AMENDMENT TO THE PUD SIGN PLAN FOR SILVER LAKE VILLAGE. 9 —TABLED AT MAY 25, 2010 COUNCIL MEETING; REMANDED BACK TO 10 PLANNING COMMISSION TO REVIEW AND CONSIDER CHANGES TO 11 PROPOSAL FOR AMENDMENT. 12 13 Assistant City Manager Moore-Sykes provided background information on the proposed PUD 14 Amendment for the Silver Lake Village Sign Plan. She outlined the discussion and action taken 15 at the May 18, 2010 Planning Commission meeting. Assistant City Manager Moore-Sykes 16 stated the modifications as recommended by the Planning Commission were reviewed by the 17 City Council at the regularly scheduled Council meeting on May 25, 2010. After discussion, the 18 City Council voted to table the request until the June 22, 2010 Council meeting. Council asked 19 the Planning Commission to review new revisions to be presented to the Planning Commission at 20 the regularly scheduled June 15, 2010 meeting. The Council further asked that the Planning 21 Commission submit a single resolution with additional findings and their revised 22 recommendations. 23 24 Assistant City Manager Moore-Sykes advised that the revised sign plan from Doran 25 Construction, LLC shows plans for one new ground sign adjacent to Wendy's on the Wal-Mart 26 Tract and an existing modified ground sign in front of Smashburger. It also shows a modified 27 Cub sign that has been reduced in height from 26 feet to 24 feet. 28 29 Chair Jensen noted for the record that the revised plan no longer includes a directional sign. 30 31 Mr. Dale Wenkus, Vice President of Architecture with Doran Companies, addressed the 32 Planning Commission and stated that the revised plan is a compromise that has taken into 33 consideration requests of the City Council and comments of the Planning Commission. The 34 directional sign seemed to add questions and concerns and was eliminated from the plan 35 amendment. The Cub sign has been reduced from a height of 26 feet to 24 feet. 36 37 Commissioner Heinis inquired about the height of the current Cub sign. Mr. Wenkus replied that 38 the sign is currently 20 feet tall. Mr. Wenkus replied 43 that it would be difficult to modify the sign due to the structural support within the brick. He 44 commented that the brick and stone within the shopping center and on the sign provide a 45 residential/light commercial feel, and that the additional height will make the sign more in 46 balance with the size of the base. i Planning Commission Regular Meeting Minutes June 15, 2010 Page 3 1 2 Commissioner Crone noted that it was stated at the previous Planning Commission meeting that 3 there are businesses that are not interested in moving into Silver Lake Village because they are 4 not able to have a sign out front. She questioned what businesses these are and if the current 5 request meets the applicants needs without the directional sign. Ms. Brenda Thomas, Vice 6 President of Property Management with Doran Companies, replied that there are no specific 7 examples of a business not coming to the center because they are not able to have a sign. The 8 signage is a good marketing piece for the center to be able to offer. 9 10 Chair Jensen suggested the possibility of listing different business names on opposite sides of the 11 sign, which would create an opportunity for 12 new names in the six new spaces. 12 13 Commissioner Chaput requested clarification on whether the proposed sign plan amendment will 14 meet the future needs of the applicant. Mr. Wenkus replied that the feeling now is yes. This 15 provides options for potential new tenants as well as existing tenants. It will greatly help with 16 the current needs at the center. He stated the market is demanding more visibility. As much as 17 the landscaping that was done is appreciated, it is difficult to see the signs on the buildings 18 through the trees. 19 20 Commissioner Crone thanked the applicant for continuing the landscaping around the new 21 monument sign. 22 23 Chair Jensen asked if the applicant has comments on the proposed motion before the Planning 24 Commission. Mr. Wenkus noted corrections to the square footage of each sign and the proposed 25 cap for the Cub sign included in the proposed motion. 26 27 Motion by Commissioner Chaput, second by Commissioner Niccum, to recommend approval of 28 the revised signage plan, dated June 7, 2010, and as proposed by Doran Companies, LLC for 29 Silver Lake Village incorporating one (1)new ground sign, nine(9) feet high with 48 SF of sign 30 copy(each side) to be located at 3800 Silver Lake Road; to modify an existing ground sign, nine 31 (9) feet high and increasing the sign copy to 48 SF (each side), located at 3900 Silver Lake Road; 32 and modifying the existing Cub Foods sign to increase its height to twenty-four(24) feet so as to 33 accommodate an addition of a fifty-two (52) SF sign copy(each side). All signs that are made 34 part of this motion are proposed to have installed as part of a cohesive design element, a twelve 35 (12) inch cap for each ground sign. A recommendation to approve includes the above-referenced 36 design. Date Application Received: June 22,2010 Property Address: 3701 Stinson Boulevard Zoning District: Commercial 60-Day Expires: August 20, 2010 Waiver Letter Required: Yes_ Date Sent:_ No X Future Action: Public Hearing for CUP with the Planning Commission Back,,ground: Staff met with Mr. Terry Abney of Abney Development Services,Inc.,consultant for International House of Pancakes restaurants to discuss the possibility of locating an IHOP restaurant at 3701 Stinson Boulevard. This site was previously the location of Baker s Square restaurant that closed in 2009. Mr. Abney's architecture team provided Staff with drawings of the proposed changes needed to accommodate locating an IHOP restaurant at this location. Staff advised Mr. Abney of the need to obtain a conditional use permit(CUP) because the restaurant is located within 250 of a residential structure or district (City Code 152.122, (P)J. The Bakers Square restaurant was originally constructed in 1971 as the Poppiri Fresh Pies restaurant. No CUP was required at the time the original restaurant was constructed. Since then, the City has adopted Section 152.122, (P) that requires that restaurants, cafeterias, and delicatessens that are uses allowed in the Commercial Zoning District but are located less than 250 feet from a residential structure or district, to obtain a conditional use permit from the City Council. Staff advised Mr. Abney of the CUP requirements and public hearing process as described in the City's Ordinance, Section 152.243. Application Review and Analysis: Mr. Abney arid-his team have provided additional information in response to the following CUP conditions and requirements. 1. The requested conditional use is one of the Permitted Conditional Uses specifically listed for the zoning district in which the conditional use is located. City Code states in 152.122 (P) that restaurants, cafeterias, and delicatessens located less than 250 feet from a residential structure or district are required to have a Conditional Use Permit. 07202010 IHOP 250 feet residential dist CUP.doc 2. That the requested conditional use permit will not be detrimental to health, safety or general welfare of persons residing or working in the vicinity or injurious to property values or improvements in the area. Since this building and use have not changed since 1971 when the Poppin' Fresh Pies restaurant was opened, there has been no incident in which the use has been documented as detrimental to the health, safety or general welfare of persons residing or working in the vicinity or injurious to property values or area improvements. It can be argued that the restaurant being located in this area is perceived as beneficial to area redevelopment efforts. The residential properties that are impacted by the close proximity of this restaurant are the Landings, that was constructed as part of the mixed use PUD redevelopment project of Silver Lake Village in 2004, and the apartments located on the west side of Stinson Boulevard, in Columbia Heights. 3. The requested Conditional Use Permit is considered necessary or desirable at the subject location to provide a service or a facility which is in the interest of public convenience and will contribute to the general welfare of the neighborhood or community. The requested CUP is considered desirable at the subject location. Bakers Square and Poppin Fresh Pies before it,was considered a community gathering place, where people would gather for a piece of pie and coffee or lunch. When Bakers Square closed, City staff received several calls from residents stating how disappointed they were with the closure. Since the public hearing notices have gone out to surrounding properties, staff has again received several phone calls asking about the project and the callers have all been positive in their comments about the proposed opening of the IHOP restaurant. Conditions of the CUP: 1. Garbage areas must be enclosed with materials that match buildings. 2. Lighting must be"down spill" with no spillage to affect the adjacent residential properties. 3. No music or other artificial noise shall be audible from the restaurant to adjacent residential properties. 4. The remodel and redevelopment of the property shall conform as closely as possible and practicable to The Village at St. Anthony design standards. Communications: Staff has received 6 phone calls in favor of the approval of the CUP for IHOP. Action: Recommendation from the Planning Commission for approval of the CUP application for 3701 Stinson Boulevard, for a Restaurant Located within 250 Feet of a Residential Structure or District. Mr. Abney was notified that a drive-through use also requires a conditional use permit. Mr. Abney advised Staff that the drive-through facility would only be for the ordering of coffee,smoothies, pastries and some take-out orders. He reported that this is a new idea for IHOP and it is being proposed for the St. Anthony site because the existing restaurant building has a smaller seating capacity so it is an opportunity to try this idea. There would be a small menu board next to the window for beverages and pastries. He also indicated that the take-out orders would have to be called in, similarly to the "Carside to Go" concept of another restaurant chain. Application Review and Analysis: 1. The requested conditional use is one of the Permitted Conditional Uses specifically listed for the zoning district in which the conditional use is located. City Code states in 152.122 (B) that the use is permitted under 5152.121 except for the fact that the use has a drive-through facility 2. That the requested conditional use permit will not be detrimental to health, safety or general welfare of persons residing or working in the vicinity or injurious to property values of improvements in the area. There was a concern voiced about vehicles exiting directly onto Stinson Boulevard-from the-drive-through. Since this is a-commercial district for two-cities,-Columbia Heights and St. Anthony, cars are driving directly into and out of several businesses along Stinson Boulevard. The applicant does not feel this will have a large impact on traffic because they are not offering a large drive-through menu. There are several intersection controls in place at 37`h and Stinson and at 39`h and Stinson so that are enough opportunities for vehicles exiting the drive-through to keep the traffic flow consistent, regardless if a vehicle is turning left or right. 07201020 [HOP Drive Thru CUP.doc 3. The requested Conditional Use Permit is considered necessary or desirable at the subject location to provide a service or a facility which is in the interest of public convenience and will contribute to the general welfare of the neighborhood or community. The applicant does see the drive-through as desirable for the community and a facility which is in the interest of public convenience. Drive-throughs at coffee shops and restaurants have become an essential service for the commuting society. Since the public hearing notices have gone out to surrounding properties, staff has received a phone call in favor of the drive-through window and no calls against the concept. There are also a few restaurants in the Silver Lake Village PUD that do utilize a drive-through facility to augment their businesses. These businesses include Applebee's, Wendy's, and Culver's. Conditions of the CUP: 1.) No canopy over the drive-thru. 2.) Orient the traffic to a one-way flow pattern to minimize potential traffic conflicts. 3.) Hours of Operation will be limited to opening to an hour before closing. 4.) Positioning the driveway to limit and/or prevent headlights from shinning into residential neighborhoods. Communications: Staff has received no phone calls or emails in opposition to the drive-through proposal. Following is brief summary of our Scope of Work: 1. Replace all Mechanical, Electrical & Plumbing components including new kitchen equipment and seating. A small addition at the northwest corner of the building will add a few seats. 2. Upgrade all finishes to new IHOP finishes on the interior and exterior of the building. 3. Add new IHOP signs on the building and in the parking area. 4. Provide additional yard lighting. 5. Install grease trap. 6. Enhance landscaping. 7. Rebuild the trash enclosure. 8. Overlay the existing asphalt. As a precaution, is it possible to consider a variance for the building location in the event of a fire at some point in the future? We would like address this issue in the appropriate meeting agenda.
