ANTHONY PLANNING BOARD MINUTES August 19,1975 The meeting was called to order by Chairman Ietourneau at 7:30 P.M. The following were present for roll call: Johnson, Hiebel, Letourneau, Bowerman and Rymarchick. Also present:Ha=j Lekson Absent: Cmmn & Marks Motion by Mr. Bowerman and seconded by Mr. Hiebel to approve the minutes of the July 1.5, 1975 Board meeting. Motion carried. ,Zthe Public Hearing on the request from American Monarch Corporation to rezone the pro-perty they own to the east from Light Industrial to Commercial opened at 7:37 P.M. Mr. Dick Ernst of the R.C.E. Corporation presented drawings and his proposal for two buildings his company wanted to build on the easterly 322 feet of Apache Terrace, Block 1, Lot 1. (Approximately at 2901 37th Avenue N.E.) The developer said he planned to purchase the land from American Monarch and • build on the east portion a Country Kitchen restaurant with a walk-in level devoted to office rental space. 7ne building to the west of the restaurant would be a two story, 50 x 90 ft, professional office building. Both buildings would be from 22 to 0 ft. high at their highest points. He elaborated further on the 9 points in favor of the project and answered the 7 objections residents had voiced to the proposal as they were listed in the atteched resume which he distributed to those present. Answering the objections, he stated that this would be the first "in town" restaurant Country Kitchen, Inc. has built and the hours would be regulated by its residential location with a closing time of about 11 P,M„ He also said the usual pylon identification sign used by Country Kitchen would be modified to fit the residential nature of the neighborhood. This point was questioned by Mr. Johnson citing the Country Kitchen executive's insistance that the sign had to be in front of a Country Kitchen he was requesting permission to erect a short distance from this location. It -vas Mr. Ernst's contention that the restaurant would cause a diminishing of speeding and careless driving rather than an increase and that it would be possible to erect traffic directional signs which would steer restaurant customers away from Belden Drive and Coolidge Street. He also said filtering would prevent the annoyance of cooking odors. He said his experience in filling office buildings at the corners of Silver Lake Road and County Road D and Mississippi Drive assured him that there was a need for additional space in this area. Mr. Ernst contrasted other uses permitted by ordinance in industrial zoning for other municipalities as a defense of the use of the property for a restaurant. There were more than 25 residents of the area present and all who spr.,ke voiced opposition to the restaurant. -2- Mr. Art Thompson, 2900 37th Avenue N.E. said he didn't want to live across the street from a restaurant and presented the petition signed by residents of his block requesting the city officials not to change the zoning to permit the restaurant. Other concerned neighbors who spoke included John Sarbuco, Mr. R Airs. Walter Wojcik., Roger Martin, Edward Cyryt and Grant Helmer who live on Belden Drive; Duane Duerre and Mr. & Mrs. Paul Iverson, who reside on 37th Avenue as well as Terry Hoffman of 3616 Coolidge St. N.E. Their objections included the potential traffic increase on 37th as well as Belden and Cooliage, where they stated there are many small children who use the streets extensively; the height of the two proposed buildings; the noise, odors and late hour business of a restaurant which they did not consider appropriate to a i:a,idential. neighborhood; the probability of the restaurant eventually deteriorating to an "eye sore" and the fact that they didn't consider the project an appropriate transition or buffer between their homes and Apache Shopping Center. A riujo•_ity said they would not oppose a one story service office develolxnent in that spot but Mr. Sambuco said he thought only multiple dwellings should be a.13cn;:'d there. Ila-. Marks arrived at 8:15 and participated in part of the above discussion. There was also a discussion between the Board and the residents of how financial conditions made the use of the land for a park area prohibitve. . Th chialic Hearing was closed at 8:30 P.M. Miction by Mr, Bowerman and seconded by Mr. Marks to recommend that the Courcil_ deny the recuest to rezone the easterly 322 ft. of Apache Ten-ace, B1cck l., Lot 1, rt industrial to Commercial. Motion carried unanimous]y. Tbcre was a. discussion of wnether a monumental type sign would actually be needed when the roadbed. was rebuilt and semaphors placed along Silver Lake Road with &. Ryma:•chic's and Mr. Letourneau expressing reticence to adding another free standing sign to that area. • Air. Aea.ly said Goodyear believed the lack of proper identificati-on of their store was the primary reason the business was not prospering as well as had been anticipated. yfotion by Mr. Marks and seconded by Mr. Johnson to table action on the Goodyear request for a monumental sign until the Board had further data as to the exact location of the sign including its position in relation to the driveway as well -3- as more detailed landscaping plans. "'Motion carried L:nani.mnously. 11 TS—Board agreed that the elevation of the Herfurth Realty Company sign did not fulfill the intent, of Ve permit for its erection in regards to height and Mr. ;ymarchick and Mr. Bc?rerman vere instructed to research the matter and recommend what course of action could be taken by the Beard to secure con-Tliance with their intentions when they recommended approval of the sign's erection. Mr. Lekson vas asked for any information he had on the progress being; made on the Kedlund property towards the construnti.on of the retirement Wpartment building or the renovation of the existing residence to a construction and land office. Mr. . R;,maxchick also rai3ed the question aboi;t what was being done regarding the WA truck which vas parked on the empty lot at the corner of Silver Lake Road ana ]7th Avenue N.E. He will represent the Board and present their recommendations to the Council at their next meeting, August 25th. Moci.on by PIr. Marks, seconded by Mr. Rymarchick to adjourn the neeting at 9:30 RM. The proposed development will allow the owner to disp6so of the vacant land in a maMer acceptable to the owner. 3. The proposed development will provide jab opportunities to residents in the irmmeiiato neighborhood. 4. The proposed developj�ent will return a larger not tax gain to the City then uses permitted in the Industrial Zone. 5. The proposed dev®lopment mill protect the residential property values to the South far better then most uses permitted In an Industrial Zone. 6. The proposed development is eonsistaat with the development pattern already established on the North side of 37th Aveme. 7. The Village visely created a R2 Zone along the Soazth side of 37th Arezue to serve as a buffer and protect the single family dwellings. 8. The proposed development is more compatible with the neighborhood then many of the uses permitted in an Indastrial Zone. 9. The proposed developneat is a valid addition to the neighborhood and an asset to St. Anthony. 1. Concern about 24 hour restaurant operation. 2. Concern about speeding aad careless driving on 37th. 3. No City park on the West side of Silver Lake Road. 4. The proposed site was promised .o the neighborhood for a park. q 5. Concern about the signs. 6. Concern about potential cooking odors from the restaurant. 7. Concern about traffic increase on Belden and Coolidge. �, Y
