ANTHONY COUNCIL MINUTES April 28, 1970 The meeting was called to order by the Mayor at 8:00 o'clock P.M. The following were present at roll call : Emond, Miedtke, Levandowski , Kukielka. Absent: Crouse Also Present: Village Attorney, Loren Knott Village Manager, John R. Printon The following corrections on the minutes of the April 14, 1970 meeting were noted: On page 4 on the motion by Mayor Miedtke regarding the cutting down of the cotton- wood tree, it should show that Councilman Levandowski voted "No". Also it should read "other dead trees on the highway right-of-way". Motion by Mayor Miedtke and seconded by Councilman Emond to approve the minutes- of the April 14, 1970 meeting as corrected. Motion carried. Mayor Miedtke read Ordinance 1970-3. Councilman Emond suggested that a fee of 5100.00 be inserted in Subdivision 2- Procedure of the Ordinance. Motion by Councilman Levandowski and seconded by Councilman Emond that Ordinance 1970-3 be adopted following the recommendation of Councilman Emond and that we waive the second and third readings of the Ordinance. ORDINANCE 1970-3 AN ORDINANCE AMENDING SECTION 300 •, (ZONING) OF THE 1968 CODE OF ORDIN- ANCES BY ADDING THERETO SECTION 300. 11 ESTABLISHING AUTHORITY AND PROCEDURES FOR GRANTING CONDITIONAL USE PERMITS Notion carried. Mayor Miedtke read Ordinance 1970-4. Motion by Councilman Kukielka and seconded by Councilman Levandowski that Ordinance 1970-4 be adopted and that we waive the second and third readings of the Ordinance. ORDINANCE 1970-4 AN ORDINANCE AMENDING SECTION 300 (ZONING) OF THE 1968 CODE OF ORDIN- ANCES BY ADDING NURSING HOMES AS A CONDITIONAL USE IN R-1, R-2 AND MD DISTRICTS �_ _ � i �.� 70 -2- Motion 2-Motion carried. Mayor Miedtke read Conditional Use Permit No. 1970-1 giving Mr. Co► cion Hadland a permit for a nursing home. Councilman Emond said he would not vote in favor of this permit. Councilman Levandowski also indicated that he was not in agreement with the location of the nursing home. Motion by Councilman Kukielka and seconded by Mayor Miedtke to ratify the Condition- al Use Permit 1970-1- Voting on the motion: Aye: Kukielka, Miedtke Nay: Emond, Levandowski Motion not carried. Mr. Harvey Coleman talked again about the possible amending of the ordinance re- garding the developing of the Gaza Strip. • Robert Johnson, 2913 Silver Lake Court, spoke in opposition to the proposed changes in the ordinance and also against the protective covenant. Dr. Eldon Berglund, 2909 Silver Lake Court, also spoke against these proposed chang- es. Richard Merrill, Silver Lane, asked that the people living along Silver Lane have a chance to review and study the Protective Covenant and to get an opinion on it. Mayor Miedttce then read the Protective Covenant Agreement. Other residents of the area, Dr. William Carr, 4021 Silver Lake Terrace, Mrs. Betty Nerdahl , 2813 Silver Lane, Mr. & Mrs. Robert Johnson, 2913 Silver Lake Court, Joe Rosinek, 2609 Silver Lane and Mrs. Virginia Zahhos, 2919 Silver Lake Court, asked several questions of Mr. Coleman and the Village Attorney regarding the proposed changes and the Protective Covenant. Motion by Councilman Levandowski and seconded by Councilman Kukielka that the home - owners in this area be alto wed to look over this Protective Covenant and study it closely and to come back in a month and give their comments and suggestions regard- incl it. Motion carried. Mr. Lick Carlson presented the minutes of the April 21 , 1970 Planning Board Meeting. Motion by Councilman Kukielka and seconded by Councilman Levandowski to approve the request of the Sveden House for the changes in signs, two new 10' x 10' and re- placing two 15' x 4' original signs, and to allow the variance of 150 square feet. Motion carried. 1 f. r �� .. • l • -3- Motion by Councilman Emond and seconded by Councilman Kukielka to give the Sveden House permission to use the temporary sign as requested in their letter. Motion carried. The Council unanimously agreed to go along with the Planning Board's recommendation not to allow a used car lot in the Village of St. Anthony. Motion by Councilman Emond and seconded by Councilman Kukielka to accept the recommendation of the Planning Board and approve the request of Playworld to add lettering to their present sign on the east side. Motion carried. Mayor Miedtke ruled that the Council take no action on the request of a resident at 3621 Silver Lake Road to park a boat trailer and commended the Planning Board on their actions in regard to this. Motion by Mayor Miedtke and seconded by Councilman Emond to hold a public hearing on May 26, 1970 on Mrs. Harstad's request for rezoning of Lot 3 and the North 1-2 of Lot 4, Block 11, Mounds View Acres, 2nd Addition, from Light Industrial to Multiple Dwelling. Motion carried. • Mayor Miedtke ruled that the final plat of the Barrett Property on 39th Avenue be referred to the Village Attorney and the Village Engineer and that it be put on the Agenda for the next meeting, May 12, 1970. Motion by Councilman Emond and seconded by Councilman Levandowski to table the adoption of a burning ordinance for sixty days. Motion carried. Motion by Mayor Miedtke and seconded by Councilman Kukielka that Ordinance 1970-5 be adopted. ORDINANCE 1970-5 AN ORDINANCE AMENDING THE 1968 CODE OF ORDINANCES RELATING TO THE COLLECTION OF ASSESSMENTS FOR IMPROVEMENTS Motion carried. The Mayor directed the Village Attorney to draw up a snowmobiling ordinance using the State Ordinance making the changes that were penciled in. Motion by Councilman Emond and seconded by Councilman Levandowski to table action on Ordinance 1970-6 until the May 26, 1970 meeting and to give copies of it to the Planning Board members for their suggestions and comments. Motion carried. -4- Mayor 4-Mayor Miedtke ruled to table action on a fence in Silver Point Park until the next meeting and directed the Village Manager to come back with a recommendation and cost for this fence. Motion by Councilman Emond and seconded by Councilman Kukielka to pay the Certific- ate of the Engineer #1968-4 for $345.26. Motion carried. Motion by Councilman Emond and seconded by Mayor Miedtke to issue a permit to the Minneapolis Gas Company for installation of anodes. Motion carried. Motion by Councilman Emond and seconded by Councilman Kukielka to approve the verified claims. Motion carried. Motion by Councilman Levandowski and seconded by Councilman Emond to deny Apache Plaza's request for sweeping their parking lot and also not to accept any private contracts whatsoever for private driveways or parking lots. Vbtion carried. • Motion by Councilman Kukielka and seconded by Councilman Levandowski to direct the Village Manager to close off the extension of Silver Lake Road to Highway 8 completely to through traffic. Motion carried. Motion by Councilman Emond and seconded by Mayor Miedtke to direct the audit report to be filed. Motion carried.
