CLEARWIRE CUP REQUEST Planning Commission Regular Meeting Minutes December 15, 2009 Page 2 1 2 Assistant City Manager Moore-Sykes presented the staff report on the Conditional Use Permit 3 (CUP) request for Clearwire Communications, LLC. Mr. Rob Viera, Buell Consulting, Agent for 4 Clearwire Communications, LLC, contacted staff about the process for obtaining a CUP to allow 5 for the placement of high-speed wireless Internet antennas on the roof of the Silver Lake Plaza 6 building(formerly the Apache Medical building) located at 4001 Stinson Boulevard. If 7 successful in obtaining a CUP from the City of St. Anthony, this location will be part of a multi- 8 year network build-out plan. Clearwire is currently working to acquire sites throughout the 9 Minneapolis/St. Paul area. In addition to this site, Mr. Viera is also working with the City to 10 obtain administrative approval for an antenna co-location on the City's water tower. Assistant pp Y 11 City Manager Moore-Sykes stated that the Planning Commission has been provided with the 12 Clearwire antenna installation plans for review. 13 14 Mr. Rob Viera, Buell Consulting representing Clearwire Communications, LLC, addressed the 15 Planning Commission and provided information on the CUP request outlined above. Mr. Viera 16 provided an overview of the installation plans and presented photo simulations of the proposed 17 antenna placement. Mr. Viera answered questions of the Planning Commission on the CUP 18 request. He stated the panel antennas are approximately four feet tall by one foot wide. Further 19 information will be provided in relation to the DAP at the public hearing in January. A base unit 20 that is approximately 4 %2 feet by 2 Meet will be located on the rooftop. Mr. Viera stated the 21 range of coverage is approximately '/z to 2/3 of a mile. Clearwire has just started acquiring sites 22 in the Twin Cities area a few months ago. He stated installations will begin in 2010 and FCC g � 23 regulations are adhered to. There is not adequate space to locate the Clearwire antennas at the T- 24 Mobile and Sprint tower location at 4001 Stinson Blvd. Mr. Viera explained that there is 25 virtually no radiation at the ground level; however the engineer will be present at the public 26 hearing to answer additional technical questions concerning radiation in relation to the building 27 being occupied. 28 29 Chair Jensen noted if the dimensions at the time of installation were to go outside of the range 30 included in the submitted work drawings an amendment to the CUP would be required. Mr. 31 Viera indicated if the dimensions were to change the construction drawings could be amended 32 prior to pulling the building permits. 33 34 Mr. Viera indicated that the target audience of Clearwire will be anyone that utilizes the Internet, 35 including businesses and individual consumers. The Internet service will be sold as a Clearwire 36 product. It was noted that this will be a Wi-Max system, which is made for a larger geographical 37 area than Wi-Fi. 38 39 Chair Jensen requested Mr. Viera to contact staff with any additional graphics. He noted the 40 request of the Commission that the applicant provide an engineering summary of the radiation 41 impact at the public hearing on the CUP request. 42 43 IX. OTHER BUSINESS. 44 45 IX.I. Staff advised Mr.Viera of the CUP requirements and public hearing process as described in the City's ordinance Title IX, Chapter 90, WIRELESS TELECOMMUICATIONS TOWERS,Subdivision §90.06, PERMITTED CONDITIONAL USES. In addition to this site at 4001 Stinson Boulevard, Mr. Viera is working with the City to get administrative approval for an antenna co-location on the City's water tower. Application Review and Analysis: Mr. Viera presented the Clearwire Communications proposal for Silver Lake Plaza Building in a concept review at the December 15,2009 Planning Commission meeting. Installation plans and photos indicating the proposed location of the high-speed wireless Internet antennas were included with the Staff Report for the Commissions review. The Planning Commission did question Mr.Viera about the wireless Internet technology and installation. Mr. Viera responded that he would have an engineer at the public hearing to respond to the technical questions. Mr.Viera has provided additional information in response to the following CUP conditions and requirements. 1. The requested conditional use is one of the Permitted Conditional Uses specifically listed for the zoning district in which the conditional use is located. City Code states in§90.05(A) of the City Code that towers and wireless telecommunication facilities are permitted with administrative 01192010 PH Clearwire Communications CUP.doc approval if sited in the Industrial Zoning District or on City property. Siting in other zoning districts requires a CUP based on the requirements stated in§90.06, PERMITTED CONDITIONAL USES. Mr. Viera reported that Clearwire Communications,LLC, is proposing to install high-speed wireless Internet antennas on the roof of the Silver Lake Plaza building at 4001 Stinson Boulevard. 2. That the requested conditional use permit will not be detrimental to health, safety or general welfare of persons residing or working in the vicinity or injurious to property values of improvements in the area. Mr. Viera stated that other communications companies currently have antennas installed on the roof of the Silver Lake Plaza building. He also indicated that the radiation levels associated with the high-speed antennas negligible to anyone in the building and on the ground that there is no danger to the general public. He did indicate that technicians working directly with the antennas do wear protective clothing. 3. The requested Conditional Use Permit is considered necessary or desirable at the subject location to provide a service or a facility which is in the interest of public convenience and will contribute to the general welfare of the neighborhood or community. Mr. Viers stated that this location is desirable for this type of high-speed Internet antennas because of the height associated with the proposed location. The high-speed Internet service provided by Clearwire Communications uses the bandwidth that is at this height. When asked about any radiation threat to those in the building and Mr.Viera responded that because the bandwidth is at this height and is not directed toward the building or the ground,there is virtually no danger to anyone in the building,on the ground or living in the area. He again suggested that he would have an engineer at the public hearing to provide more technical information regarding these types of questions. The proposed rooftop placement of the antenna was approved with the owner of the Silver Lake Plaza building. Attached is a copy of a letter received from the owner advising the City of the negotiated agreement with Clearwire Communications for the placement of antennas on the rooftop. Conditions of the CUP: 1. The antenna(s) does not extend more than 30 feet above the highest point of the building or structure. 2. The antenna(s) complies with all applicable federal regulations. 3. The antenna(s) complies will all applicable building codes. 4. The installation of the antenna(s) will be done in such a manner as to minimize any adverse effect of the proposed antenna(s) to adjoining properties. Communications: Staff has received no phone calls or emails regarding the installation of the proposed high- speed Internet antennas for this location. Action: Recommendation from the Planning Commission for CUP application for 4001 Stinson Boulevard. Minnesota State Statutes require that any land use or zoning applications, such as yours, be approved or denied by the governing body within 60 days of receipt of a completed application. From this date forward, the City, according the 60-Day Rule, has 60 calendar days to approve or deny your request. The 60 days for your request expire on February 16, 2010. The Planning Commission will make their recommendations, which will be presented to the City Council at their meeting scheduled for January 26, 2010 at 7:00pm. While the City Council is expected to make a decision on your Conditional Use Permit application at this time, Minnesota Statute does allow the City to request, in writing, an additional 60 days should it become apparent that the original 60 days are not sufficient to process your application. Nothing is anticipated at this time that would cause a delay, but again, you will be notified in writing if additional time to issue a final decision on your request is needed by the City.
