CITY COUNCIL REGULAR MEETING MINUTES
FEBRUARY 10, 2009
CALL TO ORDER.
Mayor Faust called the meeting to order at 7:00 p.m.
PLEDGE OF ALLEGIANCE.
Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance.
ROLL CALL.
Present: Mayor Faust; Councilmembers Gray, Roth, Stille, and Thuesen
Absent: None
Also Present: City Manager Mike Momson, City Attorney Jerome Gilligan, Assistant City Manager
Kim Moore - Sykes, Police Chief John Ohl, and Liquor Operations Manager Mike
Larson.
CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING
ITEMS.
I. APPROVAL OF FEBRUARY 10, 2009 CITY COUNCIL MEETING AGENDA.
Motion by Councilmember Stille, seconded by Councilmember Roth, to approve the City
Council Meeting Agenda of February 10, 2009.
Motion carried unanimously.
II. PROCLAMATIONS AND RF,COGNITIONS.
None.
III. CONSENT AGENDA.
A. Consider January 27, 2009 Council meeting minutes.
B. Consider licenses and permits.
C. Consider payment of claims.
Motion by Councilmember Thuesen, seconded by Councilmember Gray, to approve the Consent
Agenda items.
IV. PUBLIC HEARING.

1 A. Ordinance No. 09 -001: Codifying the General Ordinances of the City of St Anthony,
2 Minnesota: Adopting a New City Code, and Repealing Certain Ordinances Kim Moore -
3 Sykes, Assistant City Manager, presenting,

5 Assistant City Manager Moore -Sykes reviewed Ordinance 09 -001 with the Council. She stated
6 the City's Code of Ordinances was last recodified in 1993. In the 15 years since, the Code of
7 Ordinances has experienced occasional minor revisions that reflected changes in governing at the
8 local, state or federal levels. In the last two years, staff has witnessed more substantial changes
9 that needed to be included in the City's Code of Ordinances. The proposed revisions included
10 major changes to the City's Sign Ordinance, Building Code, Fire Code, Animal Control
11 Ordinance, and the addition of a City Housing Code. Council identified recodification of the City
12 Code as a goal at the 2007 Goal Setting. A bid from American Legal Publishing, who works with
13 the League, was approved June 12, 2007.

15 Assistant City Manager Moore -Sykes provided a PowerPoint presentation on the 2009
16 Recodification of the City Code.

18 City Manager Mornson stated the third reading of the Ordinance 09 -001 is scheduled for March
19 10, 2009. The recodification will be effective on April 1, 2009 to give the Police Department the
20 opportunity to work with the counties. He stated the contract the City has with American Legal
21 Publishing allows for updates to existing ordinances and additions of new ordinances.

23 Councilmember Thuesen inquired about the $18 charge by American Legal Publishing for
24 revisions as outlined in the contract. Assistant City Manager Moore -Sykes explained there would
25 be an $18 charge for any revisions at the end of the three year contract.

27 Mayor Faust inquired whether it would be plausible to include the code recodification on the
28 City website with the status of "pending approval ". Assistant City Manager Moore -Sykes
29 indicated this could be done. However, there could be difficulties if someone were to depend on
30 the document as current because it does not become effective until April.

32 Council consensus was that staff report back to Council on the possibility of including the
33 recodification on the City website.

35 It was noted that there is a dynamic search engine available with the current ordinance book on
36 the City website and that this tool will likely be available with the recodification.

V. REPORTS FROM COMMISSION AND STAFF.
A. 2009 Goals Presentation. Richard Fursman Global Synergy Group presenting_
7 Mr. Richard Fursman, Global Synergy Group, provided a PowerPoint presentation on the
8 January 25, 2009 St. Anthony Village Strategic Planning & Focus Session. The presentation
9 included an overview of the following agenda of the Session:

34 Mr. Fursman commended the City Council on how seriously this is taken and how it pays
35 dividends to the community.

37 Mayor Faust thanked the Council, staff, and Mr. Fursman for the work put into the Strategic
38 Planning & Focus Session. He stated it is a good opportunity to distill the information received
39 from the residents into hard concrete direction to move the City over the next few years. The
40 goals do not change; they are general areas. The City will never be finished with the goals of
41 environmental stewardship and technology. This retreat goal setting session provides the
42 opportunity to put plans in action and move forward.

44 Councilmember Stille verified with Mr. Morrison that the additions to the goals that have been
45 discussed are not substantive and can be added after the goals have been adopted.

5 B. St. Anthony Liquor Operations Annual Report. Mike Larson, Liquor Operations
6 Manager, reporting,

8 Liquor Operations Manager Larson provided a PowerPoint presentation on the St. Anthony
9 Village Liquor Operations 2008 Annual Report, including the following information:

21 Liquor Operations Manager Larson stated the appreciation Liquor Operations staff has for the
22 working relationship with the other departments in the City.

24 Councilmember Gray inquired about the difference in average sales between 2007 and 2008.
25 Liquor Operations Manager Larson stated there was an increase of about $1.40 per sale between
26 2007 and 2008. Items like high priced wines slowed down in sales dramatically and moved
27 towards the lower priced wines. He stated the largest price increases he can remember came from
28 suppliers this year and came fast and furious throughout the year.

30 Councilmember Thuesen asked if there was a change in people purchasing less expensive beer
31 rather than specialty beers. Liquor Operations Manager Larson replied no; St. Anthony Liquor
32 Operations specializes in crafted micro, more expensive beers, and that selection fights off the
33 trend of buying less expensive beers. They have seen people go for better quality and reducing
34 the amount they are buying. He noted that three new liquor stores opened around the community
35 in 2008. About three to four months after the openings there was a drop in overall sales at the
36 Silver Lake Village Store. In regards to the increased sales in dollars he believes they are
37 capturing the market when it comes to larger volumes for the holidays.

39 Councilmember Roth inquired about plans to be the leader in wine sales for 2009. Liquor
40 Operations Manager Larson stated approximately 150 new wines have been brought in since the
41 middle of January with an emphasis on trying to be sensitive to the price points the customers
42 will want.

44 Mayor Faust commended Liquor Operations staff for the diligence in making sure that everyone
45 who purchases liquor is a bona fide legal buyer. He pointed out that this keeps the City and
46 residents safe and provides good revenue for the City.

2 C. St. Anthony Police Department Annual Report. John Ohl, Police Chief, reporting,
4 Police Chief Ohl provided a PowerPoint presentation on the St. Anthony Police Department
5 2008 Annual Report, including the following information:

17 Police Chief Ohl commended Captain Dominic Cotroneo and the officers. He thanked Mayor
18 Faust, the City Council, and City Manager Mornson for the support of the Police Department.

20 Mayor Faust requested information about the Shop with a Cop Program. Police Chief Ohl stated
21 Walmart and Pepsi donated funds and have allowed the Police Department to take kids that have
22 been identified by the School District as being in economically difficult situations shopping.
23 They were able to fill some Christmas wishes.

25 Mayor Faust requested information about the Stop and Talk Program. Police Chief Ohl explained
26 Stop and Talk involves police officers interacting with citizens about the potential for them to
27 become a victim of an offense. One example would be leaving a note or making contact with an
28 individual when a garage door is left open.

30 Mayor Faust commended the Police Department for the way they reach out to the community
31 and show that they are there to protect and serve.

33 Councilmember Gray inquired about changes in crimes categorized as theft and whether these
34 types of crimes are economically driven. Police Chief Ohl replied he has not been able to
35 determine a direct correlation between the economy and criminal offenses. When gas prices were
36 high there were drive offs, but business people react to the trend and do business in a different
37 way such as requiring pre -pays. He pointed out that Part 1 crimes are flat and there has been a
38 decrease in Part 2 crimes.

40 Councilmember Roth requested discussion on what citizens can do to better protect their
41 property and neighbors' property as far as getting police involved when they see something
42 suspect. Police Chief Ohl stated the Police Department conducts premise surveys for crime
43 prevention purposes if requested. One of the best ways to affect offenses in the City is to call 911
44 when an individual sees something that does not look right. He stated the big message is to be
45 willing to be wrong. There will often be a reasonable explanation for what is seen, but there are

1 times the 911 call will help the Police Department find the bad guy. He stated citizen
2 involvement resulted in solving a bank robbery and the arrest of a pair of burglars.

4 Mayor Faust expressed the deep gratitude of the Council and residents to the police officers and
5 reserve officers. He stated the officers are risking their lives on the citizens' behalf and it does
6 not go unnoticed. When he talks to the residents they are very impressed with how the work is
7 done.

13 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS.

15 City Manager Morrison reported on the following:
16 ■ Thank you to Liquor Operations Manager Larson and Police Chief Ohl and their staff for
17 the reports presented tonight.
18 ■ Silver Lake Village: Building permits are on file for Smash Burger and Radio Shack.
19 ■ Staff met with the garbage haulers as a result of the Single Hauler Task Force Report.
20 Dialogue will continue on the issues that were brought up in the single hauler task force
21 meetings.
22 ■ Last week Mayor Faust, Finance Director Larson, and he attended an Ehlers &
23 Associates seminar where St. Anthony was mentioned by two city managers and a
24 developer as a city that did something right.
25 ■ The Fire Department recently conducted CPR classes at St. Anthony and St. Charles
26 schools.
27 ■ The Water Reuse Project has received an Honorable Mention for Project of the Year by
28 the City Engineers Association of Minnesota.
29 ■ Mayor Faust and Public Works Director Jay Hartman received an Environmental
30 Leadership Award from the Freshwater Society for efforts to reduce the environmental
31 impacts of winter road maintenance.

33 Councilmember Gray reported on the following:
34 ■ Thursday February 5, 2009 St. Anthony Chamber of Commerce Board meeting. This
35 month's general membership meeting will be held on February 17, 2009 and will include
36 a round table discussion on the future of the Chamber. Executive Director George
37 Wagner will be retiring from his position on the Board.
38 ■ February 5, 2009 North Suburban Communications Commission meeting. He will serve
39 as Chair of the Commission this year and President of the North Suburban Access
40 Corporation which oversees CTV.
41 ■ February 26, 2009 at 6:00 p.m. there will be a meeting held at the offices of North
42 Suburban Communications Commission for anyone in the ten cities area that would like
43 to talk about community broadband network.

5 Mayor Faust reported on the following:
6 ■ January 28, 2009 he and City Manager Morrison met with the mayor and city manager of
7 Columbia Heights to discuss setting ground work to look at cost sharing. There will
8 dialogue at the city manager /finance director /public works director level about ways to
9 possibly share service or equipment that would benefit both cities.
10 ■ On February 3, 2009 he and Public Works Director Hartman accepted an award from the
11 Freshwater Society on the 8`h Annual Road Salt Symposium for efforts to reduce the
12 environmental impacts of winter road maintenance.
13 ■ February 4, 2009 City Council work session included a discussion on a number of issues
14 including the budget and the creation of a number of meetings in the future on how to
15 move forward with the budget.
16 ■ February 5 and 6, 2009 Public Finance Seminar which included presentations on the
17 importance of the City having a financial plan in place for a disaster.
18 ■ February 9, 2009 Vital Aging Council meeting. There was discussion on the Adopt a
19 Bench Program, the monitors and availability of earphones in the City Council
20 Chambers, transportation options that are available, Clean-Up Day, service on the Police
21 Department 24 hour call list, and the possibility of Vital Aging Council meeting dates
22 being included on the new electronic sign in addition to the information currently being
23 included in the Village Notes and Channel 16.
24 City Manager Morrison and he met with the city managers and mayors of Lauderdale and
25 Falcon Heights. Police Chief Ohl provided an overview for the cities. They are extremely
26 pleased with the efforts of Police Chief Ohl and the efforts of his police officers.

31 are not on the regular agenda.
