ANTHONY CITY COUNCIL REGULAR MEETING MINUTES NOVEMBER 25, 2008 CALL TO ORDER. Mayor Faust called the meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE. Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. ROLL CALL. Present: Mayor Faust; Councilmembers Gray, Roth, Stille, and Thuesen Absent: None Also Present: City Manager Mike Mornson, Assistant City Manager Kim Moore - Sykes, Assistant Fire Chief Don Drusch, and Todd Hubmer, WSB & Associates CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING ITEMS. I. APPROVAL OF NOVEMBER 25, 2008 CITY COUNCIL MEETING AGENDA. Motion by Councilmember Gray, seconded by Councilmember Roth, to approve the City Council Meeting Agenda of November 25, 2008. Motion carried unanimously. II. PROCLAMATIONS AND RECOGNITIONS. A. Fire Prevention Poster Contest Winners. Mr. Drusch provided background information on the Fire Prevention Poster Contest. He stated it has become very difficult to judge these fire prevention posters due to the quality of the posters that have been entered in the cost. He stated his appreciation of the School District's participation in the Fire Prevention Poster Contest Program. Mr. Drusch announced the first through fourth place winners in the Fire Prevention Poster Contest. Mayor Faust presented each contest winner with a certificate and check. I1I. CONSENT AGENDA. A. Consider November 12, 2008 Council meeting minutes. B. Consider licenses and permits. C. Consider payment of claims. Motion by Councilmember Stille, seconded by Councilmember Roth, to approve the Consent Agenda items. City Council Regular Meeting Minutes November 25, 2008 Page 2 Motion carried unanimously. IV. PUBLIC HEARING. None. V. REPORTS FROM COMMISSION AND STAFF. 9 A. Resolution 08 -072, Administrative Lot Combination for 3534 Harding Street 10 11 Mr. Brian Heinis, Planning Commission Member, provided a report on the administrative lot 12 combination for 3534 Harding Street. He stated the Planning Commission was in agreement with 13 the lot combination and there were no comments in opposition of the lot combination. 14 15 Mayor Faust noted for the public that the house was removed from the two parcels in this 16 location. The purpose of the lot combination is that the owner plans to build a new house on the 17 lot, which must be 9,000 square feet in size. 18 19 Mr. Heins stated the one comment made by the Commission was that the City should work in 20 good faith to ensure that the landowner is not delayed due to any delays resulting from the 21 County and the tonens process used to combine the parcels. 22 23 Motion by Councilmember Thuesen, seconded by Councilmember Gray, to adopt Resolution 08- 24 072, Administrative Lot Combination for 3534 Harding Street. 25 26 Motion carried unanimously. 27 28 VI. GENERAL BUSINESS OF COUNCIL. 29 30 A. Consider Resolution 08-073, of the 2008 Comprehensive Plan 31 32 Mr. Bill Weber, McComb, Frank and Roos, provided a presentation on the Draft City of St. 33 Anthony Comprehensive Plan Update dated October 2008. 34 35 Councilmember Stille questioned the effect of the increased population estimate included in the 36 current Comprehensive Plan Update. Mr. Weber replied some of the figures in the last chapter of 37 the Water Resources Plan were changed in relation to the expected outflow of waste water to 38 correspond with the increased population. Also, a small property on the northeast end of the City 39 was changed from the current land use of Commercial to a possible land use of Housing or 40 Commercial in the future. The landowner of this parcel has been to the City inquiring about a 41 possible land use change. 42 43 Motion by Councilmember Roth, seconded by Councilmember Gray, to adopt Resolution 08- 44 073, Adoption of the 2008 Comprehensive Plan. 45 46 Motion carried unanimouslv. City Council Regular Meeting Minutes November 25, 2008 Page 3 2 Mayor Faust thanked the Planning Commission and staff for their work on the Comprehensive 3 Plan Update. 4 5 B. Consider Resolution 08 -074: Ordering Transfer of Ownership and Preparation of 6 Feasibility Report for Arbors Alley Roadway and Utility Improvements 8 Mr. Hubmer reviewed the resolution with the Council and indicated that residents of the Arbor 9 Townhome Community have submitted a petition requesting the City to take ownership and 10 complete public street and utility improvements on the alley located immediately south of Croft 11 Drive and west of Old Highway 8. The alley is currently owned and maintained by the Arbors 12 Homeowners Association. The proposed resolution authorizes a feasibility study to consider the 13 City taking over ownership of the alley and completing reconstruction of the roadway and 14 utilities. 15 16 Councilmember Thuesen questioned if the assessments would be the traditional 35/65 split. Mr. 17 Hubmer replied on an alley improvement such as this, assessments would be proposed at 100% 18 to bring the road up to city standards before the City takes ownership. 19 20 Councilmember Thuesen asked if there are other alleys in the City that are similar to this where 21 the City has not taken control of the roadway. Mr. Hubmer replied there are one or two small 22 alleys that exist in the City. 23 24 Councihnember Gray questioned if there is any precedent of the City taking over an alley in this 25 manner. Mr. Morrison responded in the negative. 26 27 Councilmember Roth clarified with Mr. Hubmer that the alley is currently owned by The Arbors 28 Townhome Association. The Arbors does not physically have access to their property from this 29 alley and the watermain does not serve the Arbors site. However, The Arbors has ownership 30 responsibility for the maintenance of the watermain and maintenance of the roadway. There are 31 two residences that receive their water from this watermain. 32 33 Councilmember Gray questioned why the resolution authorizes the transfer of ownership and the 34 feasibility study at the same time, rather than completing the feasibility study first. Mr. Hubmer 35 explained part of the feasibility study is exploring the issues associated with purchasing the 36 parcel. He noted the resolution was not intended to authorize a transfer of ownership. 37 38 Mayor Faust clarified with Mr. Hubmer that the request is not to transfer ownership of the parcel 39 at this time. The request is to conduct a feasibility study on the utilities and to look at the issues 40 associated with the transfer of ownership. 41 42 Mr. Hubmer indicated he will discuss the land transfer with the City Attorney. He suggested 43 amending the proposed resolution as follows: 44 A Resolution Ordering Preparation of Feasibility Report for 45 Arbors Alley Roadway and Utility Improvements City Council Regular Meeting Minutes November 25, 2008 Page 4 1 "WHEREAS, it is proposed the City of St. Anthony and 2 improve..." 3 4 Councilmember Roth verified with Mr. Hubmer that the subject alley will be built to the same 5 standards as the alley behind his home on 27`h Avenue. 6 7 Motion by Councilmember Gray, seconded by Councilmember Stille, to adopt Resolution 08- 8 074, Ordering Preparation of Feasibility Report for Arbors Alley Roadway and Utility 9 Improvements (as amended above). 10 11 Councilmember Roth questioned who will pay for the feasibility study. Mayor Faust replied it is 12 paid for by the City. 13 14 Mr. Hubmer stated the feasibility costs would be added to the assessment if it is determined to go 15 forward with the improvement. 16 17 Motion carried unanimously, 18 19 C. Consider Ordinance 08 -007, Dangerous Dog Ordinance. (2 "d reading). 20 21 Mr. Mornson reviewed the ordinance with the Council and provided the following staff response 22 to questions raised by the Council during the first reading on November 12, 2008: 23 ■ 1205.01— Staff has deleted "cat" from this section to keep consistency in the ordinance. 24 ■ 1205.05 — The 10 -day period has been recommended by veterinarians for detecting 25 rabies. 26 ■ 1205.08 — This section does not reflect a period of time as we may need more than 10 27 days in some cases. Generally, if the owner has proof of the rabies shots, we implement 28 1205.05 and allow the owner to quarantine the animal for 10 days. The police department 29 has been told that this time period will, in most cases, reveal if the dog is sick. 30 ■ Staff did not define potentially dangerous dogs, as the hearing process only refers to 31 dangerous dogs. We will depend on State Statute for a variety of definitions rather than 32 reiterating State Statute in our ordinance. 33 34 Mr. Momson noted the appeals process outlined in Section 1205.11. 35 36 Motion by Councilmember Roth, seconded by Councilmember Gray, to hold second reading of 37 Ordinance 08 -007, Dangerous Dog Ordinance. 38 39 Motion carried unanimously. 40 41 VIL REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 42 43 City Manager Mornson reported on the following: 44 The next regular City Council meeting is scheduled for Monday, December 8, 2008 45 following the Truth in Taxation Public Hearing. City Council Regular Meeting Minutes November 25, 2008 Page 5 1 ■ The Fire Department has purchased one of the first carbon monoxide detectors for the 2 Department. 3 ■ Bob Paschke, Public Works Supervisor for 17 years, has resigned to take a job with the 4 City of Monticello. His last day will be tomorrow. 5 ■ The Metro Cities Regional Meeting included a recommendation on implementing a sewer 6 inspection policy. It has been verified that the City currently does a good job with its 7 sewer inspection program. Also, Chair of the Metropolitan Council, Peter Bell, 8 encouraged cities to submit their comprehensive plans. 9 ■ Improvements to the Council Chambers that are included in the budget will be done 10 between December 17`h and January 13`h 11 ■ The City Hall parking lot was finished today with a base to last through the winter. A 12 mill, overlay and striping will be completed next year. 13 14 Mayor Faust requested Mr. Mornson to express the Council's thanks to Mr. Paschke for his 17 15 years of service. 16 17 Councilmember Roth reported on his attendance at the Metro Cities Regional Conference last 18 week. 19 20 Councilmember Stille reported on the following: 21 ■ His attendance at the November 14, 2008 Silver Lake Road Ribbon Cutting Ceremony 22 ■ His attendance at the November 17, 2008 Final Single Hauler Garbage Task Force 23 Meeting. Findings of fact and a recommendation will be presented to the City Council at 24 the December 8, 2008 City Council meeting. 25 • The public is invited to attend the December 7, 2008 Sister City Annual Meeting at 7:00 26 p.m. 27 28 Councilmember Thuesen reported on his attendance at the following events: 29 ■ Metro Cities Regional Conference last week 30 ■ Silver Lake Road Ribbon Cutting Ceremony 31 32 Councilmember Gray reported on his attendance at the Metro Cities Regional Conference last 33 week. 34 35 Mayor Faust reported on his attendance at the following events: 36 ■ November 14, 2008 Silver Lake Road Dedication. The brass plaque presented to 37 Commissioner Stenglein by the City of St. Anthony with a signature of his father as 38 Mayor emeritus was very appreciated. It was reported that the 4M Fund is being invested properly. VIII. COMMUNITY FORUM. Mayor Faust invited residents to come forward at this time and address the Council on items that are not on the regular agenda. Hearing none, Mayor Faust moved forward with the agenda. IX. INFORMATION AND ANNOUNCEMENTS. Mayor Faust announced the Middle Mississippi Watershed Management Organization will be putting on a parking lot and sidewalk maintenance workshop intended for developers and retailers on December 11, 2008 at the St. Anthony City Council Chambers.
