ANTHONY PLANNING BOARD MTNUTE16 • June 1811974 The meeting was called to order by Chairman McGinn at 7:37 P.M. The following were present for roll call: Johnson, Kronk, Lctourneau, McGinn and Marks. Absent: Carlson The Board noted with regret the reception and acceptance of the resignation of Mr. Trowell Thompson from the Board following his election to the School Board. The following amendment was made to the minutes of May 21, 1974 Planning Board Meeting: Page 2,Para. 1: The addresses of the two Sroga lots should be 3200 and 3204 Roosevelt St. N.F. Motion by Mr. Marks and seconded by Mr. Johnson to approve the minutes of May 21, 1974 as amended. Motion carried. The Public Hearing on granting a conditional use permit to Mr. Phillip Sularz to build a room on the front of his home at 2524 St. Anthony Boulevard opened at 7:39 P.M. Mr. Sularz explained his request was for a room and not a porch to be added in front of the breezeway on his house which would "square off that corner and roof". Mr. & Mrs. John Thorin who live next door to Mr. Sularz at 2528 St. Anthony Blvd. were present and were represented by Mr. Robert Johnson, an attorney, who ex- pressed the Thorin's "strenuous objections" to the addition stating that it would cut off the Thorin's vision from three windows on the side of their house next to the Sularz home and would diminish the value of their home. He also stated that according to a surveyors sketch which they did not present, the Sularz home would now be only 3.7 ft from the lot line dividing the two homes. .Mr. Sularz stated that he had built the home 22 years before the Thoring had moved to their home next door and Mr. Kronk observed that if the room had been added then it would have been in compliance with the building ordinances and would come under the "Grandfather Clause" of the present city ordinances. Mrs. McGinn read a letter from Mr. & Mrs. Charles F. Kausel, 2525 St. Anthony Blvd. which is across the street from the Sularz home. They contend that the "construct- ion minimums were disregarded when the home was built" and thereby "brought the value of the homes on St. Anthony Blvd. down". They also stated that "That house never should have been built on St. Anthony JDlvd." The public hearing was closed at 7:47 P.M. • Following a discussion by the Board and those present on whether the new addition would defeat the City of St. Anthony's intention of creating open spaces between houses and the possibility of the room being built farther back where the breeze- way was now and not cutting off vision from the Thorin house, the following motion was made: 1 -2- Motion by Mr. Johnson and seconded by Mrs. McGinn to recommend to the Council the denial of tie request by Mr. Phillip Sularz for a conditional use permit for a variance of 5 feet side yard to allow the construction of an addition to the front of his house on Lot 17, Block 5, Murray Heights Addition. Voting on the motion: Aye: McGinn, Letourneau and Johnson Nay: Kronk and Marks � Motion carried. The public hearing on a conditional use permit for a child care center at 3201 Diamond Eight Terrace opened at 7:47 P.M. Mrs. Lorraine Witz explained to the Board that she babysits two children, age 4 and 21 for working mothers in her apartment at the above address and, since one of the mothers receives welfare assistance, she is required by the Welfare Dept. to obtain a baby-sitting license which in turn requires a permit from St. Anthony. No one appeared to speak for or against the request and Mrs. McGinn read a letter from the Kleinman Realty Company, 1409 Willow Street, manager of the Diamond Eight apartments which they stated they were not opposed to Mrs. Witz conducting this child care service in her home as long as no more than three children would be taken care of at the same time. Public hearing closed at 8:10 P.M. • Motion by Mr. Marks and seconded by Mr. Johnson to recommend approval to the Council of the request for a conditional use permit for Mrs. Lorraine Witz, exclusively, in order that she might take care of a maximum of three children, with no time limit set, in her apartment at 3201 Diamond Eight Terrace. Motion carried. No one appeared to present the request for rezoning part of Lots 3 and 4, Block 2, St. Anthony Office Park from Light Industrial to Commercial for a McDonald Restaur- ant and Mr. Lekson reported that protests from other residents of the office park had evidently discouraged the further pursuing of the request. When he asked the feeling of the Board on such a request the opinion seemed to be that rezoning for such a purpose would establish a conflicting use of the office park property. Mr. Fornell told of the disappointing return of surveys put out by the Community Services Department and there was speculation of the value of the opinions to be gained from those returns regarding park planning for the community. The group indicated an interest in gaining some response from the community regarding parks and the suggested methods of getting this information included sending out a short questionnaire with the billing statements in the fall and the possib lity of Mrs. McGinn's attending a meeting of the Community Services Advisory Committee. Motion by Mr. Kronk, seconded by Mr. Marks to adjourn at 8:30 P.M. to resume work on the zoning ordinance. Motion carried. Helen Crowe, Secy.
