PUBLIC HEARINGS 5 6 VII.1 Lot Subdivision for 4020 Silver Lake Terrace and 4024 Silver Lake Terrace 7 8 Chair Stromgren opened the public hearing at 7:04 p.m. 9 10 Assistant City Manager Moore-Sykes presented the staff report on the requested lot I 1 subdivision/combination for properties located at 4020 Silver Lake Terrace and 4024 Silver Lake 12 Terrace. She stated Elizabeth and Paul Hayes, property owners at 4020 Silver Lake Terrace, Lot 13 4, Block 1, Olson's Addition, are proposing to sell a 337 SF portion of their lot at the NW corner 14 to Dr. Gary Good,property owner of the adjacent property, 4024 Silver Lake Terrace, Lot 3, 15 Block 1, Olson's Addition. Dr. Good is proposing to sell approximately 3,062 SF to Mr. and 16 Mrs. Hayes in order to give the Hayes' more lakeshore for recreation. Both property owners have 17 applied for subdivision and plat approvals to accommodate each of their lot splits and lot 18 combinations. Both owners were informed that this land use action requires a public hearing. Mr. 19 Paul Hayes, 4020 Silver Lake Terrace, initially contacted staff to determine if he and his 20 neighbor, Dr. Gary Good, 4024 Silver Lake Terrace, could sell each other portions of their 21 respective property. Staff provided Mr. Hayes with information regarding the lot subdivision 22 process. Mr. Hayes advised staff that Dr. Good intended to sell him a portion of property that 23 runs along the easement that goes from Silver Lane to the Lake. 24 25 Assistant City Manager Moore-Sykes stated on August 27, 2008, staff received site plan review 26 applications and subdivision/plat approval applications with a survey map of the subject lots 27 from both Paul and Elizabeth Hayes and Dr. Gary Good. Each respective application described 28 the lot subdivision and lot combination proposed for each property. The proposed site map and a 29 description of the proposed subdivision were forwarded onto the City Attorney for review. He 30 did not find any issues of concern with the proposed lot subdivisions and combinations. Staff 31 received two phone calls asking about the proposed subdivision. One individual wanted to advise 32 the City that a walkway easement runs adjacent to the 3,062 SF that Mr. Hayes in buying from 33 Dr. Good. He wanted to insure that this easement providing access to Silver Lake is protected. 34 The other caller simply wanted more information about the proposed subdivision. 35 36 Assistant City Manager Moore-Sykes stated staff has verified that the proposed lot splits do not 37 cause the whole lot to be out of conformance with lot size regulations of the City's Zoning Code. 38 Each lot meets the minimum lot size of 9,000 SF. Currently, Lot 3 is 22,948 SF and Lot 4 is 39 14,709 SF. The proposed square footage of Lot 3 is 20,223 and the proposed square footage of 40 Lot 4 is 17,434. According to the calculations of the certified land surveyor, the 35% lot 41 coverage requirement is also adhered to by both properties, currently and with the proposed 42 subdivision. Assistant City Manager Moore-Sykes advised that the minimum side yard and rear 43 yard setbacks for each lot are also maintained. An R-IA lot requires a minimum side yard width 44 of five feet and a minimum combination of the two side yards of 15 feet. The rear yard of any lot 45 not abutting the lake must be at least 75 feet from the natural high water elevation of the lake. 46 The rear yard of any lot not abutting the lake must be at lest 20% of the depth of the entire lot, w Planning Commission Regular Meeting Minutes September 16, 2008 Page 3 1 but in no case less than 25 feet. Assistant City Manager Moore-Sykes stated Lot 3 owned by Dr. 2 Good does abut the Lake and has a rear yard of 80.2 feet and Lot 4 owned by Mr. Hayes does not 3 abut the Lake and has a rear yard of 35.18 feet. Side yards for both properties are well above the 4 required footage. Lot 4 conforms to the front yard setback with 36.14 feet; Lot 3 does not 5 conform to the 30-foot front yard setback requirement. The original survey does show a front 6 yard setback of 25 feet, still shy of the required setback of 30 feet that was adopted by the City in 7 1976. The structure was built in 1961. Either one of these would make the front yard setback for 8 4024 Silver Lake Terrace grandfathered in. Both lots will conform to the rear yard setbacks and 9 the side yard setbacks if the lot combinations are approved. 10 11 Assistant City Manager Moore-Sykes stated a resident came in to City Hall today and questioned 12 the legal descriptions for both lots. She reported that the resident was assured the information the 13 surveyor provided is accurate and the information can be received on-line or in person at the 14 County. 15 16 Mr. Paul Hayes, 4020 Silver Lake Terrace, addressed the Planning Commission and stated the 17 purpose of purchasing more lakeshore is strictly recreational. Also, in the future it will be easier 18 to sell their property. He reviewed the location of the lot subdivision/combination and explained 19 that it will follow the natural terrain. It will also clean up the situation of a six-foot area on his 20 property that was previously tarred by Dr. Good. 21 22 Dr. Gary Good, 4024 Silver Lake Terrace, stated he previously blacktopped an area large enough 23 for two cars. It turned out that seven feet of that area was on Mr. Hayes' property. 24 25 Commissioner Jensen noted that the utility easement will still be intact when this is complete. He 26 pointed out that this will be adding width to the current lake access on the Hayes' property. 27 28 Assistant City Manager Moore-Sykes stated the Hayes' property currently has access through the 29 easement, and will now have private access as well 30 31 Chair Stromgren closed the public hearing at 7:17 p.m. 32 33 Motion by Commissioner Jensen, seconded by Commissioner Goodwin, to adopt a resolution for 34 recommendation of approval of the proposed lot splits and combinations at 4020 Silver Lake 35 Terrace and 4024 Silver Lake Terrace to the City Council. 36 37 Motion carried unanimously. 38 39 Chair Stromgren informed the applicants that this item will be included on the agenda of the 40 September 23, 2008 City Council meeting. 41 42 VIII. REPORTS FROM STAFF 6 7 Assistant City Manager Moore-Sykes reported on the following: 8 ■ Staff has received the final copies on the City Code re-codification. The information will 9 be presented to Council for review and final approval in the next few months. 10 ■ The Comprehensive Plan will be submitted to the Metropolitan Council once the required 11 Water Survey Plan has been completed. Approval will likely be in October. Chair 12 Stromgren confirmed with Assistant City Manager Moore-Sykes that the Water Reuse 13 Project will be included in the Plan. 14 ■ The City Council approved the Park Commission recommendation to proceed with the 15 Emerald Park Renovation Project. 16 17 XI. COMMUNITY FORUM. 18 19 None. 20 21 XII. INFORMATION AND ANNOUNCEMENTS. 22 23 Commissioner Jenson inquired about the timeline for the Silver Lake Road project. 24 25 Assistant City Manager Moore-Sykes stated things have slowed down a bit due to the rain,but 26 the project is basically on time. It is expected that the first layer will be down by November and 27 the project will be finished in the spring. 28 29 XIII. Background: Staff received a phone call from Mr. Tom Albert, the property owner of 3903 Foss Road, Mirror Lake Properties. He asked about the possibility of rezoning this property to an R-2. Mr. Albert is interested in redeveloping 3903 Foss Road into an R-2 use. Currently the property is designated at R-3 but the structure has being used for light industrial/commercial uses. Staff explained that the City usually does not spot zone,but he can certainly bring his proposal before the City Planning Commission for their review and comments. Staff also advised Mr. Albert that this meeting would not provide with permission to change the zoning designation; that he would have to apply for a zoning change and go through the public hearing process. Mr. Albert agreed to present his proposal to the Planning Commission at a concept review. Background: In reviewing the applicant's demolition and building permits, Staff discovered that 3523 Harding is really two lots, one lot is 15'x130',Lot 3,Block 5, Gardena Acres and adjacent to another lot which is 60'x130', and also described by Hennepin County as Lot 3,Block 5, Gardena Acres. Both of these lots individually are not conforming with regard to square footage. Combined, these lots would be 9,750SF, meeting the Ordinance requirement of an interior lot being at minimum 9,000SF. A residential structure does exist at this site and possibly across both lots. Because both lots have the same legal description, Staff believes that there was intent to combine the lots. Staff advised the contractor of this non-conforming situation with the lots and informed Mr. Patrick O'Keefe, Bayshore Properties,LLC, that because of the proposed changes to the property, these two lots need to be combined to alleviate the non-conforming situation, as required by the City's Zoning Ordinance. Staff further advised Mr. O'Keefe that the City could combine these two lots administratively provided, as the owner,Mr. O'Keefe is agreeable to the combination; that the combination of these lots is permanent; and that this newly combined parcel will be treated as one parcel for purposes of all applicable ordinances of the City and that the property line between the parcels be disregarded for purposed of the City's setback,building and zoning ordinances. Mr. O'Keefe has agreed to the Administrative Lot Combination. The City Attorney has reviewed the application and has provided a Declaration of Restrictions for Mr. O'Keefe's signature. ANTHONY, a municipal corporation under the laws of the State of Minnesota (the "City"). A. Owners are the fee owners of the two parcels of real property located in the City of St. Anthony, County of Hennepin, State of Minnesota, legally described on Exhibit A attached hereto and identified on the attached Exhibit A as "Parcel A" and "Parcel B" (together referred to as the "Property"). B. Owner wishes to combine Parcels A and B into one contiguous tract or parcel in order that they be treated as one parcel for purposes of all applicable ordinances of the City and in order that the property line between the parcels be disregarded for purposes of the City's setback, building and zoning ordinances. The restrictive covenants herein contained shall operate as covenants running with the title to the Property and shall be enforceable by the City. The City shall have the right to sue for and obtain an injunction, prohibitive or mandatory, to prevent the breach of the covenants herein contained, or to take any other action to enforce the performance or observance of the restrictive covenants herein set forth. 4. These restrictive covenants shall inure only to the City and its successors and assigns. Any modification, amendment, termination or release of the restrictions herein contained may be made pursuant to a document executed by only the City and then fee owners of the Property.
