June 23, 1970
The meeting was called to order by the Mayor at 8:00 o'clock P.M.
The following were present at roll call : Crouse, Emond, Miedtke, Levandowski.
Absent : None
Also Present: Village Attorney, Larry Vickrey
Village Manager, John R. Printon
The following correction on the minutes of the June 9, 1970 meeting was made:
At the bottom of page 1 the motion by Councilman Crouse regarding Ordinance 1970-8
was corrected to read as follows:
Motion by Councilman Crouse and seconded by Councilman Emond to adopt Ordinance
1970-8 upon second reading in the form prepared by the Village Attorney with the
following modifications:
1. The following shall be added at the end of paragraph number 4:
If Ramsey County officials do not accept the plat because of the
inclusion of the platted scenic, open space and drainage easement
thereon, then the plat may be reprepared, deleting such easement
and a grant by the owners of the land being platted by Quit Claim
Deed of a scenic easement over the portion of the premises to be
platted now described as Outlot A, Apache Plaza, may be accepted
in lieu of the platted easement, such easement to be in the form
of scenic easement submitted by owner on file in the Official Village
Records.
2. The second full paragraph shall be amended to read:
The change in the zoning shall be valid for a period of 18 months
after the passage of Ordinance 1970-8 to allow the owner to submit
plans for construction which shall be subject to the following
restrictions:
3. In paragraph number 3, the term "two year period" shall be deleted
and 1118 month period" shall be substituted therefore.
Motion by Councilman Crouse and seconded by Councilman Emond to approve the
minutes of the June 9, 1970 meeting as corrected.
Motion carried.
Mr. Parrill presented the minutes of the June 16, 1970 meeting of the Planning
Board.

the request of Richard Miller, Inc. for a 1 foot side yard variance to construct
a home at 3932 Macalaster Drive.

Motion carried.
Motion by Councilman Crouse and seconded by Mayor Miedtke directing the Village
Manager to contact the Village Engineer and ask him to present a temporary sketch
of the property in question in the letter from Comstock and Davis and to bring it
back to the next Council meeting on July 14, 1970.
Motion carried.
Motion by Councilman Crouse and seconded by Councilman Levandowski to approve the
action of the Planning Board granting the request of Richard Goblirsch to move a
house from 5516 Normandale Road to 2517 35th Avenue N.E. in the Village.
Motion carried.
Councilman Crouse introduced Resolution 70-021 and moved its adoption.

• FUND FROM TWENTY-FIVE DOLLARS TO
FIFTY DOLLARS
The resolution was duly seconded by Councilman Emond.
Voting on the resolution:

Nay: None
Resolution declared adopted.
Motion by Councilman Crouse and seconded by Councilman Emond directing the Village
Attorney to prepare a proper ordinance for disposing of unclaimed vehicles and
other property, as necessary.
Motion carried.
Motion by Mayor Miedtke and seconded by Councilman Emond to adopt Ordinance
1970-7 regarding the appointment of the Planning Commission, etc.

Motion not carried.
Motion by Councilman Crouse and seconded by Councilman Emond to waive the third
reading of Ordinance 1970-8 and that it be adopted.

AN ORDINANCE AMENDING ORDINANCE NO.
1969-4 WHICH IS AN ORDINANCE RELATING
TO LAND USE AMENDING THE VILLAGE
ZONING MAP AS ADOPTED BY SECTION
300.04 OF THE 1968 CODE OF ORDINANCES
Motion carried.
The Council reviewed their action taken on the replatting of the Gearhart property
and reaffirmed their previous action.
Councilman Emond introduced Resolution 70-022 and moved its adoption.

RESOLUTION APPOINTING CURT ENGLUND TO
FILL VACANCY ON THE COUNCIL CREATED BY
THE RESIGNATION OF MATHEW KUKIELKA
The resolution was duly seconded by Councilman Crouse.

Resolution declared adopted.
Motion by Councilman Crouse and seconded by Councilman Emond to table discussion
on the Public Safety Director's report for one month to July 28, 1970, and asked
For additional figures on the financial costs involved.
Motion carried.
Motion by Mayor Miedtke and seconded by Councilman Crouse to grant the licenses
as applied for.
Motion carried.
Plotion by Councilman Crouse and seconded by Councilman Emond to pay the statement
from attorneys, Popham, Haik, Schnobrich, Kaufman and Doty in the amount of $457.50
for the Soo Line Railroad Company case.

Motion carried.
Motion by Councilman Levandowski and seconded by Councilman Crouse to pay the
statement from attorneys, Dorsey, Marquart, Windhorst, blest and Halladay in the
amount of $1 ,381 .40 for services for the month of May, 1970.
Motion carried.
Mayor Miedtke set June 30, 1970 for a meeting of the Council with the Planning
Board to discuss rezoning and other matters.
Motion by Councilman Crouse and seconded by Councilman Emond to pay the Certifi-
cates of the Engineer, for village services in the amount of $575.28 for improve-
ment #1968-3 in the amount of $50.11 and for Improvement #1968-4 in the amount of
$1 ,506.98.
Motion carried.
Motion by Councilman Emond and seconded by Councilman Crouse that the 1969 Non-
Collectible Checks (list attached hereto) by the liquor stores be written off the
books as not collectible.
Motion carried.
Motion by Mayor Miedtke and seconded by Councilman Emond to authorize Northwestern
Bell Telephone Company to lay buried telephone cable on Foss Road as proposed.
• Motion carried.
Motion. by Councilman Crouse and seconded by Mayor Miedtke to pay the verified
claims.
Motion carried.
Mayor Miedtke appointed Donald Kronk as chairman of the Planning Board, replacing
Curt Englund who was appointed to fill the vacancy on the Council .
Motion by Councilman Emond and seconded by Councilman Crouse approving the Mayor 's
appointment of Donald :Cronk as chairman of the Planning Board.
Motion carried.
Motion by Councilman Crouse and seconded by Mayor Miedtke that the meeting be
adjourned.
