ANTHONY 2 CITY COUNCIL REGULAR MEETING MINUTES 3 OCTOBER 11, 2005 4 5 CALL TO ORDER. 6 Mayor Faust called the meeting to order at 7:00 p.m. 7 8 PLEDGE OF ALLEGIANCE. 9 Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. 10 11 ROLL CALL. 12 Present: Mayor Faust; Councilmembers Gray, Horst, Stille, and Thuesen. 13 Absent: None. 14 Also Present: City Manager Mike Momson. 15 16 17 CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING 18 ITEMS. 19 20 I. APPROVAL OF OCTOBER 11, 2005 CITY COUNCIL MEETING AGENDA. 21 Motion by Councilmember Horst, seconded by Councilmember Stille, to approve the City 22 Council Meeting Agenda of October 11, 2005. 23 24 Motion carried unanimously. 25 26 II. PROCLAMATIONS AND RECOGNITIONS. 27 None. 28 29 I1I. CONSENT AGENDA. 30 A. Consider September 27, 2005 Council meeting minutes 31 B. Consider licenses and permits. 32 C. Consider payment of claims. 33 34 Motion by Councilmember Thuesen, seconded by Councilmember Stille, to approve the Consent 35 Agenda items. 36 37 Mayor Faust pointed out that Page 3, Line 17 should read Ayes — 4, Nay — I ( Stille) Motion 38 carried rather than Ayes — 3. 39 40 Motion carried unanimously. 41 42 IV. PUBLIC HEARINGS. 43 None. 44 45 V. ITEMS TABLED FROM SEPTEMBER 27, 2005 COUNCIL MEETING. 46 A. Ordinance, 05 -011; Egress Window (requires only one reading). 47 48 Mr. Morrison explained the resolution. The amendment to the Ordinance is the addition of Item 49 J: The Building Official and/or the Fire Marshall shall have the authority to require a fence or City Council Regular Meeting Minutes October 11, 2005 Page 2 1 any other means of structure to be installed in such a manner as to protect the public from 2 accidentally falling, tripping or sustaining an injury of any sort as the result of the installation 3 and existence of an egress window well. 4 5 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve the first and 6 final reading of Ordinance 2005 -011 re: An Ordinance relating to amending Section 1650.03 of 7 the St. Anthony City Code. 9 Councilmember Horst stated the sentence noting the Fire Marshall shall have the authority to 10 require a fence or any other means of structure to be installed is unclear. In discussions, it was 11 stipulated that this should be a fence dividing the yards and not a fence around the egress 12 window. Mayor Faust said it is his understanding the fence would keep someone off the 13 property rather than encompassing the window well. He added that the responsibility would be 14 on the applicant to be sure it is safe in order to have it approved. 15 16 Councilmember Horst clarified that the fence would have to go between the yards to get an 17 egress window permit. Mr. Morrison answered that is correct. The Fire Marshall and/or the 18 Building Official have the authority to determine whether a fence or other structure is needed. 19 20 Councilmember Horst said he was concerned about the Fire Marshall holding the authority to 21 require a homeowner to make additional improvements resulting from safety issues. He 22 suggested the Fire Marshall have the ability to strongly suggest changes be made, but not to 23 require changes be made. He stated an egress window is a safety feature, which is more life - 24 saving than the prospect of falling into a window well. 25 26 Mayor Faust pointed out that if the applicant does not have an egress window in the basement, 27 no one can sleep in there, legally, according to the State Statute. To be in compliance, a permit 28 must be obtained from the City. The Building Official and Fire Marshall would issue the permit, 29 and they would be the right persons to determine the safest way to come into compliance. That 30 may include putting in a fence. 31 32 Motion carried unanimously. 33 34 VI. GENERAL POLICY BUSINESS OF THE COUNCIL. 35 A. Consider Resolution 05 -080. re: Elected Officials Travel Policy. 36 Mr. Momson reviewed the resolution with the Council and indicated that this is a requirement 37 from the state statute. All local units of government must develop a policy that regulates travel, 38 and the policy must be reviewed annually. Any changes must be by recorded vote. This policy 39 is the same that appointed staff members have to follow. Council has always followed it, but 40 now a written policy must be in place. 41 42 Mayor Faust stated the policy is strengthened from the model provided by the League of 43 Minnesota Cities. 44 45 Councilmember Stille stated the General Guidelines states the travel must be approved in 46 advance by detailed motion. He questioned whether that means it would be something other than 47 the Consent Agenda. Mr. Morrison said it would be. City Council Regular Meeting Minutes October 11, 2005 Page 3 2 Councilmember Stille noted the second provision on page 15 states the results of the trip will be 3 given at the next Council meeting. He suggested it should state within 30 days if it is not 4 practical to give the results at the next meeting. Mayor Faust said rather than changing it, we 5 have always given reports orally and this should be sufficient. If someone would like to present 6 a PowerPoint presentation, an exception could be made. This could be changed over time if it is 7 needed. 9 Motion by Councilmember Gray, seconded by Councilmember Thuesen, to adopt Resolution 05- 10 080, re: Approving Elected Officials Out of State Travel Policy. 11 12 Motion carried unanimously. 13 14 B. Consider Ordinance 05 -013: Park Dedication Fees (first reading). 15 Mr. Mornson reviewed the Ordinance with the Council and indicated that this is amending 16 Ordinance Section 1500, Subsection 12. He read the current rates for park dedication fees. He 17 said a survey has just been completed, and it showed the City's rates are low. He also noted the 18 City does need to enhance its revenue. He recommended the rates be raised to $1,500 /unit for 19 single family, $1,800 /unit for duplex, $2,000 /unit for townhouse development, $1,000 for mobile 20 home, $1,500 unit for multi family apartment/condo and $4,000 /acre for commercial/industrial. 21 He noted these rates are still lower than the metropolitan average. 22 23 Councilmember Stille commented that St. Anthony is more in line with the inner ring suburbs. 24 The outlying cities that have new parks being built are a different market. This allows us to be 25 competitive with our neighbors. 26 27 Motion by Councilmember Horst, seconded by Councilmember Stille, to approve the first 28 reading of Ordinance 05 -013, re: Amending Section 1500.12 of the City of St. Anthony City 29 Code to Include Park Dedication Fees. 30 31 Motion carried unanimously. 32 33 C. Consider Ordinance 05 -014: Wine and 3.2 Malt Liquor Combination License (First 34 Readin . 35 D. Consider Ordinance 05 -015 • Fees for Combination Liquor License (First Reading). 36 37 Mr. Morrison indicated this Ordinance would allow businesses with an on -sale wine license and 38 an on -sale 3.2 malt liquor license to sell intoxicating malt liquor without an additional license. 39 Under current liquor legislation, the State of Minnesota allows this special license. He said the 40 establishment would need to be in compliance with all provisions stated in Section 1000.12 41 under Section 1000.12 subd. 3 Percentage of Food; businesses would need to abide by the State 42 Statute of gross receipts are at least 60% attributable to the sale of food and hold a liquor liability 43 insurance policy. The second ordinance would allow the fees for the Combination On -Sale Wine 44 and 3.2 Malt Liquor License. 45 46 Councilmember Stille clarified that this Ordinance would allow on -sale wine and anything above 47 3.2 beer. Mr. Momson responded that it allows any type of beer over 3.2 but no mixed drinks. He said 2 establishments have asked for this Ordinance in the past. Councilmember Stille asked if there is a limit in the Ordinance for 3.2 beer. Mr. Morrison said there is not. 7 Motion by Councilmember Stille, seconded by Councilmember Horst, to approve the first 8 reading of Ordinance 05 -014, re: An Amendment to Ordinance 1000.04 License Types to add a 9 Combination On -Sale Wine and 3.2 Malt Liquor License. 10 11 Motion carried unanimously. 12 13 Motion by Councilmember Thuesen, seconded by Councilmember Gray, to approve the first 14 reading of Ordinance 05 -015; re: An Amendment to Ordinance 615.06 Other License Fees to 15 include the fee for the Combination On -Sale Wine and 3.2 Malt Liquor License. 16 17 Motion carried unanimously. 18 19 VII. REPORTS FROM CITY MANAGER AND COUNCILMEMBERS. 20 City Manager Morrison reported the following: 21 • October 12, Fire Station Open House 22 • October 15, Silver Lake Village Update 23 • October 25, Council: 24 o Nextel Lease 25 o Fee Adjustment for Copy Charges 26 o Todd Hubmer to speak on the 2005 Street Project and the Lift Project 27 • November 8 Council Start at 8:00 pm 28 o John Ohl first presentation as Police Chief and swearing in of new officers 29 o Phase 2 Silver Lake Village 30 o Canvass Election Results 31 • Joint Power Agreement with Ramsey County 32 • Union Negotiations for all three unions currently underway; contracts expire this year 33 • 2 "d Storm Recap; there was incredible response from all Staff 34 • Meeting with Congressman Sabo's Staff 35 36 Councilmember Thuesen reported that the Ramsey County Library Task Force is starting to look 37 over the data collected by the task force. He reported they intend to send a recommendation this 38 month. He also thanked the Mayor for the work he did on the Joint Power of Agreement. He 39 thanked the staff for their response during the storms. 40 41 Councilmember Gray had no report. 42 43 Councilmember Horst had no report. 44 45 Councilmember Stille said as the Parks Commission Liaison he attended the September 20 open 46 house. It was an open house for the residents in the area to get a feel for the possibilities and 47 voice their opinions. The architect took comments and intends to bring something back to the 2 7 8 9 10 11 12 13 14 15 16 17 18 19 City Council Regular Meeting Minutes October 11, 2005 Page 5 Parks Commission and the Council in the first quarter of 2006. He said the open house was well attended. Mayor Faust indicated that this Saturday from 3:00 to 9:00 p.m. is the Open House for Silver Lake Village. There will be entertainment, sidewalk sales, food, street dance, and more. He noted the Chamber is taking on a fundraiser to help our troops. One of our residents is serving in Iraq. The soldiers cannot keep in contact with family very easily. He explained that AT &T calling cards are needed by the soldiers, and this is what the fundraising is for. VIII. COMMUNITY FORUM. Mayor Faust invited residents to come forward at this time and address the Council on items that are not on the regular agenda. IX. 20 X. 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 XI.
