The following were present at roll call : Crouse, Emond, Miedtke, Levandowski, Kukielka. Also present : Village Attorney, Larry Vickrey Village Manager, John R. Printon The following corrections on the minutes of the March 10, 1970 meeting were noted: On page 2 in the motion by Mayor Miedtke, strike out "Membership" and put in "League of Minnesota Municipalities". On page 3 in the middle of the page in the motion by Councilman Crouse, it should be make recommendation to the "Council" not to the "Residents". Motion by Councilman Levandowski and seconded by Councilman Crouse to approve the minutes of the March 10, 1970, meeting as amended. Motion carried. Orville Bratland presented the minutes of the March 17, 1970, Planning Board meeting. Motion by Councilman Kukielka and seconded by Mayor Miedtke to accept the re- commendation of the Planning Board to approve the request of Mobil Oil Company to put up a four foot diameter sign on the wing wall of each of their two stations according to the limitations of the sign ordinance code. Voting on the motion: Aye: Miedtke, Emond, Kukielka, Levandowski Nay: Crouse Motion carried. (Motion by Mayor Miedtke and seconded by Councilman Emond to approve the proposed addition to Bover Welding as recommended by the Planning Board subject to final drawings, landscaping and blacktopping of the parking lot. Motion carried. Motion by Councilman Crouse and seconded by Councilman Kukielka to refer to the Village Attorney the proposed changes in Ordinance 1969-4 as presented by Harvey •' Coleman and for him to (1 ) review the legality of the protective covenant, (2) review the amending of the present ordinance, (3) determine whether a public hearing is necessary and to recommend a date and time for the hearing and (4) present all this to the Council at the next meeting, April 14, 1970. Motion carried. 2 -2- Motion by Mayor Miedtke and seconded by Councilman Crouse to affirm the Planning Board's action to deny the request for a permit for an addition of a two car garage by a prospective owner on Stinson Boulevard because the party requesting the • permit is not the owner but would reconsider when he becomes the owner. Motion carried. 'Motion by Councilman Crouse and seconded by Councilman Levandowski to approve the new proposed sign for the south side of the American Legion Hall as recommended by the Planning Board since it does conform to the sign ordinance code. 1"'1_7 tion carried. Mayor Miedtke introduced Resolution #70-011 and moved its adoption. RESOLUTION #70-011 RESOLUTION RELATING TO THE APPORTION- MENT OF SPECIAL ASSESSMENTS FOR LOCAL IMPROVEMENTS The resolution was duly seconded by Councilman Kukielka. Voting on the resolution: Aye: Crouse, Emond, Miedtke, Levandowski, Kukielka Nay: None Resolution declared adopted. Bids were received for aggregate, blacktop and asphaltic oils a copy of which is attached to these minutes. Motion by Councilman Emond and seconded by Councilman Levandowski to award the bids to Anderson Aggregate for aggregate, to T.A. Schifsky for blacktop and to Barber Oil for asphaltic oil. Notion carried. Mayor Miedtke ruled that the Liquor Store Report be filed and that the Village Liquor Store Manager be commended on a job well done. Motion by Councilman Crouse and seconded by Councilman Emond to approve the sub- stitution of attorneys for the Soo Line case. Motion carried. The Mayor ordered that the February reports from the Police and Fire Departments be filed. Motion by Councilman Crouse and seconded by Councilman Levandowski to discontinue doing business with the 0ld Peoria Company based on Coun6el1s recommendation, pending a specific ruling being obtained from the Attorney Generat's office concerning this specific case, Councilman Kukielka's sitting on the Council while working for the Old Peoria Company, who in turn normally sells to the Liquor Store. I -3- Voting on the motion: Aye: Crouse, Emo � Miedtke, Levandowski Nay: Kukielka Motion by Mayor Miedtke and seconded by Councilman Kukielka to grant the licenses as presented. Motion carried. Motion by Councilman mond and seconded by Councilman Crouse to approve the corrected statement from the Municipal Court Prosecutor from $407.50 to $507.50. Motion carried. Motion by Councilman Crouse and seconded by Councilman Levandowski to approve the Certificate of the Engineer in the amount of $389.76. Motion carried. Motion by Councilman Levandowski and seconded by Councilman Emond to pay Raymond Haik, former Village Attorney, $180.00 for Village General Legal Matters, and $478.00 for Hennepin County Municipal Court and Village Police Matters. Motion carried. Motion by Councilman Emond and seconded by Councilman Crouse to pay the statement- Ramsey County, Ditch #2 in the amount of $357.43• Motion carried. Action on the snowmobile ordinance was tabled until the April 28, 1970, meeting. The Village Manager was instructed to have the Police Department review the need for street lights on Penrod Lane and Macalaster Drive between Silver Lane and 39th Avenue N.E. A resident inquired about the possibility of having a street light installed on an existing pole on Silver Lake Road between 36th Avenue N.E. and 37th Avenue N.E. Motion by Councilman Crouse and seconded by Councilman Kukielka to authorize the Village Manager to negotiate the contract with the Policemen accepting the check- off for union dues but not the auxiliary fire pay provision. Motion carried. Motion by Mayor Miedtke and seconded by Councilman Kukielka to direct the Village Manager to negotiate with the Firemen and proceed with the following figures as presented: $575.00-Start $692.00-After 3rd year $642.00-Anter 1st year $717.00-After 4th year $667.00-After 2nd year S742.00-After 5th year $50.00 additional per grade. Motion carried. -4- Council 4-Council asked for the following to be put on the Agenda for the April 14, 1970, meeting: A recommendation from the Police Department as to possible control on flow of traffic on Coolidge Street N.E., back of Foodtown. Motion by Councilman Levandowski and seconded by Councilman Kukielka that we pay the verified claims. Motion carried. Motion by Mayor Miedtke and seconded by Councilman Emond to ratify the following proclamation regarding the census : WHEREAS, the Nineteenth Decennial Census of the United States will be cond- ucted beginning on April 1, 1970; WHEREAS, all the inhabitants of the Village of St. Anthony are to be enum- erated in this census; and WHEREAS, the information collected in the census serves many useful purposes, among which are apportionment of representation in Congress and other legis- lative bodies, measurement of the economic well-being and purchasing power of communities and their inhabitants, allotment of certain Federal and State tax revenues and other financial aid to- states, determination of future needs for public services, and numerous other useful purposes; and WHEREAS, the accuracy and completeness of the census for the Village of St. Anthony will determine its population rank among other communities of the 49 country; NOW, THEREFORE, I, Duane R. Miedtke, Mayor of the Village of St. Anthony do hereby proclaim April 1, 1970, as CENSUS DAY in Village of St. Anthony, and do urge all citizens to cooperate fully during the month of April with those who are charged with the responsibility of this most important work. Motion carried. The Mayor asked that the following items be put on the Agenda for the April 14, 1970, meeting: 1. Audit Report 2. Financing the 1963 bonds that we have not reassessed. 3. R3port and recommendation from the Manager on rating from the Underwriters ; Company 4. Report from the Public Safety Director on the operation of the Police and Fire Departments Motion by Councilman Crouse and seconded by Councilman Levandowski that the meet- ing be adjourned. Motion carried.
