PLEDGE OF ALLEGIANCE. 14 15 Chair Jensen invited the Commission and the audience to join him in the Pledge of Allegiance. 16 17 III. ROLL CALL. 18 19 Commissioners Present: Chairperson Jensen; Commissioners Niccum Cincoski, Heinis,Jenson, 20 Crone, and Chaput. 21 Absent: None. 22 Also Present: Assistant City Manager Kim Moore-Sykes. 23 24 IV. APPROVAL OF MEETING AGENDA. 25 26 Motion by Commissioner Crone, second by Commissioner Jenson, to approve the Planning 27 Commission Meeting Agenda of November 17, 2009. 28 29 Motion carried unanimously. 30 31 V. APPROVAL OF MEETING MINUTES 32 33 Commissioner Crone requested that the minutes be amended to include the discussion on 34 assisted living and skilled/nursing care under the Autumn Woods, Assisted Living Project 35 Concept Review discussion. 36 37 Following a review of the September 15, 2009 Planning Commission meeting 38 webstream, the following text will be added to the September 15, 2009 minutes: 39 Commissioner Crone asked if there are long-term plans to build skilled care units on site. 40 She commented on the possible scenario of a couple moving from an independent 41 apartment to assisted living,with either both of one of them needing more skilled care. 42 Mr. Bronk replied that this has not been determined yet. In some of their 75 unit 43 properties, LaNel Group has converted some units to care suites. The issue in this 44 location is that the building will likely be limited to 50 to 55 units due to the constraints 45 with the size of the building and the land. He indicated that LaNel Group will investigate 46 the possibility of including some care suites in replacement of 2 bedroom units. 47 48 Commissioner Crone stated her support of couples having the ability to remain together 49 with the option for skilled care at this location. She verified with Mr. Bronk that it is not • Planning Commission Regular Meeting Minutes November 17, 2009 Page 2 1 in the long term plans at this time to build a separate skilled care building in this location 2 due to land constraints. 3 4 Chair Jensen requested the following correction to page 4, line 17: "...to have a an approval 5 tool..." 6 7 Motion by Commissioner Jenson, second by Commissioner Chaput, to approve the September 8 15, 2009 Meeting Minutes as amended above. 9 10 Motion carried unanimously. 11 12 VI. CODE ENFORCEMENT REPORT 31 32 Fire Chief Malenick presented the St. Anthony City Code Enforcement Activity Third Quarter 33 2009 Report. In addition to the report on code enforcement activity, he noted major code changes 34 and the re-codification were completed in 2009. He stated most significant was the adoption of 35 the International Property Maintenance Code to supplement the Housing Code. He noted that the 36 City is in the second year of the Rental Property Inspection Program. 37 38 Fire Chief Malenick provided the following information in response to questions of the Planning 39 Commission. 40 • The increase in complaints regarding garbage cans is likely due to the issue being 41 highlighted with the ordinance amendment that allowed for garbage cans to be stored in 42 front yards. 43 • The International Property Maintenance Code draws on past court rulings which 44 facilitates the court system process. 45 9 The annual report to the City Council will include a tally of the enforcement categories. Planning Commission Regular Meeting Minutes November 17, 2009 Page 3 1 • Inspectors respond to issues such as long grass with a notice left at the property. 2 Enforcement efforts increase if there is not a response to the violation. 3 • Many of the enforcement activity relates to housing type issues, such as home and lawn 4 maintenance. This may be attributed to the economy and the amount of foreclosed 5 homes. 6 7 X.2. REVIEW OF ZONING ORDINANCE REVISIONS 8 9 Assistant City Manager Moore-Sykes reported on the status of the following revisions suggested 10 by staff, residents, the City Attorney and Planning Commissioners in July 2005 as outlined in the 11 November 17, 2009 memorandum to the Planning Commission, noting that many of the issues 12 have been resolved by ordinance amendments or the re-codification of the City Code. 13 • Amend Section 1660 14 • Accessory Uses 15 • Customary Home Occupations 16 • Non-Commercial Opinion Sign Ordinance 17 • Amend Section 810.03 to include language allowing native prairie plants 18 • Amend PUD to include smaller areas than the 3 acre minimum 19 20 Assistant City Manager Moore-Sykes reported on the status of the following items that have 21 been considered in the past: 22 • Electronic Gas Pricing Sign: The City continues to prohibit the use of electronic gas 23 pricing signs. 24 • Eight-foot fences: The fence height of six feet remains unchanged in the updated and 25 revised City Code. The Planning Commission reviewed proposed changes to the City 26 Code to increase the fence height to eight feet. 27 • Egress Windows: Two years ago, the Planning Commission reviewed a proposed change 28 to allow egress windows as an allowable encroachment into the setbacks providing that 29 the rights-of-way were preserved. The Planning Commission recommended the proposed 30 change to the City Code and the City Council approved the ordinance changes regarding 31 egress windows. 32 33 Chair Jensen asked if staff has a work program relating to issues raised by the Planning 34 Commission or if this would relate primarily to code or zoning issues raised by the Commission. 35 Assistant City Manager Moore-Sykes replied that the work plan would primarily relate to issues 36 relating to the City Code raised by the Planning Commission, City Council or staff. She noted 37 the Planning Commission would generally address these issues first if it involves land use or 38 zoning issues. 39 40 Chair Jensen suggested a discussion on the open Zoning Ordinance revision items during the 41 joint City Council/Planning Commission that will likely be scheduled in early 2010. He noted 42 over the past several years he has suggested amending the PUD to include smaller areas than the 43 three-acre minimum. He pointed out that with redevelopment it is becoming clear in other 44 communities that three acres is likely a little large. He commented that the three-acre threshold 45 may not be met in the parcels that are likely to be developed in St. Anthony over the next several 46 years. V ` Planning Commission Regular Meeting Minutes November 17, 2009 Page 4 1 2 Chair Jensen suggested that the December Planning Commission meeting agenda include an 3 update on Planning Commission recommendations that have not progressed to date. Assistant 4 City Manager Moore-Sykes noted one issue that reoccurs is the electronic gas pricing sign. 5 6 Chair Jensen commented it would be wise to look at what is happening immediately outside the 7 border and the trends that may make those businesses successful and hinder St. Anthony 8 businesses. Commissioner Jenson pointed out that there are now electronic signs at schools in the 9 City. 10 11 Commissioner Chaput inquired about the opposition to electronic signs. Commissioner Jenson 12 noted concerns related to height, illumination and frequent flashing. 13 14 Commissioner Chaput commented it may be interesting to see the feedback from residents 15 around the City with the signs that have been approved for the schools. 16 17 XI. INFORMATION AND ANNOUNCEMENTS. 22 23 X11.1 CODE ENFORCEMENT REPORT 24 25 Assistant City Manager Moore-Sykes informed the Planning Commission that the League of 26 Minnesota Cities Loss Control Staff will be present at the January 19, 2010 Planning 27 Commission meeting to provide a presentation on Land Use Ground Rules. 28 29 XH.2. GTS 30 31 Assistant City Manager Moore-Sykes reported that the Government Training Service(GTS) 32 provides training sessions for new and experienced Planning Commissioners on various Land 33 Use Planning and Zoning issues. For new commissioners,two sessions,Basics of Planning and 34 Zoning, and Beyond the Basics of Planning and Zoning, are presented at the beginning of the 35 year and are highly recommended. The Commission will be provided with the 2010 schedule 36 when it is available. 37 38 Chair Jensen asked if there are applicants for the upcoming Planning Commission vacancy. 39 Assistant City Manager Moore-Sykes replied that two additional applications have been 40 submitted. If successful in obtaining a Conditional Use Permit from the City of St. Anthony,this location will be part of a multi-year network build-out plan. Clearwire is currently working to acquire sites throughout the Minneapolis/St.Paul area. In addition to this site at 4001 Stinson Boulevard,Mr.Viera is working with the City to get administrative approval for an antenna co-location on the City's water tower. Mr.Viera agreed to have the Clearwire proposal for Silver Lake Plaza placed on the December Planning Commission agenda for a concept review. Installation plans have been included with this Staff Report for the Commission's review. Mr.Viera is planning to have the proposal brought back to the January Planning Commission meeting for a Public Hearing to consider Clearwire Communications request for a Conditional Use Permit. Action: None required at this time. The antenna complies with all applicable federal regulations; and 3. The antenna complies with all applicable building codes. (b) Antennas on existing towers. Any WTF which is proposed to be attached to an existing tower may be administratively approved by the City Manager and,to minimize adverse visual impacts associated with the proliferation and clustering of towers, collocation of antennas by more than 1 carrier on existing towers shall take precedence over the construction of new towers,provided the collocation is accomplished in a manner consistent with the following: a tower which is modified or reconstructed to accommodate the collocation of an additional antenna shall be of the same tower type as the existing tower, unless the City Manager allows reconstruction as a monopole. (1993 Code, § 1680.05) Penalty, see § 10.99 § 90.06 PERMITTED CONDITIONAL USES. 400 l (A) Generally. Unless it is a permitted use in accordance with § 90.05, a tower or WTF shall be permitted,only-&w-condliioaal'rustr=pii tvhws b=ussued forthatsuaeby.ethe4Oty;Cottnc4 The following provisions shall govern the issuance of conditional use permits for towers or WTFs by the City Council. (1) Applications for conditional use permits under this section shall be subject to the procedures and requirements of Chapter 152, except as modified in this section. (2) In granting a conditional use permit,the City Council may impose conditions to the extent necessary to minimize any adverse effect of the proposed tower or WTF on adjoining properties. (3) Any information of an engineering nature that the applicant submits, whether civil, mechanical, or electrical, shall be certified by a licensed professional engineer. (4) An applicant for a conditional use permit shall submit the information described in this section and a nonrefundable fee as established by resolution of the City Council to reimburse the city for the costs of reviewing the application. (B) Towers. In addition to any information required for applications for conditional use permits pursuant to Chapter 152, applicants for a conditional use permit for a tower shall submit the following information: (1) A scaled site plan clearly indicating the location, type, and height of the proposed tower, on-site land uses and zoning, adjacent land uses and zoning, adjacent roadways,proposed means of access, setbacks from property lines, elevation drawings of the proposed tower and any other structures,topography,parking, and other information deemed by the city staff to be necessary to assess compliance with this section; (2) The legal description of the property on which the proposed tower is to be constructed; Wireless Telecommunication Towers 11 (3) The setback distance between the proposed tower and the nearest residential property; (4) The separation distance from other towers and, if known,the type of construction of the existing tower(s) and the identity of the owner(s)/operator(s)of the existing tower(s); (5) A landscape plan showing specific landscape materials; (6) Method of fencing, and finished color and, if applicable,the method of camouflage; (7) A statement of compliance with all applicable federal, state, or local laws; (8) A notarized statement by the applicant as to whether construction of the tower will accommodate collocation of additional antennas for future users; (9) A description of the suitability of the use of existing towers, other structures, or alternative technology not requiring the use of a tower or new structure to provide the services to be provided through the use of the proposed new tower; and (10) A description of the feasible location(s)of future towers or WTFs within the city based upon existing physical, engineering,technological, or geographical limitations in the event the proposed tower is erected. (C) Factors considered in granting conditional use permits for towers. In addition to any standards for consideration of conditional use permit, applications pursuant to Chapter 152, the City Council shall consider the following factors in determining whether to issue a conditional use permit, no 1 of which shall be conclusive, although the City Council may waive or reduce the burden on the applicant of 1 or more of these criteria if city staff or City Council concludes that the goals of this chapter are better served thereby: (1) Height of the proposed tower; (2) Proximity of the tower to residential structures and residential district boundaries; (3) Nature of uses on adjacent and nearby properties; (4) Surrounding topography; (5) Surrounding tree coverage and foliage; (6) Design of the tower,with particular reference to design characteristics that have the effect of reducing or eliminating visual obtrusiveness; (7) Proposed ingress and egress; and 12 St.Anthony- General Regulations (8) Availability of suitable existing towers, other structures,or alternative technologies not requiring the use of towers or structures. (D) Existing facilities. No new tower shall be,permitted unless the applicant demonstrates, to the reasonable satisfaction of the City Council, that there is no existing tower, structure, or alternative technology not requiring a tower or structure that can accommodate the applicant's proposed WTF or tower. An applicant shall submit information requested by the City Council related to the availability of suitable existing towers,other structures,or alternative technology. Evidence submitted to demonstrate that no existing tower, structure,or alternative technology can accommodate the applicant's proposed WTF may consist of any of the following. (1) No existing tower or structure is located within the geographic area that meet applicant's engineering requirements. (2) Existing towers or structures are not of sufficient height to meet applicant's engineering requirements. (3) Existing towers or structures do not have sufficient structural strength to support applicant's proposed WTF and related equipment. (4) The applicant's proposed WTF would cause electromagnetic interference with 1 or more WTFs on existing towers or structures, or a WTF on the existing towers or structures would cause interference with the applicant's proposed WTF. (5) The fees, costs, or contractual provisions required by the owner in order to share an existing tower or structure or to adapt an existing tower or structure for sharing are unreasonable. Costs exceeding new tower development are presumed to be unreasonable. (6) The applicant demonstrates that there are other limiting factors that render existing towers and structures unsuitable. (7) The applicant demonstrates that an alternative technology that does not require the use of towers or structures, such as a cable microcell network using multiple low-powered transmitters/receivers attached to a wireline system, is unsuitable. Costs of alternative technology that exceed new tower or antenna development shall not be presumed to render the technology unsuitable. (E) Separation. All towers for which a conditional use permit is required shall be separated by a minimum of 750 feet between the proposed tower and any pre-existing tower;provided, however,that the City Council, after considering any recommendations of city staff, may reduce the standard separation requirements if the purposes of this chapter would be better served thereby. The separation distance shall be measured by drawing or following a straight line between the base of the existing tower and the proposed base,pursuant to a site plan,of the proposed tower. (1993 Code, § 1680.06) , Wireless Telecommunication Towers — r _7_VcA_R-V— 9 § 90.05 PERNUTTED USES/ADMINISTRATIVE APPROVAL. (A) Towers and WTFs shall be a permitted use in a light industrial district, as described in Chapter 152, and on city-owned property. T Ys,�nd-%FIT§pffprosed-, a-light-industnaigdistrict-or on�city- 1owned_:prtperty-mayobeadministrati%lyapprovedo (B) The following provisions shall govern the issuance of administrative approvals for towers and WTFs. (1) Each applicant for administrative approval shall submit an application to the City Manager providing the information set forth in§ 90.07,when applicable, and a nonrefundable fee as established by resolution of the City Council to reimburse the city for the costs of reviewing the application. (2) The City Manager shall review an application for administrative approval of a tower or WTF and determine if the proposed use complies with this chapter. (3) The City Manager shall respond to each such application within 60 days after the filing of the application by either approving or denying the application. If the City Manager fails to respond to the applicant within 60 days,then the application shall be deemed to be approved,unless the time has been extended under M.S. § 15.99,as it may be amended from time to time. (4)_ In connection with any such administrative approval,the City Manager may, in order to encourage hared use,or the use of alternative tower structures, adminstratively-waive or modify any- zoning district setback requirements in or separation distances between towers by up to 50%. (5) If an administrative approval is denied, the applicant may file an appeal to the City Council. Any appeal must be filed by the applicant within 30 days of the receipt of the City Manager's decision. (C) The following uses may be approved by the City Manager after conducting an administrative review: (1) Locating a tower or WTF, including the placement of additional buildings or other supporting equipment used in connection with a tower or WTF, in any light industrial district or on city-owned property; and/or (2) Locating antennas on existing structures or towers consistent with the terms of divisions (C)(2)(a) and(C)(2)(b)below: (a) Antennas on existing structures. Any WTF proposed to be affixed to an existing building or structure may be approved by the City Manager as an accessory use to the building or structure,provided: 1. The antenna does not extend more than 30 feet above the highest point of the building or structure;
