ANTHONY 2 CITY COUNCIL REGULAR MEETING MINUTES 3 APRIL 25, 2017 4 5 CALL TO ORDER. 6 7 Mayor Faust called the meeting to order at 7:00 p.m. 8 9 PLEDGE OF ALLEGIANCE. 10 11 Mayor Faust invited the Council and audience to join him in the Pledge of Allegiance. 12 13 ROLL CALL. 14 15 Present: Mayor Faust; Councilmembers Brever, Gray, and Stille. 16 Absent: Councilmember Jenson 17 Also Present: City Manager Mark Casey, Parks Commission Chair Scott Bentz, City Engineer Todd 18 Hubmer. 19 Guests: Robin Hartfiel, Stacie Kvilvang, Ehlers & Associates. 20 21 CONSIDERATION, DISCUSSION, AND POSSIBLE ACTION ON ALL OF THE FOLLOWING 22 ITEMS. 23 24 I. APPROVAL OF APRIL 25, 2017 CITY COUNCIL MEETING AGENDA. 25 26 Motion by Councilmember Gray, seconded by Councilmember Brever, to approve the City 27 Council Meeting Agenda of April 25, 2017. 28 29 Motion carried 4 -0. 30 31 II. PROCLAMATIONS AND RECOGNITIONS. 32 33 A. Arbor Day Proclamation 34 35 Parks Commission Chair Scott Bentz presented the proclamation in recognition of Arbor Day 36 Friday April 28, 2017 and the month of May 2017 as Arbor Month in St. Anthony Village. 37 38 Mayor Faust announced St. Anthony Village is now a Tree City. He noted more trees are added, 39 than are taken out when street projects are done. 40 41 B. Spirit of St. Anthony Award 42 43 Ms. Robin Hartfiel presented the 2017 Spirit of St. Anthony Award to Lieutenant Jeff Scholl. 44 Lieutenant Scholl thanked the City for this award. Mayor Faust noted this award comes from the 45 employees of the City. 46 47 III. CONSENT AGENDA. 48 49 A. Approval of April 11, 2017, City Council meeting minutes. I B. Licenses and Permits. 2 C. Claims. 3 4 Motion by Councilmember Brever, seconded by Councilmember Stille, to approve the Consent 5 Agenda items. 6 7 Motion carried 4 -0. 8 9 IV. PUBLIC HEARINGS - NONE. 10 11 V. REPORTS FROM COMMISSION AND STAFF - NONE. 12 13 VI. GENERAL BUSINESS OF COUNCIL. 14 15 A. Resolution 17 -039 a Resolution Authorizing Issuance, Awarding Sale Prescribing the 16 Form AND Details AND Providing for the Payment of $5.600,000 General Oblilzation 17 Bonds, Series 2017A. 18 19 Ms. Stacie Kvilvang reviewed details of the bond sale. The savings is $50,000 per year due to the 20 refunding. 21 22 Councilmember Stille asked who else is involved other than Piper Jaffrey. Ms. Kvilvang stated 23 Ehlers Companies, Dorsey Whitney, and Bond Trust Services Corporation. The rate is 2.2% 24 rather than 2.58% The City is fortunate to get a good rate. Councilmember Stille noted this is for 25 the 2017 street project, refinancing and a new truck, and noted this is packaged all together 26 which also saves money. 27 28 Mayor Faust stated it is important to invest in infrastructure when the rates are this low. 29 30 Motion by Councilmember Stille, seconded by Councilmember Brever, to adopt Resolution 17- 31 039; a Resolution Authorizing Issuance, Awarding Sale to Piper Jaffrey, Prescribing the Form 32 and Details and Providing for the Payment of $5,600,000 General Obligation Bonds, Series 33 2017A. 34 35 Motion carried 4 -0. 36 37 B. Resolution 17 -040 a Resolution Awarding a Bid for the 2017 37`s Avenue Sidewalk and 38 Signal Proiect. 39 40 City Engineer Todd Hubmer reviewed the sidewalk improvements are on 37h Avenue NE on the 41 south side from Stinson Blvd. to Highcrest Rd. He indicated the location of the traffic signal 42 improvements. The project partners are MnDOT, Hennepin County, Ramsey County, City of 43 Columbia Heights, City of New Brighton, City of Roseville, and the School District. The Project 44 cost and funding was reviewed as well as the Project schedule. 45 3 1 City Engineer Todd Hubmer reviewed the resolution under consideration to award the contract 2 for construction on the Highway Safety Improvement Program to the lowest bidder. Bids were 3 received for the project on Thursday, February 16, 2017, opened, and read aloud. A total of 5 4 bids were received. The bids were checked for mathematical accuracy and tabulated. The bid 5 tabulation indicates the low bidder as Sunram Construction Inc. of Corcoran, MN in the amount 6 of $1,097,362.20. Staff recommends the City Council consider the bids and award a contract to 7 Sunram Construction. 8 9 Councilmember Gray noted there were three bids within $3,000 and they all beat the engineer 10 estimates of the project. Mr. Hubmer stated the calculations are rechecked and corrected as 11 necessary. Councilmember Gray added Stinson Blvd. looks great. 12 13 Councilmember Stille stated the Mirror Lake project has been going well and asked how Sunram 14 Construction is when working with the City. Mr. Hubmer stated they are working well with the 15 City. Councilmember Stille mentioned the Safe Route to School Grant that was obtained in 2013. 16 This has been in the City's plan since 2000. 17 18 Mayor Faust noticed on the drawing for the traffic signal the arrow indicating direction. 19 20 Motion by Councilmember Gray, seconded by Councilmember Stille, to adopt Resolution 17- 21 040; a Resolution Awarding a Bid for the 2017 37th Avenue Sidewalk and Signal Project to 22 Sunram Construction Inc. in the amount of $1,097,362.20. 23 24 Motion carried 4 -0. 25 26 Mr. Hubmer mentioned there have been a number of residents requesting improvements to the 27 intersections to allow for wheel chair access and he is pleased these improvements will now be 28 made. 29 30 C. Resolution 17 -041 a Resolution Awarding a Bid for the Silver Lake Road LED Street 31 Light Improvement Project. 32 33 City Engineer Hubmer reviewed this resolution awards the contract for the Silver Lake Road 34 LED Street Light Improvement Project to the lowest bidder. Bids were received on Thursday, 35 April 13, 2017, were opened, and read aloud. Eight bids were received. The bids were checked 36 for mathematical accuracy and tabulated. The bid summary was provided for Council review. 37 The low bid was received from Killmer Electric Co., Inc., Crystal, Minnesota in the amount of 38 $416,174.46. The project is a cooperative effort between the City of St. Anthony Village and the 39 City of New Brighton which include LED street lighting replacements on Silver Lake Road from 40 37' Avenue NE to I -694 with each community responsible for only funding improvements to 41 their respective lighting systems. The total low bid amount is broken into two separate schedules 42 for improvements in each city. The bid amount for the St. Anthony Village improvement totals 43 $196,929.84. New Brighton is anticipated to review these bids and consider awarding a contract 44 for their portion of the project totaling $219,244.62 at their next regular Council meeting. If 45 approved, work will be completed throughout this summer. 46 4 0 Motion by Councilmember Brever, seconded by Councilmember Gray, to adopt Resolution 17- 041; a Resolution Awarding a Bid for the Silver Lake Road LED Street Light Improvement Project in the amount of $196,929.84 to Killmer Electric Co., Inc. D. ll Ouarter Goals Update Motion carried 4 -0. 9 City Manager Casey provided the first quarter update on the City of St. Anthony Goals Chart and 10 highlighted the status of the goals. 11 12 Councilmember Stille asked about the AOP Plant and how will that work. Mr. Hubmer stated 13 there will be a start-up process. Testing will be done of the water to ensure the plant is working 14 and the water is safe before sent to the public. 15 16 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. 17 18 City Manager Casey stated last Saturday was Earth Day and there were several volunteers that 19 spent the day cleaning parks. Staff assisted by removing debris when finished. Two trees will be 20 planted in Trillium Park as part of Arbor Day. With the launch of the new website, the push 21 notifications need to be re- requested by residents wishing to receive the notifications. 22 23 Councilmember Brever noted a new feature of the website is "Ask the City" and Mr. Casey 24 noted it was well received and has been used frequently in the few days the website has been up 25 and running. ring. A tracking mechanism will track issues. 26 27 Councilmember Gray stated on April 13 he attended the Chamber of Commerce Annual 28 Meeting. On April 20, he attended the North Suburban Communications Strategic Planning 29 Work Session. On May 12, there will be a meeting to discuss finance going forward. On April 30 19, he attended the Body Cam Workshop. The draft policy on the use of body cams was 31 presented by Chief Mangseth. Councilmember Gray thanked the other cities for participating in 32 the Body Cam Workgroup. On April 17, he attended the Village Fest meeting and noted there is 33 no one to chair the parade committee and without a chair, there may not be a parade. 34 35 City Manager Casey stated the body cams are hoped to be implemented in the fall. A grant has 36 been applied for and there will be an opportunity for public input on the use of the body cams 37 prior to them being implemented. 38 39 Councilmember Brever stated on April 13 she attended the Dare 2 Be Real Conversation at the 40 High School. On April 17, the Family Services Collaborative sponsored a community listening 41 session. A second session was held on April 19. 42 43 Councilmember Stille stated on April 13 he attended the Chamber Annual Meeting. He attended 44 the April 17 listening session. On April 19, he addressed City Staff at the Annual Staff 45 Appreciation luncheon. He feels all the City Staff has the spirit of St. Anthony. Mayor Faust reported he attended the Chamber Annual Meeting on April 13 and congratulated the Business of the Year and the Villager of the Year. They were directed to provide a site plan showing the location and dimensions of the proposed enclosure on the property, as well as a written request to the City Council in the form of a letter. The Applicants provided a written request and a diagram on April 13thshowing the location and dimensions of the chicken coop in relation to their property. In these materials, the Applicants state that the coop will have a 4 -foot x 6 -foot footprint and the plans indicate the coop will be 4 feet tall in height. The coop contains a 3 by 4 -foot by 4 -foot tall section that will be enclosed with chicken wire. The remainder of the coop will be constructed with wood. The diagram shows that the coop will be located in the rear property yard and will be visually screened from the neighboring property by bushes and vegetation. Applicant states that the materials for the coop will be constructed with non -toxic materials and will be a natural wood color that blends well with the existing landscaping. CITY CODE RELATED TO REQUEST Title IX General Regulations, Chapter 91 Animals, Section § 91.56 KEEPING OF CERTAIN ANIMALS states that "No person may keep swine, cattle, horses, goats, or more than 2 dogs or 3 dogs allowed under § 91.01 through 91.05 or fowl, within the city nearer than 500 feet to any human habitation or platted land, without approval of the City Council. The City Council may, before approving or denying any request for approval, request a report from the Health Officer concerning the effect on public health." RECOMMENDED ACTION Staff has reviewed the request, and recommends approval of the request to allow the request, as proposed, based on the provisions in city code. 1. Motion to adopt resolution approving the request. The City Council may refer to the resolution for approval to include any conditions that it deems necessary. I 18 2. Motion to deny the request. In the event the City Council chooses denial of the request, it should clearly state its reasons for the denial recommendation and direct staff to prepare a resolution. Following my conversation with Ms. Nicole Miller through email, I am submitting my letter of request, along with a drawing of our backyard and the coop's proposed location. The drawing also includes a side view of our planned coop and its dimensions. The dimensions of the planned coop are approximately 4' x 6' and 4' high for the chicken wired enclosed base area with an enclosed wooden nesting area with dimensions of 4' x 3' sitting on %: of the base coop. The coop is to be located in one of the property corners — at least 4' from the property line — where the bushes will cover the coop from neighbors' view. The coop will be made of non -toxic materials — safe for humans and poultry — and in natural colored wood that will blend in nicely with our bushes, trees, and garden.
