ANTHONY COUNCIL MINUTES May 27, 1969 The meeting was called to order by the Mayor at 8:00 o'clock P. M. The following were present at roll call : O'Connor, Emond, Levandowski, Dougherty. Absent: Crouse. Also Present : Raymond Haik, Village Attorney John Printon, Village Manager Motion by Councilman Emond and seconded by Councilman Levandowski that the minutes of the regular meeting of May 13, 1969 be approved as submitted. Motion carried. Motion by Councilman Dougherty and seconded by Councilman Emond that the minutes of the special meeting of May 19, 1969 be approved as submitted. Motion carried. Mr. William Peet, insurance consultant read his insurance report to the Village Council, a copy of said report follows: May 23, 1969 Village of St. Anthony 2900 Kenzie Terrace St. Anthony, Minnesota 55418 Attention: Village Council and Manager Re: Award of Property and Liability Insurance Renewals You are advised to make captioned award alternatively as follows : Alternative I: entire account to the Home Insurance Company* through the Kerney Company, Inc. of S t. Paul. Approximate annual cost: $30,011 Alternative II: as above except for workmen's compensation on which you would choose either Sentry Insurance at a net premium saving of about 322 AID Insurance Sorvices where you could save up to over $4,200 for less than 6% losses, or lose up to $674 if losses exceed 56% of premiums. On basis of past • performance which has been better than average, AID's and Sentry's net cost would be about equal. The alternatives are in order of our preference for the following reasons: -2- 1 . 2-1 . Neither AID nor Sentry proposed an entire program, as Home did at a cost far below those of all competing proposers. Horne, and its agent, thus have the biggest stake in helping keep your record good so they can continue your insurance at lower over all cost. 2. If workmen's compensation experience proved bad, AID and Sentry would have no other more profitable coverage as a reason to continue on your risk rather than cancel. WILLIAM PEET CO. ANALYSIS For the sake of comparison, the following coverages are listed at basic limits shown in the specifications: Automobiles and contractors equipment (liability, "comprehensive" • and $250 deductible collision and upset ) General and liquor liability (latter at $300,000) General property (fire, extended coverage, vandalism and boiler) Voting machines Neon sign Fidelity, faithful performance and forgery ($25,000 each) Money and securities Business interruption Besides Home/Kenney, only one other proposer offered them all : Aetna Life and Casualty through the Swen Anderson Agency. Their annual cost of $31 ,566* compares with that recommended of $17,434*. Cavanagh Agency proposed through four companies, one of them AID, but failed to include fidelity, forgery, money and securities and theft. Even with those omissions, their estimated annual premium was $22,631-',. *All proposers used the same source as Kenney for liquor liability, although Cavanagh indicated the Western Casualty and Surety would provide it at a sub- stantially higher price and only as an adjunct to the general liability, where they were distinctly non-competitive. This is pertinent because the Chicago has a B+ ("very good") rating instead of the A+ or A ("excellent") called for by the specifications. In view of the other factors involved, however (especially the big overall price differential ), you can award the liquor liability to the Chicago without being subject to valid criticism. We recommend the following additional purchases from Home/Kenney f -3- • **Property insurance extended to "a l l risks", including theft, at all locations. Annual cost $540 Fidelity and faithful performance increased to $100,000 blanket. Annual cost $204 Forgery increased to $50,000. Annual cost $ 58 ;:-r "Umbrella liability" $1 ,000,000 excess of $10,000 (but cost of defense included), or of existing public and employer's liability coverages, including $300,000 liquor. Annual cost $2,500 Total annual cost for recommended additions $3,302 Home/Kenny's estimated net annual cost for workmen's compensation after 6% dividend indicated is $9,275. The AID and Sentry variations shown in Alternative II of covering letter are off that figure. Cost Reconciliation: Basic proposal $17,434 Recommended additions 3,302 Workmen's compensation 9,275 $30,011 • * No other proposers offered these. After a discussion period, Councilman (mond moved and seconded by Councilman Dougherty that the Kenney Insurance Company, St. Paul be awarded the Village insurance as recommended in alternate #11 $30,011.00 Motion carried. Mr. Robert Mesenbring presented the Planning Boards minutes of their May 20, 1969 meeting. Motion by Councilman Dougherty and seconded by Mayor O'Connor that the request of C. B. Christiansen to divide lot 6, block 5, Mounds View Acres Second Addition into four lots with the addition of part of lot 5, and lot 7, with variances as follows; 754 sq. ft. on 62 foot lot, 13 foot variance in width, 62 foot lot and a four foot variance in width on the 71 foot lot, be approved subject to platting. Motion carried. /Motion by Councilman Levandowski and seconded by Councilman Dougherty that a request by A. J. Martin for a 2 ' side yard variance be approved. Motion carried. Motion by Mayor O'Connor and seconded by Councilman Emond that consideration of a • 6' - 8" side yard variance be tabled pending submission of a plot plan showing present buildings and proposed addition, and a letter from the adjoining neighbor indicating feelings on the proposed. Motion carried. 1 • -4- "/Motion by Councilman Dougherty and seconded by Councilman Emond that the request of Standard Oil Compand and Minneapolis Scientific Controls Company to rezone the property on the N. W. Corner of 37th Avenue N. E. and Silver Lake Road from light industrial to commercial be approved and that the Village Attorney be directed to prepare an amendment to the Zoning Ordinance. Motion carried. Mo ion by Councilman Dougherty and seconded by Councilman Emond that the preliminary plat of Apache Terrace Addition be approved subject to joining lots 2 and 3 into one lot. Motion carried. Motion by Councilman Emond and seconded by Mayor O'Connor that a 3' variance be /granted on the N. W. corner of the house set back at 3216 Roosevelt St. N. E. ` � Motion carried. Motion by Councilman Levandowski and seconded by Mayor O'Connor that the Council turn down any land acquisition for parks near the holding pond. Voting on the motion: Aye : Levandowski, O'Connor. • Nay: Emond, Dougherty. Absent not voting: Crouse. Motion not carried. Motion by Councilman Dougherty and seconded by Councilman Emond that the Village Manager be directed to prepare a recommendation for a ballot for a referendum vote for acquisition of a park site in Ramsey County. Motion carried. Mrr_ Coleman and the attorney for the Apache Corporation appeared. Mr. Coleman presented a preliminary plat of the townhouse - apartment development proposed North of the Apache Center building. The preliminary plat was divided into four lots, indicated burm elevations, and location of apartments and townhouses. After discussion, Councilman Emond moved and seconded by Mayor O'Connor that the preliminary plat as submitted by the Apache Corporation be approved. Motion carried. Motion by Councilman Levandowski that the request of the Apache Corporation for zoning change be denied until plans are submitted. No second to motion. Councilman Emond moved and seconded by Mayor O'Connor that Ordinance 69-4, An Amendment to the Zoning Ordinance, be adopted and that the rules be waived and the Ordinance adopted on first reading. Voting on the motion: •t. % -5- Aye: 5-Aye: O'Connor, Emond, Levandowski , Dougherty. Nay: None. Absent not voting: Crouse. Motion carried. The meeting was recessed at 9:45 and reconvened at 9:55. All present that answered opening roll call. The Burning Ordinance was next discussed. Motion by Councilman Emond and seconded by Mayor O'Connor that the use of incinerators meeting the National Fire Code be allowed and that the Burning Ordinance be so amended. Voting on the motion: Aye: O'Connor, Emond, Dougherty. Nay: Levandowski. Absent not voting: Crouse. Motion carried. Motion by Councilman Dougherty and seconded by Councilman Levandowski that the Minnesota Highway Departments proposal for signing the St. Anthony Blvd. exit and entrance on 352W be approved. Motion carried. Mayor O'Connor introduced Resolution No. 69-024 and moved its adoption. RESOLUTION NO. 69-024 A RESOLUTION APPROVING THE SETTLEMENT OF A TAX CLAIM BY THE STATE OF MINNESOTA, AND APPROVING THE TRANSFER OF THE NECESSARY FUNDS. The resolution was duly seconded by Councilman Dougherty. Voting on the resolution: Aye: O'Connor, Emond, Levandowski, Dougherty. Nay: None. Absent not voting: Crouse. is Resolution declared adopted. A letter of proof of membership was requested of Local /#664. Councilman Dougherty requested a roster of Village employees. -6- Motion by Councilman Levandowski and seconded by Mayor O'Connor that the engineers certificate in the amount of $215.88, Village engineering services, be approved. Motion carried. Motion by Councilman Dougherty and seconded by Councilman Emond that the licenses be approved as submitted. Motion carried. Motion by Councilman Emond and seconded by Mayor O'Connor that the properly verified accounts be approved. Motion carried. Motion by Mayor O'Connor and seconded by Councilman Levandowski that the claim of the Ramsey County Auditor in the amount of $663.09, County Ditch #2, be approved. Motion carried. Motion by Councilman Emond and seconded by Councilman Dougherty that the following engineers certificates be approved: Project 1968-4, $2,477.40 Project 1969-1, $2,622.94 • Motion carried.
