Chair Jensen also agreed to attend if necessary. 43 44 VII. PUBLIC HEARINGS. 45 46 1. SIGN PLAN AMENDMENT(AND SITE PLAN UPDATE)—2912 PENTAGON 47 DRIVE, ST. ANTHONY SHOPPING CENTER 48 49 Chair Jensen opened the public hearing at 7:07 p.m. Planning Commission Regular Meeting Minutes September 20, 2011 Page 2 1 2 Assistant City Manager Moore-Sykes presented the staff report. 3 4 Chair Jensen explained that this matter is a public hearing because the request is an amendment 5 to the existing sign plan for the shopping center. He asked if the proposed amendment represents 6 an increase to the overall square footage allowed for the sign area. 7 8 Mr. Greg Kozulla, Kozulla&Associates appeared before the Planning Commission and stated 9 that the proposed sign plan requests an increase from two to three square feet per linear foot of 10 frontage. He added that all existing signage conforms to the 2SF of sign area per lineal foot of 11 frontage and they would like the opportunity in the future to have a larger sign if requested by a 12 tenant. He noted that any proposed signage would have to be submitted to the owner prior to the 13 City and any proposed signage that extends above the parapet or beyond the building would not 14 be approved. He stated that he is not aware of any tenants that are going to replace their existing 15 signage. He added that the project will be competitively bid next week and construction would 16 begin in mid-October. 17 18 Chair Jensen requested that Mr. Kozulla prepare a rendering of the project that depicts the 19 current size of the signage as well as a rendering that depicts the requested 3SF of sign area per 20 linear foot. He stated this would be helpful for the City Council and serve as a point of reference 21 to see the maximum size of signage that would be allowed on the site. 22 23 Chair Jensen closed the public hearing at 7:20 p.m. 24 25 Motion by Commissioner Poucher, second by Commissioner Cincoski, to recommend that the 26 City Council approve the Comprehensive Sign Plan amendment for the St. Anthony Village 27 Shopping Center as submitted. 28 29 Motion carried 4-0. 30 31 Chair Jensen stated that this item will be considered by the City Council at its September 27, 32 2011, regular meeting. 33 34 2. ENCROACHMENT VARIANCE FOR FRONT PORCH— 3408 MAPLEWOOD 35 DRIVE 36 37 Chair Jensen opened the public hearing at 7:25 p.m. 38 39 Assistant City Manager Moore-Sykes presented the staff report. 40 41 Ms. Corri Sandwick, Albertsson Hansen Architecture, Ltd., appeared before the Planning 42 Commission on behalf of Cully and Barbara Johnson, the property owners. She advised that Mr. 43 and Mrs. Johnson are requesting an increase in the front yard encroachment from 5' to 7'-9-1/2" 44 to construct a porch on the front of their home. She stated that the porch will include a front 45 stoop and steps to the porch which will extend another five feet into the front yard setback and 46 the stoop and steps are necessary to enter and exit the porch. She indicated that the porch will Planning Commission Regular Meeting Minutes September 20,2011 Page 3 1 enhance the property's curb appeal, increase use of the front yard, and foster neighborhood 2 communications. She stated that the setback of the house was determined by using the two 3 houses adjacent to the property which is 33.4' from the front property line, behind the front 4 fagade of the garage. She added the proposed variance is in the spirit of the ordinance and will 5 not alter the essential character of the neighborhood. 6 7 Chair Jensen closed the public hearing at 7:35 p.m. 8 9 Chair Jensen requested clarification regarding the actual front yard setback and asked if the 10 setback is 30' or a blend of the two properties next door. 11 12 Ms. Sandwick replied that the setback is 30' or an average of the two adjacent front yards, 13 whichever is greater, so it is 33.4'. 14 15 Chair Jensen noted that with a 30' setback, if this were a new structure and the first one on the 16 block, the property owners would not need a variance. He requested that the property owners 17 confirm the surveyor dimensions. 18 19 Motion by Commissioner Heinis, second by Commissioner Cincoski,to recommend that the City 20 Council approve an encroachment variance of 2' 10" from the front yard setback requirements. 21 22 Motion carried 4-0. 23 24 3. GARAGE SETBACK PERMIT—2610—30TH AVENUE NE 25 26 Chair Jensen opened the public hearing at 7:40 p.m. 27 28 Assistant City Manager Moore-Sykes presented the staff report and noted that the City received 29 one letter against the proposed plan; this letter is included in the record. 30 31 Mr. Glenn Bergum, 2610 301h Avenue NE, appeared before the Planning Commission and 32 requested several corrections to the August 16, 2011, Planning Commission meeting minutes. 33 He requested that the second paragraph on page 5 be revised to state "Traci and Glenn Bergum, 34 2610 301h Avenue NE, appeared before the Planning Commission and Ms. Bergum presented 35 several photographs of improvements done to their home since they purchased it in 1993." He 36 also requested that lines 25 and 30 be revised to accurately reflect their contractor's name as 37 Mark Van Patter of MVP Construction. He stated that the City's basic objection to the requested 38 variance is that the proposed 768 square foot garage results in lot coverage of 37.5%. He 39 questioned how the City defines the essential character of the neighborhood and stated the 40 proposed garage mimics the existing architecture of the house better than the existing garage. He 41 indicated the current garage has a fairly flat pitch and the proposed garage will have a 10 and 12 42 pitch, mimicking the house's 9 and 12 pitch. He explained that the proposed garage will have a 43 staircase leading to the bonus room upstairs with a mini dormer, which will also mimic the 44 architecture of the existing home and is similar to other homes in St. Anthony with dormers. He 45 presented a photograph of the rear yard area and explained that the existing property line fence is 46 only about 2' or less to the existing garage and this will be moved out to 5', which will allow this Planning Commission Regular Meeting Minutes September 20, 2011 Page 4 1 area to be landscaped in a manner more befitting properties in the City. He indicated that their 2 neighbors recently built a garage approximately 20-22' wide and felt that their proposed garage 3 is not grossly oversized compared to neighboring garages and is not out of line with the essential 4 character of the neighborhood. He added that the existing sidewalk will be torn out which will 5 allow more green space in this area. 6 7 Chair Jensen closed the public hearing at 7:52 p.m. 8 9 Commissioner Heinis asked if there will be any difference in height between the current garage 10 and the proposed garage. He also asked if the Bergum's yard drains into the neighbor's property. 11 12 Mr. Mark Van Patter,MVP Construction, stated that the new garage will be 20-21' high and they 13 plan to add one course of block to the slab. He stated that there is a swale between the driveways 14 and the area is fairly flat. 15 16 Commissioner Heinis asked if the lot coverage limitation includes the driveway. 17 18 Assistant City Manager Moore-Sykes replied that the site plan shows removal of the concrete 19 sidewalk and replacing it with pervious pavers and this was not included in the calculations for 20 lot coverage. 21 22 Chair Jensen stated that the dilemma in evaluating this request is that there is nothing to show the 23 existing impervious surface coverage and the proposed lot coverage is more than the 35% 24 limitation. He indicated that he would like to see the applicant come up with a summary of the 25 impervious surface calculation existing today, because whichever size garage is chosen, there 26 can be no greater than 35% impervious surface coverage. He stated that if the goal is to 27 minimize the number of variance requests, the applicant might consider using more pervious 28 pavers in the driveway area. He added that it may be helpful to table action on this item to allow 29 the applicant to work on the lot coverage calculations. 30 31 Motion by Commissioner Heinis, second by Commissioner Cincoski,to recommend that the City 32 Council approve a variance request to build a 768 SF garage and approve the rear yard setback 33 variance. 34 35 Chair Jensen suggested a friendly amendment to approve the variance requests contingent upon 36 the applicant reducing the impervious surface area of the lot, consistent with the City's lot 37 coverage limitation of 35%. 38 39 Commissioner Heinis approved the friendly amendment. 40 41 Commissioner Cincoski seconded the friendly amendment. 42 Motion carried 4-0. 43 44 45 46 Planning Commission Regular Meeting Minutes September 20,2011 Page 5 1 VIII. CONCEPT REVIEWS. 2 3 1. CONDITIONAL USE PERMIT—2824 AND 2828 ANTHONY LANE S. 4 5 Assistant City Manager Moore-Sykes presented the staff report and stated that she spoke with the 6 Fire Marshal earlier today and he advised that the building is mostly sprinklered, but some areas 7 where there are offices may need to have alarms installed. 8 9 Mr. Tom Baker, KW Commercial, appeared before the Planning Commission representing the 10 prospective buyer of the property. He stated that the property is being purchased to use as a 11 church and meeting hall and will be limited to 170 occupants. He noted that the University of 12 Minnesota will be displaced because the building will be used for religious purposes. 13 14 Commissioner Cincoski requested information regarding emergency exits. 15 16 Mr. Baker stated that this would be addressed at the time of building permit application. He 17 added that the building is sprinklered and some sprinkler heads may need to be relocated to meet 18 Code. He explained that they will have 75 parking stalls based on 170 occupants. 19 20 Chair Jensen requested that staff verify compliance with City Code with respect to parking 21 requirements. 22 23 Mr. Jeff Young, current owner of the property, requested that the record reflect the correct 24 address of the property as 2824 and 2828 Anthony Lane. 25 26 Commissioner Poucher asked if the change in use will change the property tax status for this 27 property. 28 29 Chair Jensen requested that staff clarify the property tax status for this property. 30 31 2. 3219 STINSON BOULEVARD—GARAGE VARIANCE AND LOT COVERAGE 32 VARIANCE 33 34 Assistant City Manager Moore-Sykes Kim presented the staff report. She discussed the site plan 35 found in the City's file containing the building inspector's earlier note regarding the property and 36 the notations from the previous owner of the property. 37 38 Ms. Rachel Sanzone, 3219 Stinson Boulevard, appeared before the Planning Commission and 39 stated that the goal is to rebuild the garage that existed when she purchased the property. She 40 noted that the play arbor shown on the site plan has been removed. 41 42 Chair Jensen stated that he would like to hear from the building official regarding the current 43 status of this property and the issues associated with the previous garage. He indicated if the 44 building permit was closed out, this matter exists outside the Planning Commission process. He 45 added there is not much for the Planning Commission to comment on at this stage with so much Planning Commission Regular Meeting Minutes September 20, 2011 Page 6 1 uncertainty regarding the property's history and requested that staff work with the building 2 official to determine next steps. 3 4 3. LA NEL ASSISTED LIVING— SITE REVIEW 5 6 Assistant City Manager Moore-Sykes presented the staff report. 7 8 Mr. Greg Bronk, President of LaNel Financial, appeared before the Planning Commission and 9 introduced Jay Nelson, architect, and Frank Lang and Gene Nelson(Lang-Nelson). He stated 10 that they have enjoyed a good relationship with the City and are now proposing to build a 72-unit 11 assisted living facility adjacent to the Autumn Woods apartments. He added they see an 12 immediate use within the campus to provide additional housing for residents in an assisted living 13 facility and would like to proceed with construction this year. 14 15 Mr. Nelson presented images of the proposed building and stated that the site plan is largely 16 similar to its previous arrangement on the site. He stated that parking will be available along the 17 side and they will be making application to the County to allow parking along the street, similar 18 to the parking allowed further up the street, and they believe this will help promote this as a 19 growing urban area. He indicated that water retention has been a big interest on the site and they 20 plan to provide rain gardens around the perimeter of the site. 21 22 Commissioner Cincoski asked about staff parking availability. 23 24 Mr. Nelson explained that the current lots are underused and they plan to make use of those lots 25 for staff. 26 27 Mr. Bronk indicated that in other communities of this size,there is a staff requirement of 26 28 people at different times throughout the day. He stated that there are 59 parking spaces available 29 at Autumn Woods, together with the underground parking and in front of the entrance, there will 30 be a total of 82 parking stalls available. He added that an indentation is planned on Kenzie 31 Terrace with parking available on the street. He advised that they do not currently see a need to 32 purchase additional land for the development. 33 34 4. CHANDLER PLACE—ENCROACHMENT VARIANCE INTO FRONT YARD OF 35 PORTE-COCHERE 36 37 Assistant City Manager Moore-Sykes presented the staff report. 38 39 Mr. Alan Plutowski, Trossen Wright Plutowski Architects,PA, appeared before the Planning 40 Commission and explained that Chandler Place is an independent and assisted living facility with 41 a memory care component as well as a skilled nursing facility. He stated that as you drive into 42 the facility, there is currently a 24' drive with a drop-off area containing a pitched roof vestibule 43 enclosure that encroaches into the current setback. He indicated that the main reason for 44 constructing the porte-cochere is to provide better safety for residents because the slope of the 45 drive is steep and unprotected. He advised that they have narrowed the drive slightly in order to 46 get the column structure for the canopy which will create a one-way situation where people can Planning Commission Regular Meeting Minutes September 20, 2011 Page 7 1 park and drop-off residents,will provide more room, and will allow passage of another car 2 alongside when another car is helping a resident. He presented architectural drawings of the 3 proposed porte-cochere and stated the porte-cochere would match the building,provide more 4 defused lighting, and create a more welcoming entrance that provides safety to residents. He 5 indicated this would be a permanent structure and would allow clearance of 14' to allow fire 6 truck access. He added that they intend to complete a survey of the area prior to proceeding with 7 construction. 8 9 Chair Jensen asked if they have been able to have a porte-cochere that close to the right-of-way 10 in other locations. He also asked if they have considered using heated pavement in the drop-off 11 area. 12 13 Mr. Plutowski replied that they completed a similar project four years ago in Montana. He also 14 stated that they have not discussed using heated pavement but would consider it particularly if 15 they cannot solve the grade issue. 16 17 Assistant City Manager Moore-Sykes stated that she spoke with the Fire Marshal and he 18 expressed concern about the height and whether they would be able to get a fire truck under the 19 structure. She added that the Fire Marshal has considered striping and signing the west side of 20 the island as a fire lane to keep traffic out. 21 22 Commissioner Cincoski felt that the porte-cochere is aesthetically very attractive. 23 24 5. KIM AND DON PAVELKA—3205 36'" AVENUE NE 25 26 Assistant City Manager Moore-Sykes advised that she met with Kim Pavelka who provided a 27 sketch of the proposed garage addition. She stated that the property meets the 15' total side yard 28 setback requirements and the property owners are proposing to build a 6' x 22' addition, 29 increasing the footprint to 1,128 SF and leaving them with lot coverage of 12%. She explained 30 that they would need a garage setback permit because they propose to build into the setback on 31 the side yard. 32 33 Mr. Don Pavelka, 3205 36`h Avenue NE, appeared before the Planning Commission and stated 34 that they would like to increase the size of the garage to accommodate two cars. 35 36 Chair Jensen indicated that the encroachment for eaves is 30" and the sketch has an overhang at 37 2' off the side of the building or 3' from the lot line, so that eave should be 6"rather than two 38 feet in order to not require another variance, which is desirable. He stated that at the time of the 39 variance request, the property owner should include a survey. He added that it would also be 40 helpful to ask the surveyors to dimension to the property's structure edge and include dimensions 41 both from the property's structure and the neighbor's structure. He requested that the drawing 42 also clarify whether the driveway area will be increased and to include a drawing of the front of 43 the building. 44 45 IX. Background. The property at 2824 and 2828 Anthony Lane South is currently zoned Light Industrial and was built in 1978 as a part of the original St. Anthony Office Park. The purpose of the Light Industrial District is to designate areas for, and regulate the development of, light industry. Areas are designated as light industrial due to the proximity of high capacity roadways or rail facilities and existing development and regulated to enhance the compatibility of light industrial uses and uses within the commercial and residential districts. Subsection 152.141 lists the permitted uses,which are light industrial in nature and Subsection 152.142 list permitted conditional uses and these are uses that are only allowed by the approval of City Council of a conditional use permit. Conditional permitted uses for Light Industrial include (G), Assembly, meeting lodge,or convention halls. Staff met with Mr.Tom Baker, KW Commercial,and the applicant in April to discuss the proposed purchase of 2824 and 2828 Anthony Lane South. Mr. Baker advised Staff that his client is the pastor of the Mountain of Fire Miracles Ministry,a Christian denomination based in Houston,TX. The Miracles Ministry group is looking at large buildings like the subject property to use as an assembly and meeting place for their members. Mr. Baker reported that this group plans to use the building mostly on Sundays and some week nights. He indicated that these times of use would not impact the surrounding properties as they are not generally open for business on Sundays or week nights. Staff has contacted the Fire Department to advise staff on any fire suppression needs for a potential occupancy of up to 200 people. This number was determined based on the information provided by Preliminary Furniture Plan and conversations with Mr. Baker. The Fire Department indicated that the building had recently been renovated and as a result, it is sprinkled in the large,open areas but may need to be alarmed in the office areas. I was advised by Mr. Baker that the Ministry would have adequate parking for their members. He estimated that they have about 170 spaces. Staff counted 70 parking spaces on the subject property from a site plan that was submitted by the applicants as part of their application submission. The City's zoning code for parking (152.178(5) (g)) in the Light Industrial District requires 1 parking space for every1,000 SF of building floor area,which is 14 spaces,clearly not adequate for the proposed use. Staff reviewed the code for parking required for similar uses,which are churches and clubs. The parking requirement for these uses is the total designated seating capacity of the structure divided by 2.5. The seating capacity as noted on the site plan is 210 and doing the computation gives the site the minimum of 84 parking spaces. Using the seating capacity,the available parking is short by 14 parking spaces. When staff used the congregation size of 170,the required parking spaces is 68 spaces. Staff was assured by Mr. Baker that they will not grow to more than the current membership. Staff has received calls from one of the tenants at 2824-2828 Anthony Lane South for status updates on the disposition of this application. The caller,who works for the University of Minnesota,has requested that Staff keep them updated on the status because if the City approves the Mountain of Fire Miracles Ministry's application and the sale goes through, they will be required by law to find another place to rent. A neighboring property owner called to say he is concerned that the proposed buyer will not have enough parking for their congregation. The reason for the conditional use permit is for the church to purchase and make use of a minimally leased office/industrial building in southern St. Anthony. This is in an area of industrial/office use with some other uses that have required a conditional use, such as a daycare. The property currently has two tenants and is 26% leased. The building value has dropped by 52% from the purchase in 2005. The church is negotiating final terms of a purchase agreement which is based on receiving the Conditional Use Permit from the City of St. Anthony. The church will allow the two tenants to stay in the building, at their option, but does not plan to lease any space in the building after these tenants vacate. Mountain of Fire Miracles Ministry is a Christian Church with a national headquarters in Houston. The church would have the highest use of the property when the majority of the other businesses are closed or operating minimally. The church would use the building for Sunday services with smaller groups through the week. The church has normal attendance of 150-165 at the Sunday service. The current on site parking will handle parking for 170. The removal of 13,595 square feet of vacant space will allow the vacancy factor for the city to be favorably adjusted. The weekend use will provide activity in the area when other businesses are closed. This will be an excellent use of the building in an area bordered by industrial, retail and cemetery uses. The property owners are proposing to construct a porte cochere to provide a canopy over the drop-off area at the main entrance to the facility for the safety and convenience of the residents and visitors. Because the building is built up to the property line, the property owners are seeking a variance in order to move forward with this proposal. The City Code states that the front yard setback for an R-4 principal structure is 30'from the property line. Staff reviewed the property file and found that Chandler Place was built in 1966,ten years before the City codified its Zoning Ordinance. Since there were no regulations in place to prevent the owners at the time from building at the property line, the current owners have a practical difficulty if they want to build a porte cochere and are required to seek a variance for their project. Analysis: The property owners are responsible for demonstrating why the strict enforcement of the Ordinance would cause practical difficulties for them by preventing the subject property to be used in a reasonable manner; that the plight of the landowner is due to circumstances unique to the property and not created by the landowner; that the variance if granted, will not alter the essential character of the locality; and that economic considerations alone are not the basis of the practical difficulties (City Code §152.245(C)). Strict enforcement of the zoning code on this property will maintain an issue of safe access to the facility in inclement weather. Granting of the variance will allow construction of the drive through porte-cochere at the entry to this facility to allow safe,protected ingress and egress to this facility and to vehicles bringing people to and from the facility. The construction of the proposed porte-cochere is a permanent structure built of steel standing seam metal roofing & stucco columns attached to one side of the existing building. Ms. Rachel Sanzone,property owner of 3219 Stinson Boulevard,is requesting a Garage Setback Permit and a 308 SF variance to rebuild her garage that was severely damaged in a summer storm. She had originally requested a building permit but when Staff was reviewing Ms. Sanzone's building permit application,they discovered that the former owner had built a 396 SF "garage addition' to an existing garage in 2003. The current property owner,Rachel Sanzone,who purchased the property two years ago,was called and advised that she could not rebuild the size of garage that she previously had,that it had been built illegally. She responded that she used the garage and expected to be able to replace it; that she had called her insurance company about the storm damage and had contractors ready to start rebuilding. Analysis. Ms. Sanzone is insistent that she be able to rebuild her garage to the size that she had when she bought the property. She stated she was not aware at the time of purchase that the garage was illegally built and maintains that the garage was the reason that she bought the property. She is a potter and the large garage offered her a place to do her craft as well as park her car. Ms. Sanzone's lot is 50' x 163' or 8,150SF; is an interior lot;is non-conforming due to its width and total area; and has a maximum of 40% lot coverage. Ms. Sanzone reported that all of the temporary storage sheds have been removed from the lot;they were not there when she purchased the property. If that is the case, her lot coverage,including the over-sized garage,is at 38%. (City Code §152.245(C)) 1. The request is not within the scope of Subsection 152.176 (F), Garage Setback Permit. The Code allows for a 528 SF garage to be in the side yard setback and/or the rear yard setback. Ms. Sanzone also needs a 308 SF variance to the Garage Setback Permit in order to build the size of garage that was originally there. 2. Strict enforcement would cause no practical difficulties because: a. The property owner proposes to use the property in a manner that is not otherwise permitted by the zoning code. If she wants to build a garage in the setback„the Ordinance requires it to be at maximum,528SF. She is also allowed to build a garage up to 1,000 SF as long as it is out of the rear yard and side yard setbacks. b. The plight of the property owner is due to circumstances unique to the property not created by the property owner. While the construction of two garages was not done by the current owner, the previous owner was aware that the garage situation that he was creating was illegal. The City also did not amend the ordinance in any way that created this situation.The City Attorney confirmed that this situation with the garages is not a non-conforming situation,therefore does not meet the test of having circumstances unique to the property. C. The variance,if granted will alter the essential character of the neighborhood. The property owner has demonstrated that the siting of the proposed rebuilt garage will be in essentially the same location as the current structure. Nevertheless,building a garage that is proposed to be 836 SF in the setbacks does alter the essential character of the residential neighborhood. d. Economic considerations alone are not the basis of the practical difficulties. 3. The variance, if granted, would not be consistent with the with the City's comprehensive land use plan. While the City does recognize that attached and detached garages are appropriate uses in the residential zoning districts, it has set limitation to size in order to keep and maintain the residential nature of an R-1 zoning designation. 4. The granting of the variance is not in harmony with the general purposes and intent of the zoning code. Because of this act of God which was beyond my control, I am being penalized. This has been a long and drugged out process that has not only caused me to not be able to use my garage, but it has and will continue to cause me a lot of unnecessary stress in my life. I am asking to put my garage and property back to what it was, prior to the storm and nothing more. I do not believe this garage caused any issues or complaints before and will not alter or change the character of the locality or affect any neighbors. Greg Kozulla of Kozulla&Associates,is an architect working with the owners of the St. Anthony Shopping Center to update and renovate the look of the Center. He presented information to the Planning Commission at a public hearing at the September 20th Planning Commission and at the City Council meeting on September 27th on the visual rejuvenation planned for the Shopping Center and a proposed sign plan update. Mr. Kozulla showed color renderings of what the Shopping Center might look like,including reinstallation of existing tenant signage. The St. Anthony Village Shopping Center received approval by the City Council in 1989,with an update to allowable colors presented and approved in 2003. Construction on the Shopping Center began in the late 1950's according to property file records and which continued into the early 1960's. The City Council at their September 27th meeting voted unanimously to table action on Resolution 11-058, Approving the Proposed Comprehensive Sign Plan Update for the St. Anthony Shopping Center. Mr. Kozulla is before the Planning Commission with a request to review the proposed update to the information on the technical aspects of the Shopping Center's current comprehensive sign plan and to recommend approval to the City Council. The owners are planning to renovate the facade of the stores in the Center and will give the individual tenants the opportunity to install new signs, but as stated in the 2011 Comprehensive Sign Plan,the owners will not require the current tenants to install new signs. The tenants will be given the option of re-installing their old signs,which will be grandfathered in until such time as they are replaced with new signs. Given this shopping center has two entrances /exits,Mr. Kozulla is also requesting the owner have the option in the future to provide a monument sign at the Kenzie Terrace entrance. This monument sign would be the second such sign for the Center as there is currently a pylon sign located along the County Road 88 site entrance. Mr. Kozulla is asking that an additional monument sign at the Kenzie Terrace entrance be allowed in the future should this second sign be desired. An attached spreadsheet shows the proposed changes; the comprehensive sign plan that was adopted in 1989; and the current City Ordinance requirements for signs in the Commercial District. Mr. Kozulla addressed other issues in his letter to the City dated September 8,2011 as the result of questions asked of him by the Planning Commissioners during the concept review of the planned renovation for the Shopping Center. He received many questions regarding the parking lot for the Shopping Center because of the Center's plan to do a mill and overlay. As he stated in his letter, the Shopping Center has 86,564 gross square feet of floor area. The City Code requires that a commercial property installing a parking lot today have one (1) parking space per 300 SF of gross floor area,measuring 9' by 19'. The mill and overlay that is part of the planned renovation of the Shopping Center is nothing more than maintenance of an existing parking lot,which has existed at the current site and mostly unchanged since construction was completed in the 1960's. As such,the parking lot for the Shopping Center is considered grandfathered in and is not required to conform to the City's Zoning Ordinance on Commercial Parking, which was passed in 1976. The Center has approximately 294 parking spaces. Mr. Kozulla states,however, due to the existing landscaped islands, the size of the spaces vary from 8.5' to 10' wide and 18' long. He reports that the Center does use most of their spaces and also provides overflow parking for the Market Place Center, the retail area to the northwest of the St. Anthony Shopping Center. Easements—Although there are easements associated with this property with either the City or the County,this project is not requesting any new easement or proposing amendment to any existing easement. Variances—This project is not requesting any variances. Parkins—It is the intent to mill and overlay and restripe the existing parking lot. Concrete curb&gutter landscape islands and parking lot lighting will remain in their current locations. The current Zoning Code requires parking spaces equating to I space per 300 square feet of gross floor area. This property contains three buildings. The north building (46,052 s.f.),the west building(39,388 s.f.)and the Dairy Queen(1,124 s.f.),totaling 86,564 gross square feet. A factor of 300 s.f.suggests 288 parking spaces required. The existing parking lot has a total of 294 spaces,thus meeting current quantity requirements. It is the intent of the proposed parking layout to replicate that of the existing striping layout; however accessible ramp locations and accessible space locations will differ from the existing layout. Space widths vary from 8.78'to 10'depending on the location. Existing striping is 18' long. Because the landscaped islands dimensionally lock the parking lot striping layout,the 18'space length must be maintained. If we find the 18' length can be increased,the design will accommodate. Setbacks—In some cases,this property has zero lot setbacks. It is my understanding that since this project is not a redevelopment project setback restrictions will be grandfathered. Comprehensive Sign Plan—This project submitted a Comprehensive Sign Plan to the City. This Sign Plan was briefly discussed at the August 16 Planning Commission,however not to detail. The City is currently reviewing the proposed property Sign Plan and scheduled to be on the September 20 Planning Commission agenda. Site Drainage—Communications were held with the City and WSB&Associates with respect to storm water management. Given it is the intent to do a mill&overlay rather than a replacement,it was determined an underground storm water management system or specific site retention location not be required. Planning Commission and City Council—Given the project is not requesting any rezoning,variances,easements,etc.,it is the opinion of this office the project is more of an administrative City process,however,this project's representatives are willing to work with City staff,Planning Commission and City Councll,as necessary. Please let this document be considered St. Anthony Shopping Center's Comprehensive Sign Plan Tenant Signage The Comprehensive Sign Plan will provide for the following: 1. ANTHONY SHOPPING CENTER GENERAL-The Sign Criteria as set forth herein, shall govern all outdoor signage to be used or displayed by the Tenants of "ST. Anthony Shopping Center". This will insure quality signing throughout the Center, while maintaining pleasing architectural standards and fairness to all tenants. Consideration will be given to allowing maximum flexibility of sign designs, individuality and creativity within the limits described below: Sign Criteria/Specifications-All Criteria/S�cifications-All Tenant signs must be designed, fabricated and installed to comply with the following criteria and specifications: 1. All Tenant signs must be individually illuminated neon channel letters with plastic translucent faces. Painted faces are not acceptable. 2. Signs shall be limited to the wording necessary to describe the business trade name and/or logo, or logo type. Type styles will not be restricted, providing that they are legible, or within the size and limitations describdd below and meet the Lessor's approval. 3. Tenants will be allowed one (1) sign per storefront elevation. Elevations exceeding 60 Linear feet my have a second sign, also subject to Lessor's approval. 4. Unless unusual circumstances warrant special permission from the Lessor, the signs shall be limited to a single line, the total width of which shall not exceed 80% of the Tenant's store front width. The minimum letter height shall be 16". The minimum stroke width shall be 3 3/8". a. Letter Channels (Returns)-All letter returns shall be formed from aluminum in minimum thickness of .040 inches. Depth of channels shall be 6". All interior surfaces must have a splash coat of white for reflective purposes. Outside color will be Dupont 4296d-99 Cream. b. Letter Backs-Letter backs are to be made of aluminum of the same or greater thickness as that of the letter channels. Armorply, plymetal, foam, styrene, or any other inflammable material shall not be used under any circumstances. C. Letter Faces-All letter faces are to be pigmented Plexiglas, or equal acrylic sheets with a minimum thickness of .125 inches. d. Face Retainer-All letter faces must be attached to the letter channels using trimcap material, (1 inch) trim color gold. 6. Installation a. There are 3 or more rows of SGR-8961 extruded aluminum channels embedded in the background, 13" inches center to center running the full length of the sign area. b. The letters are to be attached to those channels using STD No. 33.10 snap-in clips' furnished by the sign contractor. (Except for the letter I, all letters shall have a minimum of three clips, although more clips may be required,• depending upon the size of the letter. ) C. No letter attachment holes through the SGR-8961 channels and no welding to those channels will be permitted. 7. Electrical Requirements a. Letters shall be internally illuminated with neon tubing, 15MM, or 13MM using 30 MA transformers for neon illuminated letters and 60 MA transformers for for Argon illuminated letters. b. The required transformers shall be mounted on the back side of the fascia directly behind the letters and housed in a sheet metal box 7" X 7" X 18". The secondary wiring (GTO-15) running from the transformer to a letter will be contained in 1/2' Liquid tight flex conduit. That conduit shall be mechanically fastened to both the transformer box and the back to the letter track, by the use of Appleton 1/2" Connectors, #ST-50 or Equal. No holes shall be drilled in the SGR-8961 channel for any purpose except for running secondary wiring from the letter to the transformer. Those holes shall be 7/8 inches in diameter in order that, at a later date, they may be plugged with a standard snapin blank for 1/2 inch knock outs, Appleton #S50 or equal. C. All wiring pertaining to the transformers, the SGR-8961 channels, and the letters shall be done in accordance with the latest edition Underwriters Laboratories Inc. Standards for Electric Signs and bear the required U.L. Labels. The use of P-K, or similar, neon electrode receptacles will not be permitted. d. No penetrations for attachments in the finished fascia surface will be permitted under any circumstances . u � 8. �proval Tenant shall submit two (2) drawings to the Lessor for written approval, prior to the fabrications of any sign. Lessor must also approve Tenant's Sign Contractor as having previously met the criteria for performing acceptable job standards over a period of not less than three years to assure compliance with our specifications. Any construction accomplished by the Tenant or Sign Contractor, without having the Lessor's written approval and not in compliance with these specifications will be done at the tenant's own risk. Tenants are free to select any Sign Contractor they choose, subject to Lessor's approval. Lessor suggests that Tenants select Sign Contractors willing to give acceptable warranties on their work. A. Mr. Bronk and Ms. Caitlin Goff have also come before the Planning Commission at its September 20, 2011 meeting for a concept review of the site and facility plan. The Planning Commission reviewed the site plan and provided feedback to this proposed project. The next step will be for the LaNel Group to present their final development plan in a public hearing before the Planning Commission. Staff will work with Mr. Bronk and Ms. Goff to schedule that public hearing. Attachments: • Written description of the proposed Assisted Living Autumn Woods Project • Renderings and color drawings of the proposed facility and landscaping Autumn Woods Assisted Living is a 72 unit assisted living facility, offering a variety of unit types to attract a number of different residents; those needing CareSuite services, looking to downsize in home size to Studio or 1 bedroom units or couples looking for larger 2 bedroom units. The building has a wide variety of common area spaces. Those spaces include an outdoor patio, fitness room, beauty parlor, 'spa'rooms, Movie Theater, dining room and full service kitchen, in- house Chapel, craft room, library and a number of Parlors and sitting areas to promote social activities. Landscaping on the site will be to the high standard known at other Lang-Nelson communities. A variety of perennial and shrub planting as well as Deciduous and Coniferous Tree Planting. This will give the building a more residential feel and also create natural barriers from the existing buildings and homes around the area. The owners of the proposed development together with their Architect and Civil Engineer have had the opportunity to meet with the members of St. Anthony's public works team, including engineering as well as the Fire Marshal. We believe these meetings have helped develop this building into a cohesive plan that will benefit not only the existing neighborhood but the community as a whole. Parking for the building will consist of 18 underground stalls for residents and staff, as well as 13 street parking stalls on the North East end of the building on Kenzie and 13 striped parking stalls on the south west end of the building. Parking will also be available via our existing parking lot at Autumn Woods, which is under common ownership. This area has 59 stripped parking spaces which are seldom used by residents. To expand on the parking breakdown of the building; Lang-Nelson's 8 other Assisted Living communities were extensively surveyed to obtain the number of staff and residents needing parking. Common stats include 17% of the units in Lang-Nelson's additional building use a parking space (more often than not to park a car that is never or very seldom driven by an Assisted Living resident). On average we have 36 staff members needing parking at varying times of the day. If 36 staff members needed parking and 17% of the proposed 72 units equating to 12 residents needed parking, totaling 48 cars needing parking we are above our number of slotted spaces by 34 stalls.
