PUBLIC HEARINGS. 40 41 6.1 Pratt/Ordwgy Phase II 42 a. PrelimingUff inal Amendment to Rezoned PUD 43 44 Chair Stromgren opened the public hearing at 7:03 p.m. 45 46 Ms. Moore-Sykes informed the Commission that the original application was dated May 47 26, 2006. This application expires on June 26, 2006. Consequently, this must be acted 48 upon by the City Council. Planning Commission Meeting Minutes June 20, 2006 Page 2 1 2 Ms Moore-Sykes reported Staff was contacted earlier this year by representatives from 3 the Apache Redevelopment, LLC regarding their proposal to begin Phase Ila of the 4 residential redevelopment plan. Mr. Daryl Gemar advised City staff that Apache 5 Redevelopment, LLC had purchase agreements for Ed's Carwash and Firestone Tires. 6 These properties have been identified in Phase II of the residential development plan and 7 were also included in the area rezoned to a Planned Unit Development in accordance with 8 the Planned Unit Development Agreement on file with the City dated September 23, 9 2003. 10 11 In order to allow the proposed project to move forward, Mr. Gemar was advised of the 12 four land use and zoning issues to be addressed in separate public hearings. A Notice of 13 Public Hearing was published in the City's legal newspaper for May 31, 2006 and June 7, 14 2006. Each item was heard separately and a recommendation to the City Council was 15 made for each item. 16 17 Initially Staff advised Mr. Gemar that Apache Redevelopment, LLC would need to 18 rezone separately the three properties in order to include them in their existing Mixed Use 19 PUD. Upon further research Staff and the City attorney determined the properties 20 formerly known as Ed's Carwash, Firestone Tires, and the vacant lot were included in the 21 Mixed Use PUC and approved by the City Council on September 23, 2003. However, a 22 public hearing before the Planning Commission is required for a PUD amendment to the 23 rezoned Mixed Use PUD as stated under 1655.10, Subdivision. 3, Preliminary 24 Development Plan. The public hearing for a preliminary development plan requires the 25 following be addressed as part of the City's Findings of Fact and the preliminary 26 development plan: Overall maximum PUD density range for the proposed 27 Redevelopment Phase Ila; General location of major streets and pedestrian ways; General 28 location and extent of public and common and open space; General location of residential 29 and nonresidential land uses with approximate type of intensities of development; Staging 30 and time schedule of development; and other special criteria for development. Other 31 criteria for development include: Resolve any easement issues; Work with the Fire 32 Department regarding hydrant placement and any other public safety issues associated or 33 potentially associated with this redevelopment project; Work with Development 34 Committee regarding landscaping, screening and construction issues; Work with City 35 Engineer and Public Works regarding storm water, sanitary system and water issues; 36 Removal of underground fuel tanks and clean up of any possible contamination; and a 37 Phase Il Environmental Review of the sites, which has been completed. 38 39 The Final Development Plan, which will include the above-referenced items as well as 40 any resulting from the public hearing, will be presented to the City Council for approval. 41 The applicant has met with the Planning Commission in a Concept Review and with the 42 Development Review Committee as required by the City ordinance. 43 Planning Commission Meeting Minutes June 20, 2006 Page 3 1 Ms. Moore-Sykes reminded the Planning Commission of their task to propose a motion 2 to recommend to the City Council to approve or deny the applicant's request to amend the 3 Mixed Use PUD to include the properties: Ed's Carwash, 2415 39th Ave NE, St. 4 Anthony, MN 55421, Lot 2, Block 1, Beutz Addition; Firestone Tires, 3901 Stinson Blvd 5 NE, St. Anthony, MN 55421, Lot 3, Block 2, Apache Plaza; and the Vacant Lot, Stinson 6 Blvd NE, St. Anthony, MN 55421, Lot 2, Block 1, Wirth Addition. 7 8 Chair Stromgren called Mr. Gemar to the podium to discuss the development plan. 9 10 Mr. Gemar provided plans of the development to the Commission. He pointed to how the 11 26 units would look once developed. The 26 units were previously designed as side-by- 12 side units. These units will now be 26 cottage style homes. The site is 2.4 acres with 13 approximately ten units per acre. The development includes three design choices ranging 14 from 1200 square feet to 1500 square feet. Mr. Gemar stated the two buildings to the east 15 will be completed first. These are five unit buildings. The second area will be six units 16 and the third will be five units 17 18 Mr. Gemar presented site plans and diagrams of the cottage units. Pointing to the 19 diagrams, Mr. Gemar pointed out that Stinson and 39th Avenue are the two major streets 20 adjacent to the development. Mr. Gemar identified sidewalks along Stinson and 39th Ave. 21 He noted that a significant number of pedestrians walk along Stinson where no sidewalks 22 exist. Mr. Gemar is proposing adding sidewalks along and looping around Stinson and 23 across the northerly portion of the property. This will result in sidewalks around the entire 24 development. 25 26 As a frame of reference, Mr. Gemar point out the locations of the Wirth property, 27 Firestone Tires and Ed's Carwash. He also indicated where open space and common 28 areas will be located. Each unit will have a private space in the front and a green space in 29 the back. A berm and landscaping will also be part of the development. Mr. Gemar 30 envisions the residents having access to and using Solo Park. 31 32 Mr. Gemar informed the Commission that he met with the Fire department about access 33 to the buildings. The private drive will be left open at the far end for safety purposes. He 34 also met with the developer and City engineer to go through the plans.No underground 35 storage tanks are located on this site. When Ed's carwash is demolished, the tank on this 36 property will be removed. 37 Chair Stromgren asked Mr. Gemar to put up the aerial photos for discussion. 38 39 Mr. Gemar referenced the elevation of the roof design and the back elevation. He pointed 40 out the numerous design elements for the units. The units will have brick or stone fronts, 41 Hardiplank siding,porches,pillars, and landscaping. He is planning to have these units 42 blend in with the other projects. The garages are located in the back of the property. 43 Referring to the site plan, Mr. Gemar pointed out how residents enter the development 44 from 39h-Avenue to access their garages. He also pointed out the fire lanes. Planning Commission Meeting Minutes June 20, 2006 Page 4 1 2 Chair Stromgren closed the public hearing at 7:23 p.m. 3 4 Commissioner Galyon asked about the storage tank on the former Ed's carwash. Mr. 5 Gemar stated it is part of the next phase. 6 7 Motion by Vice Chair Hanson, second by Commissioner Hoska,to recommend approval 8 of the request of Pratt/Ordway Phase H for preliminary and final amendment to rezone to 9 PUD with the condition they fulfill the requirements specified in Staff Report Number 10 11 Motion carried unanimously. 12 13 b. Subdivision of Property —Lot Combination 14 15 Chair Stromgren opened the public hearing at 7:27 p.m. 16 17 Ms. Moore-Sykes informed the Planning Commission that Apache Redevelopment, LLC 18 is also applying for a subdivision of property to combine the three lots formerly known as 19 Ed's Carwash,Firestone Tires and the vacant lot to the north of the site of Ed's Carwash 20 in order to continue the Phase Ila portion of the residential construction plan. In addition 21 to combining the lots, Mr. Daryl Gemar of Apache Redevelopment, LLC was advised that 22 Apache Redevelopment, LLC would need to complete a preliminary plat of the site and 23 secure final plat approval. Preliminary plat review does require a public hearing with the 24 Planning Commission. 25 26 Ms. Moore-Sykes informed the Planning Commission they are tasked to propose a 27 motion to recommend to the City Council to approve or deny the applicant's request to 28 amend the Mixed Use PUD to include the properties: Ed's Carwash, 2415 —39,'Ave NE, 29 St. Anthony, MN 55421, Lot 2, Block 1, Beutz Addition; Firestone Tires, 3901 Stinson 30 Blvd NE, St. Anthony, MN 55421, Lot 3, Block 2,Apache Plaza; and the Vacant Lot, 31 Stinson Blvd NE, St. Anthony,MN 55421, Lot 2, Block 1, Wirth Addition. 32 33 If the City Council approves the Subdivision of Property request, Apache 34 Redevelopment, LLC is required to file this action for recordation with the County of 35 Ramsey prior to the issuance of any building permit or within 60 days, which ever is 36 sooner. 37 38 Mr. Gemar presented the site plan once again and entertained questions. 39 40 Chair Stromgren asked if this action would effect the description of their property. 41 Mr. Gemar answered that it would not. 42 43 Chair Stromgren closed the public hearing at 7:30 p.m. 44 Planning Commission Meeting Minutes June 20, 2006 Page 5 1 Motion by Vice Chair Hanson, second by Commissioner Galyon to recommend approval 2 of the request of Pratt/Ordway for subdivision and lot combination. 3 4 Motion carried unanimously. 5 6 C. Preliminary/Final Plat 7 8 Chair Stromgren opened the public hearing at 7:32 p.m. 9 10 Ms. Moore-Sykes reported that because Apache Development, LLC is including 11 subdivision of the property as part of the Phase Ila development plan,they are also 12 required to submit a preliminary plat for review at a public hearing before the Planning 13 Commission. 14 15 Mr. Gemar reported that demolition of Ed's Carwash and Firestone buildings will begin 16 approximately the week of June 30, 2006,with construction beginning some time in 17 August or September. He indicated they will construct the first two buildings in the area 18 adjacent to Equinox Apartments. Each building will contain five single level, slab on 19 grade units with attached garages. 20 21 The next three buildings with the same floor plan offerings will be built in the area along 22 Stinson Boulevard and 39th Age.NE. Two of the buildings will also have five units in 23 each and the third building will contain six units. The total number of units planned for 24 this phase of the residential development is 26 with between 1,200 square feet and 1,500 25 square feet of living space. This project is designed to be more sensitive to the transition 26 from the traditional single-family home to a slightly smaller or"down-sized"home. 27 28 The Fire Department has also reviewed the preliminary plat as part of the development 29 review committee. They have indicated that the road widths are sufficient for emergency 30 vehicles. Mr. Gemar also indicated Apache Development LLC plans to berm and 31 landscape the areas adjacent to neighboring properties. 32 33 If the preliminary plat is recommended for approval by the Planning Commission, it will 34 be presented to the City Council at the June 27, 2006 meeting as a final plat. If the final 35 plat is approved by Council resolution, Apache Redevelopment, LLC must record it with 36 the Ramsey County Recorder or Registrar of Title within 30 days after the date of 37 approval. If recordation does not occur within the 30 days,the approval of the final plat 38 will be null and void. 39 40 Chair Stromgren closed the public hearing at 7:35 p.m. 41 42 Motion by Commissioner Young, second by Vice Chair Hanson, to recommend approval 43 of the request of Pratt/Ordway for preliminary and final plat. 44 Planning Commission Meeting Minutes June 20,2006 Page 6 1 Motion carried unanimously. 2 3 VII. CONCEPT REVIEWS. 4 7.1 Building Fasteners—Variance Request for Parking Expansion 5 6 Ms. Moore-Sykes reported Staff was contacted by Mr. Loren O'Brien, CEO of Building 7 Fasteners, about the process of applying for a parking variance. He reported that Building 8 Fasteners is proposing renovation plans for their building by adding more office space. 9 The renovation plan also calls for the expansion of their parking lot to relieve an already 10 tight parking situation. To achieve more parking, Mr. O'Brien proposes to encroach 11 approximately ten feet west into the right-of-way adjacent to Anthony Lane South. 12 13 Mr. O'Brien indicated he may also need to add approximately four to seven parking stalls 14 in the front of the building for walk-in clients. This proposal involves the area to the 15 south of the building and also encroaches into the right-of-way adjacent to the south loop 16 of Anthony Lane South. 17 18 One suggestion was for the City to construct on-street angle parking along the main 19 portion of St. Anthony Lane South coming into the area. Staff researched the idea and 20 determined that because this portion of St. Anthony Lane South is very busy, especially 21 during morning and afternoon rush hours, this on-street parking idea would create more 22 problems with the flow of vehicle traffic and therefore an unworkable idea. 23 24 Ms. Moore-Sykes stated there is no action required at this time. Mr. O'Brien requested to 25 come before the Planning Commission to continue the discussion of this parking 26 expansion proposal. Mr. O'Brien is very interested in maintaining his business in St. 27 Anthony. He has applied for a parking variance, as a result, a public hearing will be held 28 in July. 29 30 Chair Stromgren asked Mr. O'Brien to step to the podium. 31 32 Mr. O'Brien presented the plan to the Commission. He informed the Planning 33 Commission that they are a wholesale business so they do not have much walk-in 34 business. However, there are customers coming in to pick up items. He pointed out where 35 customers will enter the building and where the new parking would be located. The 36 property currently has parking only on the west. He pointed out where the shipping and 37 receiving doors currently exist and where they would be relocated to. He proposes turning 38 a portion of the property into green space to close the exit to 29`h and stop traffic from 39 cutting through this area. Mr. O'Brien plans to double their current office space by adding 40 a second story. He will also completely renovation of the building exterior. Mr. O'Brien 41 asked about the easement and Ms. Moore-Sykes said she would have to research this. If it 42 is the City's easement, it would be a utility easement. 43 Planning Commission Meeting Minutes June 20, 2006 Page 7 1 Chair Stromgren asked how many parking spaces currently exist on the property. Mr. 2 O'Brien replied there are currently have 32; the expansion will increase the number to 58. 3 4 Vice Chair Hanson asked how much wider the parking space would be after the 5 expansion. Mr. O'Brien pointed to the overhead and showed the current and proposed 6 parking space. The parking space would go an additional ten feet to the west, south and 7 north ends and also moved closer to building. 8 9 Chair Stromgren asked how many square feet would be added with the mezzanine level 10 for offices. Mr. O'Brien indicated the addition would be between 5,000 and 6,000 square 11 feet, depending on if they build a second level to the north end of the offices. Additional 12 warehouse space on the east side would add 1,345 square feet. 13 14 Vice Chair Hanson asked about exiting onto 29ffi. Mr. O'Brien stated this would be 15 blocked off and landscaped. 16 17 Vice Chair Hanson sees benefits to adding the green space,the additions to the building 18 and the proposed exiting plan. 19 20 Chair Stromgren reminded everyone the issue for the Commission is only to determine if 21 the variance meets the code. 22 23 Mr. O'Brien informed the Commission that they run 24 hours per day and during shift 24 change this causes extra employee traffic. The building is currently a little over 20,000 25 square feet. He is not sure what the ratio is for parking space to office or warehouse size. 26 27 Chair Stromgren said it is 1 space per 1000 square feet, so he is covered now and with the 28 expansion. Another way to look at it is the highest shift change plus the number of 29 company vehicles. He is wondering if they can pick up a few feet on the west to get off 30 the actual property line and reduce what the actual variance requirement would be. 31 32 Mr. O'Brien said he could go back to the engineers and explore this and any other ideas. 33 34 Commissioner Galyon asked about exploring an angled parking option on the north side. 35 A discussion around the angled parking possibilities ensued. Mr. O'Brien will also 36 research this option and also pointed out some of the disadvantages of that option. 37 38 Vice Chair Hanson asked about trucks for sale sitting in the lot. Mr. O'Brien said they go 39 through about ten trucks per year. The trucks are not usually parked there more than ten 40 days. The number of vehicles Vice Chair Hanson saw over the weekend is about the 41 normal number of vehicles on site. 42 43 Commissioner Galyon reported on a type of underground parking he saw while on a trip 44 to St. Louis. Mr. O'Brien stated what the engineers are proposing business wise is their Planning Commission Meeting Minutes June 20, 2006 Page 8 1 best option. He does not see growth of the business from this location. This location will 2 house more of the administrative functions of the business. 3 4 Chair Stromgren would like Mr. O'Brien to look at reduction of the parking lot width and 5 at the north end, because it is a primary road, and city owned frontage of boulevard is 6 narrower on 29h,he is wondering about the last two parking spaces. The idea of getting 7 rid of the extra entrance/exit on 29t' is a good idea for safety and will be a nice green 8 space. 9 10 No action required. 11 12 VIII. INFORMATION AND DISCUSSION. 13 8.1 Comprehensive Plan Task Force Update 14 15 Ms. Moore-Sykes updated the Planning Commission about some of the Task Force 16 activities relating to comprehensive land use. The Task Force met earlier this month. The 17 assignment was to take pictures around the community of items members thought should 18 be changed, removed, added or kept. Bill Weber, the consultant working on the update, 19 has taken all ideas and will put together a draft for the taskforce to look at in August or 20 September. 21 22 8.2 Quarterly Code Enforcement Report 23 24 Chair Stromgren stated this is included in packet and no discussion was needed. 25 26 8.3 Walkable Communities— Safe Routes Grant 27 28 Ms. Moor-Sykes reported they are working on putting together a grant available for the 29 Walkable Communities Project. MNDOT has monies available for communities who 30 want to install or upgrade sidewalks and trails to encourage and enhance the safe 31 walkability and biking of children to school. Ms. Moore-Sykes outlined the benefit of 32 this project. This project will encourage kids to get away from the TV and go outside, be 33 active and enjoy the outdoors. It also reduces dependence on gasoline and cars or busses 34 to take children back and forth to school. Currently kids are not encouraged to walk or 35 bike because it is not safe and we do not have sidewalks that take them to school. Up to 36 $175,000 is available to communities who choose to participate in this program. This 37 would go to the infrastructure. A non-infrastructure part of the grant is allocated to 38 educating children about safe routes to school using bikes or walking and the 39 attractiveness of this mode of transportation. The application is due right after July 4, 40 2006. They need and have participation from Hennepin and Ramsey Counties and Cathy 41 Knapp, transportation director of the school district. This project is targeted towards 42 grades 8-12. 43 44 IX. ANNOUNCEMENTS. Planning Commission Meeting Minutes June 20, 2006 Page 9 1 2 Ms. Moore-Sykes announced the following: 3 - The opening date for the Village Pub will be in July but she is not certain of the date. 4 5 -Pei Pei,the take out division of P. F. Chang's Restaurant,will open very soon. It has 6 very good Chinese food. 7 8 -The Clinic at Silver Lake Village is open. 9 10 Chair Stromgren asked about the progress of Phase Ilb of the Silver Lake Development. 11 Ms. Moore-Sykes stated the plan is not complete. 12 13 X. Background: Staff was contacted by Mr. Loren O'Brien, CEO for Building Fasteners, about the process for applying for a parking variance. He reported that Building Fasteners is proposing renovation plans for their building to add more office space. The renovation plan also calls for the expansion of their parking to relieve an already tight parking situation. To achieve more parking, they are proposing to encroach approximately 10 feet west into the side yard adjacent to Anthony Lane South. He also suggested that they could add approximately 4 to 7 parking stalls in the front of the building (south side of the building) for walk-in clients. Mr. O'Brien has repeatedly stated to Staff and the Planning Commission that he continues to be very interested in keeping and maintaining his business in St. Anthony. The City was also asked to explore the feasibility of constructing on-street angle parking along the main portion of Anthony Lane coming into the area. Staff researched the idea and determined that because this portion of St. Anthony Lane South is very busy, bringing in traffic to the area from 29`s Avenue/County Road 94 during the morning rush hour and relieving the area in the afternoon, this proposed on-street parking would create additional problems with the flow of vehicular traffic. Analysis. A variance is required because the City's Ordinance restricts parking within ten feet of a front lot line in this zoning district (1650.05, Subd. 2 (a)). Variances as granted by the City Council allow modifications to the dimensional requirements of a particular zoning district. Statutorily, City Council has the authority to grant variances when performance standards as required by the Zoning Code cannot be met due to unusual physical site characteristics, called a 'hardship'.A hardship is related to the physical characteristics of the land, such as slopes or mature trees. The property owner must prove there is a hardship and the variance requested is necessary to alleviate a physical hardship caused by unusual circumstances. Variances cannot be used to either establish or enhance a use,which is not otherwise permitted in the zoning district. 07182006 Bldg Fasteners Parking Variance Staff Report.doc MW Section 1665.06 outlines the requirements that must be addressed to qualify for a variance and the process by which a variance is granted. Subd. 3 states that no variance will be granted unless evidence presented discloses the following facts: Strict enforcement would cause undue hardship because: The property cannot be put to a reasonable use without the variance. The warehouse and related office uses of Building Fasteners, as it currently exists, does meet permitted use criteria of the ordinance but does need to provide an additional 11 parking spaces to comply with the City's Zoning Code requirements for parking in this zoning district. To accomplish this compliance, the additional parking spaces with need to be built in the 40- foot front yard setback,which in turn requires a variance. Mr. O'Brien would like to increase the required parking by an additional 8 spaces to better accommodate shift changes and walk-up customers. The circumstances causing the hardship were not created by the owner. The building was originally built in 1981 as Hub Warehouse, owned by Watson/Forsberg and Mr. O'Brien is a subsequent owner. The current 27 parking spaces originally constructed did comply at the time with the number required for the warehouse square footage and six additional spaces apparently reflected the number of employees on the largest shift at Hub Warehouse. Mr. O'Brien's business, over time, has required additional staff to accommodate the needs of his business. As a result this has increased the number of parking spaces required for this site based on the number of employees on the largest shift. The variance,if granted,will not alter the essential characteristics of the locality. The Industrial District is designated for and the regulation of the development of light industry. This designation is due to the proximity of high traffic capacity roadways and rail facilities and accommodating the moving and transport of manufactured products and related services. Approving the variance for additional parking spaces would not alter the essential character of the area due to the requirement of the zoning code for high-density parking areas to accommodate the large number of employees and service providers required by the businesses existing in this zoning district. Economic considerations alone are not the basis of the hardship. While the variance,if approved,would provide for the construction of the minimum number of parking spaces required to satisfy the spirit and intent of the Zoning Code for this zoning district.
