reports of Village financial operations and condition for the months of January and February, 1965 were received &filed. Page 3 Council Minutes March 23, 1965 Upon order of Mayor McNulty, the minutes of the Planning Board meeting of March 16, 1965 were received and filed. • Upon motion by Councilman Dougherty, seconded by Councilman Sorenson, it was moved to accept Planning Board recommendation and grant a setback waiver from 30 feet to 24 feet from Roosevelt Street; from 30 feet to 26 feet, measured parallel to the west side of the structure from St. Anthony Road; and from 25 feet to 10 feet on the rear yard on lot 18, block 5, Clark and i:ings Hennepin Garden's as requested by Raymond J. Swenson. Themotion carried unanimously. on motion by Councilman cricl-son, seconded by Councilman Bailey, it was moved to accept the Planning Board recommendation and grant a setback waiver from 30 feet to 23 feet from Edward Street on part of lot 11 lying E. of 1H. 115 feet, Block 2, Clark & kings Garden Tracts, as requested by Henry De Luce, 3604 Edward Street. The motion carried unanimously. Upon motion by Councilman Dougherty, seconded by Councilman Sorenson, it was moved to accept the Planning Board recommendation and approve a building permit to the D. J. Kranz Co. to construct an addition to the existing structure at 3005 - 37th Avenue NE. subject to approval of the Village Engineer. The motion carried unanimously. Upon motion by Councilman Dougherty, seconded by Councilman Sorenson, it was moved to accept the Planning Board recommendation and approve a building permit for the Faith Methodist Church for an addition to the existing structure at 2708 - 33rd Avenue NE subject to providing a 15 foot setback of the parking lot from 322 Avenue NE. Voting on the motion: Aye: Dougherty, Erickson, McNulty, Sorenson Nay: None . Abstaining: Bailey The motion carried. 7. MISCELLANEOUS Upon order of Mayor McNulty, the motice from the Village Manager of the appointment of Harcelle Slindee as Resident Deputy Court Clerk for the Hennepin County Municipal Court was to be noted in the minutes. Upon motion by Councilman Sorenson, seconded by Councilman Bailey, it was moved to adopt Resolution No. 65-033 Authorizing and Instructing the Village Consulting Engineering firm of Comstock and Davis to prepare plans on specifications for the relocation of utilities in the area of the construction of new Highway #8 at 29th Avenue NE and setting date for an improvement hearing.
