ANTHONY CITY COUNCIL REGULAR MEETING MINUTES October 9, 2007 CALL TO ORDER Mayor Faust called the meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. ROLL CALL Present: Mayor Faust; Council Members Gray, Horst, and Thuesen. Absent: Councilmember Stille Also Present: Assistant City Manager Moore -Sykes CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING ITEMS: I. APPROVAL OF THE OCTOBER 9, 2007 CITY COUNCIL MEETING AGENDA. Motion by Councilmember Horst seconded by Councilmember Gray to approve the City Council meeting agenda of October 9, 2007 as presented. Motion carried. II. PROCLAMATIONS AND RECOGNITIONS None III. CONSENT AGENDA A. Gensider Aimfeval of the r B. Consider Licenses and Permits C. Claims D. Resolution 07-068, of Election Judges for the November 6 2007 General Municipal Election. E. Resolution 07 -069• Approving the Ramsey County Score Grant. Councilmember Thuesen requested Item A be removed for corrections. Motion by Councilmember Thuesen, seconded by Councilmember Gray, to approve the Consent Agenda Items B, C, D, and E. Motion carried. Consider Approval of the September 25 2007 Council Meeting Minutes 2 3 Councilmember Thuesen requested that page 4, line 31 read "He commented that he believes the 4 consensus from the community is happy with the projects." 6 Councilmember Thuesen requested that "Did not meet" be stricken from page 6, line 33. 7 8 Motion by Councilmember Thuesen, seconded by Councilmember Horst, to approve Consent 9 Agenda Item A as amended. 10 11 Motion carried. 12 13 IV. Ordinance 07 -004• Text Amendment to Light Industrial Section 1640.02 (Second 24 Reading) 25 26 Assistant City Manager Moore -Sykes reported the prospective buyers of 2812 Anthony Lane 27 South requested a text amendment to the City's Zoning Ordinance to allow daycares as a 28 permitted conditional use in the Industrial Zoning District. She stated the applicants presented 29 the proposed text amendment to the Planning Commission in a concept review at the August 21, 30 2007 Planning Commission meeting. She stated Staff sent the proposed text amendment to the 31 City Attorney for his review and comments. She stated the proposed text amendment was 32 considered at a Public Hearing during the September 18, 2007 Planning Commission meeting 33 where it was recommended for approval. 34 35 Assistant City Manager Moore -Sykes stated the applicant presented the proposed text 36 amendment to the City Council on September 25, 2007 for Council action. She reported the 37 Council moved the first reading and requested it back before the City Council for a second 38 reading at the October 9, 2007 City Council Meeting. She stated that if the proposed language 39 change is approved, it would allow daycare centers as a permitted conditional use in the 40 Industrial Zoning District and this would require an approved Conditional Use Permit (CUP). 41 42 Motion by Councilmember Thuesen, seconded by Councilmember Gray, to approve Ordinance 43 07 -004, an Ordinance Amending Chapter 15 of the City Code being Zoning and Land Use, 44 Second Reading. 45 46 Motion carried. Ordinance 07 -005• Chapter 555 of the City Ordinance, Single Sort Recycling (First 3 Readin 4 5 Assistant City Manager Moore -Sykes reported that in September 2006, the City Council adopted 6 an ordinance allowing single -sort recycling in St. Anthony for twelve months as a pilot program. 7 She stated the City Council wanted to see how well the community accepted this change in 8 collecting recyclables, if this method was efficient in its collection of recyclables, and effective 9 in maintaining or increasing recycling efforts within the community. 10 11 Assistant City Manager Moore -Sykes reported that because a number of metro -area communities 12 had implemented this method of collecting recycling, the City Council asked Staff, as part of this 13 pilot program, to investigate many of the claims before approving a permanent single -sort 14 recycling program. She explained Council wanted Staff to review tonnage amounts collected 15 and compare those amounts collected by the dual -sort collection method, a method traditionally 16 used by the City; provide the residents information about single -sort recycling; obtain feedback 17 from the residents using single -sort recycling; and flush out issues that needed to be addressed in 18 the single -sort recycling ordinance. 19 20 Assistant City Manager Moore -Sykes reported the findings stating the amounts collected by the 21 two methods were roughly comparable at the same point in the year. 22 23 Assistant City Manager Moore -Sykes reported Staff and representatives from Allied Waste, 24 Walter's, and Waste Management advised the City Council that they would provide residents 25 and customers with the information regarding single -sort recycling. She stated Council also 26 requested that residents be provided information about the new recycling bins and the various 27 sizes available to meet their needs. She reported Staff provided information to the residents 28 through the City's newsletter and personal requests for information. 29 30 Assistant City Manager Moore -Sykes indicated overwhelming amounts of ernails were received 31 from residents stating their support for continuing the single -sort recycling method. She stated 32 many indicated convenience as the primary reason in that one container for all recyclables 33 reduced time spent sorting and only one container had to be rolled to the end of the driveway. 34 She stated Staff estimates they received more than 50 responses in favor of continuing single -sort 35 recycling. 36 37 Assistant City Manager Moore -Sykes reported some residents voiced concern about the 38 possibility of broken glass mixing with recycled paper. She stated staff received one emailed 39 response from a hauler advising that they have not received any complaints from their mills 40 regarding glass shards in the paper. She stated another hauler verbally indicated that they also 41 have not received any complaints about glass. She commented other residents commented 42 favorably on the reduction of trips and trucks are making on the City streets; a few also 43 commented on the welcomed reduction in noise and fuel smell in the air. 44 45 Assistant City Manager Moore -Sykes stated staff recommends approval. 46 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 City Council Regular Meeting Minutes October 9, 2007 Page 4 Councilmember Thuesen stated he was surprised the single -sort numbers were not higher. Assistant City Manager Moore -Sykes replied St. Anthony has always been forthcoming with recycling. Councilmember Horst asked how the single sort recycling affected apartments and townhouses. Assistant City Manager Moore -Sykes replied multi - family units are required to recycle. Ms. Torre Heiland, Municipal Marketing Manager, Waste Management, replied that commercially it is up to the City Ordinance if they are included. She reported that Waste Management offers recycling containers for paper and cardboard and another for other recycled items. She stated there is a contract between the apartments and the townhome associations and the waste hauler. Mayor Faust asked why an apartment or townhome would not want single sort recycling. Mr. Eric Sederstrom, Operations Manager, Walters Recycling and Refuse, Inc. replied they have a hard time keeping the garbage out of the recycle. He stated they have struggled with this. Councilmember Horst questioned whether the hauler could site a homeowner for contaminating recycle bins with garbage. Mr. Sederstrom stated from his experience this is hard to do in apartment or townhome complexes where it is hard to know who put garbage in with recycling. Mr. Sederstrom commented that a homeowner would be notified if garbage was contaminating the recycle and the hauler would not pick it up. Councilmember Horst stated that as a new townhome owner, he noticed the recycling bins. Mayor Faust asked all the haulers would provide single -sort recycling if an apartment or condominium complex wanted it. He commented that it is really a case of accountability by the apartment or condominium residents to recycle appropriately. Mr. Sederstrom replied that was correct. He stated in many communities, multi dwellings are requiring the residents to recycle. Mayor Faust questioned why the single -sort is resulted in less tonnage than dual sort. Ms. Heiland replied participation rate had increased by 20 %; however, they have lost homes, so she could not really answer why the tonnage was low. Mr. Sederstrom stated he was amazed at the tonnage results. He stated St. Anthony has always had about a 98% response rate. He commented that perhaps the reporting formulas used previously were not as accurate as they are now. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 City Council Regular Meeting Minutes October 9, 2007 Page 5 Motion by Councilmember Horst, seconded by Councilmember Gray, to approve Ordinance 07- 005, an Ordinance approving Chapter 555 of the City Ordinance, Single Sort Recycling, First Reading. Councilmember Horst recommended waiving a second and third reading. Mayor Faust replied it is better to hold all three readings in case additional information comes forward. Councilmember Gray agreed with Mayor Faust. He questioned whether there was any negative response for the single -sort recycling. Assistant City Manager Moore -Sykes replied one resident did not like single -sort because of the color of the bins. Councilmember Horst requested the haulers be available to answer questions at the second and third readings. Motion carried. VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. Assistant City Manager Moore -Sykes reported the St. Anthony Police Department will be offering two safety seminars. She stated the first seminar will be held on October 24, 2007 from 7:00 p.m. to 8:00 p.m. regarding computer and internet safety and the second seminar on November 7, 2007 from 7:00 p.m. to 8:00 p.m. would cover sexual assault and personal safety. She stated she would make sure these were advertised on CTV and the website. Assistant City Manager Moore -Sykes reported a new Historical Society Brochure is available. She stated she finds out new information almost daily about St. Anthony and it is important to retain the history of the City. She stated the Historical Society meets the third Wednesday of every month from 2:00 p.m. to 3:30 p.m. She stated it is interesting to see the scrapbooks and information brought forward by residents. Assistant City Manager Moore -Sykes invited the Council to attend the League of Minnesota Cities Regional Meetings. The Metro meeting will be held on November 29, 2007 in Bloomington. She commented anyone that wanted to attend and should let her know and she will complete the registration. Councilmember Horst reported attending the St. Anthony Community Services Advisory Council meeting on October 4, 2007. He noted that childcare enrollments are somewhat down and stated a needs assessment discussion on what services should be operating out of the City would occur at the next several meetings. He asked residents to contact the St. Anthony School District or Community Services for more information. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 City Council Regular Meeting Minutes October 9, 2007 Page 6 Councilmember Thuesen reported he attended a workshop about water quality and land use. He reported there are five things that homeowners could do to improve water quality include keeping lawn clippings, fertilizers, pet droppings, and phosphates on the yard and not in the street. He reported that one of the issues being looked at is the use of road salt as one teaspoon of salt in five gallons of water equates to impaired water. Councilmember Gray reported attending the North Suburban Communications Commission's NATOA Conference from October 2 through October 6, 2007. He reported the conference focused on where the United States rated relative to broadband. He reported the US has slipped to 181h place from first place. He stated he would present what he found out during a work session. Mayor Faust reported that on October 2, 2007, KGAN TV from Cedar Rapids, Iowa interviewed him and Mr. Len Pratt on the St. Anthony Village project. He stated KGAN TV would report on how Silver Lake Village was developed and the relationships with the developers. He stated Cedar Rapids is involved with a similar project. Mayor Faust reported that on October 4, 2007 he attended the Water Quality and Land Use Workshop also. He reported on the type of land cover that accounts for the impervious surface is city streets. He stated the City has control over how often streets are swept and how much salt and sand is put on the streets. Mayor Faust reported that on October 4, 2007 he attended a Personnel Committee Meeting with the League of Minnesota Cities. VIII. COMMUNITY FORUM None IX.
