CALL TO ORDER. 9 10 Chair Jensen called the meeting to order at 7:00 p.m. 11 12 II. ROLL CALL. 13 14 Commissioners Present: Chairperson Jensen; Commissioners Chaput, Cincoski, Crone,Niccum, 15 and Poucher. 16 Absent: Commissioner Heinis. 17 Also Present: Assistant City Manager Kim Moore-Sykes. 18 19 III. PLEDGE OF ALLEGIANCE. 20 21 Chair Jensen invited the Commission and the audience to join him in the Pledge of Allegiance. 22 23 IV. APPROVAL OF MEETING AGENDA. 24 25 Chair Jensen advised that the Planning Commission has been asked to adjust the order of the 26 public hearings and move agenda items VII.3. and VIIA. to be heard as agenda items VII.1. and 27 VII.2. He asked the applicants currently listed as agenda items VII.1. and VII.2. if they were 28 agreeable to this change in the agenda and both applicants were amenable to this change. 29 30 Motion by Commissioner Chaput, second by Commissioner Cincoski,to approve the meeting 31 agenda of October 18, 2011, as amended. 32 33 Motion carried 6-0. 34 35 V. APPROVAL OF MEETING MINUTES. 36 37 Chair Jensen requested that line 42 on page 3 be revised to state "garage will have a 10 and 12 38 pitch roof, mimicking the house's 9 and 12 pitch roof. He explained that the..." 39 40 Chair Jensen requested that a paragraph be added before the Motion on line 31 on page 4 to state 41 "Chair Jensen asked the applicant whether he wanted to move forward with his request to the 42 City Council regardless of the Planning Commission's action and the applicant replied that he 43 wanted to move forward with a vote and allow them to move forward to the City Council." 44 45 Chair Jensen noted that the correct spelling of the name of the President of LaNel Financial 46 noted on line 4 and line 23 on page 6 is Mr. Greg Bronk. 47 f Planning Commission Regular Meeting Minutes October 18, 2011 Page 2 1 Chair Jensen requested that lines 36 and 37 on page 7 be revised to state "helpful to ask the 2 surveyors to dimension to the property line and include dimensions 3 both from the neighbor's structure. " 4 5 Motion by Commissioner Niccum, second by Commissioner Cincoski, to approve the September 6 20, 2011,Meeting Minutes, as amended. 7 8 Motion carried 3-0-3 (abstain Chaput,Crone,and Niccum). 9 10 VI. COMMUNICATION WITH CITY COUNCIL. 11 12 Chair Jensen stated that he will plan to attend the October 25, 2011, City Council meeting. 13 Commissioner Poucher also agreed to attend if necessary. 14 15 VII. PUBLIC HEARINGS. 16 17 1. 3205 —36`x' AVENUE NE—GARAGE SETBACK PERMIT 18 19 Chair Jensen opened the public hearing at 7:07 p.m. 20 21 Assistant City Manager Moore-Sykes presented the staff report. 22 23 Ms. Kimberlee Pavelka, 3205 —36`h Avenue NE, appeared before the Planning Commission and 24 stated that concerns were raised at the previous meeting about the 2' overhang as originally 25 proposed and they have revised their plans to include a gable roof with no overhang. She added 26 that they do not plan to add on to the existing driveway because it is already a double car 27 driveway. She indicated that the fence belongs to the neighbors and is located one foot in from 28 their property line and encloses their backyard. 29 30 Chair Jensen closed the public hearing at 7:15 p.m. 31 32 Chair Jensen stated that the removal of the overhang eliminates the need for another variance, as 33 was noted during P the concept review last month. 34 35 Commissioner Chaput requested that the applicant submit an updated sketch and some 36 photographs to the City Council. 37 38 Commissioner Cincoski requested that the applicant also provide the City Council with a sketch 39 showing the proposed garage addition from the perspective of the neighbor's house. 40 41 Motion by Commissioner Cincoski, second by Commissioner Crone,to recommend that the City 42 Council approve a garage setback permit and a 2' variance from the property line for 43 constructing an addition to the existing single car garage and to direct the applicant to provide 44 updated photographs and sketches to the City Council for its consideration on October 25,2011. 45 46 Motion carried 6-0. Planning Commission Regular Meeting Minutes October 18, 2011 Page 3 1 2 2. 3219 STINSON BOULEVARD—GARAGE VARIANCE AND LOT COVERAGE 3 VARIANCE 4 5 Chair Jensen opened the public hearing at 7:21 p.m. 6 7 Assistant City Manager Moore-Sykes presented the staff report. 8 9 Ms. Rachel Sanzone, 3219 Stinson Boulevard, appeared before the Planning Commission and 10 introduced Mr. Mark Belke, Integrity Restoration, Inc. She explained that one of the questions 11 raised at closing was whether there were any issues with the building and the seller told her she 12 was not aware of any. She indicated that the City's paperwork showed that the slab was 13 approved but not the structure. She stated that part of the reason she purchased the property was 14 because of the large area for doing yard work and the workstation in the back. She stated that 15 her neighbor does not have an issue with her constructing a larger garage and noted that the 16 garages around her are all larger garages. She pointed out that had the storm not happened, she 17 would not be here and the storm damage was completely outside her control. 18 19 Mr. Belke indicated there were three sheds on the property that have since been removed and 20 explained that the garage addition meets the 5' setback and the 2' setback represents an old 21 garage that has been in place since 1950. He stated the plan is to remove the garage that was 22 damaged during the storm and put it back as it was. He reiterated that the garage in the rear 23 meets the setback requirements. He stated that the intent is to construct a garage that meets City 24 Code and to give Ms. Sanzone what she had prior to the storm in order to make her whole. 25 26 Chair Jensen closed the public hearing at 7:32 p.m. 27 28 Mr. Belke explained that the garage addition was not constructed properly and stated it was his 29 belief that it should come down and be rebuilt properly. He added that the garage addition has 30 been in place since 2003 with no complaints on record. 31 32 Commissioner Chaput expressed concern that the applicant has requested a variance for what is 33 already a non-conforming structure that should be removed. 34 35 Mr. Belke respectfully disagreed and stated that the pre-existing garage from 1950 was 36 conforming and the garage addition is non-conforming. He recited the notes from the City's file 37 and referenced the notation that states"everything can be taken down while concrete is poured." 38 He stated that the former owner did not do it right but for eight years,the structure stood there. 39 He added that Ms. Sanzone is asking to take the existing situation, which involved an act of God, 40 and build a garage to Code. He pointed out that the back garage addition is conforming and the 41 existing original garage should be grandfathered in because it was built in 1950. 42 43 Commissioner Crone stated that this still represents an illegal garage, even though it was built 44 through no fault of Ms. Sanzone. 45 Planning Commission Regular Meeting Minutes October 18, 2011 Page 4 1 Commissioner Poucher noted that building permits are public record and the applicant could 2 have easily reviewed these records when she bought the house. 3 4 Chair Jensen stated he was not sure he could support a motion that this is not in harmony with 5 the neighborhood. He added this may not have been the best design but it has not been a 6 detriment to her ability to live in harmony with the neighborhood. 7 8 Motion by Commissioner Cincoski to recommend that the City Council approve a garage 9 setback permit and variance on the original existing garage from 5' to 2' due to its existence 10 prior to the City Code being written and to approve replacement of the garage addition because it 11 is in harmony with the existing neighborhood and not injurious to the neighborhood if rebuilt on 12 the existing slab. 13 14 Commissioner Chaput stated that while he appreciates the applicant's desire to have additional 15 square footage, a non-conforming garage exists and this would be an opportune time to 16 reconfigure the slab where the existing garage is located and to align it with the slab from the 17 garage addition and then build a conforming structure. 18 19 Mr. Belke stated the existing garage is undersized for what she has previously been able to have 20 and tearing out the back slab would require significantly changing the landscaping and driveway. 21 22 Commissioner Chaput noted that the Planning Commission has no photographs that would show 23 what type of hardship that would be. 24 25 Mr. Belke indicated it would cost a lot more and he may have to move electrical. He reiterated 26 his request to build a nice garage right where the neighbors are used to seeing it. 27 28 Commissioner Niccum stated that the Planning Commission does not have any plans showing 29 what the new structure will look like. 30 31 Mr. Belke advised that the footprint will be the same and the garage will be trussed, on center, 32 with the electrical brought up to Code. 33 34 Chair Jensen stated the property owner proposes to use the garage in a manner that is consistent 35 with the Zoning Code. 36 37 The Motion was seconded by Commissioner Niccum. 38 39 Commissioner Niccum suggested a friendly amendment to request that the applicant 40 immediately present a drawing and photographs to staff for consideration by the City Council 41 that will help the City Council in making its decision. 42 43 Motion failed 3-3 (Chaput,Crone,and Poucher opposed). 44 45 Motion by Commissioner Cincoski, second by Commissioner Niccum,to recommend that the 46 City Council approve the garage setback variance and 308 SF variance request because the Planning Commission Regular Meeting Minutes October 18, 2011 Page 5 1 variance is not injurious to the neighborhood and the plight of the property owner is due to 2 circumstances unique to the property not created by the property owner. 3 4 Commissioner Chaput asked if the applicant has considered the future resale value of her 5 property and whether she is sure this is what she wants to do. He also asked if she would prefer 6 to take this opportunity to create a space that is conforming and that will be more appealing to 7 the property. He stated the applicant might want to discuss this when this matter is brought to 8 the City Council and noted that the property has a slab that is seven years old as well as an older 9 slab that could be reworked and suggested that the applicant discuss this with her contractor. 10 11 Chair Jensen called the question. 12 13 Motion carried 4-2 (Crone and Poucher opposed). 14 15 3. 2824—2828 ANTHONY LANE S. —CONDITIONAL USE PERMIT 16 17 Chair Jensen opened the public hearing at 8:05 p.m. 18 19 Assistant City Manager Moore-Sykes presented the staff report. 20 21 Mr. Tom Baker,KW Commercial, appeared before the Planning Commission and stated that 22 they have reviewed the parking requirements and determined that a maximum occupancy of 170 23 persons will meet the City Code for parking. He explained that the church uses their facilities as 24 an incubator space to build other spaces, which is why they limit the number to 170 and after it 25 reaches 170,they will start a new church in a different location. He added that they understood 26 the maximum occupancy allowed would be 175. 27 28 Chair Jensen explained that the prior submittal proposed 170 occupants, creating the need for 68 29 parking stalls and by moving up to 70 existing parking stalls, the maximum occupancy allowed 30 would be 175. He requested further information regarding typical and peak uses. 31 32 Mr. Baker stated the building will be at peak occupancy primarily on Sunday mornings and there 33 would not be a lot of other uses during the week. He explained that the building has two existing 34 tenants, one of which is affiliated with the University of Minnesota and they have indicated if the 35 sale goes through, the University will be required to move based on their charter. He added they 36 have plans to do a build-out of half of the building to be used temporarily during the term of the 37 leases and they have no intention of terminating the leases. 38 39 Chair Jensen closed the public hearing at 8:10 p.m. 40 41 Commissioner Poucher stated the only thing limiting the maximum occupancy is the applicant's 42 word that they will keep it at 175. 43 44 Assistant City Manager Moore-Sykes noted that a violation of the Conditional Use Permit would 45 exist if maximum occupancy exceeds 175. 46 Planning Commission Regular Meeting Minutes October 18, 2011 Page 6 1 Commissioner Crone questioned how the applicant can guarantee that not more than 175 people 2 will attend the church on any given day. 3 4 Mr. Baker stated that a typical Sunday will have 110-120 people and the church is estimating 5 that it will hit 170-175 people on holiday Sundays. He added that the church may want to look 6 for additional parking in the future but right now they are confident that sufficient parking exists 7 on site. 8 9 Motion by Commissioner Niccum, second by Commissioner Poucher,to recommend that the 10 City Council approve the Conditional Use Permit as proposed and limiting the maximum 11 occupancy to 175 to meet the required 70 parking stalls on site. 12 13 Commissioner Crone expressed concern about available parking stalls if the maximum 14 occupancy exceeds 175 and suggested a friendly amendment to direct the applicant to be 15 proactive in contacting neighboring businesses about using their parking as a back-up to ensure 16 that adequate parking exists. 17 18 Commissioner Niccum approved the friendly amendment. Commissioner Poucher seconded the 19 friendly amendment. 20 21 Motion carried 6-0. 22 23 4. CHANDLER PLACE—ENCROACHMENT VARIANCE INTO FRONT YARD 24 25 Chair Jensen opened the public hearing at 8:19 p.m. 26 27 Assistant City Manager Moore-Sykes presented the staff report. 28 29 Mr. Alan Plutowski,Trossen Wright Plutowski Architects,PA, appeared before the Planning 30 Commission and stated that the entry drive has been changed to a one-way drive and the 31 driveway will allow a car to park and another to pass. He presented a revised sketch and stated 32 that they are looking to improve the grading of the existing drive as well because it is so steep. 33 He added they propose to build the porte cochere so that it is all within the setback, including the 34 footings. He explained that currently there is a covered vestibule that extends into the setback 35 and they will remove that structure entirely because the columns make it awkward for dropping 36 off residents. He discussed the "no parking fire lane"designation requested by the Fire 37 Department adjacent to the entrance of the porte cochere and stated that the porte cochere is 38 currently designed to include a 14' clearance; since the"no parking fire lane"will be striped,he 39 asked if they could reduce the height of the porte cochere to 12' or 12.5' which would provide 40 better protection for cars while still allowing an ambulance to enter the area. 41 42 Chair Jensen closed the public hearing at 8:25 p.m. 43 44 Commissioner Crone expressed concern about the one-way driveway and possible congestion, 45 particularly if delivery trucks and other vehicles are in the driveway when an ambulance is trying 46 to get to the building. Planning Commission Regular Meeting Minutes October 18, 2011 Page 7 1 2 Motion by Commissioner Poucher, second by Commissioner Crone, to recommend that the City 3 Council approve a variance to the front yard setback of 30' to allow a 0' setback for purposes of 4 constructing a porte cochere as submitted in drawings by the applicant. 5 6 Motion carried 6-0. 7 8 Chair Jensen recessed the Planning Commission at 8:25 p.m. 9 10 Chair Jensen reconvened the Planning Commission at 8:34 p.m. 11 12 VIII. CONCEPT REVIEWS. 13 14 None. 15 16 IX. OTHER BUSINESS. 17 18 1. ST. ANTHONY SHOPPING CENTER 19 20 Assistant City Manager Moore-Sykes presented the staff report. 21 22 Mr. Greg Kozulla, Kozulla& Associates, appeared before the Planning Commission and 23 explained that the Planning Commission previously reviewed the proposed amended sign plan 24 and approved it,provided that the City Council was provided with some additional exterior 25 elevational drawings. He presented a matrix and drawings that identified each of the buildings 26 and the tenant wall length and height and square footage of each store frontage. He stated that 27 the store frontage will not exceed 3SF of tenant signage per lineal foot of tenant store front. He 28 explained the matrix goes through each space alphabetically and shows the maximum length of 29 sign, maximum square footage of sign, both on a 3SF rule and a 15%rule. He indicated that the 30 last paragraph of the sign plan proposal discusses the potential for future ground signs and he 31 presented a sketch showing the current freestanding pylon sign on Old Highway 88. He stated 32 that one sign is permitted per property entrance and requested that the Planning Commission 33 consider approving a future monument sign. He noted that they do not have a design for a future 34 sign and they would be required to coordinate this with the Zoning Code and staff if they are 35 permitted to have a second sign in the future. He stated that parking was discussed with the City 36 Council on September 27th and it was noted that the current Zoning Code requires 9' x 19' 37 parking spaces but because the lot was built before 1976, it was their understanding that parking 38 would be grandfathered in,as suggested in the staff report. He indicated that they cannot meet 39 the 9' x 19' space requirement because of land locks on the property and it is their intention to 40 have the same parking layout and space count as exists today following completion of mill and 41 overlay. He noted that they are not requiring tenants to purchase new signs and as the fagade 42 project is completed and new signs installed,they are asking to re-install the existing signage 43 with tenants having the option to buy new signs. He added that any new tenant would be 44 required to have a backlit sign. 45 Planning Commission Regular Meeting Minutes October 18, 2011 Page 8 1 Commissioner Crone requested that the property owner consider adding some directional arrows 2 to the parking lot to alleviate confusion that drivers may have when exiting the area by Subway. 3 She also asked if outlets could be added in the parking lot during the mill and overlay project. 4 5 Mr. Kozulla stated that during the mill and overlay project,they plan to get 120 volt power to the 6 power poles in the parking lot. 7 8 Motion by Commissioner Chaput, second by Commissioner Cincoski,to recommend that the 9 City Council approve the amended Comprehensive Sign Plan consistent with the revised 10 application, including allowing 3SF per lineal foot of tenant frontage with total signage area not 11 to exceed 15%of the total wall area and allowing up to two ground signs consistent with current 12 City Code and not to exceed 80SF. 13 14 Motion carried 6-0. 15 16 2. LANG-NELSON AUTUMN WOODS ASSISTED LIVING PROJECT 17 18 Mr. Greg Bronk,President of LaNel Financial, appeared before the Planning Commission and 19 stated that LaNel has managed the Autumn Woods apartments since 1988 and purchased 20 adjacent parcels from the City in 2004 with the intent to build a 72-unit assisted living facility 21 located south of the Autumn Woods apartments. He indicated they feel the assisted living 22 facility will provide housing services to the residents currently living in the apartments and will 23 allow them to stay in St. Anthony. He stated that this project may create up to 36 full-time jobs 24 in the community, including property management, food service, and health care; in addition, the 25 contractor estimates that approximately 47,000 work hours will be required to complete the 26 project and would involve 225-250 people working on the site during the construction period. 27 28 Assistant City Manager Moore-Sykes explained that a public hearing on this PUD will be held in 29 November and a recommendation forwarded to the City Council for consideration the following 30 week. 31 32 Mr. Jay Nelson, architect, appeared before the Planning Commission and presented several 33 architectural renderings of the project. He stated that one of the big issues with the site has been 34 water retention and dealing with storm water without overwhelming the existing ponds. He 35 discussed the layout of the building,proposed amenities, parking, and landscaping. He stated 36 that they have a request in to the County for additional parking on Kenzie that will help enhance 37 an urban atmosphere and promote future development. 38 39 Chair Jensen requested further information regarding the developer's response to the concerns of 40 the neighbors. 41 42 Mr. Bronk advised that there was one neighbor who asked if they would buy his house and initial 43 discussions indicated that the property owner was asking for a price in the mid-$200,000's. He 44 stated they have concluded that they have enough land for the building and parking lot and do 45 not need to purchase any additional land. 46 Planning Commission Regular Meeting Minutes October 18, 2011 Page 9 1 Mr. Nelson stated that the project will provide some screening that is part of the landscape plan. 2 He indicated the fence will likely be a darker color vinyl fence with dividers and will be located 3 at the top of the retaining wall. 4 5 Chair Jensen requested that the applicant submit larger size drawings at the public hearing. He 6 suggested that the applicant have a large drawing available for viewing at City Hall. He also 7 requested that the drawings show the dimensions from Kenzie Terrace to the structure. He noted 8 that there may be a practical difficulty in the grading area surrounding the entrance to the garage 9 ramp and requested that the applicant re-examine the angles coming into this garage door 10 because it appears that it may be tight. 11 12 Mr. Nelson agreed to email the drawings to Assistant City Manager Moore-Sykes for forwarding 13 to the Planning Commission. 14 15 Commissioner Poucher expressed concern about headlights shining into adjacent garages or 16 homes. 17 18 Mr. Nelson assured the Planning Commission that this has been considered and will not happen. 19 20 X. STAFF REPORT To: Chair and Planning Commission Members From: Kim Moore-Sykes,Assistant City Manager 019 Date: November 15, 2011 Subject: PUD Amendment — Autumn Woods Assisted Living Facility Requested Action: Public Hearing Date Application Received: N/A Property Address: 2580 Kenzie Terrace Zoning District: PUD —R-4 60-Day Expires: January 2, 2012 Waiver Letter Required: Yes Date Sent: No Future Action: Council Approval of Planning Commission Recommendation Background: Mr. Greg Bronk and the LaNel Group met with Staff to complete their preliminary plans for the proposed construction of an assisted living facility to be located adjacent to their Autumn Woods Apartment I complex on 2580 Kenzie Terrace. The proposed facility will have approximately 72 assisted living units. Mr. Bronk and Ms. Caitlin Goff came before the Planning Commission at its September 20, 2011 meeting for a concept review of the site and facility plan. Analysis: Zoning District: The proposed project is located adjacent to the existing Autumn Woods apartment facilities. The parcel for the proposed assisted living facility was purchased from the City in 2000 and was included in the PUD designation that exists for the existing Autumn Woods facility as part of a Planned Unit Development approved in 2003. As defined in X152.201 DEFINITIONS, a PUD or Planned Unit Development,is a zoning district and development plan which may include single or mixed uses, and one (1) or more lots or parcels, and which is intended to create a more flexible, creative,and efficient approach to the use of land. Any PUD shall be subject to the procedures, standards and regulations contained in the zoning subchapter. The agreement entered into between the developer and the City to incorporate all terms,requirements and conditions of the PUD approval. X152.202 provides the City the ability to authorize and approve a PUD based on the following criteria. Varie : Within a comprehensive site design concept, a mixture of land uses, housing types and densities; Sensitivity: Through the departure from the strict application of required setbacks,yard areas, lot sizes, minimum house sizes,minimum requirements, and other performance standards associated with traditional zoning, a PUD can maximize the development potential of land while remaining sensitive to its unique and valuable natural characteristics; Density Transfer: The project density may be clustered,basing density on a number of units per acre in place of specific lot dimensions; District Integration: The combination of uses which are allowed in separate zoning districts such as: a. Mixed residential uses to allow both densities and unit types to be varied within the project; b. Mixed residential uses with increased density based upon the greater sensitivity of PUD projects to regulation;and c. Mixed land uses with the integration of compatible land uses within the project. The PUD development plan shall identify all the proposed land uses,which shall become permitted uses if the final development plan is approved. Any change in the uses presented in the final development plan will be considered an amendment to the PUD and must follow the procedures specified in 152.200. The construction of the proposed assisted living facility requires an approved amendment to the PUD as originally approved in 2003 because the construction of the assisted living facility would constitute a revision and/or change as stated in 5152.206. The amendment in 2003 added the five (5) vacant residential lots and an undeveloped lot purchased from the City,which totaled 55,584 SF, to the existing Autumn Woods residential PUD. The proposed facility footprint is shown to be between 21'6" and 22'6" from the southern-most side yard property line and a 301" side yard setback adjacent to Kenzie Terrace; the front yard is oriented toward the eastern border on the Autumn Woods I property,which LaNel owns. Lot Coverage: The site area was determined to be 55,584 SF,which is equal to 1.276 acres. The total lot coverage allowed for an R-4 zoning district is 50%. The building site coverage or footprint is 21,264 SF or 38%. Jay Nelson of Jay P. Nelson,Architect,reported that the building is set back 30 feet from the innermost property line along Kenzie Terrace. The proposed facility is sited between 22'3" and 22'6" from the south west property line. This area is the rear yard for all of the neighboring R-1 properties with accessory buildings and garages as adjacent structures. Parking: As stated in the Applicant's written statement,parking will include 18 underground stalls for residential parking and staff parking. There will also be 13 parking spaces on the north east end of the building on Kenzie and another 13 parking spaces on the south west end of the building. Should it be needed, there is additional parking on an existing and adjacent lot at Autumn Woods I,which is under common ownership. On site,LaNel reports that in addition to the planned 44 parking spaces for this proposed facility, the 38 parking spaces from Autumn Woods I gives both facilities an extra 34 parking spaces over what the Ordinance requires. Landscaping: The LaNel Group reported in their written statement that landscaping on the site will be varied and full,giving the site a more residential feel and creating natural boundaries from existing buildings and homes around the area. Signage: The LaNel Group is proposing to install a monument sign at the entrance to the new facility. This proposed sign adheres to the City's Sign Ordinance restrictions on height. The building has a wide variety of common area spaces. Those spaces include an outdoor patio, fitness room,beauty parlor,'spa'rooms,Movie Theater,dining room and full service kitchen, in- house Chapel, craft room,library and a number of Parlors and sitting areas to promote social activities. Landscaping on the site will be to the high standard known at other Lang-Nelson communities. A variety of perennial and shrub planting as well as Deciduous and Coniferous Tree Planting. Analysis: Staff researched the City's Zoning Ordinance and contacted the City Attorney. It appears that it is a simple process to combine residential lots as long as in the process, non-conforming lots are not created. Mr. Alm stated that he has no wish to subdivide them again once they are combined as he wants to build a house. He stated that he would like to receive just one property tax statement rather than five. In speaking with the City Attorney,it is a matter of having the Planning Commission review the proposal, send on a recommendation to the City Council and requesting the City Council approve the lot combination by resolution. By combining these lots, Mr.Alm would create a single, R-1 interior lot that is 22,842 SF. 5151.08 of the City's Zoning Code states that the City Council may waive compliance with the platting requirements and approve subdivision by conveyance of land by adoption of a resolution that in effect,based on findings by the City Council that: a. Compliance with the platting requirements would create an unnecessary hardship or expense because of the nature of the subdivision;and b. Failure to require the filing of a plat does not interfere with the purposes of this subchapter. f The City Council may also consider: a. The number of parcels resulting from the subdivision; b. The City Council may consider the number of parcels resulting from the subdivision,the complexity of the legal descriptions,the necessity for dedication of streets or drainage and utility casements, and the probability of future subdivision of the parcels. No building permit will be issued for the construction of any building, structure, or improvement on any land required to be subdivided by this chapter until all requirements of this chapter have been fully complied with. No conveyance by metes and bounds may be made or recorded if the parcel described in the conveyance is less than 2-1/2 acres in area or 150 feet in width, unless the parcel was a separate parcel of record on 8-22-1973. (1993 Code,• 1500.10) •151.11 VARIANCES. The City Council may authorize a variance from these regulations when,in its opinion,undue hardship may result from strict compliance.
