AMTHONY • PLANNING BOARD MINUTES 11/18/75 The Planning Board meeting was called to order at 7:36 P.M. by Chairman Letourneau. Present at roll call : Cowan, Rymarchick, Johnson, Letourneau. Absent: Hiebel , Bowerman, Marks. The minutes of the October 21 , 1975 were reviewed and the following corrections were made: Page 2, para. 2, to read: Voting on the motion: Aye-Hiebel , Marks, Letourneau, Boerman, Rymarchick; Nay-None; Abstain-Cowan. Page 3, para. 11 , "felt" not "flet" Page 5, para. 3, strike "Councilman", the proposed building would be owned by "Mr. Gould". Motion by Rymarchick, seconded by Cowan to approve the minutes of October 21 , 1975 as corrected. Voting on the motion: Aye: Cowan, Rymarchick, Letourneau Nay: None Abstain: Johnson IThePlanning Board discussed the request of William Barbush, Bryant Investment Company, for a Public Hearing to consider his desire to obtain a zoning change from "R-1" and "C" (S.E. corner) to entirely "C" on Plat 63507, Parcel 7620 (approx. 2651 Kenzie Terrace) . Although Mr. Barbush was not present to make a presentation, Mr. Richard Ernst, who knew about the proposal , spoke on his behalf. After some discussion on the adequacy of information provided, the following motion was made: Motion by Cowan, seconded by Johnson to recommend to the City Council that Bryant Investment Company be granted their requested Public Hearing on a zoning change from "R-1" and "C"to entirely "C" on Plat 63507, Parcel 7620 for a proposed retail and professional offices building. Motion carried unanimously. Because of the lack of space for the Council meeting in the next room, the Planning Board switched rooms with the Council . George Marks arrived at 8:05 P.M. • The Public Hearing on the request of Richard Ernst and American Monarch to rezone the easterly 322 feet of Apache Terrace, Block 1 , Lot 1 from Light Industrial to Commercial to permit construction of a Country Kitchen restaurant and offices, to be located in two buildings, was opened at 8:20 P.M. y--r,r� �-�,•' .-_.ten_ 2 • Mr. Ernst presented to the Planning Board and interested residents therevisions made in the site plan. The revisions included a redesign of the traffic pattern through the development, curb cut location changes, a combined trash area and more extensive landscaping. Mr. Josiah Brill , attorney for (North American Monarch and Mr. Ernst, then spoke to the Planning Board and residents about existing incursions in the light indust- rial zoning along 37th Avenue M.E. Specifically, he mentioned the Vet Clinic, Standard Oil and Fas Gas service stations, Autotraac, and Purity Dairy Store as commercial incursions in the original light industrial zoning of the strip. Mr. Brill then stated the Planning Board and staff recommendations in the new zonino ordinance for this parcel of land, which were light commercial by the former and light commercial with the possible desireability of certain heavier commercial uses by the latter, although the zoning should be light commercial . Mr. Brill then spoke of the addition to the tax base of such a development and the potential traffic generation, which he felt would be less detrimental than many light industrial uses. Mr. Fiori , General Manager of Porth American Monarch, stated his company's desires to sell the land. He said the company is growing and cannot expand to the east because of an easement. At that point, several Board members asked questions about the proposed development. Mr. Rymarchick asked about the impact of the widening of County Road "D" and its impact on the proposal . He was told the County would only acquire a small strip of land, tapering from about five feet to less than one foot. Mr. Cowan asked which building would be constructed first. Mr. Ernst replied that the building containing the Country Kitchen restaurant would be. As the rental space in that building is occupied, the office building would be constructed. Mr. Marks asked if the proposal effected North American Rockwell 's expansion plans. Mr. Fiori said that Porth American Rockwell would have to expand to the west; their manufacturing process could not be spilt. Mr. Rymarchick and Mr. Johnson were concerned about signing and wondered if Country Kitchen would work within the sign ordinance. Mr. Johnson stated that St. Anthony is primarily a residential community and that he felt residents wanted to keep it that way. The hearing was then opened to statements of interested landowners in the area. Maureen iverson , 2908 37th Avenue N.E. expressed her strong opposition to the proposal . She felt that the present light industrial zoning was better than a Country Kitchen. • Elvira Wojcik, 3608 Belden, said she felt St. Anthony had fourteen restaurants which was plenty and was concerned about the adequacy of parking. i 3 • Duane Duerre, who owns a duplex at 2606 37th Avenue N.E. cited potential trash problems, crime problems r-id potential parking problems and felt the proposed development would reduce his property's value. Howard McHugh of 3640 Coolidge was concerned about garbage problems and the possible lack of sewer capacity to handle the proposed development. Art Thomason, 2900 37th Avenue N.E. felt his investment in his home was :n jeopardy-he said he liked the zoning the way it was. John Sarribuco, 3613 Belden Drive, said the City could not limit the business hours because to do so would be unconstitutional . He .said that North American Monarch could always expand upwards and that it would be difficult to eliminate odor and trash problems. Helen Cotton, 3625 Belden Drive, expressed concern about possible odor problems. Dick Timmer, 3617 Belden Drive, was concerned about traffic safety in the area. Roger Martin, 3609 Belden Drive, felt that the Planning Board should initiate zoning changes and that developers should abide by the present zoning. Dick SGwden, 2800 33rd Avenue N.E. , spoke in favor cf the proposal citing the existing R-2 zoning on the south side of 37th Avenue M.E. and increase in the tax base from such a development. Mr. Sambuco stated his concern about sufficient sewage system and water supply capacity. He felt that the land should , perhaps, be given to the City. Mr. F?ori felt that his company and the proposed development should not be considered a buffer zone for the residential area south of 37th Avenue M.E. The Public Hearing was closed at 9:20 P.M. and the Planning Board members responded. Wil Johnson felt that any rezoning proposal needs guidelines which should include the public interest and probable effects of the development. He felt 37th Avenue N.E. is a transitional use area, is in favor of light commercial uses on the site and sees problems with the signing and potential traffic generation of the proposed use. R chard Rymarchick felt some of the improvements in the site plan were good and favored the office building use but felt that a restaurant was unsuitab!e. He also felt the restaurant would generate more traffic at more hou!-s and that there is bound to be more traffic on side streets. George Marks was of the opinion that the Plannino Board should have some very strong reasons to rezone the land to commercial and permit a heavy commercial use such as the Country Kitchen proposal . He agreed with con- cerned residents that St. Anthony presently is, and should be kept, residentiai in character. He felt that the office buildings use is a . good one, however. He felt the development would not be compatible with she residential area:-tothe'-south. Upon completion of discussion of the development, the following motion was made: Motion by Marks, seconded by Mr. Cowan to recommend to the City Council that the request of Dick Ernst and Morth America Monarch to rezone the easterly 322 feet of Apache Terrace, Block 1 , Lot 1 , from light industrial to cormercial be denied due to the following : i . 37th Avenue N.E should serve as a transitional area from the heavy commercial use of Apache Plaza to the residential area south of 37th Avenue N.E. 2. The proposed would generate significant traffic on neighboring streets, making those streets more noisy and hazardous. 3. The detrimental impact on property values in Lhe area pore than outweighs the potential property tax receipts from such a proposal . 4. There is concern about the generation of trash in the neighborhood and the emission of odors from the restaurant. 5. The necessary signage for a restaurant is not consistent with the residential neighborhood to the south. Motion carried unanimously. The Chairman declared a recess from 9:50 to 10:00 P.M. Upon reconvening, the Board discussed the arguments of the residents in the area and concluded that the Board, when making a recommendation to the Council should state only those reasons which are germane to good planning principles. Concern was expressed about trying to regulate the market place - whether St. Anthony has too many restaurants should not be relevant. Motion by Cowan, seconded by Marks to adjourn.
