2 Assistant City Manager Moore-Sykes stated Mr. Julius Chu contacted staff recently when he was
3 advised by the Fire Department that he should contact Planning Staff before they sign off on his
4 request for an occupancy permit. He was told that he may not be in compliance in using a
5 commercial site as a location for his assembly. Upon contacting Planning Staff,Mr. Chu was
6 advised that the use he is proposing for a site in the Northgate Business Center requires a
7 conditional permitted use, and he was informed about the application and public hearing process.
8 Mr. Chu agreed to participate in a Concept Review at this Planning Commission meeting to
9 discuss the need for a conditional use permit. Assistant City Manager Moore-Sykes stated she
10 has not received an application yet,but expects to receive one shortly. Staff has received no
11 phone calls regarding this group's proposed use of the property. The Police Department advised
12 Planning Staff that they have not received any complaint calls regarding the Twin Cities
13 Christian Assembly.

15 Mr. Julius Chu, applicant, addressed the Planning Commission and stated Twin Cities Christian
16 Assembly has been using this site since July of 2006 as a renter. Three months ago he was told of
17 the owner's intention to sell the unit, and they decided they would like to pursue using the site as
18 a permanent location for their small church. Mr. Chu stated they would like to comply with City
19 Code. The Commission has been provided with a brief description of the church. Operation
20 hours are Sunday 10:00 a.m. to 1:00 p.m., and Wednesday and Friday nights. There is not a
21 concern from the Association regarding their use on the site. Other uses of the business center
22 are mostly professional dentists and accounts, and their use is not during the same hours. He
23 stated they do not have any plans for expansion in the limited location of this site. Mr. Chu stated
24 he is available to answer any questions of the Commission.

26 Chair Stromgren clarified that the Fire Marshal will cover any issues regarding the occupancy of
27 the building, exiting, etc. The Planning Commission is strictly considering the land use in
28 relation to City Code. He inquired about the number of parking spaces on the site.

30 Mr. Chu replied there are 50 to 60 parking spaces. Twin Cities Christian Assembly uses less than
31 20 spaces.

33 Commissioner Jensen inquired about office functions that may occur within the Assembly space.

35 Mr. Chu stated Twin Cities Christian Assembly is a nonprofit organization and there are no
36 salaried employees. They help with counseling for students with problems, and seek power from
37 up above. There are also medical doctors in the congregation that help members.

39 Commissioner Jensen commented this use seems to fit the way the Guide Plan describes the area
40 with commercial zoning and office/service as a complimentary use. In addition, there would not
41 be conflict with the boat store that cannot be open on Sundays.

43 Chair Stromgren inquired about the size of the facility.

45 Mr. Chu replied the building is approximately 2,000 square feet.

1 Chair Stromgren commented that the limited size of the church seems to fit well within the
2 assembly category.

4 VIII.2. LYNN SQUIRES— 3400 BELDEN DRIVE
5
6 Assistant City Manager Moore-Sykes stated Mr. Todd Gunderson contacted staff about the
7 possibility of building a two-car garage at 3400 Belden Drive. He is not the property owner at
8 this time, but has a purchase agreement with the current owner, Lynn Squires. Staff went through
9 the ordinance requirements and the process of the public hearing and 60-Day Rule. A letter was
10 sent to Ms. Squires about the City's receipt of the application, and the 60-Day Rule. Assistant
11 City Manager Moore-Sykes advised currently, there is a single car tuck-under garage attached to
12 the principle structure. Mr. Gunderson is proposing to construct an additional 20' x 24' accessory
13 building to be used primarily as a single car garage. Mr. Gunderson is proposing to construct the
14 accessory building ten feet from the existing garage, using the existing driveway to access both
15 garages. This location situates the proposed accessory building five feet from the rear lot line and
16 seven feet from the north side lot line. Mr. Gunderson has stated that he also intends to remove
17 an existing 20' x 12' deck and replace it with plantings.

19 Assistant City Manager Moore-Sykes stated this property is a corner lot but is only 9,170 square
20 feet rather than the 11,000 square feet as required by City Code. The lot coverage restriction for
21 lots with conforming square footage is 35%. City Code allows for 40% lot coverage for those
22 lots that were plotted with smaller dimensions. The project as proposed by Mr. Gunderson will
23 utilize 34% lot coverage, well within the 40% lot coverage restriction.

25 Chair Stromgren clarified for the Commission that the criteria for the garage permit is set out in
26 Section 1650.02 and relates to things such as neighbors, plantings, trees, relation to the street,
27 etc. The seven variance criteria are not required to be met with this permit.

29 Commissioner Jensen stated he sees no issue in moving forward with the application. He noted
30 the structure appears to occupy the same space as the current location and the function is similar.

32 Chair Stromgren commented that the request is in line with the City Code requirement for a two-
33 stall garage. He stated hopefully Mr. Gunderson or the homeowner will be able to attend the next
34 Planning Commission meeting.

36 Assistant City Manager Moore-Sykes indicated it is within the Commission's authority to table
37 the application until the applicant and/or the homeowner attend a Commission meeting.

39 Commissioner Jensen noted that applicants are encouraged to attend Commission meetings, but
40 their attendance is not mandatory.

1 Assistant City Manager Moore-Sykes stated the City Council selected American Legal
2 Publication to complete the recodification of the City's Code of Ordinances. The ordinances
3 have not been reviewed and recodified since 1993. Staff received a proposed draft of the
4 recodified City Code in April to review and respond with comments and corrections by June 13,
5 2008. American Legal Publishing has also asked for copies of new and revised ordinances
6 approved by the City Council since the beginning of the year. The Commission has been
7 provided with staff responses to items highlighted for review. Staff is currently awaiting a
8 response from American Legal Publications.

10 Chair Stromgren inquired about the approval process timeline.

12 Assistant City Manager Moore-Sykes replied she has had 60 days to review the proposed draft
13 since it was received in April and some of her comments will be incorporated into the document.
14 If American Legal Publication has additional comments they will be submitted to her and she
15 will have a certain time to respond. The contract with American Legal Publication states that the
16 City will receive a recodified document by the end of 2008. The document will be presented to
17 Council for approval as soon as it is received by staff and they are satisfied with the document.

19 Chair Stromgren asked if the contract includes PDF documents for the City website.

21 Assistant City Manager Moore-Sykes replied yes, American Legal Publication has agreed to put
22 the document on a disc that can be downloaded onto the City's computers. There is also the
23 option for American Legal Publication to hold the document on their website for a fee. The
24 document is available for review at City Hall.

28 Assistant City Manager Moore-Sykes reported the following information has been included in

36 Assistant City Manager Moore-Sykes reported that the Comprehensive Plan has been fully
37 submitted to the Metropolitan Council. Staff was informed last week that the Plan is ready to go
38 for the most part, with the exception of the Water System Summary. Staff has been informed the
39 City has until October to submit this portion of the Plan.

3 Commissioner Jensen requested an update on the Summer Hill Project.

5 Assistant City Manager Moore-Sykes stated staff met with the developer in April and was
6 provided with a preliminary look at a potential site plan. She stated she has no further
7 information at this time.

9 Commissioner Jensen asked whether the plan fits within the PUD latitude.
10
11 Assistant City Manager Moore-Sykes replied she does not believe there was an issue in relation
12 to the PUD. The only issue she recalls was the water table in relation to the underground parking
13 garage that has been proposed.

15 Commissioner Goodwin requested an update on the Silver Lake Road Project.

17 Assistant City Manager Moore-Sykes reported the project is slightly behind schedule due to
18 weather, but there are no serious issues.

Background: Mr.Julius Chu,Twin Cities Christian Assembly(TCCA), contacted Staff when he was advised by
the Fire Department that he needed to contact the City Staff before they would sign off on Mr. Chu's request for
an occupancy permit. He was told that the TCCA may not be in compliance with the City's Zoning Ordinance
as it is not a use listed as a permitted use in the commercial zoning district.
Upon contacting City Staff,Mr. Chu was advised that locating TCCA in the Northgate Business Center requires
a conditional permitted use (1635.03 (c)). Mr. Chu was also informed about the application and public hearing
processes. He attended a concept review at the June 17'Planning Commission meeting to present information
on the Twin Cities Christian Assembly organization and to discuss the need for a conditional use permit.
Application Review and Analysis: Minnesota Statutes and City Ordinances require that various criteria be met
by the applicant for an application for a conditional use permit can be considered.
1. The requested conditional use is one of the Permitted Conditional Uses specifically listed for
the zoning district in which the conditional use is located. City Code, Chapter 16 at 1635.03 (c),
that lists assembly, lodge or convention halls as permitted conditional uses in the Commercial zoning
district.
2. That the requested conditional use permit will not be detrimental to health, safety or general
welfare of persons residing or working in the vicinity or injurious to property values of
improvements in the area. TCCA, as reported by Mr. Chu is a non-profit organization and often
provides resources and information on community services. Mr. Chu also reported that TCCA has
been located at the subject property since July 2006. Mr. Chu stated in his application that to the best

of his knowledge,no detrimental incidents have been reported or filed against the organization. Staff
did confirm this information with the Fire Department and the Police Department.
3. The requested Conditional Use Permit is considered necessary or desirable at the subject
location to provide a service or a facility which is in the interest of public convenience and will
contribute to the general welfare of the neighborhood or community. TCCA,as the only
English/Chinese bilingual church in St. Anthony, seeks to serve the local community by offering
information on available resources and promoting understanding.
In addition to the responses to the above-noted criteria,the Planning Commission also discussed with Mr. Chu
the TCCA's parking requirements and if the Northgate site offered sufficient parking. Mr. Chu responded that
the Assembly's main hours of operation are Wednesday and Friday evenings and Sunday from 10:00 am to 1:00
pm. These times are off times for the other businesses and organizations located at Northgate Business Center.
Mr. Chu added that while he estimates that there are between 50—60 parking spaces available,the TCCA group
uses about 20 parking spaces and there are no plans to expand the church.
Communications: Staff has received no phone calls regarding this group's proposed use of the property. The
Police Department advised the Planning Staff that they have not received any complaint calls regarding the Twin
Cities Christian Assembly.

Dear Mr. Chu:
Your request for a Conditional Use Permit has been received and will be
presented to the Planning Commission for a public hearing on Tuesday,July 15,
2008 at 7:05 p.m., or as soon thereafter as possible. Minnesota State Statutes
require that any land use or zoning applications be approved or denied by the
governing body within 60 days of receipt of a completed application.
Following the public hearing, the Planning Commission will make their
recommendations to the City Council. The City Council will make a decision on
your application at the July 22, 2008 Council Meeting. Your presence or that of a
representative is required at both meetings. If you or your representative is not
present at the Planning Commission meeting on the above date, the Planning
Commission may table the request until you or your representative is able to
appear.

Project Update
The Silver Lake Road (C.S.A.H. 136) project continues to move
forward in the month of June on schedule. The project will be
y-L= moving from south to north with sanitary sewer and watermain
-r installation occurring in front of the roadway construction work.
Hennepin County is working with the Contractor to minimize the
area of roadway disturbed at any one time, this effort is the reason
pavement or driveways have not been disturbed north of Townview
Avenue while crews were working in the month of May. The effort is
intended to allow the Contractor to complete the work in a timely
fashion while minimizing the duration that homes and facilities will be
impacted by the construction. Work will continue to the north as
underground construction is completed. As soon as possible, crews
will pave sections of roadway beginning at the southern end of the
project moving to the north as quickly as work can commence.

Safety Considerations
The primary goal of any project is to keep everyone safe and unharmed. This newsletter will
offer some practical reminders about safety during a construction project that should be
considered carefully.
-inform Your Children about Construction Work
Often there is a natural attraction for children to the excitement of large construction vehicles
zooming around a job site. Construction workers on this job are well informed about the need to
look for pedestrians and young children in residential areas such as this, however even the
sharpest eye can lose sight of a small child on a job site among the many distractions that
workers must be aware of. Residents should take an extra moment to discuss with children safe
practices of staying off construction sites and away from construction work.
-Use Extra Caution with,Toddlers
Toddlers that may be too young to inform properly should be monitored closely if outside and
doors should be locked or secured to prevent a "curious" toddler from exiting the home
unsupervised to see the large equipment.
-Report Unsafe Conditions
Although Hennepin County, the City of St. Anthony, and Construction staff are constantly
monitoring the site for unsafe conditions, we welcome comments on any items that you deem
may be a safety hazard to allow us to review and react promptly.
-Minimize Walking Through or Across Construction
Even for cautious adults, it can be dangerous to walk among the numerous construction
vehicles working on the job site. Workers are required to wear bright reflective vests for added
visibility and are trained in how to navigate around construction equipment in operation,
pedestrians can be difficult to spot among the large pieces of machinery. If at all possible, use
your car to drive to your nearby destination while construction is actively occurring in your area
and do not walk into an active construction site, please call the contacts listed if you need
assistance.
