The meeting was called to order by Chairman McGinn at 7:38 P.M.
The following were present at roll call: Marks, Kronk, Letourneau, McGinn, Hiebel
and Bowerman.
Absent: Johnson
Also present: Jim Fornell, Adm. Asst.
The following amendment was made to the Planning Board minutes of September 17, 19711:
Page 2, para. 2: Correct "hearty" to"hardy" in the 3rd stipulation.
Motion by Mr. Letourneau and seconded by Mr. Hiebel to approve as amended.
Motion carried.
The Public Hearing on the Michaelhoff request for a side yard variance opened at 7:40 P.M.
Vx. Ralph Amundson, 3424 Highcrest Drive, stated that Mrs. Dale Michaelhoff, 906 W.
County Rd. D Apt 233, wanted to buy the 78 ft. lot he owned at 3604 Downers Drive
to build a 66 ft. house and would therefore need a side yard variance of 5 feet to con-
struct the home.
• Mr. Johnson arrived at 7:50 P.M.
Mrs. Michaelhoff showed the plans for the house but did not have a survey of the lot.
She said that Mr. Lekson had told her the fireplace and overhang were considered
permitted encroachments under the new zoning ordinance.
Mr. Amundson owns the 90 ft. lot to the east of 360+ and said he did not feel a
variance of 5 ft. would cause a space problem for a house which might be built on
that corner lot. Mrs. McGinn and Mr. Letourneau pointed out the problem which had
recently arisen on St. Anthony Blvd., where a resident requested a side yard variance
to build an addition to his home and the next door neighbors, who had moved to their
douse after he had built, strenously opposed the construction and voiced their opinion
that the house which. had been constructed over 22 years ago should never have been
built so close to the property line. The request for variance in that case had been
denied.
Mrs. Amundson also spoke in defense of the request citing several cases "d®tim the
street" where "houses too large for the lots had been built: IMIr. Marks told her
that it was the job of the Board to prevent such deviations from the ordinance.
Mrs. Grace Schlegel, who lives at 3600 Downers Drive, i-rhieh is west of the property
in question, said she and her husband had no objections to the variance in side yard
since their house was positioned 15 feet away from the property line.
Mrs. Micheelhoff said she could not see whey the house would interfere with property
on either side. She said that based on encouragement from the Mayor and Mr. Lekson
she had gone ahead and made a financial commitment towards obtaining a mortgage.

She pointed out that there had been no objections to the house from any of the
neighbors, and made reference to the problems she had encountered in building this
same house on 37th Avenue N.F. &. Silver Lake Road. The. Public Hearing closed at 8:10
P.M.
Dlotion by Mr. Letourneau, seconded by Mr. Marks to recommend a denial of the request
for a 5 foot side yard variance by Mrs. Dale Michaelhoff to build a 68 ft. house on
the 78 ft. lot at 360+ Downers Drive because the proposal does not comply with the
zoning ordinance as to size and the City had refused other similar requests in the past.
Voting on the motion
Aye: Marks. Johnson; Letourneau, McGinn and Bowerman
Nay: Kronk and Hiebel
Motion carried.
Mr. Johnson said he would be unable to represent the Board at the Council meeting
October 22nd and T,Ir. Letourneau agreed to take his place. The Chairman then extended
the invitation from the Mayor to the entire Board to attend the Council Meeting at
9:00 P.M.
e Public Hearing on the Bernu Construction Company request for a sign variance was
not held since no one appeared. to present .the request. Mr. Fornell said that
although a representative of Bernu Construction Company had been at the Council
meeting when the public hearing was ordered and had been in touch with Mr. Lekson
in the interim, there was some doubt whether an official notice had been sent to the
Bernu Company and that filing fee for making an application had not been paid. Mr.
Hiebel and Mr. Johnson felt the Board did not have adequate specifications of the
sign. Mr. Kronk was concerned with the expense of holding another public hearing.
Mdtion by Mr. Johnson, seconded by Mr. Letourneau to table action on the request for
a sign variance for the Midwest Professional Bldg. until the applicant properly notified
and the proper administrative procedures are followed.
Motion carried.
Mr. Fornell told the Boaxd that the proprietor of the Village Inn Cafe did not want to
pay the filing fee for application for a sign variance as long as it was not reimburs-
ible if he did not receive a sign variance. He had stated his intentions of consulting
his attorney on the legality of the fee. The variance would alloy a sign identifying
his cafe to be placed on the roof of the Union 76 station which is on the Kenzie `I_rr.
side of the same building.
The Planning Board was unable to act on the matter because it had no application and
following a discussion of the relationship of the amounts charged for applications for
variances in R-1 and R-2 districts and from the sign ordinance, the following motion
was made.
Motion by Mr. Bowerman, seconded by Dir. Johnson to recommend to the Council that the
relationship between fee schedules for variances be examined so there can be reasonable
Equity among them.
Motion carried.
Mrs. McGinn told of plans being made for a joint Council/Planning Board dinner meeting
in December.
Motion by Mr. Masks, seconded by Dir. Kronk to adjourn at 8:55 P.M.
