1 Mr. Greg Bronk, President of LaNel Financial Group, appeared before the Planning Commission
2 and reviewed the proposed 72 unit assisted living facility adjacent to the Autumn Woods
3 apartment complex. He advised that they developed the Autumn Woods apartments in 1988 to
4 include 50 units designated as 50 and over and they have heard from a number of residents
5 throughout the community that they would like to see this type of facility. He stated that the
6 demographics of St. Anthony continue to show an aging population and those seniors want to
7 remain in St. Anthony and the proposed facility will be a natural progression to allow residents
8 to remain in St. Anthony and be a part of the Autumn Woods community. He pointed out this
9 development will create approximately 35 full-time jobs as well as 30-35 construction jobs.

11 Mr. Jay Nelson, Jay P. Nelson Architect, appeared before the Planning Commission and
12 presented several drawings of the proposed facility and explained that the ends of the building
13 are stepped down in size which will help reduce the scale of the building and will include brick
14 and siding materials. He stated they have asked Hennepin County to allow parking along Kenzie
15 Terrace and if allowed, this will provide an additional 13 parking spaces. He advised that
16 because of the limitations of the site, the garage ramping will take place inside the building in the
17 covered space to make it safer and aid in drainage. He discussed the drainage on the site which
18 will include rain water gardens and a recessed underground water storage area along Kenzie to
19 receive water and control run-off. He presented interior courtside pictures which show porches
20 around Kenzie and in the front entry. He noted that they are requesting that the porches be 6'
21 instead of 5'. He pointed out the proposed setbacks depicted in the drawings which meet City
22 Code. He stated that the lower level will include parking, a maintenance area, trash and utility
23 spaces, storage,as well as a community room, fitness area, and spa. He indicated that level one
24 will include a parlor area with library, a generous community dining area, an activities area in the
25 corner including an outdoor porch, a chapel, movie theater, as well as several care suites for
26 those with higher care needs. He advised that the upper floors will include studio suites,one-
27 and two-bedroom units with a laundry and sitting area on each floor. He noted that level four is
28 where the building steps down so the units on the end are deleted. He discussed the civil
29 engineering drawings and plans for controlling water run-off and also discussed the landscape
30 plan which will screen the area from the adjacent neighbors. He added there will be a 6' fence
31 along the property line at existing grade elevations which will then come out 5' for the retaining
32 walls with base plantings along and above the wall.

34 Commissioner Cincoski indicated that the south side of the property butts up to an existing R-1
35 residential area and contains a lot of bituminous material. He asked whether consideration was
36 given to the property behind this area to ensure there is no water run-off to these properties. He
37 also requested information regarding the type of fencing to be used.

39 Mr. Nelson assured the Planning Commission that water run-off to adjacent properties is not
40 going to happen. He explained this area includes a pipe that collects water from the roof and
41 diverts it to an underground storage area. He added that the idea is to have roof water running
42 directionally into the storage area from the gutters and downspouts. He explained that a 6' vinyl
43 privacy fence is proposed and will be either brown or gray.

45 Commissioner Crone requested information regarding the fire lane and its proposed use as a
46 walking path.

2 Mr.Nelson explained that the fire lane, which is a no parking area, is 8' wide and can also serve
3 as a walking path.

5 Chair Jensen noted that the applicant is not asking for any exceptions as it relates to the setbacks
6 because the proposed facility exceeds the distances to the side lot line and along Kenzie. He also
7 noted there are no height exceptions being requested by the applicant. He requested further
8 information regarding available parking and compliance with City Code.
9
10 Mr.Nelson stated that they have met the City's parking requirements under the Code and
11 reiterated that they are asking for a 6' porch on Kenzie.
12
13 Ms. Moore-Sykes explained that a 5' setback is allowed and a 6' porch creates an encroachment.
14
15 Ms. Barbara Sullivan, 2615 Lowry Avenue, appeared before the Planning Commission and
16 expressed concern about the proposed development. She stated she reviewed the City's files
17 related to environmental testing done on the Autumn Woods property which was built on a
18 former shopping center site and found they were told not to dig more than 10'. She indicated she
19 was fighting a company called Interplastics relative to something in the environment which
20 could have impacted one of the City's wells. She asked if the developer has checked the soil and
21 expressed concern about the amount of impermeable surface. She stated she did not understand
22 how the City thinks it would be a good idea to build on such a small space. She recited an email
23 from the Winter Park Citizens in Action questioning why they did not receive notice of the
24 public hearing and expressed dismay this group was not included. She stated that her cousin
25 who lives adjacent to the site as well as people living across from Lowry have watched water
26 rolling down their driveways. She questioned whether MWMO has reviewed the plan and
27 indicated that the City has enormous groundwater problems. She did not understand how the
28 City would allow a development with so much impermeable surface and added that the Winter
29 Park Citizens in Action want to know what is going on.

31 A resident residing at 2605 Lowry Avenue appeared before the Planning Commission and stated
32 that this original lot contained five separate houses and over the years was combined and the
33 zoning changed to allow this type of building. He indicated that he lives behind the proposed
34 development and will be looking out his back door at this monstrosity. He added if he had
35 known this type of building would be allowed when he moved in 35 years ago, he would not
36 have bought his property and the proposed building will affect the value of his property and
37 others. He felt it was ridiculous to build this monstrosity on such a tiny lot. He stated that his
38 neighbor has lived in her home for 80 years and felt this was unfair treatment. He indicated he
39 thought they might build some row houses on this site which would fit nicely on the property.

41 Ms. Yvonne Meyer 2352 Coolidge Avenue NE, appeared before the Planning Commission and
42 stated in the past, they have discussed water run-off on this site with City Engineer Todd
43 Hubmer because they are receiving water run-off from the existing Autumn Woods parking lot.
44 She explained that because the effect of the water run-off was discovered after the building was
45 done,they were told that when this proposal was approved,their concerns regarding run-off from
46 the parking lot would be addressed. She requested clarification regarding the plans and whether

1 the new addition will connect to the building behind it. She stated if it does connect, it adds
2 more to their concerns because of the run-off. She indicated she could not find the letter from
3 Mr. Hubmer which indicated that a holding tank would be added in the parking lot of the existing
4 Autumn Woods apartments so that run-off would not come onto Lowry Avenue and down the
5 hill into various homeowner's driveways. She asked if that holding tank is included in the plans.

7 Mr. Bronk replied that there is nothing planned to be added to the existing Autumn Woods
8 property.

10 Ms. Meyer asked if there was a way for the City to address the run-off at the existing Autumn
11 Woods property.

13 Ms. Beverly Tombarge, 2609 Lowry Ave. NE, appeared before the Planning Commission and
14 stated she has lived on her property for 82 years and felt that the proposed development was
15 pushing them out because Autumn Woods is controlling a big portion of this area. She
16 questioned who would want to live on her property and expressed concern she will not be able to
17 sell her property. She stated the development is planned on a little bit of land and they will be
18 surrounded by a four story building and it is not fair and she is not happy about this.
19
20 Ms. Mary Ward, 2200 block of Wilson Street, Minneapolis,appeared before the Planning
21 Commission and asked if the building will in fact be four stories because it appears that one story
22 is below grade. She asked about the final roof height as compared to the existing Autumn
23 Woods property. She also asked about the proposed parking on Kenzie Terrace and whether it
24 means that Kenzie Terrace will go down to one lane in that area or whether an additional lane
25 will be added.

27 Chair Jensen explained that Kenzie Terrace will be widened to create 13 parking stalls similar to
28 what was done on Silver Lake Road. He noted that the travel lanes on Kenzie will not be
29 diminished and the sidewalk would be moved. He stated that the County needs to approve this
30 and will be handled at a future time with a permit from the County to allow that improvement.

32 Chair Jensen closed the public hearing at 7:52 p.m.

34 Mr. Bronk explained that the existing three buildings of Autumn Woods have underground
35 parking and 59 surface parking stalls available; seven of the 59 parking stalls will be lost due to
36 the new construction. He indicated there will be a total of 82 parking spaces available which
37 exceeds the requirements of the City Ordinance.

39 Chair Jensen requested additional information about the proposed drainage on the site. He also
40 asked if the plans are compliant with MWMO regulations.

42 Mr. Nelson reviewed the drawings and showed the areas where water will be collected and
43 treated before flowing into the City's storm water system. He indicated that the drainage going
44 toward Lowry has not changed and water will never get to the adjacent residential areas.

1 Chair Jensen noted it is not likely that the proposed development would have gotten this far
2 without the City Engineer's approval and requested that the City Engineer provide a summary to
3 staff and the City Council that explains the design premise of the drainage and how it complies
4 with MWMO regulations. He requested clarification regarding the height of the proposed
5 facility.

7 Mr.Nelson explained that the facility is four stories from the ground up but the ground is
8 depressed from the southerly neighbors by four feet, making the building 3.5 stories from the
9 neighbors immediately to the south.
10
11 Chair Jensen asked if the developer has encountered anything related to environmental issues in
12 the ground.
13
14 Mr. Nelson advised that they had a Phase 1 survey done on the site and they are not aware of
15 anything that showed up during this testing. He stated there are ground water issues on this land
16 where you will get water at 15' or 20'. He indicated they are trying to get above the water table
17 that showed up during the tests.

19 Mr. Bronk stated that there were no issues related to soil conditions during the Phase 1
20 environmental testing.
21
22 Chair Jensen responded to the questions regarding valuations on land use by indicating that the
23 Planning Commission does not get into a judgment of whether one project next-to-another _
24 creates a change in value. He stated that the proposed project has been deemed appropriate for
25 the site and the Planning Commission is looking at whether this plan today meets the recent
26 guide plan amendments passed by the City in 2000 as well as the various updates last approved
27 in 2010. He added that the applicant is not asking for a lot of additional amendments or
28 variances in order to accomplish construction of the facility. He stated this area of the
29 community has single family residences that were reviewed as part of the City's land use plans
30 and it was deemed that the zoning of the existing homes would not be changed. He added that a
31 different land use category that allows higher density was applied to this site, in this case R-4,
32 which allows for the creation of a bigger building. He advised that the City's notification
33 process requires the City to notify property owners of record within 350'of the site.

35 Ms. Sullivan requested copies of the Phase 1 environmental reports on the Autumn Woods
36 property as well as the proposed assisted living facility site.

38 Chair Jensen requested that the applicant provide these reports to residents as well as to the City
39 Council and City Engineer. He also asked if the applicant wished to comment regarding the
40 question of building row houses on the site.
41
42 Mr. Bronk stated he did not wish to comment.
43
44 Chair Jensen indicated that an assisted living facility requires a bigger building than row houses.
45 He stated that adding an assisted living facility to the Autumn Woods campus made sense to the
46 City related to the comprehensive guide plan approved by the City. He added it may be possible

1 to get an opinion from the Watershed District to address how these plans meet all Watershed
2 District requirements and requested that this be provided to the City Council.

4 Commissioner Crone asked if there was a reason why they chose to build a 72-unit structure and
5 also asked what the impact would be if they eliminated a floor.
6
7 Mr. Bronk stated that a 72-unit building represents a manageable number in terms of rental,
8 staffing, food,etc. and all of their campuses fall within that range. He added they would lose 20
9 units if they eliminated a floor which would not be a feasible development.

I 1 Commissioner Niccum asked about the proposed lighting in the back of the building and its
12 impact on adjacent homes.
13
14 Mr. Nelson replied there will be some minimal pond lighting in the area as well as security
15 lighting. He noted that the lighting fixtures will point downward.
16
17 Chair Jensen requested the applicant discuss the landscaping and screening to address the
18 concerns raised by residents.
19
20 Mr. Bronk stated it is their goal to have a well shaded environment for their residents and to
21 include a significant amount of landscaping and larger trees than required under the Ordinance.
22
23 Commissioner Crone asked if residents will have a contact person to call or email if they have
24 questions during construction.
25
26 A representative from Lang-Nelson assured the Planning Commission that there will be a point
27 of contact for residents throughout construction.
28
29 Ms. Ward requested that the Planning Commission address Ms. Meyer's question regarding
30 existing run-off problems that they thought would be addressed if further development was
31 planned in this area.

33 Chair Jensen indicated that this issue will be forwarded to the City Engineer and requested that
34 the City Engineer be asked to provide a comment at the City Council meeting and/or a letter
35 added to the file for this project. He noted that this is not critical to the land use decision in front
36 of the Planning Commission tonight. He stated the planned drainage depicted in the drawings
37 shows them capturing more water and holding it back to some degree, which meets the City's
38 criteria.

40 Motion by Commissioner Niccum, second by Commissioner Chaput, to recommend that the City
41 Council approve the Preliminary Development Plan submitted by LaNel Group for the proposed
42 construction of Autumn Woods Il,an Assisted Living Facility based on the following findings of
43 fact:
44
45 a. That the proposed site for the proposed assisted living facility was formally added to the
46 existing LaNel Planned Unit Development(PUD) in 2003;

1 b. That the Preliminary Development Plan does not exceed the maximum density range and
2 is an appropriate plan for the R-4 Residential Zoning District;
3 C. That the general location of major streets and pedestrian ways are shown on the
4 Preliminary Development Plan;
5 d. That the Preliminary Development Plan shows the general location and extent of public
6 and common open spaces;
7 e. That the Preliminary Development Plan shows the general location of residential and
8 non-residential land uses with the appropriate type of intensities of development;
9 f. That the LaNel Group has provided adequate information regarding the staging and time
10 schedule of development; and
11 g. That the Preliminary Development Plan includes other special criteria and design details
12 for the development of the proposed assisted living facility including parking,
13 landscaping,and signage within the R-4 Residential Zoning District.
14
15 Motion carried unanimously.

17 Motion by Commissioner Crone, second by Commissioner Cincoski, to recommend that the City
18 Council approve the Preliminary Development Plan as the Final Development Plan submitted by
19 LaNel Group for the proposed construction of Autumn Woods II, an Assisted Living Facility,
20 based on the findings of fact by the Planning Commission as listed in the motion to recommend
21 approval of the Preliminary Development Plan.

23 Commissioner Heinis requested that the north arrows on the architectural drawings be corrected.

27 2. LaNEL—PUD AMENDMENT, 2580 KENZIE TERRACE

29 Motion by Commissioner Poucher, second by Commissioner Crone, to recommend that the City
30 Council approve the Final Development Plan as an Amendment to the existing LaNel Autumn
31 Woods Planned Unit Development based on the findings of fact established as a result of the
32 Planning Commission's review of the Preliminary Development Plan and Final Development
33 Plan as submitted by the property owners, LaNel Financial Group.

35 Motion carried unanimously.

37 Chair Jensen indicated this item will be heard by the City Council at its regular meeting on
38 Tuesday,November 23`d, and asked that the applicants provide the City Council with comments
39 from their engineers, as well as Hennepin County and the Watershed District. He also asked the
40 applicants to provide copies of the environmental assessment documents created for construction
41 as well as any soil reports.

1 Assistant City Manager Moore-Sykes presented the staff report.

3 Chair Jensen indicated when this project was put together,the building requested to have some
4 movement in terms of how the front facade creates the impression of multiple spaces. He stated
5 that the photograph in the packet shows how the right hand side could potentially be another
6 user, so the fact that there is one user creates this requirement for a variance. He asked whether
7 the variance is required because this is one user or whether the City is trying to get clarity on one
8 fagade versus two facades.
9
10 Assistant City Manager Moore-Sykes stated that the City Code defines the requirements by
11 stating that one identifying wall sign is allowed per commercial establishment.
12
13 Mr. Richard Lang, 475 Cleveland Avenue North, St. Paul, appeared before the Planning
14 Commission representing Hennepin County Medical Center Community Clinics and indicated
15 that Hennepin County Medical Center wants the Clinic visible from Highway 88 and wants their
16 users to be able to find the entrance door. He indicated that a variance for a monument sign was
17 denied and with that in mind, the Clinic hopes to make a bigger splash on the largest portion of
18 its storefront and add a smaller sign so people understand where the entrance is located. He
19 presented drawings of the proposed signage and indicated the main sign blends with the
20 architecture,does not stand out, and will have down lights with the hopes of creating a fresh look
21 that separates the Clinic from other tenants.

23 Commissioner Niccum noted that it looks like this could be two separate tenant spaces.
24
25 Commissioner Chaput indicated there were doors on the left side at one time which were taken
26 out when the storefront glass was installed. He stated that in looking at the square footage
27 signage allotment, if the facades were calculated individually, it would fall within the City's
28 allotted signage, but in this case, the two facades represent the space of one tenant.

30 Commissioner Crone stated that in comparison to the former Snyder's sign, this sign is more
31 attractive and more appealing to the neighborhood. She asked if there were two signs for
32 Snyder's.

34 Commissioner Chaput stated that Snyder's had two signs.

36 Chair Jensen stated that this item will be presented as a public hearing at the December Planning
37 Commission meeting.

39 2. ADMINISTRATIVE LOT COMBINATION—3629 ROOSEVELT

41 Assistant City Manager Moore-Sykes presented the staff report and noted that she requested an
42 aerial photograph which will be included with the staff report. She added that the proposal is to
43 combine the lots under one property tax statement.

45 Chair Jensen stated that this item does not require a public hearing and the Planning Commission
46 can move its recommendation directly to the City Council.

2 Motion by Commissioner Niccum, second by Commissioner Chaput, to recommend that the City
3 Council waive compliance with the platting requirements and approve subdivision by
4 conveyance of land by adoption of a resolution based on findings of fact that:

6 a. Compliance with the platting requirements would create an unnecessary hardship or
7 expense because of the nature of the subdivision; and
8 b. Failure to require the filing of a plat does not interfere with the purposes of§ 151.08 of
9 the City's Zoning Code.

11 Chair Jensen stated there are a number of different lot configurations in this block area with a
12 number of small areas as well as several substantially larger lots that have been rebuilt over the
13 last 10-12 years.

Background: Staff received a call from Richard Lang of Visual Communications Signs,requesting information
on the process to apply for a variance. Staff had previously reviewed a sign plan for the Hennepin County
Medical Center Clinic, which has located a facility at the St. Anthony Market Place Shopping Center. Staff
advised Mr. Lang that the requested second identification sign which is proposed to be placed above the
entrance, requires a variance because the City allows only one identification sign per right-of-way frontage per
commercial establishment. Mr. Lang reported that the owners of the clinic are concerned that patients may not
recognize the entrance as an entrance without this additional identification sign.
Analysis. The clinic submitted as part of an overall sign plan, a request for two (2) wall signs identifying the
clinic on the same wall.
§155.29 DISTRICTS SCHEDULES, (B)(1) states that for Commercial and limited businesses, one (1)
identification (wall) sign per right-of-way frontage per commercial establishment is allowed. This sign may have
no more than 2 SF of surface area per lineal foot of business frontage, up to a maximum of 150 SF.
The proposed main wall sign is 64.6 SF; the proposed smaller wall sign to be placed over the entrance is 25.5 SF.
§155.03 DEFINITIONS defines an identification sign as a sign which is a non-commercial sign but is limited to
the name, address, and number of a building,institution or person and to the activity carried on in the building
or institution or the occupation of the person.
Application Review
As part of the application process, the applicant is required to provide evidence that discloses facts that are
unique to the subject property. Section 152.245 of the City Ordinance outlines the requirements that must be
addressed to qualify for a variance and the process by which a variance is granted. Specifically Section 152.245
It i
(C) states that no variance will be granted unless evidence presented supports the following facts, that strict
enforcement would cause undue hardship because:
The property cannot be put to a reasonable use without the variance. Staff did not find any evidence that a
second identification sign would improve the tenant's ability to put this property to reasonable use. It is possible
that there may be confusion about the location of the entrance to the clinic,but as time goes on, the exact
entrance will become known to the community and the clinic's patients.
The circumstances causing the hardship were not created by the owner. The circumstances of the perceived
hardship are not of the applicant's making. Staff does agree the architectural design of the front of the building
does hint that there may be two (2) separate businesses.
The variance, if granted,will not alter the essential characteristics of the locality. The applicant states that adding
a second identification sign would not alter the essential character of the locality. Staff feels that since no other
business in the Market Place Shopping Center has a second identification sign, allowing a variance to the Sign
Ordinance could potentially create a situation that does change the character of the locality.
Economic considerations alone are not the basis of the hardship. The applicant admits that adding a second
sign is not an economic consideration or the basis of their perceived hardship. Their clinic essentially occupies
two (2) units and the frontage looks architecturally different giving the visual sense that there are two (2)
businesses instead of one (1).
The circumstances causing the hardship are unique to the individual lot. The applicant feels that the hardships
that they foresee are unique to the individual site. Their clinic essentially occupies two (2) units and the frontage
looks architecturally different giving the visual sense that there are two (2) businesses instead of one (1).
The granting of the variance is in keeping with the spirit and intent of the Zoning Code and Comprehensive
Land Use Plan. Staff could find no evidence that the applicant's request is in keeping with the spirit and intent
of the City's Zoning Code or Comprehensive Land Use Plan.
Action: Establish Findings of Fact for this request, based on information and testimony presented by the
applicants, the public and staff and pass a recommendation to Council regarding the variance request to the
City's Sign Ordinance for a second identification sign.
Communications: Staff received one phone call regarding this application and the caller was against the
variance request to allow a second identification sign.

started the construction of any building,structure,addition or alteration requested as part of the approval,said variance
shall become null and void unless an application for extension of the approval has been submitted. A letter to extend

Reason for Variance Application
Statement of Unique Circumstances
St. Anthony Village Clinic/Hennepin County Medical Center has recently opened a new
community clinic in the Shopping Center located at 2748 Hwy 88. The clinic has a large storefront
however, the patient entrance is located to the for right of the store on a fascia that is setback
from the main storefront elevation. It is essential that users of all ages and physical disabilities,
medical conditions understand where the main entry is for ease in approaching the facility, from
vehicular traffic or when being dropped off.
Currently the larger sign centered on the brick fascia is intended to act as identification and
advertising for the clinic as there is not a possibility of ground monument identification. The sign
requiring the Variance on the setback elevation is meant to direct users to the entrance in a more
user friendly manner while providing lighting on the "Entrance" letters and sidewalk..
The signage has been designed with down lighting to illuminate the "Entrance" non illuminated
letters which are essential during when daylight savings time is not in use during the dark winter
months.
The signage for each wall surface is less than 15%of the wall surface per (11) Signs on walls. Wall
signs having a sign surface area exceeding 15%of the area of the wall
surface to which it is affixed;
This Variance Request is for the allowance of two identification signs on one frontage.
The current sign code within this C = Commercial District reads as follows:
(B) Commercial and limited business. The following signs are allowed in a"B"Service Office Limited
Business District and"C"Commercial Districts and may be installed after obtaining a permit and
Paying a required license fee.
(1) One identification sign per right-of-way frontage per commercial establishment. The sign may
have no more than 2 square feet of surface area per lineal foot of business frontage, up to a
maximum of 150 square feet.The total area of all wall signs affixed to a wall may not exceed 15%
of the total area of that wall.
The Subject matter of the application is within the scope of this section:

(a) The property owner proposes to use the property in a reasonable manner not
permitted by the zoning code.
(b) The plight of the property owner is due to circumstances unique to the property not created by
the property owner.
(c) The variance, if granted, will not alter the essential character of the locality.

(3) The variance, if granted, would be consistent with the city's comprehensive land use plan.
(4) The granting of the variance is in harmony with the general purposes and intent of the zoning

Congratulations to Don and Pat on their re-appointment to the Planning Commission! Their new three- year
terms will run through December 31, 2014.
Commissioners Jensen and Niccum will need to be sworn in for their new terms prior to the January 17`h
meeting.
Also, the first order of business at the January Planning Commission meeting is to select a new chair and vice-
