ANTHONY COUNCIL MINUTES • March 25,1975 The meeting was called to order by Councilman Sundland, Chairman Pro Tem at 730 P.M. The following were present for roll call: Sauer, Sundland, Stauffer. Absent: Miedtke, Haik Also present: Jerry Dulgar, City Manager Jim Fornell, Adm. Asst. Motion by Councilman Sauer, seconded by Councilman Stauffer to approve the minutes of the March 17, 1975 Special Meeting. Motion carried unanimously. The minutes of the March 11, 1975 Council meeting were amended as folows: Page 2-Para. 4: Eliminate the word "camp" from 'campground". Motion by Councilman Stauffer, seconded by Councilman Sauer to approve the minutes of March 11th as amended. Motion carried unanimously. -There was no one from the Planning Board present to give the Board's recommendat- ions from their meeting of March 18, 1975 and Mr. Wm. Flaherty explained his own request for a lot size variance of five feet to enable him to build a swimming pool at his residence at 3200 Rankin Road. He supplied a copy of the Certificate of Survey for the property indicating the area in which he planned to build the pool and questioned whether a public hearing was necessary since the Board had been furnished a letter from Rev. Paul Stohlberg which indicated the Salem Covenant Church which owned the property to the south of the proposed structure would offer no opposition to the proposal. Councilman Sundland advised him that both city and state ordinances require a public hearing but that the Council would be willing to follow the recommendations of the Planning Board and would set the public hearing for 8 P.M. during the next Council meeting, April 8th. This was possible since it was ascertained that it would not be necessary to publish a newspaper notice of the hearing but only see .to it that all neighbors within 200 feet of the proposed project are notified. Motion by Councilman Sundland, seconded by Councilman Sauer to set a Public Hearing for 8 P.M. , April 8, 1975 on Mr. Flaherty's request for a variance of 5 feet to build a swimming pool at 3208 Rankin Road. Motion carried unanimously. The Council felt that no action should be taken on Resolution #75-019 A RESOLUTION REQUESTING THE STATE HIGHWAY DEPARTMENT REDUCE THE SPEED LIMIT ON U.S. HWY 8 BETWEEN LOWRY AVENUE, EXTENDED, AND COUNTY ROAD C. The Council felt as long as the Highway Department was willing to install 35 MPH advisory speed limit signs for Hwy 8 traffic on both approaches to the St. Anthony Boulevard crossing until the traffic semaphores are installed at that intersection. The City Manager was instructed to advise the Highway Department that the City will accept the advisory speed limit signage they had proposed. I -2- Motion by Councilman Stauffer, seconded by Councilman Sauer to adopt Resolution #75-017. • RESOLUTION 75-017 RESOLUTION REGARDING MINNEAPOLIS TAX STUDY AND PROVIDING FOR FURTHER INVESTIGATION OF FACTS AND CONTINGENCIES Motion carried unanimously. It was the recommendation of the Manager and Police Chief that, because of the excess use for parking by the high school students of the south side of 33rd Avenue N.F. in front of the St. Anthony High School, parking should be restricted to some degree on that street. However, Councilman Stauffer pointed out that since parking on the turn-around in front of the school was prohibited and the parking lots were usually full, there was no place for short term visitors to the school to park. Motion by Councilman Stauffer, seconded by Councilman Sauer to restrict parking on the south side of 33rd Avenue N.F. from Silver Lake Road to Rankin Road to "One Hour parking from 8 A.M. to 4 P.M. weekdays". Motion carried unanimously. There as a discussion of the League of Minnesota Municipalities request for nominations for the C.C. Ludwig Award for distinguished municipal service but no action was taken. • Following the recommendations from the City Manager that the Council should indicate its support of the legislation being put into bill form by Rep. Howard Neisen of Moundsview regarding proposed amendments to the Open Meeting Law, the following motion was made: Motion by Councilman Stauffer, seconded by Councilman Sauer to adopt Resolution #75-oi8• RESOLUTION 75-018 A RESOLUTION SUPPORTING PROPOSED AMENDMENTS TO THE OPEN MEETING IAW. Motion carried unanimously. The detailed plans for the September 14, 1975 Festifall from Jean and Ed Hance were considered and the Council members expressed the opinion that the efforts of Mr. and Mrs. Hance deserved a commendation for the excellence of their proposal. Motion by Councilman Stauffer, seconded by Councilman Sauer to adopt Resolution 75-020. RESOLUTION 75-020 RESOLUTION REGARDING ASSESSMENT LEVELS OF THE METRO AREA T AXES. • Motion carried unanimously. -3- Motion by Councilman Sauer, seconded by Councilman Sundland to approve Resolution 75-021. RESOLUTION 75-021 RESOLUTION AUTHORIZING PARTICIPATION IN THE SUBURBAN RATE AUTHORITY; DIRECTING THE EXECUTION AND DELIVERY OF A JOINT POWERS AGREEMENT; AND DESIGNATING A RFPRFSFNTATIVF OF THE CITY AS ITS MEMBER ON THE BOARD OF THE SUBURBAN RATE AUTHORITY Motion carried unanimously. The Suburban Public Health Report was filed as informational. During the discussion of the Police and Fire Reports for February 1975, the Manager told the Council that the Ride--Along Project had been initiated by the Police Department with 22 St. Anthony High School students participating during their Faster holiday by riding in the squad cars, attending court sessions and visiting the Mpls. Workhouse. Councilman Sundland indicated an interest in participating personally in the program. There was also conversation about the success of Patrolman Hickerson's contacts with juveniles and their parents and Councilmen Sauer and Stauffer indicated an interest in having the police reports identify the juveniles who are involved in tags or arrests as residents and repeaters when such is the case. Mr. Dulgar reported on his and Mayor Miedtke's meeting with representatives of the School District ;r282 School Board regarding assessment policies. Motion by Councilman Sundland, seconded by Councilman Sauer to grant all licenses listed in the March 25, 1975 agenda. Motion carried unanimously. Motion by Councilman Sundland, seconded by Councilman Stauffer to table action on the Rod Hopp Shows application for permission to operate a carnival at Apache Plaza Shopping Center until the Manager has an opportunity to ascertain whether the Apache merchants are in favor of the project. Motion carried unanimously. Motion by Councilman Sauer, seconded by Councilman Sundland to approve payment of $203.68 to Comstock & Davis for services rendered in February,1975. Motion carried unanimously. Motion by Councilman Sauer, seconded by Councilman Stauffer to approve payment of all verified claims listed in the March 25, 1975 agenda. Motion carried unanimously. Mr. Fd Hance, Chairman of the 1975 fall celebration, arrived at 8:50 P.M. and • told of his plans for the festival enlisting the Council for their aid and support of the venture. He said he planned to make the project self-supporting by seeking a great deal more involvement by merchants of both the St. Anthony Shopping Center and Apache Plaza and hoped to get so many people in the City working on the celebration, they in turn would stimulate a larger attendance at the affair. He also told how the celebration committee planned to incorporate the Bicentenn- ial theme with the cooperation of Councilman Haik and Judy Just and it was suggested that the honoring of former officials and staff of the City could become a part of this commemoration. The Council members gave their suggestions on the sale of buttons, dances and the dance band as well as the possibility of an art show and inside bingo game which might attract an older group to the celebration. The Council's earlier commendation of Mr. Hance's efforts were conveyed to him. Motion by Councilman Stauffer, seconded by Councilman Sauer to adjourn the meeeting at 9:25 P.M.
