32 A. Chamber Member of the Year and Business of the Year

34 Mr. William Huseonica, Vice President of St. Anthony Chamber of Commerce presented the
35 Business of the Year and Chamber Member of the Year. The Business of the Year Award was
36 given to Anytime Fitness. The Villager of the Year Award was given to Tara Halverson. Mr.
37 Huseonica provided background information on Anytime Fitness and Tara Halverson.

IV. PUBLIC HEARINGS
3 A. 2018 Budget
5 Mayor Faust opened the public hearing at 7:06 p.m.

7 Finance Director Shelly Rueckert provided a summary of the 2017 General Operating Budget.
8 Notices were sent to residents advising them of the public hearing to receive public input on the
9 2018 budget. The highlights of the 2017 Budget were reviewed including the General Operating
10 Budget, General Fund Levy, Overall Levy, Median Valuation in 2017, City Portion of Property
11 Taxes, 2017 Local Government Aid and Breakdown of 2016 Property Taxes for Median valued
12 home. The 2018 Budget Calendar after this public hearing will include in the May — June 2017
13 timeframe City Manager led work sessions with Department Heads — Discussion on 2018
14 Operating Budget and Capital Budgets and July — August 2017 Work Session with Council —
15 Discussion of Staff Proposals for 2018 Operating Budgets and Capital Budgets. The Proposed
16 2018 Operating Budget and Property Tax Levy will be presented to the City Council on August
17 22, 2017. On September 12, 2017, a Resolution will be presented to set the proposed 2018
18 Operating Budget and Property Tax Levy and announce the date and time when the final Budget
19 and Tax Levy will be discussed. The long -term capital budgets /plans will be presented in the
20 October — November 2017 timeframe and the 2018 Operating Budget and Levy with Public
21 Input will be presented on December 12, 2017 along with adoption of the 2018 Operating Budget
22 and Property Tax.

24 Ms. Rueckert reviewed the 2017 General Fund Revenues, General Fund Expenditures, General
25 Fund and Overall Levies.

31 VI. GENERAL BUSINESS OF COUNCIL.

33 A. Resolution 17 -042; a Resolution to Approve a Request to Keen Chickens in an R -1
34 Zoning District at 2805 29h Avenue NE
35
36 City Manager Casey reviewed a request was received for information about what was needed in
37 order to be able to have chickens on their property. They were directed to provide a site plan
38 showing the location and dimensions of the proposed enclosure on the property as well as a
39 written request to the City Council in the form of a letter.

41 Alireza and Zahra Khani submitted a letter along with a sketch of their property and the proposed
42 location of the chicken coop. The applicants stated the coop will have a 4 foot by 6 foot footprint
43 and the plans indicate the coop will be 4 feet tall in height. The coop contains a 3 foot by 4 foot
44 by 4 foot tall section that will be enclosed with chicken wire. The remainder of the coop will be
45 constructed of wood. The coop will be located in the rear property yard and will be visually
46 screened from the neighboring property by bushes and vegetation. The materials for the coop

will be constructed with non -toxic materials and will be a natural wood color that blends well
with the existing landscaping. The applicants were not present at the meeting.
City Manager Casey provided the City Code relating to this request. Staff recommends approval
of the request, as proposed based on the provisions in City Code.
7 Councilmember Stille stated the Planning Commission is looking at the Ordinance so Council
8 does not need to address issues like this. Staff will need to confirm the chickens are female.

10 Motion by Councilmember Jenson, seconded by Councilmember Gray, to adopt Resolution 17-
11 042; a Resolution Approving a Request to Keep Chickens in an R -1 Zoning District at 2805 291i
12 Avenue NE.

16 B. St. Anthony Finance Department Annual Report

18 Finance Director Rueckert presented the Annual Report for the St. Anthony Finance Department.
19 The Mission Statement, Organizational Chart, Core Accounting Functions, Finance Activity
20 Unique to 2016, Technological Advances, Long Term Financial Management, and Support Staff
21 to Agencies.

23 Councilmember Stille noted a larger presentation can be accessed on the City website. She
24 commended Ms. Rueckert and her team for their work.
25
26 Councilmember Gray echoed Councilmember Stille's remarks and noted customer service is
27 very important and commended staff on their work.

29 Councilmember Brever thanked Ms. Rueckert and staff for everything they do.

31 Councilmember Jenson stated he agrees, noting Ms. Rueckert has always been available for
32 questions.

34 Mayor Faust stated it was a difficult year and Ms. Rueckert and her staff are the face of St.
35 Anthony. He stated he has always been very appreciative of the work provided. He commended
36 Ms. Rueckert on her finding the soft costs for the advanced oxidation plant.

38 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS.

40 City Manager Casey stated last Saturday was clean -up day and 225 cars visited Clean Up Day.
41 Next Monday, May 15, at 5p.m., there will be a Construction Education Event at park entrance
42 on Maplewood Drive and Skycroft.

44 Councilmember Brever stated on April 26, she attended the GARE Training for April. On May
45 8, she attended the Sister City Committee. There will be a concert on November 5, 2017. On
46 June 10, there will be a Finish Sauna and sign up can be done on the website.

2 Councilmember Jenson stated on April 13, he attended the St. Anthony Chamber Meeting. On
3 April 22, eight Kiwanis high school kids assisted in cleaning Salo Park ponds. On May 2, he
4 attended the North Suburban Communications Meeting.
Councilmember Stille stated on May 6, he attended clean-up day.
8 Councilmember Gray stated the Village Fest was looking for a Parade Committee Chair and one
9 was found so there will be a parade this year.

11 Mayor Faust noted he was at clean-up day and gave a brief description of the event. He
12 commended City Staff on their work. On May 8, he attended the Regional Council of Mayors
13 Meeting and on May 9, he attended the Mississippi Water Management Meeting.

15 VIII. COMMUNITY FORUM.

17 Ms. Jenny Latte, 2601 Kenzie Terrance, Kenzington Building. She has lived in St. Anthony for
18 five years. She is not opposed to the project as a whole but is opposed to the size and scope of
19 the project. She never imagined tall buildings would be built and she would like to see the
20 density reduced to the lower level (375 -600 units). She is opposed to the height and proximity of
21 the buildings to Kenzington Building as her view will be obstructed. She would like to see the
22 buildings 3 -4 stories. She believes the plan as it stands now does not fit into the neighborhood.
23 She would like to work with the developer and City to make this a project all can be proud of
24
25 Mayor Faust stated Council said from the beginning it should have the look and feel of Silver
26 Lake Village, noting that nothing official has been received from the developer. He stated the
27 Comp Plan should be followed, affordable housing offered, and it needs to be compatible with
28 surrounding land uses. Protection of the environment is also very important along with a fair and
29 open process. He stated there will be a public hearing where residents can voice their opinion. He
30 stated that he and Councilmembers have not spoken with the developer outside of the Council
31 Meetings. This was a land purchase between two parties.

33 Reverend Lawton, pastor at Northeast United Church located near the Lowry Grove Trailer Park,
34 stated she is not a resident of St. Anthony and urged Council to come up with affordable housing
35 options in St. Anthony. She would like Council to evaluate their plans through faith. Mayor
36 Faust stated affordable price will not be the same as the price to live in Lowry Grove.

38 Ms. Mel Chaput, 3537 Coolidge Street NE, read three paragraphs from a recent StarTribune
39 article about how Richfield handled the loss of affordable housing. She is concerned that the City
40 Council has not been proactive with handling issues but instead have been reactive. She urged
41 the Council to think about the residents of Lowry Grove. She wants to keep these residents in St.
42 Anthony.

44 Ms. Antonia Alvarez, 2501 Lowry Avenue, Lowry Grove, invited the Council to meet with the
45 Lowry Grove residents as they want Council support for the residents. She stated they have only

1 spoken with the City Manager and invited the Council to a meeting next Friday at 6:30 p.m. at
2 Lowry Grove. She stated the children do not want to move and change schools.

The Master Partnership Contract provides a framework for Mn /DOT and Local Agencies to provide
services and payment to each other. A few MnDOT provided routine services are included in the
contract —see Exhibit A -- but all other services require work orders describing costs and scope.

Also required is a new resolution passed by the Council /Board authorizing its officials to sign and

RESOLUTION 17 -043
A RESOLUTION RENEWING THE MASTER PARTNERSHIP CONTRACT WITH THE
MINNESOTA DEPARTMENT OF TRANSPORTATION
WHEREAS, the Minnesota Department of Transportation wishes to cooperate closely with local
units of government to coordinate the delivery of transportation services and
maximize the efficient delivery of such services at all levels of government; and
WHEREAS, MnDOT and local governments are authorized by Minnesota Statutes sections
471.59, 174.02, and 161.20, to undertake collaborative efforts for the design,
construction, maintenance and operation of state and local roads; and
WHEREAS, the parties wish to able to respond quickly and efficiently to such opportunities for
collaboration, and have determined that having the ability to write "work orders"
against a master contract would provide the greatest speed and flexibility in
responding to identified needs.
BE IT RESOLVED, that the City of St. Anthony Village enter into a Master Partnership Contract
with the Minnesota Department of Transportation, a copy of which was before the City Council.
THEREFORE, BE IT FURTHER RESOLVED, that the proper City officers are authorized to
execute such contract, and any amendments thereto.
THEREFORE, BE IT FURTHER RESOLVED, that the City Engineer is authorized to negotiate
work order contracts pursuant to the Master Contract, which work order contracts may provide for
payment to or from MnDOT, and that the City Engineer/ may execute such work order contracts on
behalf of the City of St. Anthony Village without further approval by this City Council.

A RESOLUTION REGARDING RENEWAL OF MUNICIPAL INSURANCE COVERAGE
AND THE NON WAIVER OF TORT LIABILITY LIMITS FOR THE LEAGUE OF
MINNESOTA CITIES INSURANCE PROGRAM.
WHEREAS, the City Council of the City of St. Anthony hereby approves participation in the
League of Minnesota Cities Insurance Trust ( LMCIT) insurance program for the
year 2017 through 2018; and
WHEREAS, the City has elected to purchase excess coverage in the amount of $1,000,000.00.
WHEREAS, the City DOES NOT WAIVE the monetary limits on municipal tort liability
established by Minnesota Statutes, Section 466.04.
BE IT RESOLVED, that the City Council of the City of St. Anthony hereby approves the renewal
of insurance coverage through the League of Minnesota Cities for the policy period of June 1, 2017
to May 31, 2018.
THEREFORE, BE IT FURTHER RESOLVED, that the City Council of the City of St. Anthony
hereby does not waive the monetary limits on tort liability established by MN statute 466.04, Subd.
7, to the extent of the limits of the liability coverage obtained from the LMCIT for the policy period
of June 1, 2017 to May 31, 2018.

BACKGROUND /ANALYSIS
Staff received a request letter and a coop site plan diagram from the Applicants on May 9th. The coop
site plan diagram and the letter submitted describe the location and relative dimension of the chicken
coop in relation to their home and other landmarks on the Applicants' property.
The site plan shows that the planned location of the coop is the southwest corner of the rear yard. The
Applicant's letter describes that corner of the yard as "relatively isolated ", with an 8 -foot fence
separating their yard from the neighbor to the west and a shed partially blocking the view from the
neighbors to the south. A review of the area confirms that these structures exist and will likely obstruct
the view of the coop from the surrounding neighbors' yards. There does not appear to be a fence
separating the Applicants property from the property to the south, although there is existing vegetation
on both properties that will likely provide some visual screening.
In their letter, the Applicants describe the coop's dimension and provide a rendering showing the
finished coop's design. The coop has a run enclosure below and an elevated nesting box area above. The
original application letter stated incorrect dimensions which the Applicant has since corrected in a
correspondence with City staff (included in packet). The coop is of a prefabricated design. The corrected
dimensions show that the coop will stand 57 inches (4.75 feet) tall and that the footprint of the entire
coop enclosure will be 42 inches wide by 84 inches long, or a 24.5 square feet footprint. Although the
coop is designed for as many as 8 chickens, the Applicants state they are planning to keep 4 chickens in
their coop. The Applicant has stated that they will be female chickens, thus minimizing concerns about
noise.
CITY CODE RELATED TO REQUEST
Title IX General Regulations, Chapter 91 Animals, Section § 91.56 KEEPING OF CERTAIN ANIMALS states
that "No person may keep swine, cattle, horses, goats, or more than 2 dogs or 3 dogs allowed under §
91.01 through 91.05 or fowl, within the city nearer than 500 feet to any human habitation or platted
land, without approval of the City Council. The City Council may, before approving or denying any
request for approval, request a report from the Health Officer concerning the effect on public health."

The City Council may elect to include reasonable conditions or specifications with a resolution approval,
should they deem such conditions appropriate to the intent of the ordinance.
RECOMMENDED ACTION
Staff has reviewed the Applicant's materials and based on the reasonable location, dimensions and
details shown in the application materials, do recommend approval of this request to keep four (4)
female chickens on the property in question.
Staff recommends that the coop location be set back at least 5 feet from any property line as is the
standard for an accessory structure. Currently, setback dimensions are not indicated on the site plan.
1. Motion to adopt resolution approving the request. The City Council may refer to the resolution
for approval to include any conditions that it deems necessary.
2. Motion to deny the request. In the event the City Council chooses denial of the request, it
should clearly state its reasons for the denial recommendation and direct staff to prepare a
resolution.

We are writing to request a permit to keep four female chickens on our property
located at 3626 Belden Drive NE. We have attached a drawing of our back yard which
includes the placement of the coop.
Our lot is approximately 0.32 acres, and we plan to house the chickens in a small coop
with an enclosed run (approximately 4x10x30 foot maximum total area) in the
southwest corner of the property.
This corner is relatively isolated from our neighbors, with pine trees directly to the north
of it, an 8 foot fence shielding the neighbors directly to our west, and another
neighbor's shed close to the southwest of that corner, shielding their yard, so we think
it will be minimally noticeable. We will not keep any roosters so noise will also be kept

RECOMMENDATION
Staff received a request letter and a coop site plan diagram from the Applicants on May 9t'. The coop
site plan diagram shows the location and relative dimension of the chicken coop in relation to their
home and other landmarks on the Applicants' property.
The site plan shows that the chicken coop would be adjacent to an existing garden and 18 feet set back
from the south property line with the garden separating the coop from the neighboring property to the
south. The site plan also shows existing vegetation acting as a partial screening buffer along the eastern
property line, and a tall wooden fence along the northern property boundary that would screen the
view from the property to the north. The Applicants' property is bounded by a chain link fence on the
east and south sides, which does not completely screen the view of the coop from neighboring
properties. In their letter, the Applicants describe that they have communicated with and received
verbal consent from their neighbors to the east and south regarding their plans to keep a chicken coop
in the back yard.
In their letter, the Applicants describe the coop's dimension and design and provide a link to the coop
that they are planning to purchase. They state, and the link confirms, that the coop will stand 42 inches
(3 Y2 feet) tall. The coop will have a 10 % foot by 2 Y4 foot (23 % square foot) footprint. The coop is a
prefabricated design with two nesting houses. It is primarily constructed of wood, with a run fully
enclosed by a wire grid. Although the coop can fit up to 10 chickens, the applicant states that they are
only planning to keep six chickens on their property.

We are writing you all to request permission to raise chickens in our backyard. Our house is
located at 3631 Harding St NE. Per instructions received from Nicole Miller, we are emailing
you this request. Attached you will find a very basic diagram of our backyard and where exactly
the chicken coop would be located.
Our backyard is entirely fenced in, with a very tall fence on the north side that entirely blocks the
view into the neighbors yard. The fence to the east and south have a smaller chain linked fence,
and we have spoken to both of those neighbors about our desire to raise chickens and they have
both given their consent. (In the words of our neighbor to the East, it would 'bring her back to
her childhood'). The fence to the east is bordered by extremely tall lilac bushes which hide the
view into the yard. The fence to the South has no such border though, and is fairly exposed.
As far as the chicken coop itself goes, we are purchasing a coop off of wavfair.com. It is entirely
enclosed, and would be placed right next to our garden, which is a 18'X 18' square in the SE
corner of the back yard. The dimensions are 42.5" H X 123.5" W X 27.5" D. You can see the

The Unofficial would like to throw their 2 "d annual Customer Appreciation Party on Saturday July 291h
Just like last year we would like to smoke a whole pig and serve sandwiches. We would like to invite
local craft vendors to set up tents in our parking lot. As well as have live music outside in our parking lot
between the hours of 4pm and lopm. We would also like to serve local craft beer out of a trailer in our
lot. We plan to shut the whole outside operation down at 10pm per St Anthony noise ordinance.
This is exactly the same event that we threw last year and it was a huge success! Folks from all over the
neighborhood came and had a great time. Our regulars talked about it for months afterward and kept
asking when and if we were going to do it again. Ive got a feeling this year can be even better!
