COMMUNICATION WITH CITY COUNCIL 5 6 Chair Stromgren stated Commissioner Crone will attend the July 22, 2008 City Council meeting 7 to report on the Twin Cities Christian Assembly public hearing. 8 9 VII. PUBLIC HEARINGS 10 11 VII.1. CHU—NORTHGATE, TWIN CITIES CHRISTIAN ASSEMBLY 12 13 Chair Stromgren opened the public hearing at 7:06 p.m. 14 15 Assistant City Manager Moore-Sykes stated this is a conditional use permit for the property 16 located at 2500 U.S. Highway 88,Northgate Business Center. The application was received on 17 June 19, 2008; the 60-day expiration date is August 20, 2008. 18 19 Assistant City Manager Moore-Sykes stated Mr. Julius Chu,Twin Cities Christian Assembly 20 (TCCA), contacted staff when he was advised by the Fire Department that he needed to contact 21 City staff before they would sign off on Mr. Chu's request for an occupancy permit. He was told 22 that the TCCA may not be in compliance with the City's Zoning Ordinance as it is not a use 23 listed as a permitted use in the commercial zoning district. Upon contacting City staff, Mr. Chu 24 was advised that locating TCCA in the Northgate Business Center requires a conditional use 25 permitted use (1635.03) (c). Mr. Chu was also informed about the application and public hearing 26 processes. He attended a concept review at the June 17, 2008 Planning Commission meeting to 27 present information on the TCCA organization and to discuss the need for a conditional use 28 permit. Assistant City Manager Moore-Sykes provided an overview of the criteria review and 29 analysis as outlined in the staff report. She advised in addition to the criteria, the Planning 30 Commission also discussed with Mr. Chu the TCCA's parking requirements and if the Northgate 31 site offered sufficient parking. Mr. Chu had responded that the Assembly's main hours of 32 operation are Wednesday and Friday evenings and Sunday from 10:00 a.m. to 1:00 p.m. These 33 times are off times for the other businesses and organizations located at Northgate Business 34 Center. Mr. Chu added that while he estimates that there are between 50—60 parking spaces 35 available, the TCCA group uses about 20 parking spaces and there are no plans to expand the 36 church. 37 38 Assistant City Manager Moore-Sykes stated staff has received no phone calls regarding this 39 group's proposed use of the property. The Police Department has advised the Planning Staff that 40 they have not received any complaint calls regarding the TCCA. 41 42 Mr. Chu, applicant, addressed the Planning Commission and stated Twin Cities Christian 43 Assembly is very grateful to be here again about the use of their church to serve the community. 44 They like the City of St. Anthony. It is a nice peaceful community. Mr. Chu presented an aerial 45 photograph of the proposed site plan. He stated the current location has 2,000 square feet that can 46 be used. If they need some extra space in the future he believes there are some rooms available. r Planning Commission Regular Meeting Minutes June 17, 2008 Page 3 1 Upon approval of the conditional use permit they would consider purchasing,rather than 2 continuing to rent. 3 4 Commissioner Crone inquired about the maximum occupancy number for the Assembly 5 building. 6 7 Mr. Chu replied he is not certain of the actual number. However, they have been working with a 8 professional consultant and the requirements fit with the square footage of the building. He noted 9 that approval is subject to the Fire Marshal's recommendation. 10 11 Chair Stromgren closed the public hearing at 7:19 p.m. 12 13 Commissioner Jensen noted that the application references the condo number and the conditional 14 use permit would run with this particular condo number until the time that it would expire for 15 lack of use. Staff would have latitude on whether to amend the conditional use permit or add an 16 additional address for any future requests on additional space. 17 18 Assistant City Manager Moore-Sykes indicated future action would depend on what the owners 19 or occupants of the space ultimately decide to do. 20 21 Motion by Commissioner Jensen, second by Commissioner Goodwin, to recommend that the 22 City Council approve the conditional use permit request for Condo No. 0535,Northgate Office, 23 2626 Highway No. 88, #110, St. Anthony,MN 55418. 24 25 Commissioner Jensen pointed out that the conditional use permit is consistent with the 26 parameters of the zoning code. 27 28 Chair Stromgren offered a friendly amendment to include the condition that the conditional use 29 permit is subject to approval and certification of the occupancy permit by the Fire Marshal and 30 Building Official. 31 32 Motion adopted unanimously. 33 34 Chair Stromgren indicated the conditional use permit will be included on the agenda of the July 35 22, 2008 City Council meeting. 36 37 VIII. UPDATE ON COMPREHENSIVE PLAN 2 3 Assistant City Manager Moore-Sykes reported the Comprehensive Plan is currently being 4 reviewed by the Metropolitan Council. The Metropolitan Council has requested submittal of the 5 City's Water System Summary, which is being prepared by the City's Engineering Firm, WSB 6 and Associates. 7 8 X.2. UPDATE ON THE CITY CODE RECODIFICATION 9 10 Assistant City Manager Moore-Sykes reported staff is currently waiting for a response from 11 American Legal Publishing on their review of the City Code Recodification. 12 13 Commissioner Jenson inquired about the status of the standardized code guidelines that were 14 previously presented by the Fire Marshal. 15 16 Chair Stromgren noted that the Fire Code, Building Code and Housing Code are in effect under 17 State Law; the City Code will be brought up to date. 18 19 Assistant City Manager Moore-Sykes indicated changes to the Housing Code have been adopted 20 in City Code and are in effect as of the publication date. 21 22 Commissioner Jenson asked when the City Code Recodification will go into effect. 23 24 Assistant City Manager Moore-Sykes replied the Recodification will likely go into effect in 25 November of this year. City Council review is required, which includes an approval process. 26 27 X.3. SILVER LAKE ROAD UPDATE 28 29 Assistant City Manager Moore-Sykes reported the June update on the Silver Lake Road Project 30 is included in the Commission's packet. She distributed the July update and stated the 31 contractors have reported that everything is running on time. She commented there have been 32 very few complaints and people have been very patient. 33 34 XI. COMMUNITY FORUM. 35 36 None. 37 38 XII. INFORMATION AND ANNOUNCEMENTS. 39 40 Assistant City Manager Moore-Sykes stated two member of the Commission will be out of town 41 on the regularly scheduled meeting date in August. The meeting could be cancelled or 42 rescheduled as a worksession on a different week. Today is the deadline for most applications, 43 and none have been submitted at this time. There have not been any inquiries or requests to 44 schedule a concept review. 45 Planning Commission Regular Meeting Minutes June 17, 2008 Page 5 1 Commissioner Jensen suggested Tuesday, August 261h at 6:15 p.m. as a potential meeting date if 2 necessary. 3 4 Consensus of the Commission was to direct staff to reschedule the August Planning Commission 5 meeting to August 26, 2008 at 6:15 p.m. if necessary. It will be at staff's discretion whether to 6 cancel the meeting if there are no agenda items for consideration. 7 8 XIII. LOT SUBDIVISION— COMBINATION; PAUL HAYES 44 45 Assistant City Manager Moore-Sykes stated staff was contacted by Mr. Paul Hayes, 4020 Silver 46 Lake Terrace, requesting information for the process of completing a lot combination. The 47 property owner at 4024 Silver Lake Terrace is willing to sell Mr. Hayes a portion of this lot. 48 Staff informed Mr. Hayes of the lot subdivision process and the minimum size requirement on 1 1 Planning Commission Regular Meeting Minutes August 19, 2008 Page 2 1 the square footage of lots. Mr. Hayes has provided staff with a copy of a minor subdivision for 2 the Good and Hayes properties located at Lots 3 and 4, Block 1, Olson's Addition respectively. 3 4 The Commission reviewed the Ramsey County GIS site plan of the subject properties. 5 6 Mr. Paul Hayes, 4020 Silver Lake Terrace, addressed the Planning Commission and stated he 7 would like to purchase 16 additional feet of lakeshore from his neighbor, Dr. Good. He stated he 8 currently owns a small bit of lakeshore, roughly 8 to 10 feet. In addition, Dr. Good will be 9 purchasing roughly five feet of property on the street side from him. The reason for this is that 10 many years ago Mr. Goods tarred the five feet, assuming it was his lot. 11 12 Acting Chairperson Jenson asked whether the lots will meet the minimum square foot 13 requirements. 14 15 Assistant City Manager Moore-Sykes replied both of the lots would comply with the City Code 16 requirement to be at a minimum of 9,000 square feet in size. Currently Dr. Good's lot is more 17 than 22,000 square feet. With the proposed change Dr. Good's lot size will drop to 20,223 square 18 feet and Mr. Hayes' lot would be 17,434 square feet. Both lots will be well above the minimum 19 lot size requirement. In regards to setback requirements, Mr. Hayes' lot at 4022 Silver Lake 20 Terrace meets all of the requirements. Dr. Good's lot is shy on the front setback; however, the 21 structure on the property was built in 1961 and his situation would be grandfathered in due to the 22 code being codified in the mid 1970's. 23 24 Acting Chairperson Jenson asked if the tarred area being purchased by Dr. Good is part of the 25 driveway. Mr. Hayes replied it is more of a parking area. 26 27 Acting Chairperson Jenson indicated he does not have any further questions, as the requested lot 28 subdivision and combination meets the requirements for lot size square footage and frontage. 29 30 Assistant City Manager Moore-Sykes stated she will work with Mr. Hayes to have the 31 application completed and this item will be included on the September Planning Commission 32 agenda as a public hearing. 33 34 IX. She noted activities are still low, and there seems to be no change as far as 42 the sales analysis in the Twin Cities area. Background: Elizabeth and Paul Hayes,property owners at 4020 Silver Lake Ten-ace, Lot 4,Block 1,Olson's Addition, are proposing to sell a 337 SF portion of their lot at the NW comer to Dr. Gary Good,property owner of the adjacent property, 4024 Silver Lake Ten-ace,Lot 3,Block 1, Olson's Addition. Dr. Good is proposing to sell approximately 3,062 SF to Mr. and Mrs. Hayes in order to give the Hayes' more lakeshore for recreation. Both property owners have applied for subdivision and plat approvals to accommodate each of their lot splits and lot combinations. Both owners were informed that this land use action requires a public hearing, which is scheduled with the Planning Commission at their regularly scheduled meeting on September 16,2008 at 7:00 pm at City Hall. Mr.Paul Hayes,4020 Silver Lake Ten-ace,who initially contacted Staff to determine if he and his neighbor,Dr. Gary Good,4024 Silver Lake Ten-ace,could sell each other portions of their respective property. Staff provided Mr. Hayes with information regarding the lot subdivision process. Mr. Hayes advised Staff that Dr. Good was intended to sell him a portion of property that runs along the easement that goes from Silver Lane to the Lake. Application Review: On August 27, 2008 Staff received site plan review applications and subdivision/plat approval applications with a survey map of the subject lots from both Paul and Elizabeth Hayes and Dr. Gary Good. Each respective application described the lot subdivision and lot combination proposed for each property. The proposed site map and a description of the proposed subdivision were forwarded onto the City's attorney for his review. He did not find any issues of concern with the proposed lot subdivisions and combinations. Staff received two phone calls asking about the proposed subdivision. One individual wanted to advise the City that a walkway easement runs adjacent to the 3,062 SF that Mr. Hayes in buying from Dr. Good. He wanted to Lot Combo 4020 SLR Ter Staff Report 081908.doc insure that this easement providing access to Silver Lake is protected. The other caller simply wanted more information about the proposed subdivision. Analysis: Mr.Paul Hayes called Staff for information regarding the process to do a lot combination. He indicated that the property owner at 4024 Silver Lake Terrace is willing to sell Mr. Hayes a portion of his lot. Staff advised Mr. Hayes of the Lot Subdivision process and that the resultant lots are required by City Ordinance to conform to minimum interior lot square footages. Mr. Hayes submitted site maps showing the proposed subdivisions for Staff review. Staff verified that the proposed lot splits did not cause the whole lot to be out of confomnance with lot size regulations of the City's Zoning Code. Each lot meets the minimum lot size of 9,000 SF. Currently,Lot 3 is 22,948 SF and Lot 4 is 14,709 SF. The proposed square footage of Lot 3 is 20,223 and the proposed square footage of Lot 4 is 17,434. According the calculations of the certified land surveyor,the 35% lot coverage requirement is also adhered to by both properties,currently and with the proposed lot subdivisions. The minimum side yard and rear yard setbacks for each lot are also maintained. An R 1A lot requires a minimum side yard width of five (5) feet and a minimum combination of the two (2) side yards of fifteen (15) feet. The rear yard of any lot abutting the lake must be at least 75 feet from the natural high water elevation of the lake. The rear yard of any lot not abutting the lake must be at least 20% of the depth of the entire lot but in no case less than 25 feet. Lot 3 owned by Dr. Good does abut the Lake and has a rear yard of 80.2 feet and Lot 4 owned by Mr.Hayes does not abut the Lake and has a rear yard of 35.18 feet. Side yards for both properties are well above the required footage. Lot 4 conforms to the front yard setback with 36.14 feet;Lot 3 does not conform to the 30- foot front yard setback requirement. The original survey does show a front yard setback of 25 feet,still shy of the required setback of 30 feet that was adopted by the City in 1976. The structure was built in 1961. Either one of these would make the front yard setback for 4024 Silver Lake Ten-ace grandfathered in. Both lots will conform to the rear yard setbacks and the side yard setbacks if the lot combinations are approved. Action: Resolution for Recommendation of Approval/Denial of the proposed Lot Splits and Combinations to the City Council. The Planning Commission can hold the public hearings for both lots at the same time. Communications: Received two phone calls from residents.
