ADMINISTRATIVE LOT SPLIT—3055 OLD US HIGHWAY 8 47 48 Chair Stromgren opened the public hearing at 7:05 p.m. 49 9 1 Planning Commission Regular Meeting Minutes ` March 17, 2009 Page 2 1 Assistant City Manager Moore-Sykes discussed the history of the request for an administrative 2 lot split at 3055 Old US Highway 8. The item was included on the January 20, 2009 Planning 3 Commission meeting and tabled to the February 17, 2009 Planning Commission meeting at the 4 request of the applicant, Mr. David Lutz, General Counsel for The Wirth Companies. Mr. Lutz 5 did not attend the February 17, 2009 public hearing with the Planning Commission and did not 6 provide the parking analysis that had been requested until February 18, 2009. The revised site 7 plan that includes the parking analysis was forwarded to the City Attorney for review prior to the 8 City Council meeting scheduled for February 24, 2009. Mr. Lutz submitted a parking plan that 9 proposes 92 parking spaces with one space designated as handicapped parking. The City Council 10 remanded this item back to the Planning Commission for a public hearing scheduled for March 11 17, 2009. The City is still in conformance with the 120-day rule for Subdivision. Staff posted the 12 public hearing in the City's legal newspaper and mailed out notices to adjacent properties as 13 required by state statutes. 14 15 Mr. David Lutz, General Counsel for The Wirth Companies, stated the Planning Commission has 16 been provided with the adjusted survey, which includes 92 parking spots and meets code 17 requirements. He stated he is available for questions. 18 19 Chair Stromgren asked if the parking spaces included in the adjusted survey are proposed or 20 current parking spaces. Mr. Lutz replied the adjusted survey shows the actual number of spaces; 21 they believe they can be more efficient and include more parking spaces. 22 23 Commissioner Crone questioned if the entrance would remain the same. Mr. Lutz responded in 24 the affirmative. 25 26 Chair Stromgren closed the public hearing at 7:10 p.m. 27 28 Commissioner Crone inquired if there is a need for a cross access agreement from one lot to the 29 other. Chair Stromgren indicated he does not believe this would be necessary until there is a 30 separate use for development. 31 32 Commissioner Jenson noted the question of the Commission previously was the parking 33 arrangement and whether the parking meets the minimum requirement based upon building 34 utilization. 35 36 Assistant City Manager Moore-Sykes indicated that the applicant has gone beyond the parking 37 requirement. 38 39 Motion by Commissioner Jenson, seconded by Commissioner Heinis, to recommend approval of 40 the applicant's request for Lot Split at 3055 Old Highway 8. 41 42 Motion carried unanimously. 43 44 Chair Stromgren indicated that the lot split will be included on the March 24, 2009 City Council 45 meeting agenda. 46 Planning Commission Regular Meeting Minutes March 17, 2009 Page 3 1 VIII. CONCEPT REVIEWS 2 3 VIII.1. PROPOSAL FOR A VARIANCE TO THE SIGN ORDINANCE—ISD 282 4 5 Assistant City Manager Moore-Sykes presented the staff report on the proposal for a variance to 6 the sign ordinance—ISD 282. She stated Mr. Stephen Peterson, on behalf of the St. Anthony 7 Baseball Association, contacted staff to request that the City reconsider the Baseball 8 Association's request to post commercial advertising signs on the Palm Field outfield fence in 9 Central Park. Mr. Peterson said the Association had previously discussed this with staff about 10 one year ago. Staff informed the Association that the City's ordinance does not allow temporary 11 banners or signs posted on fences. Mr. Peterson reported to staff that the Association is 12 proposing to ask for a variance to the City's Sign Ordinance. But in reviewing the attorney's 13 opinion from Foster&Brever, it was determined that at least two variances will be needed. The 14 School District 282, as property owners, will have to apply for these variances. As part of the 15 variance application, they will have to demonstrate a hardship exists that is unique to their 16 property and this hardship makes it difficult for the property owner to use the property to its 17 greatest potential in order for the variances to be considered for approval. 18 19 Assistant City Manager Moore-Sykes provided an overview of the variances the School District 20 would be required to apply for. The first variance deals with commercial signs in the 21 Recreation/Open Space Zoning District, which is the zoning designation of the area Central Park 22 and Palm Field are located in. The next variance deals with placement of signs. Assistant City 23 Manager Moore-Sykes advised that Minnesota State Statute states that the applicant for a 24 variance must demonstrate that the property owner's situation is unique and not created by the 25 owner;that as a result of the City's ordinances and strict enforcement,the owner is experiencing 26 an undue hardship and the proposed variance will not change the essential character of the 27 neighborhood. The hardship argued cannot be solely based on economics. 28 29 Mr. Eric Brever, Foster&Brever, PLLC, stated he is present on behalf of the St. Anthony 30 Baseball Association(SABA). He stated SABA is looking for the recommendation of the 31 Planning Commission as to what they can to put their variance application together. They will 32 also be present for a public hearing at the April Planning Commission meeting. Mr. Brever 33 stressed that SABA would like to keep a dignified and classy look with the proposed signage. He 34 provided a presentation on the proposed installation of signs with advertising on the varsity 35 baseball field as a means to generate income for field improvements. Proposed signage would 36 include 10 to 20-4' x 6' vinyl advertising signs; local businesses would be approached first. The 37 signs would be mounted on the inside of the outfield fence at the St. Anthony High School 38 varsity field on April I"and removed on September I". Ivy would be placed along the fences 39 and trees would be planted to shield the homes across the field and reduce the noise and the sight 40 of the field. Mr. Brever stated that SABA is concerned that the City budget is being stretched and 41 that the City does not have the resources needed to devote to this field. The proposed sign 42 advertising would be administered by SABA with all proceeds going to baseball facility 43 maintenance and improvements. 44 45 Commissioner Jenson inquired approximately how many signs would be envisioned to be 46 mounted on the outfield fence. Mr. Brever replied that the proposal is for 10 to 20 signs; Planning Commission Regular Meeting Minutes March 17, 2009 Page 4 1 however,there is not a specific threshold. They would like to have the appearance of ivy 2 showing through. They would insure that they are respectful of the City's fence ordinance, which 3 states that any sign placed on the fence cannot obscure the whole wall. 4 5 Commissioner Jenson questioned if the ivy cover would restrict visibility. Mr. Brever replied 6 there are ways of letting the ivy grow around and moving it from behind the signs. 7 8 Commissioner Jenson asked if SABA has met with the School Board. Mr. Brever replied SABA 9 has not met with the School Board. The Activities Director has met with the Superintendent and 10 they have met with members of the School Board informally, who have expressed support for the 11 proposal. The Activities Director will be submitting the variance application to the City. 12 13 Commissioner Crone inquired about businesses that would advertise through the proposed 14 signage. Mr. Brever replied Tracy Printing and Foster&Brever, PLLC have expressed interest. 15 Other local businesses would be approached as well. The broader community would only be 16 approached for advertising after the local businesses. 17 18 Chair Stromgren indicated he supports the signage proposal in concept. He expressed concern 19 regarding how the hardship standard would be met with the variance request. He suggested this 20 may need to be approached differently as an amendment to the code language, and noted that 21 allowing a variance would open this up to other applicants. 22 23 Mr. Brever stated the concern of SABA is that the ability of colleges and universities currently 24 using the facility would diminish without the maintenance, which has non-economic hardship 25 aspects. The argument they are trying to apply is that a reduction of the overall interest in the 26 facility would cause less use over the long run, which would prevent the kids in the community 27 from being involved in the game. 28 29 Chair Stromgren noted that another variance requirement to be met is that the situation is unique 30 and not created by the owner. This is a fairly new field, and it is difficult to argue that this was a 31 preexisting condition. He reiterated the recommendation to go through a different mechanism 32 than a variance process, such as an ordinance amendment. He noted the field is on school 33 grounds, so they know there will be limits placed on the type of advertising that is allowed. He 34 pointed out that the football field has fences around it also, and from the City's perspective they 35 would like to cover the bases from all these possibilities down the road. 36 37 Assistant City Manager Moore-Sykes indicated that the schedule could possibly remain the same 38 if they were to proceed with an ordinance amendment. An ordinance amendment requires three 39 readings,although the Council has the ability to waive the first two readings and go directly to 40 the third reading. The signage program could proceed by May if the ordinance revision is 41 approved. 42 43 Commissioner Heinis inquired if the other groups that use the field pay for the use of the field. 44 Mr. Brever replied that there are fees coming in that cover part of the field maintenance. 45 Planning Commission Regular Meeting Minutes March 17, 2009 Page 5 1 Commissioner Jenson stated his support of an ordinance amendment as the appropriate method 2 to proceed. He noted this would bring the City's fields more in line with other successful 3 communities that maintain their fields and have advertising signage with a standard that must be 4 met. 5 6 Commissioner Chaput asked if the signs would be fixed on top of the ivy as the ivy matures. Mr. 7 Brever explained that the signs would be fixed to the chain link fence in some way with the ivy 8 around them. 9 10 VIII.2. PROPOSAL FOR CUP TO ALLOW DAYCARE AT 3055 OLD US HIGHWAY 8 11 12 Assistant City Manager Moore-Sykes stated staff received a phone call inquiring about the 13 possibility of applying for a conditional use permit for a daycare center at 3055 Old US Highway 14 8. A representative of the family proposing the daycare is present tonight and will provide 15 information to the Commission. 16 17 A representative from the school's owner provided an overview of the proposed daycare center 18 at 3055 Old US Highway 8 and answered questions of the Commission in St. Anthony. In 19 response to questions of the Commission he stated that he does not currently operate a daycare 20 center. They have submitted an application to the State for a license,which is currently in 21 process. The space that would be used in the building for the daycare center is 3,500 square feet 22 with four classrooms, two bathrooms and a hallway. Drop off would be at the main door. There 23 is 400 to 500 square feet behind the building for an outdoor recreation area that would be fenced 24 in. 25 26 Assistant City Manager Moore-Sykes indicated that an application has not been submitted to the 27 City yet. The interested party has received a copy of the application. She advised the owner to 28 come to the concept review to answer questions and receive suggestions from the Planning 29 Commission. If the owner decides to move ahead the application it will likely be submitted next 30 week. 31 32 Chair Stromgren indicated that the Commission will need to see where the fence would sit 33 relative to the property line and that it meets setback requirements.He suggested the owner meet 34 with Assistant City Manager Moore-Sykes to provide the required information for the 35 conditional use permit request. 36 37 IX. APPOINTMENT OF PAUL CINCOSKI TO PLANNING COMMISSION 7 8 Chair Stromgren announced that the City Council will be considering the appointment of Paul 9 Cincoski to the Planning Commission at the next City Council meeting; if approved,he will be 10 seated on the Commission for the April meeting. 11 12 X. REPORTS FROM STAFF 13 14 Assistant City Manager Moore-Sykes reported that Clean-up Day is scheduled for May 2, 2009 15 from 9:00 a.m. to 1:00 p.m. at 3801 Chandler Drive. A list of things the City will take will be 16 included in the spring newsletter coming out in April. Background: Mr. Stephen Peterson, representative from the St. Anthony Baseball Association,contacted Staff about requesting variances to the City's sign ordinance in order to be allowed to post temporary advertising signs on the outfield fences in Palm Field at Central Park Staff presented the Association's request to the Planning Commission at a Concept Review during the March 17`x'Planning Commission meeting. Mr.Peterson was in attendance representing the St.Anthony Baseball Association's proposal and explaining the intent of the request. The Planning Commission advised Mr.Peterson that it was more appropriate to request an amendment to the City's sign ordinance to allow for the posting of signs on fences. The Planning Commission Chair indicated that as part of the variance process,the applicant is required to show a unique hardship that is particular to the site and not of the owner's doing. The Planning Commission agreed that the Baseball Association and the School District would not be able to prove such an hardship. Staff received a written request dated March 25,2009 from the Superintendent of Schools,asking that the City consider amending the language of Title XV, Section 155,Signs � (formerly Chapter 14) " . . .to allow for the installation of signs with advertising on the varsity baseball field as a means to generate income for field improvements" (letter dated March 4,2009,Rod Thompson, Superintendent of Schools) . This request would require consideration of amending the following Sections: Section 155.21 GENERAL REQUIREMENTS, (D) Placement of Signs,which states that,"No sign, or attachment to it,may be erected,placed or maintained by any person on rocks,fences,or trees,nor in such a manner as to interfere with any electric lights, power,telephone or telegraph wires,or the supports thereof"; 04212009 Ord Text Amendment Public Hearing.doc Section 155.22 PROHIBITED SIGNS,(B)(13) Signs Affixed Utility Poles and Fences. The signs would advertise local businesses, would be tasteful, and would only be up for a 120 day period during the summer months. We are very fortunate to have one of the premier high school baseball fields in the state of Minnesota. The income generated from the signs will supplement all of the volunteer labor that we receive from the St. Anthony Baseball Association (SABA) and allow us to continue to provide a first class playing field. The varsity field is used by a wide variety of groups—including our town ball team, the St. Anthony Hogs, our senior men's league team—the Norsemen, and several others. With the extensive use of the fields to these groups, we need to continue the high level of maintenance to keep our field in great shape. This is done outside of the school board budget as resources are not available for the level of field maintenance that we have become accustomed to at Palm Field. Back ogr und: Mr. Stephen Peterson, on behalf of the St. Anthony Baseball Association, contacted Staff to request that the City reconsider the Baseball Association's request to post commercial advertising signs on the Palm Field outfield fence in Central Park. Mr. Peterson said the Association had previously discussed this with Staff about a year ago. We informed the Association that the City's ordinance does not allow temporary banners or signs posted on fences. Mr. Peterson reported to Staff that the Association is proposing to ask for a variance to the City's Sign Ordinance. But in reviewing the attorney's opinion from Foster & Brever, it was determined that they will need at least two variances. The School District 282, as property owners, will have to apply for these variances. As part of the variance application, they will have to demonstrate an hardship exists that is unique to their property and this hardship makes it difficult for the property owner to use the property to its greatest potential in order for the variances to be considered for approval. The first variance the School District would have to apply for deals with commercial signs in the Recreation/Open Space Zoning District, which is the zoning designation of the area Central Park and Palm Field are located in. For this variance, the first consideration is Section 1400.07 Prohibited Signs., which states that signs that are not specifically permitted in this Chapter are hereby prohibited. That being stated, Chapter 14 SIGNS does not specifically allow signs in the Recreational/Open Space Zoning District. Also, Central Park is surrounded by single family homes in the adjacent R-1 Zoning District that does specifically restrict signs to one identification sign in the right-of-way frontage and one address sign on the curb (1400.12,Subd. 1 Residential, (1)). The only Zoning District in the City allowed to post commercial signs is Commercial and Limited Business (1400.12, Subd. 2 Commercial and Limited Business). The next variance that the School District will be required to obtain is to Section 1400.06, Subd. Placement of Signs. This subdivision states that no sign, or attachments to it, may be erected, placed or maintained by any person on rocks,fences, or trees. While Mr. Eric Brever, Esq., tries to describe the fence around Palmer Field as a wall (Brever Letter, dated December 6, 2008, page 1, 2nd Paragraph), it is recognized as a chain-link fence (Ibid,3rd Paragraph). Proposal for Signs on Palmer Field Fence 031709.doc The City Code defines fences to mean a partition, structure, wall or gate erected as a dividing marker, barrier, enclosure or visual obstruction, but excluding buildings and bushes, trees and other living landscaping. This ordinance does not differentiate between residential or recreational or commercial fencing; it pertains to all fencing that meets the definition of fences as defined at Subd. 1320.01. Again, Minnesota State Statute states that the applicant for a variance must demonstrate that the property owner's situation is unique and not created by the owner; that as a result of the City's ordinances and strict enforcement, the owner is experiencing an undue hardship and the proposed variance will not change the essential character of the neighborhood. The hardship argument cannot be solely based on economics.
