ELECTRONIC SIGN—WILSHIRE PARK ELEMENTARY SCHOOL 4 5 Assistant City Manager Moore-Sykes presented the staff report on the Conditional Use Permit 6 (CUP)request for electronic signs for St. Anthony Middle School/High School property 7 (SAMS/SAHS) and Wilshire Elementary School. She reported that Linn Bjornrud, Wold 8 Architects and Engineers, contacted staff to ask about the process for obtaining a CUP. He 9 advised that his firm had been hired by ISD 282 to design and install electronic signs at 10 SAMS/SAHS property on 33`d Avenue NE and at Wilshire Park Elementary located at the corner 11 of Highcrest Road and 37th Avenue NE. Staff advised Mr. Bjornrud of the process and the City's 12 sign ordinance regarding electronic signs. Electronic signs are permitted with an approved CUP, 13 flashing and animation are prohibited, and there are restrictions on hours of operation. Mr. 14 Bjornrud indicated that originally, animation had been planned as part of the software program 15 the School District was interested in using for the electronic signs. The School District has since 16 reconsidered and removed the animation from the plan and has decided to add an additional 17 electronic sign for Wilshire Park Elementary School. 18 19 Mr. Linn Bjornrud, Wold Architects and Engineers, addressed the Planning Commission and 20 provided information on the CUP proposal by ISD 282 for electronic signs at SAMS/SAHS and 21 Wilshire Elementary School. He stated rather than pursuing animation capabilities with the sign 22 at SAMS/SAHS the School District has opted to move forward with pursuing a CUP for an 23 electronic message sign allowed through this process, as well as an additional sign at Wilshire 24 Park Elementary School. The design will be the same for both signs; construction details have 25 been provided to the Planning Commission. The size of the sign has been revised to fit within the 26 requirements. The School District believes that the modifications they have made have brought 27 the CUP request within the requirements of the sign ordinance. 28 29 Mr. Bjornrud answered questions of the Planning Commission regarding the construction plans 30 for the proposed electronic message signs. The St. Anthony New Brighton ISD 282 logo will be 31 mounted on the masonry with"halo" back lighting. Separate applications have been submitted 32 for the signs at SAMS/SAHS and Wilshire Park Elementary. The signs will have the same design 33 and the brick on each sign will match the building. The signs will be LED lighting, similar to the 34 City sign. 35 36 Commissioner Jensen suggested it may be helpful to plot the corner visibility triangle on the site 37 plan for Wilshire Park Elementary. Commissioner Heinis concurred. 38 39 Commissioner Jensen commented that the animation statement included in the City Code may be 40 similar to animation included in a software package, which the School District has looked at 41 omitting from the signs. He suggested clarification on this when the CUP comes forward. Chair 42 Stromgren concurred. 43 44 Mr. Bjornrud replied that there was a lot of thought and consideration put into the animation. 45 One thing the School District considered was having the animation capabilities built in even 46 though it may be restricted at this time. It was decided that with the way technology is constantly Planning Commission Regular Meeting Minutes June 16, 2009 Page 3 1 moving, if upon installation of the sign they are not able to use those capabilities it would not be 2 an efficient use of funds. 3 4 Chair Stromgren requested input from staff regarding the proposed sign location at Highcrest 5 Road and 37`'' Avenue. Assistant City Manager Moore-Sykes stated she has discussed the 6 Hennepin County right-of-way in this location with the Public Works Director. Staff will be 7 watching to ensure there is not an encroachment. 8 9 Commissioner Chaput inquired if the School District would consider electronic signage other 10 than LED if the animation that was previously proposed meets the ordinance requirements. Mr. 11 Bjornrud replied he believes the School District would compare the pricing. If there is a minimal 12 cost increase and the technology meets the City ordinance, it is something that could be 13 considered. 14 15 Commissioner Crone inquired if the existing Wilshire Park Elementary sign will remain on the 16 property. Mr. Bjornrud responded in the affirmative. 17 18 Chair Stromgren suggested consideration that if the existing sign at Wilshire Park Elementary 19 remains it would be part of the total sign area allowable,which would put the signage over the 20 limit. 21 22 IX. REPORTS FROM STAFF 27 28 Assistant City Manager Moore-Sykes indicated that the Commission has been provided with the 29 Minneapolis Area Association of Realtors real estate update. St. Anthony is doing a little better 30 than the City of Minneapolis,but the cities are tracing similarly in all the categories. 31 32 XI. COMMUNITY FORUM. 33 34 None. 35 36 XII. INFORMATION AND ANNOUNCEMENTS. 37 38 Commissioner Jensen reported on his presentation to the City Council on the proposed sign 39 ordinance text amendment. He stated the City Council had a fair amount of debate and it was 40 commented that the Planning Commission had discussed revenue generation in their 41 consideration of the text amendment. He pointed out that the conversation of the Commission 42 was more that the Commission was interested in having the signs have some type of a fair time 43 horizon so that if the purchase of the signs is done well by the School District or whoever is 44 administering it, they could achieve some pricing increases. He stated the Council is cutting back 45 the amount of duration time for the signage to the vicinity of three months or tying it to the high 46 school baseball schedule, rather than using the baseball season to include spring, summer and fall Planning Commission Regular Meeting Minutes June 16, 2009 Page 4 1 ball. Commissioner Jensen requested discussion from the Commission on whether there should 2 be formal communication with the Council, or whether each commissioner should discuss it as 3 they see fit at the ordinance readings. 4 5 Chair Stromgren stated the formal response or feedback to the Council was officially done with 6 the recommendation of the Commission. Anything beyond that should happen as individual 7 citizens. 8 9 Commissioner Chaput stated he believes the Commission was respectful of the ordinance as it is 10 written. The Commission purposely limited the area of the signage without limiting the 11 application of those signs, i.e. the football field and the hockey field. The hockey rink does not 12 apply due to the 250-foot limitation. As they go through the exercise of proposing an amendment 13 to the ordinance it would be prudent to be general enough to accommodate other unforeseen 14 uses; this is why he felt compelled not to limit signage to the baseball field. 15 16 XIII. The City's ordinance restricts the height of fences at the building setback or behind to six (6) feet. Mr. Severson reported that he is requesting to be able to replace his 6-foot back fence with an 8-foot back fence. He explained that his property is adjacent to 2916 Silver Lake Court, the owners of which were granted a 2-foot variance in 2008 to install an 8-foot back fence to block out traffic noise and street lights from Silver Lake Road. Mr. Severson indicated that he too, has to deal with the same traffic noise and street light issues from Silver Lake Road. Application Review: Staff provided Mr. Severson with information about the application and approval process for obtaining a variance, including a timeline. He attended a concept review before the Planning Commission to explain his request and receive input from the Commission. Staff received Mr. Severson's submitted a completed application on May 26, 2009. As part of the application process, the applicant is required to provide evidence that discloses facts that are unique to the subject property. Section 152.245 of the City Ordinance outlines the requirements that must be addressed to qualify for a variance and the process by which a variance is granted. Specifically Section 152.245 (C) states that no variance will be granted unless evidence presented supports the following facts: Strict enforcement would cause undue hardship because: The property cannot be put to a reasonable use without the variance. Mr. Severson proposes to replace his back fence with a fence that will be two feet higher than the current fence to act as a barrier to vehicular noise and street lights, maintaining their property values and to continue the City's goal of keeping housing stock that is safe and livable. 07212009 2912 Silver Lake Court PH Fence Variance.doc The circumstances causing the hardship were not created by the owner. The current house was built in 1968, at a time when there were less traffic on Silver Lake Road. Due to the slope of the backyard, the six-foot fence currently in existence is located on the lowest site of the property and is not sufficient to buffer traffic noise or street lights. Mr. Severson is proposing to replace the current fence with an eight-foot fence if a variance is granted. The variance, if granted,will not alter the essential characteristics of the locality. Rebuilding the fence to eight feet high will not be a detriment to the neighborhood and will more in keeping with the essential characteristics of the area. Mr. Severson stated that their neighbor to the northeast has an eight (8) foot fence, for which the City granted a variance. Economic considerations alone are not the basis of the hardship. While the variance if approved,would maintain the value of this property,it is not the only consideration for the property owners. They have expressed a need to have a privacy fence that would reduce the amount of noise and light impacting the enjoyment of their property. The circumstances causing the hardship are unique to the individual lot. The lot is an interior, residential lot built adjacent to Silver Lake Road in 1968. The Severson propose to replace the fence because it is in need of repair and they would like to replace it with a higher fence, similar to the fences of their neighbor,who are also adjacent to Silver Lake Road. While the situation does also affect several neighbors,it is unique to those residential properties along Silver Lake Road. The granting of the variance is in keeping with the spirit and intent of the Zoning Code. The Zoning Code was adopted to protect the health, safety and general welfare of the City and its people. By granting this variance, the Seversons will be able to install an eight foot fence that will provide some level of protection from the noise from the traffic on Silver Lake Road and light shed from the street lights. Action: Pass a recommend to Council to approve or deny the two-foot variance request to the City's Fence Height Ordinance based on the findings of fact as derived from information presented by the applicants and Staff. Communications: Staff received no calls of concerns about the installation of the higher fence. Background: Jed Crichton,T-Mobile,contacted Staff about the process for obtaining a Conditional Use Permit(CUP) to allow for the placement of cell phone antennas on the roof of the Kenzington of St. Anthony, a condominium planned unit development (PUD) at 2601 Kenzie Terrace. Mr. Kruchten reported to Staff that he had met with the Board regarding a telecommunication antenna proposal and the Board agreed to allow the installation of the antenna and related equipment. After receiving approval from the Kenzington Board, Mr. Kruchten met with Staff to further discuss the CUP process. Staff advised Mr. Kruchten of the timeline for the approval process and encouraged him to schedule a concept review of the project. A concept review was held for T-Mobile at the April 21, 2009 Planning Commission meeting. The T-Mobile application was submitted to City and received by Staff on May 18, 2009, with a public hearing scheduled for June 16, 2009. Staff received information from T-Mobile that due to a backup in their workload,T-Mobile wanted to reschedule the public hearing for their application for July 21,2009. The 60- Day Rule expired on July 17, 2009 and a letter was sent to Mr. Kruchten on May 26, 2009, advising him that the City would require an extension to the 60-Day Rule in order to provide a review of the CUP application at a public hearing on July 21, 2009 with the Planning Commission and with City Council action on the Planning Commission recommendation at the July 28, 2009 City Council meeting. Application Review: The applicant has followed the procedure in applying for Conditional Use Permit(CUP) as outlined in Section 152.243 Conditional Use Permits. The applicant needs to respond to the following criterion as part of their application process. These responses will be reviewed by the Planning Commission and the City Council and from which findings will be determined to support the decisions of the Plann_ng Commission and the City Council. Criteria #1 The use is one of the Conditional Uses specifically listed for the district in which the property is located and is not in conflict with the Comprehensive Plan. 07212009 CUP T-Mobile 2601 Kenzie Public Hearing doc Criteria #2 The use will not be detrimental to the health,safety,or general welfare of persons residing or working in the vicinity or to the values of property in the vicinity. Criteria#3 The use will provide a service or a facility, which is in the interest of public convenience and will contribute to the general welfare. Criteria#4 The City Council has specified all conditions, which the Council deems necessary to make the use compatible with other uses in the area. An application for the CUP was made on forms provided by Staff to Mr. Gay, a T-Mobile representative working with Mr. Kruchten. The application was signed and dated and the fee in the amount as specified in Chapter 33 of the City Code was attached to the competed application. The public hearing notice for the July Planning Commission meeting was published in the City's legal newspaper and notices were mailed to property owners adjacent to the property,according to Sections 30.45 through 30.48. The application is scheduled for the July 28,2009 City Council meeting for consideration. The CUP application be reviewed and considered with the following items also in mind: A. Generally. Unless it is a permitted use in accordance with §90.05, a tower or WRF shall be permitted only if a conditional use permit(CUP) has been issued for that use by the City Council. The following provisions shall govern the issuance of a CUP for towers or WFTs by the City Council. 1. In granting a CUP, the City Council may impose conditions to the extent necessary to minimize any adverse effect of the proposed tower or WTF on adjoining properties. 2. Any information of an engineering nature that the applicant submits,whether civil, mechanical,or electrical,shall be certified by a licensed professional engineer. B. Towers &Wireless Telecommunication Towers. 1. A scaled site plan clearly indicating the location, type, and height of the proposed tower, on-site land uses and zoning, adjacent land uses and zoning, adjacent roadways, proposed means of access, setbacks from property lines,elevation drawings of the proposed tower and any other structures, topography,parking, and any other information deemed by the City Staff to be necessary to access compliance with Section§90.04. 2. The legal description of the subject property on which the proposed tower is to be constructed. 3. The setback distance between the proposed tower and the nearest residential property. 4. The separation distance from other towers and the type of construction for the existing towers and the identity of the owners/operators of the existing towers. 5. Landscape plan showing specific landscape materials. 6. Method of fencing,finished color, and if applicable, the method of camouflage. 7. Staff advised Mr. Bjornrud of the process and the City's sign ordinance at 155.29 DISTRICT SCHEDULES, (D), states that while electronic signs are permitted with an approved CUP in a Recreational/Open Space Zoning District; flashing and animation are not permitted (2)(a);and hours of operation are restricted (2)(b). Application Review and Analysis: Mr. Bjornrud appeared before the Planning Commission at a concept review during the April 21St Planning Commission meeting to present the School District's electronic sign proposal. The School District's initial request included animation as part of the software program for the electronic sign. At the concept review, the Planning Commission advised Mr. Bjornrud that the proposed animation was not an allowable feature as per the Sign Ordinance and has since been removed from the School District's proposal and application. As part of the application, Mr. Bjornrud indicated that the proposed electronic sign will replace the two (2) signs that existed previously; one identified the St. Anthony Middles School and one identified the St. Anthony High School. One double-sided electronic sign will be used by both schools to communicate events to the community. 1. The requested conditional use is one of the Permitted Conditional Uses specifically listed for the zoning district in which the conditional use is located.
