A RESOLUTION APPROVING GRANT APPLICATIONS FOR
ENVIRONMENTAL CLEANUP FOR THE PROPERTY LOCATED AT 2501
LOWRY AVENUE NE ( LOWRY GROVE)
WHEREAS the City of Saint Anthony Village is a participant in the Livable
Communities Act's Local Housing Incentives Account Program for 2017, as determined
by the Metropolitan Council, and is therefore eligible to apply for funds under the Tax
Base Revitalization Account; and
WHEREAS the City has identified a contamination cleanup project within the City to be
known as Southern Gateway and located at 2501 Lowry Avenue NE, Saint Anthony,
Minnesota that meets the Tax Base Revitalization Account's purposes and criteria and are
consistent with and promote the purposes of the Metropolitan Livable Communities Act
and the policies of the Metropolitan Council's adopted metropolitan development guide;
and
WHEREAS, the City has not yet received development applications from the owner of
the Southern Gateway site, The Village, LLC, but The Village has advised the City that
such development applications are imminent; and
WHEREAS, the City desires to submit combined cleanup applications for environmental
grants from Metropolitan Council's Tax Base Revitalization Account, Minnesota
Department of Employment and Economic Development's Contamination Cleanup, and
Hennepin County's Environmental Response Fund; and
WHEREAS the City has the institutional, managerial and financial capability to ensure
adequate project and grant administration; and
WHEREAS the City certifies that it will comply with all applicable laws and regulations
as stated in the contract grant agreements; and
WHEREAS the City finds that the required contamination cleanup will not occur through
private or other public investment within the reasonably foreseeable future without the
grant funding.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saint
Anthony Village approves the Environmental Response Fund grant application for the
Southern Gateway development be submitted to the Hennepin County Department of
Environmental Services on May 1, 2017, by the City of Saint Anthony Village as
applicant on behalf of the Southern Gateway site, owned by The Village, LLC; and
BE IT FURTHER RESOLVED that the City of Saint Anthony Village has approved
the Contamination Cleanup grant application submitted to the Department of
Employment and Economic Development (DEED) on May 1, 2017, by the City of Saint
Anthony Village as applicant on behalf of Southern Gateway, owned by The Village,
LLC; and
BE IT FURTHER RESOLVED that the City of Saint Anthony Village is located within
the seven county metropolitan area defined in section 473.121, subdivision 2, and is
participating in the local housing incentives program under section 473.254; and
BE IT FURTHER RESOLVED that, the City Council of the City of Saint Anthony
Village hereby approved the contamination investigation and cleanup grant applications
submitted to the Department of Employment and Economic Development by the City of
Saint Anthony Village for the Southern Gateway site; and
BE IT FURTHER RESOLVED that, the City Council of Saint Anthony Village
authorizes The Village, LLC to submit an application for Metropolitan Council Tax Base
Revitalization Account grant funds and, if the City is awarded a Tax Base Revitalization
Account grant for this project, the City will be the grantee and agrees to act as legal
sponsor to administer and be responsible for grant funds expended for the project
contained in the Tax Base Revitalization grant application submitted on May 1, 2017; and
BE IT FURTHER RESOLVED that, the City of Saint Anthony Village has not yet
received, or acted, on development applications for Southern Gateway site, and the City
Council of the City of Saint Anthony reserves all right to approve, deny, or modify any
such applications for Southern Gateway site.
